1. CALL TO ORDER
Chairman Harris called the meeting to order at 9:00 a.m.
2. PLEDGE OF ALLEGIANCE
Chairman Harris led the Pledge of Allegiance.

4. CORRESPONDENCE AND ANNOUNCEMENTS
Ms. Ballard updated the Commission upon the passing of Commissioner Doug Hardy and
stated several services will be held on January 15th. The first service will be a
rededication of the clock that Mr. Hardy was responsible for getting installed at Pima
Wash on McCulloch Blvd. at 2 p.m., followed by a Celebration of Life at 2:30 p.m. at
Shugrues Restaurant. If you plan to attend, please RSVP to Ms. Ballard at 928 727-0037

5. PUBLIC HEARING
ID 21-3109 Request for a Planned Development Rezone for 2250 Marina View
Avenue, Tract 2399, Block 1, Lot 75, from Mixed Use-General (MU-G) to
Mixed Use-Neighborhood/Planned Development (MU-N/PD) and Applying
the Previously Approved Maximum Allowable Building Height of Up to 60
Feet for a Residential Townhome Development
Mr. Morris thanked the Chairman and presented a PowerPoint slideshow and narrative
including some of the following key points:
• Access is from Havasu Riviera Parkway to Marina View Ave.
• The site is rough graded and vacant.
• The properties to the west and south are zoned MU-N and developed as homes under

construction and vacant lots.
• The property to the east is zoned MU-G and is vacant.
• Vacant city-controlled land lies to the north, across Havasu Riviera Parkway.
• The City adopted the Havasu Riviera Specific Plan for a 250-acre parcel in 2008.
• The adopted Land Use Plan designated 142 acres of residential, 80 acres of mixed use,
and approximately 28 acres of open space and trails.
• In the 2008 approval, the applicant requested two zoning designations, MU (Mixed
Use) District and R-4 (High Density Multi-Family) District.
• The subject lot is in the MU District portion of the original approval, and in 2018, it
was rezoned to Mixed-Use General (MU-G) applying the previously allowed
maximum building height of up to 60 feet.
• The MU-G district allows a number of commercial uses as well as multi-family
residential above the ground floor.
• Commercial development allowed as part of the MU-G zoning has not been realized on
the property.
• Therefore, the property owner desires to rezone the property to Mixed-Use
Neighborhood/Planned Development (MU-N/PD) to allow a multi-family attached
townhome residential development.

• The site plan submitted with the request shows 17 residential units clustered in two and
three-unit buildings.
• The dwelling units will be two-story, with attached garages, and served by private
driveways and sewer utility. Water will be city provided.

• The applicant is asking for a Planned Development to ensure that the project will be
developed as shown on the Site Plan and Sample Building Renderings.
• This item is accompanied by a request to approve the preliminary plat for the proposed
development.
Mychal Gorden, applicant Desert Land Group stated Mr. Morris did a great job on
explaining the background. Mr. Gorden stated that as this community is developed, these
Mixed Use parcels have sat there and the applicant has continued with their planning
efforts trying to figure out what is the highest and best use and what the best fit for the
community is. For this particular parcel, this two-story Townhome project is what is
being pursued at the moment. The parcel next door is staying as MU-G. We are in the
process of designing and developing a bistro/coffee shop component in retail office
building along with the neighborhood pool amenities for this neighborhood. Although this
area was first put in as MU-G, as things have developed in the market, it has evolved into
a more denser residential part of Riviera. A hotel, which was initially planned for is no
longer a proper fit for this area.

