(Mike Keane) Parks and Recreation Director Mike Keane advised that this item is requesting approval of a cooperative purchasing agreement with Hillyard, Inc., for janitorial supplies to be utilized by the parks and Aquatic Center. Councilmember Lin requested clarification on what janitorial services would be provided, to which Mr. Keane said it would include servicing of any of the janitorial equipment that they are providing. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Dolan moved to approve the cooperative purchase of janitorial supplies, equipment, and services from Hillyard, Inc., utilizing Mohave Educational Services Cooperative, Inc., Contract., seconded by Councilmember Lane, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Coke, Councilmember Dolan, Councilmember Lane and Vice Mayor Moses 6. CORRESPONDENCE, COMMUNICATIONS, PETITIONS, ANNOUNCEMENTS, CITY MANAGER REPORT 6.1 ID 24-4169 Announce Vacancies on Lake Havasu City Boards, Committees, and Commissions (Kelly Williams) City Clerk Kelly Williams announced the current vacancies on various Lake Havasu City Boards, Committees, and Commissions. She added that applications are available at City Hall and on the City’s website at www.lhcaz.gov. 6.2 ID 24-4168 City Manager’s Report (Jess Knudson) City Manager Jess Knudson reported on the following: • Announced various events, and ceremonies. This program was led by Dr. Bobbie Kimelton, HR Director, and partnered with AZ@Work and Mohave Community College. He said as part of the program, the class built a Havasu Water Smart Demonstration Garden located on the Police Department campus at the corner of Spezzano Way and McCulloch Boulevard. • The Municipal Courthouse held an official ribbon cutting ceremony on February 29, 2024. • The Lake Havasu City Fire Department Annual Report for 2023 is available on the City’s website. • Recognized the Administrative Services Department for receiving the Government Finance Officers Association of the United States and Canada (GFOA) Distinguished Budget Presentation Award for the Fiscal Year 2023-24 budget. 7. PUBLIC HEARINGS 7.1 ID 24-4104 Series #9 Liquor Store Liquor License, Hacienda Mini Mart, 3618 S. Jamaica Boulevard/Reichert (Kelly Williams) Ms. Williams advised that Ms. Wendy Reichert has applied for a Series #9 Liquor Store Liquor License for Hacienda Mini Mart located at 3618 S. Jamaica Boulevard. She said all posting requirements have been met, all fees have been paid, and no objections were received. Ms. Williams added that the location is properly zoned for a Series #9 liquor license. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Coke moved to recommend that the Arizona Department of Liquor Licenses & Control approve a Series #9 liquor store liquor license for Hacienda Mini Mart, 3618 S. She said an appointment is needed to fill a regular member vacancy. Ms. Williams said the Application Review Panel conducted interviews for the Board of Adjustment on March 4, 2024, and recommends that Brian McMahan be appointed as a regular member with a term ending June 30, 2026. Mr. Brian McMahan, applicant, addressed the council and thanked the council for consideration of his application to the Board of Adjustment. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Dolan moved to adopt Resolution No. 24-3730 appointing Biran McMahan as a regular member to the Lake Havasu City Board of Adjustment with a term ending June 30, 2026, seconded by Vice Mayor Moses, and carried by the following vote: Aye: 6 - Mayor Sheehy, Councilmember Lin, Councilmember Coke, Councilmember Dolan, Councilmember Lane and Vice Mayor Moses Nay: 1 - Councilmember Campbell 7.4 ID 24-4172 Adopt Ordinance No. 24-1327 Amending City Code Section 2.12.090, Elections - Scheduling, Regarding the Primary and General Election Dates (Kelly Williams) Ms. Williams said on February 9, 2024, the Governor signed House Bill 2785 changing the date of the Primary Election from August 6, 2024, to July 30, 2024. Ms. Williams stated that this bill became effective immediately on February 9th and requires Lake Havasu City Page 4 Printed on 3/27/2024 City Council Minutes - Final March 12, 2024 amendments to Lake Havasu City Code Section §2.12.090, Elections - Scheduling, to align with State Statutes regarding the Primary and General Election dates. She stated that this ordinance was introduced at the February 27, 2024, meeting. