SELECTION OF VICE MAYOR Mayor Sheehy stated that in accordance with the City Code the selection of vice mayor is done annually at the first meeting in December. Vice Mayor Lane nominated Councilmember Moses for the position of Vice Mayor for 2024. Councilmember Dolan seconded the nomination. Councilmember Moses accepted the nomination. Mayor Sheehy called for a vote on the motion on the floor. Motion carried by the following vote: AYE: 6 – Campbell, Coke, Dolan, Lane, Moses, and Sheehy. NAY: 1 – Lin. Vice Mayor Lane nominated Councilmember Moses for the position of Vice Mayor 2024, seconded by Councilmember Dolan, and carried by the following vote: Aye: 6 - Mayor Sheehy, Councilmember Campbell, Councilmember Moses, Councilmember Coke, Vice Mayor Lane and Councilmember Dolan Nay: 1 - Councilmember Lin 7. CORRESPONDENCE, COMMUNICATIONS, PETITIONS, ANNOUNCEMENTS, CITY MANAGER REPORT 7.1 ID 23-4056 Announce Vacancies on Lake Havasu City Boards, Committees, and Commissions (Kelly Williams) Lake Havasu City Page 2 Printed on 1/10/2024 City Council Minutes - Final December 12, 2023 City Clerk Kelly Williams announced the current vacancies on various Lake Havasu City Boards, Committees, and Commissions. She added that applications are available on the City’s website at www.lhcaz.gov. 7.2 ID 23-4057 City Manager’s Report (Jess Knudson) City Manager Jess Knudson reported on the following: • Recognized city employees with 5, 10, 15, 20, and 25 milestone years of service with the city. • Announced various events, ceremonies, and proclamations. • Sledding with Santa will be held on December 15, 2023, from 5:00 p.m. to 8:00 p.m. at the Tinnell Memorial Skatepark. • Lake Havasu City is conducting a Citizen Survey to help identify areas of improvements to meet the needs of the citizens. • City offices will be closed on Monday, December 25, 2023, and Monday, January 1, 2024. Fire Chief Pete Pilafas and Police Chief Troy Stirling honored Bliss Fiala and her grandmother Linda Kalk with a Good Samaritan Award for helping a resident in need. 8. PUBLIC HEARINGS 8.1 ID 23-4031 Series #06 Bar Liquor License, Lighthouse Lounge, 317 Lake Havasu Avenue South/Bechen (Kelly Williams) Ms. Williams advised that Mr. Justin Bechen has applied for a Series #06 Bar Liquor License for Lighthouse Lounge located at 317 Lake Havasu Avenue South. She said all posting requirements have been met, all fees have been paid, and no objections were received. Ms. Williams added that the location is properly zoned for a Series #06 liquor license. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Vice Mayor Moses moved to recommend that the Arizona Department of Liquor Licenses & Control approve a Series #06 bar liquor license for Lighthouse Lounge, 317 Lake Havasu Avenue South, seconded by Councilmember Dolan, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Moses, Councilmember Coke, Vice Mayor Lane and Councilmember Dolan 8.2 ID 23-4061 Approve Cooperative Purchase Agreement with American Guard Services for Armed and Unarmed Services Utilizing an Arizona State Cooperative Agreement (Mitchell Kalauli) Lake Havasu City Page 3 Printed on 1/10/2024 City Council Minutes - Final December 12, 2023 City Magistrate Mitchell Kalauli advised that staff is requesting approval of a contract with American Guard Services to provide security at the new courthouse utilizing a cooperative agreement in the amount of $131,073.60 with an additional $9,000 in contingency funds for overtime services if needed. Councilmember Lin asked if the courthouse would utilize guard services for council meetings, to which Judge Kalauli explained that overtime services for armed guards have been built into the contract if needed. Mayor Sheehy explained that there may be some overlap of guard services with the courthouse hours and community meetings; therefore, staff will not know what overtime services are needed until the city is in there using the space in its full capacity. Councilmember Campbell asked if the Lake Havasu Police Department would continue to provide security at council meetings, to which Mayor Sheehy said yes at a minimum what the city is doing today will continue moving forward Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Lane moved to approve the Cooperative Purchase Agreement with American Guard Services for Armed and Unarmed Services utilizing Arizona’s State Cooperative Contract and authorize the City Manager to sign the Agreement with a termination date of October 31, 