Chairman Harris opened the Public Hearing, hearing none, he closed the Public Hearing.
Mr. Morris stated that based on the findings, the Development Review Committee
recommends that the Commission forward a recommendation of approval to the City
Council for Land Use Action No. 21-3109, for a Planned Development Rezone for 2250
Marina View Ave, Tract 2399, Block 1, Lot 75, from Mixed Use-General (MU-G) to
Mixed Use-Neighborhood/Planned Development (MU-N/PD) applying the previously
approved maximum allowable building height of up to 60 feet for a residential townhome
development per the attached Townhomes Site Plan. This item will go to the February 8,
2022 City Council meeting.
Ms. Ballard made a motion to recommend to City Council to approve Land Use
Action No. 21-3109, for a Planned Development Rezone for 2250 Marina View
Avenue, Tract 2399, Block 1, Lot 75, from Mixed Use-General to Mixed Use-
Neighborhood/Planned Development applying the previously approved maximum
allowable building height of up to 60 feet for a residential townhome development
per the attached Townhomes Site Plan. Mr. Diaz seconded the motion which carried
by the following vote:

ID 21-3113 Request for a Preliminary Subdivision Plat for 2250 Marina View Avenue,

Alternate Member Levin arrived at the meeting, was changed from Absent to Present, and
seated at the dais.
Mr. Morris thanked the Chairman and presented a PowerPoint slideshow and narrative
including some of the following key points:
• This is a companion item to a Planned Development Rezone from MU-G to
MU-N/PD to allow the proposed townhome condominium development.
• Access is from Havasu Riviera Parkway to Marina View Ave
• The site is rough graded and vacant.
• The property to the east is zoned MU-G and is vacant.
• Vacant city-controlled land lies to the north, across Havasu Riviera Parkway.
• The proposed plat will allow the units to be individually owned as part of an association
for the common portions of the site. The project includes:
• 17 residential units with attached garages.
• Parcel 75-A, Private Street and PUE.
• The sewer and streets will be privately owned and maintained.
• The water will be owned and maintained by the city.

the maintenance of the improvements.
• The project will have a property owners association to manage and maintain the

Mr. Morris stated that based on the findings, the Development Review Committee
recommends approval of Land Use Action 21-3113, a Preliminary Subdivision Plat for

Mr. Mitchell made a motion to approve Land Use Action 21-3113, a Preliminary
Subdivision Plat for 2250 Marina View Avenue, Tract 2399, Block 1, Lot 75,
creating a 17-Unit Residential Townhome Condominium Subdivision in the
Mixed-Use Neighborhood/Planned Development District. The motion was seconded
by Ms. Medley and carried on the following vote:

Mr. Morris thanked the Chairman and presented a PowerPoint slideshow and narrative
including some of the following key points:
• The subject is made up of three properties.
• The site is generally on Buena Vista Avenue between Oro Grande Boulevard and
McCulloch Boulevard South.
• It is roughly a large triangle with a northwest side of 880 feet, an east side of 725 feet,
and a south side of 520 feet, with a total area of 5.76 acres.
• Parcel L, a large flag lot, was recently purchased from the City through property sales
process in 2018.
• Parcel L has access off of Indian Hills Drive, measures 5.16 acres and is zoned R-1.
• The two smaller lots on Buena Vista Avenue measure .31 and .29 acres and are
currently zoned R-3.

• The combined properties have a 30-foot wide flag lot access to Indian Hills Drive and
abuts the rear property lines of residential lots that front on Indian Hills Drive,
Chiricahua Drive, and Buena Vista Avenue.
• The neighboring properties on Indian Hills Drive and Chiricahua Drive are zoned R-1,
and developed with single-family homes with just two vacant lots.
• The nearby properties on Buena Vista Avenue are zoned R-3 and developed as a mix
of vacant lots, single and multi-family residential homes.
• To the south, across Buena Vista Avenue, is Lake Havasu Fire Station #3, and a large
undeveloped open parcel owned by the Lake Havasu Unified School District.

