CALL TO ORDER Chairman Harris called the meeting to order at 9:03 a.m. 2. PLEDGE OF ALLEGIANCE Chairman Harris led the Pledge of Allegiance. 3. ROLL CALL Mr. Biasiucci, Ms. Cunningham, and Mr. Bergen were seated. Present: 7- Jim Harris, Doug Hardy, John Kendig, Chad Nelson, Donald Bergen, Leo Biasiucci and Christy Cunningham Absent: 3- Lucas Still, Mychal Gorden and Dan McGowan 4. MINUTES Mr. Hardy made a motion to approve the minutes of the last meeting, seconded by Mr. Biasiucci, and carried by the following vote: Aye: 7 - Harris, Hardy, Kendig, Nelson, Bergen, Biasiucci and Cunningham Absent: 3 - Still, Gorden and McGowan Approval of Regular Meeting Minutes from March 7, 2018. 5. CORRESPONDENCE AND ANNOUNCEMENTS None. 6. PUBLIC HEARING ID 18-1588 A Request for a Preliminary Plat, Window Rock Subdivision, Tract 2404, Dividing 58.83 Acres to Include 102 Single Family Lots, Public Streets and Storm Drainage Area Mr. Schmeling thanked the Chairman and presented a PowerPoint slideshow and narrative including some of the following key points: • Property located along the far east end of town, north of Window Rock Road. Lake Havasu City Page 1 Printed on 5/3/2018 Planning and Zoning Commission Minutes - Final April 18, 2018 • Northern 19 acres were annexed to the City in 2016. • Adjacent property (80 acres) also annexed in 2016, rezoned in January 2018 to R-1 and RE. • Proposed subdivision for 58 acres presented. • 102 lots ranging from 90 to 110 feet in width and 125 to 272 feet in depth. • 4.857-acre retention basin. • 60-foot street right-of-way, including one access from Window Rock Road and a connection to the existing Angelfish Drive right-of-way. Chairman Harris asked why the requirement for such a large retention. Ms. Cunningham requested clarification towards Mr. Schmeling’s statement of typical lot configurations, as the subdivision plat development does not contain curbs and cul-de-sacs found in the existing typical Havasu lots. Mr. Schmeling stated given that most of this lot is relatively flat, the topography lends itself to a more grid like configuration than what is seen in the typical lots of Havasu. Todd Bremner, Civil Engineer for project, addressed the retention basin question presented by Chairman Harris and stated they are following policies of Mohave County’s drainage system. The County’s theory is that if you retain the entire volume of a particular event storm, then the likelihood of actual discharge in these larger storms is almost nil. A 100-year storm for 2-hour duration is what this project basin is retaining. A brief explanation of the proposed retention design was provided to the Commission. Chairman Harris opened the Public Hearing. Joan Marshall, 3981 Window Rock Drive resident, addressed the Commission regarding her concern about drainage and the increased traffic on a minimal residential road that goes to her house. She is three lots down from the development and is concerned about Window Rock Road being the only access to the subdivision. Chairman Harris closed the Public Hearing. Mr. Schmeling stated that Staff finds the proposed subdivision plat meets all the requirements set forth in Title 13. Based on the findings, the Development Review Committee recommends that land use action 18-1588 Window Rock Subdivision Preliminary Plat, Tract 2404, to include 102 single family lots, public streets, and a retention basin be approved with the following conditions: 1. Street names shall be added to the plat for City staff review and approval. 2. A Title Report shall be provided and reviewed by City staff. 3. Parcels A and C, if necessary, shall be dedicated on the plat to Lake Havasu City. Lake Havasu City Page 2 Printed on 5/3/2018 Planning and Zoning Commission Minutes - Final April 18, 2018 4. A maintenance agreement for Parcels A and C shall be reviewed and approved by City staff. 5. All homes will require fire sprinklers. 6. Fire flows shall be identified and any necessary restrictions shall be determined. 7. Sewer and Water Master Plans shall be reviewed and approved by City staff. 8. A 10-foot PUE along the western border instead of the proposed 8-foot, including Lots 1-4 of Block 3 and Lots 1-8 of Block 4 shall be provided. 9. Proposed easements shall be reviewed to determine if they are adequate to handle water and sewer utilities. Chairman Harris asked the applicant if he understood Staff’s recommendation, to which Mr. Bremner agreed. Mr. Nelson asked if Mr. Bremner could address Ms. Marshall’s concerns regarding the intent of traffic control. Mr. Bremner gave a brief explanation about the traffic impact study that has been completed in which it has been determined that the trips generated by this project are relatively minimal. Mr. Nelson asked if there are any plans of beautification to the basin area. Mr. Schmeling stated this matter has not been addressed yet. Ms. Cunningham asked for clarification of the County reference to the traffic study since the property was annexed into the City. Mr. Bremner stated that the annexation was private property and the right-of-way belongs to the County, so it remains under County jurisdiction. Mohave County requires ADOT standards be followed for roadway designs