CALL TO ORDER Mayor Sheehy called the meeting to order at 6:00 p.m. 2. INVOCATION: Pastor Dale Ray, Lakeview Community Church Pastor Dale Ray, Lakeview Community Church, gave the invocation. 3. PLEDGE OF ALLEGIANCE: Lake Havasu Gem and Mineral Society Mr. Allen Yannity, Lake Havasu Gem and Mineral Society, led in the Pledge of Allegiance. 4. ROLL CALL Present: 5- Mayor Cal Sheehy, Councilmember Nancy Campbell, Councilmember David Lane, Councilmember Cameron Moses and Vice Mayor Jim Dolan Absent: 2- Councilmember Michele Lin and Councilmember Jeni Coke *Vice Mayor Dolan was present via remote conferencing. 5. CALL TO THE PUBLIC Mr. Robert Fischer, citizen, addressed the council and asked if the city had a timeframe for repaving the asphalt at the intersection of Lake Havasu Avenue and Kiowa Boulevard. Ms. Frankie Lyons, citizen, addressed the council and spoke on the misuse of taxpayer dollars by Interagency. She also spoke on the Go Lake Havasu contract, financials, and excess of $2 million in funds. She said the citizens are waiting to see the amendment to the Go Lake Havasu contract that includes language returning any excess funding to the city when their services are no longer required. She added that the city purchased a building for a municipal court after the council and taxpayers were told that they had to deconsolidate. She said that was not true and spoke on the additional renovation, maintenance, and personnel costs that were not studied. Ms. Lyons addressed her concerns with the trash collection and bulk waste and drop-off events that are not being Lake Havasu City Page 1 Printed on 10/26/2022 City Council Minutes - Final October 11, 2022 enforced by the city. Ms. Bonnie Toy, citizen, addressed the council and requested the council consider lowering the property tax rates next fiscal year and lowering the open swim rates at the Aquatic Center during the summer months. She also spoke concerning Lake Havasu City not being a dark sky community which was brought up at the last Coffee with the Mayor and City Manager. Mr. David Leslie, citizen, addressed the council and said he understands that conversations at City Council meetings are limited to items within city limits; however, when the city accepts funds from the federal government, he believes it opens the door for conversations outside the city limits. Mr. Alfred De LaRosa, citizen, addressed the council and recited several sections of the Lake Havasu City Council Code of Conduct. He suggested that the council apply the sanctions within the Code of Conduct and remove Vice Mayor Dolan from office. 6. CORRESPONDENCE, COMMUNICATIONS, PETITIONS, ANNOUNCEMENTS, CITY MANAGER REPORT Lake Havasu City Page 2 Printed on 10/26/2022 City Council Minutes - Final October 11, 2022 7.1 ID 22-3483 Announce Vacancies on Lake Havasu City Boards, Committees, and Commissions (Kelly Williams) City Clerk Assistant Shannon Davis announced the current vacancies on various Lake Havasu City Boards, Committees, and Commissions. She added that applications are available at City Hall and on the City’s website at www.lhcaz.gov. Ms. Davis advised that the deadline to submit applications for consideration is Friday, November 4, 2022, by 5:00 p.m. 7.2 ID 22-3488 City Manager’s Report (Jess Knudson) City Manager Jess Knudson reported on the following: • Announced various ceremonies, events, and proclamations. • The Lake Havasu City Fire Department was awarded the Western Arizona Vocational Education (WAVE) “Outstanding Work Award” for the Lake Havasu High School CTE Program. • Police Officer Michael Thornhill was recognized and awarded “Officer of the Year” at the Elk’s Lodge Law and Order Appreciation Night. • Police Officer Chris Angus joined the Kiwanis Club’s Scout Troop 85 Meeting. • The Lake Havasu City Police Department was awarded a Governor’s Office of Highway Safety Grant in the amount of $33,713, for increased traffic enforcement operations and purchase of directional radar units. • Applications for the Community Resources Program are available on the city’s website at www.lhcaz.gov. The deadline to apply is Friday, December 9, 2022, by 5:00 p.m. • Lake Havasu City Public Services Employee Recruitment Video. 8. PUBLIC HEARINGS 8.1 ID 22-3477 Adopt Ordinance No. 22-1294 Amending Lake Havasu City Code Chapter 8.08, Nuisances, Revising Definitions, Updating and Clarifying Nuisances, and Including Criminal Enforcement (Luke Morris) Planning Division Manager Luke Morris and Senior Code Enforcement Officer Denise Able advised that this ordinance was introduced at the September 27, 2022, City Council meeting. Mr. Morris said the council reviewed the proposed changes and directed staff to remove the reference to palm tree fronds from Section 8.08.02.B.1.d., with no other changes. He said the ordinance is before the council tonight for final adoption. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Moses moved to adopt Ordinance No. 22-1294 amending Lake Lake Havasu City Page 3 Printed on 10/26/2022 City Council Minutes - Final October 11, 2022 Havasu City Code Chapter 8.08, Nuisances, revising definitions, updating and clarifying nuisances, and including criminal enforcement, seconded by Councilmember Lane, and carried by the following vote: Aye: 5 - Mayor Sheehy, Councilmember Campbell, Councilmember Lane, Councilmember Moses and Vice Mayor Dolan Absent: 2 - Councilmember Lin and Councilmember Coke 8.2 ID 22-3481 Adopt Ordinance No. 22-1295 Amending Lake Havasu City Code Chapter 1.12, Code Compliance, Adding Section 1.12.025, Interference (Luke Morris) Mr. Morris and Ms. Able advised that this item was also introduced at the September 27, 2022, City Council meeting with no suggested changes. Mr. Morris stated that the proposed amendment adds language specifying that it is a class 1 misdemeanor to interfere with a code enforcement officer or contractor in pursuit of their duties. He added that a class 1 misdemeanor allows sentencing of a fine up to $2,500 and/or up to six months jail time. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Lane moved to adopt Ordinance No. 22-1295 amending Lake Havasu City Code Chapter 1.12, Code Compliance, adding Section 1.12.025, Interference, seconded by Councilmember Moses, and carried by the following vote: Aye: 5 - Mayor Sheehy, Councilmember Campbell, Councilmember Lane, Councilmember Moses and Vice Mayor Dolan Absent: 2 - Councilmember Lin and Councilmember Coke 8.3 ID 22-3479 Approve and Authorize the City Manager to Execute a Crisis Intervention Agreement with Community Health Associates for the Assignment of Crisis Mobile Team Specialists to Lake Havasu City (Chief Doyle) Police Chief Dan Doyle advised that this item is an agreement to house a mobile crisis team at the Lake Havasu City Police Department. He said Community Health Associates offers services in six other counties within Arizona and added services in Mohave County effective October 1, 2022. He said in exchange for services rendered by Community Health Associates in Lake Havasu City, the city agrees to provide workspace for the Crisis Mobile Team Specialists in the Police Department to provide co-response as well as training to officers. Councilmember Moses asked if there would be a cost to the city, to which Chief Doyle responded that there is no cost other than the space at the Police Department. Councilmember Moses asked if the Crisis Mobile Team Specialists would respond to some Lake Havasu City Page 4 Printed on 10/26/2022 City Council Minutes - Final October 11, 2022 calls instead of officers, to which Chief Doyle said there is potential for that but said hopefully this will help address the repetitive mental health calls. Mayor Sheehy opened the public hearing. Mr. Leslie addressed the council and said this item sounds familiar with what is going on around the nation. Mayor Sheehy stated that the intent is to bring these services to the citizens of Lake Havasu City that need it. Ms. Toy addressed the council and questioned whether the services were state or federally funded, and whether the Crisis Mobile Team Specialists or a police officer would be dispatched, to which Chief Doyle said each situation is different; therefore, the Police Department will assess the situation. Chief Doyle stated that there has been a lot of talk that this service references defunding the police; however, this service is to provide mental health crisis and not a means to defund the police. Mayor Sheehy noted that the funding comes from the Arizona Department of Health Services with no cost to the city. There being no further comments, Mayor Sheehy closed the public hearing. Councilmember Lane moved to authorize the City Manager to execute a Crisis Intervention Agreement with Community Health Associates for the assignment of Crisis Mobile Team Specialists to Lake Havasu City, seconded by Councilmember Campbell, and carried by the following vote: Aye: 5 - Mayor Sheehy, Councilmember Campbell, Councilmember Lane, Councilmember Moses and Vice Mayor Dolan Absent: 2 - Councilmember Lin and Councilmember Coke 8.4 ID 22-3482 Approve Amendment No. 1 to the Cooperative Purchase Agreement with Omnia Partners for the Purchase of a Toro Groundsmaster 4000-D from Simpson Norton Corporation, a Distributor for The Toro Company (Bill Young) Transportation and Maintenance Superintendent Bill Young said this item is to approve a cooperative purchase agreement with Omnia Partners to purchase a Toro Groundsmaster 4000-D in the amount of $92,203.57, to replace a unit in the fleet that is beyond its useful life and repair. Lake Havasu City Page 5 Printed on 10/26/2022 City Council Minutes - Final October 11, 2022 Mayor Sheehy asked when the city expects to receive this equipment, to which Mr. Young said approximately 12 to 18 months. Councilmember Moses noted a discrepancy in the total cost, to which Mr. Young said the price listed does not include $7,618.33 in state tax. Mayor Sheehy opened the public hearing. Ms. Toy addressed the council and asked if this purchase included a warranty. Mr. Young stated that it includes a 5-year or 3,500-hour warranty. Ms. Lyons addressed the council and asked why the city waits for equipment to break and suggested that it be ordered in time. Mayor Sheehy replied that the delay in receiving this item is due to supply chain issues. There being no further comments, Mayor Sheehy closed the public hearing. Councilmember Moses moved to approve Amendment No. 1 to Cooperative Purchase Agreement 500221, renewing the agreement through March 31, 2023, with Simpson Norton Corporation for the purchase of a Toro Groundsmaster 4000-D in the amount of $88,585.24 plus tax, and authorize the City Manager to execute the amendment on behalf of the City, seconded by Councilmember Lane, and carried by the following vote: Aye: 5 - Mayor Sheehy, Councilmember Campbell, Councilmember Lane, Councilmember Moses and Vice Mayor Dolan Absent: 2 - Councilmember Lin and Councilmember Coke 9. CURRENT EVENTS Vice Mayor Dolan reported on the Go Lake Havasu bylaws and updates to the contract between Lake Havasu City and Go Lake Havasu. Councilmember Campbell invited the council to attend the Rural Transportation Summit Meeting hosted by the Arizona State Transportation Board on October 21, 2022, in the Council Chambers Room, with a dinner reception on October 20, 2022. 10.