• Property slopes down about 30 feet from Indian Hills Drive towards Buena Vista
Avenue.
• There is approximately 36 feet of elevation change on the site.
• The requested R-3 District allows a maximum building height of 15 feet from the
established pad height of the property.
• The pad height will be established by a surveyed grading plan prior to development of
the property.
• Given the topography of the site, some of the buildings near the southern portion of the
property could possibly measure 30 feet or taller from existing ground level.
• The site has approximately 185 feet of frontage along Buena Vista Avenue and 30 feet
of flag lot frontage on Indian Hills Drive.
• Upon development, the property is anticipated to have its main access from Buena
Vista Avenue, with Indian Hills Drive providing egress and ingress with an emergency
access only.
• Ingress and egress will be provided as a private driveways, there will be no public
streets.
• For general planning purposes, the applicant provided a conceptual plan showing 40
detached single-family dwellings with attached garages.
• This PD rezone request will not exceed 6.99 units per acre for the entire project based
on density limits supported by the General Plan.
• The maximum number of dwelling units will be limited to 40, based on the 5.76-acre
site overall.

• It is anticipated the dwelling units will be offered for sale as townhouse condominium
units, meaning the buyer would own both the dwelling unit and the land under it.
• The conceptual plan also shows a pool, cabana, and internal driveways and parking
areas as part of the condominium common areas.
• The project will be subject to the Design Review approval process prior to building
permit issuance and the condominium plat review process prior to creation of a
condominium subdivision.
• Staff received two letters of objection to the request after the staff report was

distributed. These have been provided to the Commission.
Sam Woods, Built Well, stated Mr. Morris nailed it and was available for any questions.
When questioned by Mr. Diaz, Mr. Woods stated some of his other developments are a
little closer; however, being held to the 40 units, the houses are spread out more- like a
miniature community. He will try to fit two and three bedroom units there too, along with
guest parking, etc as the layout allows.
Chairman Harris asked what the requested height limitation is for this project. Mr. Morris
stated the R-3 height is 15 feet and no height exceptions are being requested.
Chairman Harris opened the Public Hearing.
Six people spoke in opposition of the request citing the following:
Chuck Marin, Indian Hills resident, stated nothing has changed since the last time that it
was voted against the item 6-0. Not against development, just as R-1 as opposed to the
requested density. Cited parking as an issue. Mr. Marin provided a copy of a signed
petition (with 50 signatures) in opposition of this request. The original will be provided to
the City Clerk prior to the item going before the City Council.
Wayne Nuell, Indian Hills Drive resident echoed Mr. Marin's concern and spoke against
having 40 units built in his back yard.
Scott Shadell, Indian Hills Drive resident, does not believe this is affordable housing.
Disagree with Staff recommendation that this is beneficial to this area;however does not
want to come across as a NIMBY. When asked by Chairman Harris, Mr. Shadell stated
he worked as a Civil Engineer for the City of Carslbad, Escondido, and County of San
Diego.
Larry Palm, recently moved next to access on Indian Hills. Previously lived in similar
type complex in Colorado. Foresees parking issue to be a real problem, as he has
experienced this first hand- not enough parking once his teens were of driving age.
Rex Cross, Indian Hills resident, backs up to upper corner. This property was zoned R-1
since beginning when we and he purchased the property. Requests to leave as R-1.
John McDonald, Buena Vista resident, stated he shares the rear property line with subject
property. Feels that R-1 zoning would allow a property with half the density- maybe 20
homes and be a better fit for that property. With the topography on that lot, it will allow
them to increase the density- larger 2-story homes all along my property line. The