2025, and authorize City staff to exercise the option to renew for a not-to-exceed maximum aggregate term of five (5) years, seconded by Councilmember Coke, and carried by the following vote: Aye: 6 - Mayor Sheehy, Councilmember Campbell, Councilmember Moses, Councilmember Coke, Vice Mayor Lane and Councilmember Dolan Nay: 1 - Councilmember Lin 8.3 ID 23-4058 Approve Amendment No. 3 to Professional Services Contract with Clifton Larson Allen, LLP, for External Auditing Services (Trinna Ware) Finance Division Manager Trinna Ware advised that this item is to approve Amendment No. 3 to the Clifton Larsen Allen, LLC, professional services contract for external auditing services. Ms. Ware explained that the city entered into a five-year contract with Clifton Larsen Allen for Fiscal Years 2021 through 2025 for $358,293 with two amendments to date (addition of a National Transit Database Audit and GASB Statement 87 Audit). She said Amendment No. 3 is due to significant changes to audit standards with Information Technology Risk Assessment in the amount of $15,708. Ms. Ware noted two errors within the amendment including a misspelling of the word “revised” on Page 1 and a calculation error in the total for Year 4 on Page 3. Ms. Ware added that the first two amendments were within five percent of the contract amount and approved by the City Manager; however, Amendment No. 3 increases the contract by over five percent requiring City Council approval. Mayor Sheehy opened the public hearing. Ms. Bonnie Toy, citizen, addressed the council and asked if the audits are available to the public, to which Ms. Ware said the audits can be found on the city’s website under Budget & Finance. There being no further comments, Mayor Sheehy closed the public hearing. Councilmember Coke moved to approve Amendment No. 3 to the Professional Services Contract with Clifton Larson Allen, LLP, for $15,708, and authorize the City Manager to sign the Amendment, seconded by Councilmember Dolan, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Moses, Councilmember Coke, Vice Mayor Lane and Councilmember Dolan 8.4 ID 23-4051 Approve Cooperative Purchase Agreement for Citywide Uniforms, Floor Mats, Towel Rental and Laundry Service with Unifirst Corporation ( Bill Young and Mike Keane) Transportation and Maintenance Superintendent Bill Young advised that this item is requesting approval of a cooperative purchase with Unifirst Corporation for citywide uniforms, floor mats, towel rental, and laundry service in an amount not to exceed $75,000. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Coke moved to approve the Cooperative Purchase Agreement and annual expenditure not-to-exceed $75,000 for Citywide uniforms, floor mats, towel rental and laundry services with Unifirst Corporation; authorize the City Manager to sign the Agreement; and authorize City staff to exercise the option to renew in accordance with the Arizona State Contract for three additional twelve-month terms through November 30, 2028, seconded by Councilmember Dolan, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Moses, Councilmember Coke, Vice Mayor Lane and Councilmember Dolan 9. CALL TO THE PUBLIC Lake Havasu City Page 5 Printed on 1/10/2024 City Council Minutes - Final December 12, 2023 Mr. Leonard Lacey and members from the 2024 Lake Havasu Leadership Academy addressed the council regarding their Lake Havasu Leadership Legacy Project this year to install Mobi Mats at Rotary Park and London Bridge Beach as well as accessible swings at Rotary Park. Ms. Susan Smith, President/CEO of Go Lake Havasu, introduced herself and said she was delighted to be selected as the new President/CEO of Go Lake Havasu and said her office is always open for questions, chats and coffee. Mr. Steve Mindt, President of the Property Owner’s Association for Havasu RV Resort, addressed the council regarding a water extension project that EPCOR started in front of their property two years ago with mounds of dirt and holes left behind that are still there today. Mr. Mindt questioned the permit process for EPCOR to dig up a city road and asked for the council’s help to resolve this issue. 10. CURRENT EVENTS Councilmember Lin provided an update from the Western Arizona Council of Government (WACOG). Councilmember Campbell provided an update from the Chamber of Commerce Governance Board and said she will be attending a Lake Havasu Metropolitan Organization (LHMPO) Transportation Board meeting in Yuma, Arizona. 11.