and geometry. Mr. Biasiucci asked, in regards to the traffic, if there is only one entrance into the subdivision or if Angelfish Drive will be a second entrance. Mr. Bremner stated Angelfish is the second entrance. He also stated that there is a third anticipated tie-in to the next subdivision. Mr. Bergen asked, in regards to entrances, if Staff feels there is adequate public access to the entire area, including emergency. Mr. Schmeling stated that the Fire and Police departments are part of the review process and they did not indicate any issues or concerns. From a Planning perspective, Mr. Schmeling stated that there is adequate access both through the west on Angelfish and Window Rock Road, also considering the 80 acres adjacent as well; however, Staff will have to address and amend the current agreement with the County regarding improvements to Window Rock Road. Mr. Nelson asked if the subdivision will be gated to which Mr. Bremner replied that it will Lake Havasu City Page 3 Printed on 5/3/2018 Planning and Zoning Commission Minutes - Final April 18, 2018 not be gated. Mr. Biasiucci made a motion to approve land use action ID #18-1588 Window Rock Subdivision Preliminary Plat, Tract 2404, to include 102 single family lots, public streets, and a retention basin with the following staff recommendations: 1. Street names shall be added to the plat for City staff review and approval. 2. A Title Report shall be provided and reviewed by City staff. 3. Parcels A and C, if necessary, shall be dedicated on the plat to Lake Havasu City. 4. A maintenance agreement for Parcels A and C shall be reviewed and approved by City staff. 5. The vote was seconded by Mr. Nelson and carried by the following vote: Aye: 6 - Harris, Hardy, Kendig, Nelson, Bergen and Biasiucci Nay: 1 - Cunningham ID 18-1589 A Request to Rezone APN 110-05-062, 19.6 Acre Parcel Bordered by Chemehuevi Wash on the North and Window Rock Road on the South, from A-P (Agricultural - Preservation) District to R-1 (Single Family Residential) District Mr. Schmeling thanked the Chairman and presented a PowerPoint slideshow and narrative including some of the following key points: • The property is a portion of the same parcel just approved in the previous item. • Property annexed in 2016 under A-1 zoning. • A-P designation adopted with new Development Code. • Intent is to develop entire area with single family lots so proper designation is R-1. Mr. Biasiucci asked if there is adequate fire prevention to handle all the homes in this subdivision and if there is a need for another fire station. Mr. Schmeling stated that the Fire Department reviewed this application and as a result a requirement that all homes be sprinklered has been set. Fire flow analysis will be assessed with the plan review. A new station was not part of Fire's review comments. Mr. Bremner addressed Mr. Biasiucci’s concern and stated the fire hydraulics system will be submitted as part of the final engineering submittal. Joan Marshall, neighbor of this project and enraged hotly disgusted resident of Window Rock Drive, addressed the Commission again regarding the access and ingress into the project. She stated that 102 houses would mean about 200 extra cars up and down the road. She stated they have endured the trucks because they knew this was going to happen. When they bought the lot in 2002, they were informed this was a projected project; but without definitive proposals- possibly 5 acre parcels and horse ranches. She stated that all that is requested is some type of traffic plan that allows us to reside in our homes in the residential area that we have purchased and developed. Chairman Harris closed the Public Hearing. Mr. Schmeling stated that Staff finds that the proposed rezoning meets all the requirements set forth in 14.05.04K 6a 1&2;6c 1-6. Based on the findings, the Development Review Committee recommends that land use action 18-1589 be forwarded to the City Council with a recommendation of approval, rezoning 19.6 acres from A-P, Agricultural Preservation to R-1, Single-Family Residential. Mr. Nelson asked Mr. Bremner what the traffic requirements are for Window Rock Road. Mr. Bremner stated that 1500 or 1600 trips a day is needed in order for ADOT to warrant changes to Window Rock Road, and the traffic study performed has estimated about 700 trips a day. Mr. Schmeling once again clarified that the agreement with the County will be addressed and updated as a result of the two subdivisions currently being reviewed and improvements will be performed on Window Rock Road at a later date, with regards to traffic. Who will be responsible for those upgrades is yet to be determined. Mr. Schmeling reminded the Commission this request is to rezone 19 acres to R-1 (Residential Single Family). Mr. Nelson made a motion to approve ID 18-1589, a request to rezone APN 110-05-062, 19.6-acre parcel bordered by the Chemehuevi Wash on the north and Window Rock on the south, from A-P (Agricultural Preservation) District to R-1 (Single-Family Residential) District with Staff’s recommendations, seconded by Mr. Hardy, and carried by the following vote: Aye: 6 - Harris, Hardy, Kendig, Nelson, Bergen and Biasiucci Nay: 1 - Cunningham 7.