applicant does not have a design yet so it leaves it wide open. Would rather leave as R-1,
as is, until we know what the design is. Shared traffic in his back yard, increase density,
lighting, and noise will be detrimental for his future plans of the property and surrounding
neighbors.
Chairman Harris closed the Public Hearing.
Mr. Morris stated that based on the findings, the Development Review Committee
recommends the Planning Commission forward a recommendation of approval to the City
Council for Land Use Action 21-3107, for 3702 Indian Hills Dr and 3641 & 3651 Buena
Vista Ave, Tract 2208, Block 13, Parcel L and Tract 2217, Block 9, Lots 3 & 4, from
R-1 (Residential Single-Family) District and R-3 (Limited Multiple-Family) District to
R-3/PD (Limited Multiple-Family/Planned Development) District with the following
conditions:
1. The project shall not exceed 40 units;
2. The project shall consist of detached single-family units; and
3. Design Review for compliance with the Development Code shall be required for the
project prior to building permit issuance.
Mr. Morris stated this item will go to the February 8, 2022 City Council meeting.
Mr. Diaz asked if the conditions added to this request were also recommended the
previous time the item came before the Commission. Mr. Morris stated he does not recall
the exact conditions, just that Staff recommended approval last time as well. The item was
denied by the Planning Commission and the applicant withdrew the item before it went
before City Council.
When asked by Mr. Diaz if anything has changed, Mr. Morris stated the Conceptual Plan
might have been revised a little bit but the request remained the same.
Ms. Ballard stated the plan is calling for single car garages. I live in the same plan.
Understands HOA can control boats, etc. Issue with single car garage in 40 units and
insufficient guest parking makes her wonder if the City can limit amount of garage space
from single to double car parking.
Mr. Mitchell asked how many units are allowable on R-1 zoning per acre. The Range of
units per acre are 4-6 units per R-1. So to clarify we have 6 acres that would roughly fit
16-20 units making this request roughly twice as dense.
The Commission and Staff discussed the zoning of this property which is R-1 and that it
would need to be subdivided if wanting more than one single family dwelling on it at this

time.
Chairman Harris stated he was on the Commission when this came through last time.
Definitely affects adjoining owners and values of the neighborhood. Kind of goes against
zoning theory where there is a buffer zone between these properties. Commends the
applicant for the design and type of project just does not think this is the right place for it.
Mr. Diaz made a motion to recommend denial to City Council for Land Use Action
21-3107, for 3702 Indian Hills Drive and 3641 & 3651 Buena Vista Avenue, Tract
2208, Block 13, Parcel L and Tract 2217, Block 9, Lots 3 & 4, from Residential
Single-Family District and Limited Multiple-Family District to Limited
Multiple-Family/Planned Development District. The motion was seconded by Ms.
Medley, and carried by the following vote:

ID 21-3114 Request for a Planned Development Rezone Amending the Approved
Development Plan of PD-02-003 for 1975 Daytona Drive, Tract 2313,
Block 1, Lot 1, in the Single-Family Residential/Planned Development
(R-1/PD) District Adding a School Building and a Gymnasium
Ms. Ballard recused herself due to conflict of Interest.
Mr. Morris thanked the Chairman and presented a PowerPoint slideshow and narrative
including some of the following key points:
• The 8.18-acre subject property is located on Daytona Dr, east of Mulberry
Ave near Greentree Dr.
• It is home to three buildings, including a 23,500 sq. ft. church, a 12,400 sq. ft.
educational building, and a 4,300 sq. ft. pavilion that is under construction.
• The subject property is zoned R-1/PD.
• The abutting properties are all zoned Single-family Residential (R-1) and are developed
with a mix of homes and a few vacant lots that all back to the church property.
• In 2002, the property was zoned Limited Multiple-Family (R-3) and was rezoned to
Light Agricultural/Planned Development (A-1/PD) by Ordinance No 02-677, allowing
a new church building and a total of three buildings on the site.
• The A-1 zone allowed buildings up to 40 feet in height.
• In 2016, the Development (Zoning) Code was updated.
• As part of the update, the A-1 zoning district was eliminated and the property was
reclassified from A-1/PD to R-1/PD because the surrounding properties were also
zoned R-1.
• The allowances and conditions of the previous Planned Development Rezone still
apply, including a building height of up to 40 feet and a total of three buildings.
• This Planned Development Amendment is required because the staff report from the

2002 Rezone suggested that the site is limited to the church and two other buildings,
unless additional public hearings are held and public notice given.

• The site plan submitted with the request shows the existing church, education building,
and pavilion (under construction) and the two proposed buildings, for a total of five
buildings.
• Therefore, the property owner has submitted this amendment to add the proposed
school and gymnasium buildings.