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Lane moved to adopt Ordinance No. 24-1327 amending City Code Section 2.12.090, Elections - Scheduling, seconded by Councilmember Coke, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Coke, Councilmember Dolan, Councilmember Lane and Vice Mayor Moses 7.5 ID 24-4155 Adopt Ordinance No. 24-1328 Amending the Zoning Classification and District Boundary for 2205 Victoria Farms Road, APN 120-03-045, a 30-acre Portion of Planned Development No. 07-00200005, from Light Industrial/Planned Development District (LI/PD) to Industrial District (I) (Trevor Kearns) Planning Division Manager Chris Gilbert advised that this original request went before the City Council on June 13, 2023 and was postponed by the City Council until the violations for illegal grading and illegal storage containers were remedied. Since that time, the owner has satisfied the illegal grading per the Lake Havasu City Engineering Division and has removed all storage containers. Mr. Gilbert said the subject property is located on the northside of Victoria Farms Road and is approximately 30-acres wit, east of Highway 95, with access from Chenoweth Drive to Victoria Farms Road. The properties to the west and north are zoned Light Industrial (LI), to the south are LI and Agricultural/Preservation (A-P), and to the east Light Industrial/Planned Development (LI/PD) and Industrial (I). Mr. Gilbert said that the applicant is requesting to rezone the property to I for future uses and the property is served by a private ingress/egress easement. He added that future development of the property will require an appropriate design review, building permits and any lot alterations/splits. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Lane asked regarding the recommendation to deny this item from the Planning and Zoning Commission. Mr. Gilbert said the motion to deny was a vote of 3 to 4 and the dissenting voters did not state their reason to deny the request. Mayor Sheehy added that the Planning and Zoning Commission and the City Council denied it because of several code violations. Councilmember Campbell moved to adopt Ordinance No. 24-1328 amending the Lake Havasu City Page 5 Printed on 3/27/2024 City Council Minutes - Final March 12, 2024 zoning classification and district boundary for 2205 Victoria Farms Road from Light Industrial/ Planned Development to Industrial, seconded by Vice Mayor Moses, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Coke, Councilmember Dolan, Councilmember Lane and Vice Mayor Moses 7.6 ID 24-4159 Approve the Multiple Purchase of a 2024 F550 Regular Cab 4X2 with Crane; 2024 F550 Regular Cab XL 4X2; 2024 F250 Regular Cab; and 2024 F550 Regular Cab 4X4 from San Tan Auto Partners LLC (Bill Young) Transportation and Maintenance Superintendent Bill Young said this item is a multiple purchase of a 2024 F550 Regular Cab 4X2 with Crane; 2024 F550 Regular Cab XL 4X2; 2024 F250 Regular Cab; and 2024 F550 Regular Cab 4X4 utilizing a cooperative purchaing agreement from San Tan Auto Partners LLC in the amount of $301,727.18. Mr. Young said that the vehicles exceeded the criteria for replacement. Councilmember Dolan asked the estimated time frame to receive these vehicles, to which Mr. Young said approximately within the next fiscal year. Mayor Sheehy opened the public hearing. Vice Mayor Moses moved to approve the purchase of a 2024 F550 Regular Cab 4X2 w/Crane; 2024 F550 Regular Cab XL 4X2; 2024 F250 Regular Cab 4X2; and 2024 F550 Regular Cab 4X4 vehicles in the amount of $301,727.18 utilizing the cooperative contract CTR059323 through Arizona State Procurement Office (AZSPO) with San Tan Auto Partners LLC, subject to release of any amended manufacturer’s official published pricing and discount off of the manufacturer’s retail price by the Arizona State Purchasing Office, and authorize the City Manager to approve an amended adjustment, seconded by Councilmember Coke, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Coke, Councilmember Dolan, Councilmember Lane and Vice Mayor Moses 7.7 ID 24-4166 Approve the Cooperative Purchasing Agreement with Holbrook Asphalt, LLC, and Purchase of HA5 High Density Mineral Bond Pavement Preservation Services (Bill Young) Mr. Young advised that this item is a cooperative purchasing agreement with Holbrook Asphalt, LLC, in the amount of $184,641.58. He explained that the HA5 high density mineral bond will maintain and preserve the roadways and extend the useful life of four to Lake Havasu City Page 6 Printed on 3/27/2024 City Council Minutes - Final March 12, 2024 seven years. Councilmember Campbell expressed her appreciation to the staff and council and added that this product will help extend the life of the roads. Councilmember Lin asked for clarification regarding the affected areas on the Island, to which Mr. Young stated in front of Beachcombers and the Football Field. Councilmember Lin asked if these are city-owned properties, to which Mr. replied yes. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Lane moved to approve the Cooperative Purchasing Agreement with Holbrook Asphalt, LLC; authorize the City Manager to execute the Agreement through June 30, 2025; authorize City staff to exercise the option to renew the Agreement for one (1) additional one (1) year term; and approve the purchase of HA5 in the amount of $184,641.58, plus applicable taxes, seconded by Councilmember Dolan, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Coke, Councilmember Dolan, Councilmember Lane and Vice Mayor Moses 8.
