1. CALL TO ORDER
Member Gorden called the meeting to order at 9:02 a.m.
2. PLEDGE OF ALLEGIANCE
Member Gorden led the Pledge of Allegiance.
3. ROLL CALL
Alternate Members Bergen and Cunningham were seated.
In the excused absence of Chairman Harris, Mr. Hardy made a motion to appoint Mr.
Gorden as Chairman, seconded by Mr. McGowan, and carried by a unanimous verbal
vote.

4. MINUTES
Mr. Hardy made a motion to approve the minutes of the last meeting, seconded by
Mr. McGowan, and carried by the following vote:
Aye: 6 - Gorden, Hardy, Kendig, McGowan, Bergen and Cunningham
Absent: 4 - Harris, Still, Nelson and Biasiucci
Approval of Regular Meeting Minutes from June 6, 2018.
5. CORRESPONDENCE AND ANNOUNCEMENTS
Mr. Schmeling informed the Commission that new equipment has been installed and will
be used for presentation and voting of items for the Council and Boards & Commissions.
6. PUBLIC HEARING
ID 18-1681 A Request for Multiple Text Amendments to Title 14, Zoning
(Development Code), to Make Necessary Changes to Sections 14.02.04;
14.02.06; 14.03.02; 14.03.03; 14.04.01; 14.04.02; 14.04.04; 14.05.03; and

14.06.03 Regarding Setbacks, Planned Development Overlay,
Manufactured Homes, Outdoor Storage Screening Standards, Bicycle
Parking, Appeals, and Definition of Family and Dwelling.
Mr. Schmeling thanked the Chairman and presented a PowerPoint slideshow and narrative
regarding the current Development Code, adopted in 2016. Twelve code sections were
amended in November 2017. This agenda proposes eight amendments to nine sections of
the Development Code. Mr. Schmeling addressed each change individually with the
following key points.
1. 14.02.04.D Table 2-16: Fixes a typo to correctly reference Section 14.02.04.D.4.
2. 14.02.06.D.2: Allows a PD Overlay rezone request for all zoning districts.
3. 14.03.02 Table 3-1: Adds “Manufactured home outside a manufactured housing park”
to the Permitted Uses Table and allows in the R-MH (Manufactured Home) Zone.
4. 14.03.03.D.1 & 14.04.04.G.3.b: Allows use of chain link or wrought iron with sight
obscuring plastic lath or netting for screening in LI (Light Industrial) and I
(Industrial) Zones.
5. 14.04.01 Table 4.01-3: Fixes a typo to correct Front Yard Setback for A-P
(Agriculture/Preservation) Zone to 50 feet.
6. 14.04.02.D.2: Clarifies that bicycle parking is optional and sets maximum vehicle
parking space reductions when providing bicycle parking.
7. 14.05.03.O.8.a: Clarifies that appeals of Development/Zoning Code issues addressed to
the Council are filed with the City Clerk’s Office.
8. 14.06.03: Moves a portion of the language in the definition of “DWELLING,
SINGLE-FAMILY DETACHED” into the definition of “FAMILY”.
Mr. McGowan and Mr. Schmeling had a discussion regarding the number of members
allowed in a dwelling.
Mr. Bergen asked if the industrial uses outdoor storage (Item #4) would have affected the
recent request heard by the Commission (JR Motors ZUP), to which Mr. Schmeling stated
that it would not have as that property is zoned C-2. The only exception for wrought iron
or chain link fence here is for LI (Light Industrial) or I (Industrial). The C-2 property
owners would still have to abide by the standards that require the block wall, additional
landscaping, etc.
In regards to Item #6, Mr. Bergen feels that the MPO is working on adding bicycle
parking and the code is reducing bicycle parking. Mr. Schmeling clarified that the
amended Code still encourages business owners to incorporate bicycle parking; however
current code requires business owners, proposing 10 or more parking spots, to designate
bicycle spaces. This was not the intent when the code was being developed.

Item #7, the handling of appeal applications, was discussed and clarified in that the only
change to this item is the filing of the document. Previous language allowed the appeal to
be filed with the City Clerk or the Community Investment Department. Now all appeals
will go through the City Clerk. The remaining process is unchanged and will be heard by
the appropriate body. Mr. Schmeling also stated that cases being sent to the Board of
Adjustment have been reduced due to grading requirement changes and the Minor
Variance process which allows the Zoning Administrator a ten percent latitude in regards
to setbacks.
Chairman Gorden opened the Public Hearing, hearing none, he closed the Public Hearing.
Mr. Schmeling stated that Staff recommends land use action No. 18-1681, amending Title
14, Zoning (Development Code), to make necessary changes to sections 14.02.04;
14.02.06; 14.03.02; 14.03.03; 14.04.01; 14.04.02; 14.04.04; 14.05.03; and 14.06.03
regarding setbacks, planned development overlay, manufactured homes, outdoor storage
screening standards, bicycle parking, appeals, and definition of family and dwelling, be
recommended for approval and forwarded to the City Council.
Mr. Hardy made a motion to approve ID 18-1681, a request for multiple text
amendments to Title 14, Zoning (Development Code), to make necessary changes to
Sections 14.02.04; 14.02.06; 14.03.02; 14.03.03; 14.04.01; 14.04.02; 14.04.04; 14.05.03;
and 14.06.03 regarding setbacks, planned development overlay, manufactured
homes, outdoor storage screening standards, bicycle parking, appeals, and definition
of family and dwelling, seconded by Mr. McGowan and carried by the following
vote:
Aye: 6 - Gorden, Hardy, Kendig, McGowan, Bergen and Cunningham
7. CALL TO PUBLIC
None.
8. FUTURE MEETING
The meeting scheduled for July 4, 2018 has been canceled due to the holiday. The next
Regular meeting is scheduled for July 18, 2018 at 9:00 a.m.
9. ADJOURNMENT
Chairman Gorden adjourned the meeting at 9:43 a.m.