• The two proposed future buildings, include a 26,800 sq. ft. two-story school, and a
10,500 sq. ft. gymnasium building near the southwest corner of the property.
• The proposed structures are about 50 feet from the rear property lines of the abutting
single-family lots to the northwest.
• Parking calculations provided with the request indicate a total of 325 parking spaces
are required for the existing and proposed uses and 399 spaces are proposed.
• The parking meets the Development Code requirements.

• Exterior elevations for the school building show a building height of 30 feet.
• The building is designed with no windows on the northwest side of the building, facing
the abutting single-family homes.
• Building elevations for the gymnasium were not provided.
• Staff received a letter of objection to the request after the staff report was distributed
and it has been provided to the commission.
Father Chauncy Winkler, Pastor at Our Lady of the Lake/applicant, stated they are
starting with smaller construction; however, this is a plan for the future to build a school
building and gymnasium. Seeking approval up front for future needs. Plan to build school
building as running out of classrooms in rear educational building. Also want office in
front of the church. No windows on left side - western sun is brutal in the afternoon, and
also to not have any windows facing the residential properties.
When questioned by Chairman Harris, Father Chauncey is hoping to build the proposed
school this year and the gymnasium in about 5 years due to financial reasons.
Mr. Mitchell asked if their is a change in height for the proposed gymnasium. Todd
Brautigam, Selberg Associates, stated they are not seeking to change the 40-foot height
limit; however, the gymnasium is not planned for 40 feet, it is going to be more like 25 to
30 feet.
Father Chauncey added that the proposed two-story school building itself is only going to
be 30 feet. The church is 40 feet and it needs to be visibly the tallest building so
everything else will be significantly shorter.

Mr. Diaz asked what grades will be incorporated in the classrooms. Father Chauncey
stated they will be Pre-K through eighth grade and are currently one classroom per grade.
If in distant future it is available and the need is there, would like two classrooms per
grade.
Chairman Harris opened the Public Hearing.
Randy Habeck, owner of house on Greentree for 51 years spoke against this request. He
stated he has lived there since the first church was there. There are no houses above that
road elevation wise. To build anything more than an R1 home is invasive as it will deprive
everybody in that area of a quiet street and neighborhood. Noise concern- no one ever
dreamed of having a gymnasium with basketballs or school with bells ringing behind their
house. Always got along with the church but this is getting out of control from R-1 to
multi- story building. Traffic already a problem- parking already on our property. Our
area is low density. Mr. Habeck feels their homes will have a loss of value with a gigantic
building looking down at everybody.
Dante Marinelli, homeowner for about 45 years in Lake Havasu, owned a couple of
businesses in town, and has been a member of this Parish ever since he moved here. Part
of the Building Committee that demoed the old church and on the one that built the new
church. He stated the Diocese of Phoenix is sometimes very difficult to work with in rural
Arizona. After 20 years of finally convincing them that we need a Catholic school in
Lake Havasu, they allowed us to move forward. With the new buildings that you see,
there isn't anything that is intrusive into the neighborhood. The church sits higher than
any of the other locations along the street level. That particular area, we are not looking at
a major traffic flow. It is not like a Thunderbolt [Middle School] that houses 2300 kids.
We are a small private Catholic education center- with that, hope to hold maybe at a
maximum of 250 kids. Most typical Catholic families have two and three kids so when we
drop off, we don't drop off 250 individual cars- we drop off in multi-family units so the
flow is something we always consider in dropping off the kids. We have to now build
the school in security areas to keep the kids protected with fencing, etc. Also, right now
we are only at one classroom per grade so the gymnasium also acts as an area for
additional classrooms as we grow. Right now at 5th grade but will be able to take the new
school up to 8th grade. Not prudent time for construction; however the price has doubled
since it first started but need this to avoid modular buildings. There is a need for private
education in this community. Also the committee has made commitment to take the
two-story building down to one story due to pricing. There will not be a lot of noise
outside, as there are no outdoor playgrounds. The gym will be built in an area that allows
the kids to make noise in an indoor setting. The committee has submitted revised plans.

