1. CALL TO ORDER
Vice Chairman Gorden called the meeting to order at 9:00 a.m.
2. PLEDGE OF ALLEGIANCE
Vice Chairman Gorden led the Pledge of Allegiance.
3. ROLL CALL
Present: 5- Lucas Still, Mychal Gorden, Donald Bergen, Dan McGowan
and Suzannah Ballard
Absent: 5- Jim Harris, Doug Hardy, Chad Nelson, Matthew Mitchell and
Sam Levin
Alternate Member Ballard was seated.
4. MINUTES
Mr. Bergen made a motion to approve the minutes of the last meeting, seconded by
Mr. Still, and carried by the following vote:
Aye: 5 - Still, Gorden, Bergen, McGowan and Ballard
Absent: 5 - Harris, Hardy, Nelson, Mitchell and Levin
Approval of Special Meeting Minutes from September 23, 2020.
5. CORRESPONDENCE AND ANNOUNCEMENTS
None.
6. PUBLIC HEARING
ID 20-2566 A Request for a Preliminary Plat for 1760 McCulloch Blvd N, Tract 2345,
Block 1, Lot 5, to Convert an Existing Structure into a Commercial
Condominium Project in the C-CHD (Commercial and Health District)
Creating Three Commercial Condominiums Units.
Mr. Morris thanked the Vice Chairman and presented a PowerPoint slideshow and
narrative including some of the following key points:

• Request to approve a Preliminary Condominium Plat for a commercial subdivision.
• Subject property located at corner of Capri and McCulloch Blvd.
• Existing building built in 1990.
• Improvements done in 2004, 2007, 2017 and 2020.
• Property next to County Library and old K-Mart parking lot.
• Common area for parking, access to building, and utilities.
• Two story building being broken down to common areas and 3 units- 2 units on ground
floor and 1 unit above.
Lee Johnson, APL Surveying was present on behalf of the applicant available for
questions. There were none.
Vice chairman Gorden opened the public hearing. Hearing none, he closed the public
hearing.
Mr. Morris stated that based on the findings, the Development Review Committee
recommends the Planning Commission approve land use action ID #20-2566, a
Preliminary Plat for McCulloch Medical Plaza Condos, on Tract 2345, Block 1, Lot 5.
Mr. Bergen made a motion to approve [land use action ID #20-2566, a Preliminary
Plat for McCulloch Medical Plaza Condos, on Tract 2345, Block 1, Lot 5]. The
motion was seconded by Ms. Ballard, and carried by the following vote:
Aye: 5 - Still, Gorden, Bergen, McGowan and Ballard
ID 20-2564 A Request for a Zone Change for 6800 Chenoweth Drive, APN
120-03-064, from A-P (Agriculture Preserve District) to I (Industrial
District).
Mr. Morris thanked the Vice Chairman and presented a PowerPoint slideshow and
narrative including some of the following key points:
• Subject property is 9 acres, located on the North side of town on Chenoweth Rd.
• Surrounding area is vacant property and a couple storage lot uses.
• Letter of Intent did not specify proposed use.
• Any use allowed in Industrial use will be allowed, if request is approved.
• Requesting to rezone from AP (Agricultural Preserve) to Industrial (Industrial).
• AP does not allow any commercial uses.
• Allowable uses table was shown on screen.
Applicant was not present.
Vice chairman Gorden opened the public hearing. Hearing none, he closed the public
hearing.

Mr. Morris stated that based on the findings, the Development Review Committee
recommends the Planning Commission recommend approval of land use action No.
20-2564, for a Zone Change for 6800 Chenoweth Road, from A-P (Agriculture Preserve
District) to I (Industrial District). This item is scheduled to be heard by the City Council at
their December 8, 2020 meeting.
Mr. Still made a motion to recommend that the City Council approve land use
action No. 20-2564, for a zone change for 6800 Chenoweth Drive from Agriculture
Preserve District to Industrial District. The motion was seconded by Ms. Ballard and
carried by the following vote:

ID 20-2563 Request for a Zone Change for 2301 Cup Drive, Tract 2319, Block 2, Lot
13A, from GC (Golf Course District) to R-E (Residential Estates District)
for the Portion of the Lot Purchased from the Golf Course
Mr. Morris thanked the Vice Chairman and presented a PowerPoint slideshow and
narrative including some of the following key points:
• Request is for a portion of Golf Course rezone. Similar requests have been heard by
the Commission.
• Subject property located at corner of Fringe Dr. and Cup Dr.
• Property owner recently purchased a portion of the golf course property and added it
to his lot.
• Main property zoned RE, Golf course property purchased still zoned GC.
• Applicant asking to rezone GC portion to match residential portion zoning of RE.
• 10-foot PUE in rear has been abandoned.
Brian Springberg, owner/applicant stated he had a citizens meeting and everyone was okay
with the rezone. He has no intent of doing anything that would disrupt anyone's view. He
said he was available for questions from the Commission. There were none.
Mr. Still thanked Mr. Springberg for contacting the neighbors and also stated this property
sits on corner and has no view hindrance. Mr. Still felt important to note that this was a
different than some of the other rezones the Commission has reviewed recently.

hearing.
Mr. Morris stated that based on the findings, the Development Review Committee

20-2563, for a zone change for 2301 Cup Drive, Tract 2319, Block 2, Lot 13A, from GC

to R-E for the portion of the lot that was purchased from the Golf Course. This item is
scheduled to be heard by the City Council at their December 8, 2020 meeting.
Ms. Ballard made a motion to recommend that the City Council approve of land
use action No. 20-2563, for a zone change for 2301 Cup Drive from Golf Course
District to Residential Estates District for the portion of the lot that was purchased
from the Golf Course as shown on the attached Parcel Plat Map 37-11. The motion
was seconded by Mr. McGowan and carried by the following vote:
Aye: 5 - Still, Gorden, Bergen, McGowan and Ballard

None.
8. FUTURE MEETING
The next Regular meeting is scheduled for November 18, 2020.
9. ADJOURNMENT