Suzanne Habeck, stated this is a difficult decision, does agree that Lake Havasu needs
more private education and supports the Catholic church and that they need a school and
gymnasium. Hesitancy is that the neighborhood area is a quiet wonderful neighborhood.
Do believe new construction and new rezoning would lower home value and change
neighborhood environment. Against new construction and rezoning.
Brian Morisella, Greentree resident, just purchased house last year which is on the corner
of the driveway [Church's driveway]. He stated the driveway is already at his roofline.
When vehicles are driving out, they could basically see in his back yard and the kids
jumping on trampoline. Feels resell value will definitely drop with a 30-foot building as he
will be having a huge block wall behind him as his view. Notices the traffic already
coming in to drop off the younger kids on the other side. Can't imagine how much traffic
will be doubled. Suggested finding a bigger lot for the bigger kids. Requests the
Commission not approve this item.
Chairman Harris closed the Public Hearing.
Mr. Morris stated that based on the findings, the Development Review Committee
recommends that the Commission forward a recommendation of approval to the City
Council for Land Use Action 21-3114, for a Planned Development Rezone amending the
approved development plan of PD-02-003 for 1975 Daytona Dr, Tract 2313, Block 1, Lot
1, in the Single-Family Residential/Planned Development (R-1/PD) District adding a
school building and a gymnasium, with the following conditions:
1. The development shall substantially match the Site Plan provided with the request,
2. The site is limited to those buildings shown on the Site Plan, unless additional public
hearings are held and public notice given,
3. The new buildings shall be setback at least 50 feet from the property lines,
4. Building height for any new structures shall not exceed 30 feet,
5. Windows providing views of the abutting residential properties shall not be located on
the northwest portion of the new buildings, and
6. Design Review for compliance with the Development Code and the conditions of this
approval shall be required for the project prior to building permit issuance.
This item will go to the City Council’s February 8, 2022 meeting.
Chairman Harris asked Father Chauncey is it not typical that most churches have
educational facilities, quite a few of them in town already have schools on their premises.
Father Chauncey affirmed and stated that as Mr. Marinelli stated, we are part of the
Catholic Diocese in Phoenix and there are many Parishes with Catholic elementary
schools. When asked if there is currently a school, Father Chauncey stated they took one
of the existing buildings that had classrooms and remodeled it to be used as a school

throughout the week. We currently serve up to 5th grade. Started with kindergarten and
have grown a grade per year.
Chairman Harris stated that facility and that location since day one of the development
was designated as a church site. The zoning was probably modified through the years to
accommodate that, but it has been the intent since 1974- since Chairman Harris has been
in town. Don't know of too many Catholic churches that do not have educational
facilities. Chairman Harris feels from what is shown, there is plenty of room. There have
been good points brought up. All of the noise will be contained within the multi-purpose
gym, they are not asking for playgrounds, and a lot of noise like a typical school would
have. They have the room and the parking and does not see a problem with this request.
Mr. Diaz stated he has friends/acquaintances that live in the surrounding neighborhood and
they stated the Church is a great neighbor and has not been a noise issue with them.
Concurs with Chairman Harris that Catholic churches have an educational aspect built into
them with the school- 1st through 8th grade.
Mr. Diaz made a motion to recommend to approve Item 21-3114 with Staff's
recommendations [for a
Planned Development Rezone amending the approved development plan of
PD-02-003 for 1975 Daytona
Drive, Tract 2313, Block 1, Lot 1, in the Single-Family Residential/Planned
Development District adding a school building and a gymnasium, with the following
conditions:
1. The development shall substantially match the Site Plan provided with the
request,
2. The site is limited to those buildings shown on the Site Plan, unless additional
public hearings are held and public notice given,
3. The new buildings shall be setback at least 50 feet from the property lines,
4. Building height for any new structures shall not exceed 30 feet,
5. Windows providing views of the abutting residential properties shall not be
located on the northwest portion of the new buildings, and
6. Design Review for compliance with the Development Code and the conditions of
this approval shall be required for the project prior to building permit issuance.]
The motion was seconded by Mr. Mitchell and carried by the following vote:
