1. CALL TO ORDER
Chairman Harris called the meeting to order at 9:00 a.m.
2. PLEDGE OF ALLEGIANCE
Chairman Harris led the Pledge of Allegiance.

5. MINUTES
Approval of Regular Meeting Minutes from February 15, 2023.
Mr. Diaz made a motion to approve the Minutes from the last meeting. The motion
was seconded by Ms. Wilson and carried by the following vote:

4. CORRESPONDENCE AND ANNOUNCEMENTS
Mr. Morris stated that recently the City Council directed Staff to schedule a Planning
Commission meeting to discuss multiple-family parking. Staff will be bringing some
information for discussion at the second meeting in April, per the direction of the City
Council.

ID 23-3697 Request for a Preliminary Subdivision Plat for Hudson Subdivision for
2972 Amigo Drive, Tract 2240, Block 1, Parcel A, Creating 3 Residential
Lots in the Single-Family Residential (R-1) District.

Mr. Morris thanked the Chairman and presented a PowerPoint slideshow and narrative
including some of the following key points:

• The subject property is located on the south side of Amigo Dr, between Aladdin Drive
and Amigo Way.
• There is also a second frontage on Simitan Dr.

• The properties to the north, east and west are zoned Residential Single-Family (R-1)
District and developed as residential uses and vacant lots.
• The properties to the south are zoned Residential Two-Family (R-2) District and
developed for residential uses.

• The subject property was once a city owned property and zoned Public Lands and
Facilities (P-1) District.
• Mr. Hudson purchased this property from the city in 2018 and rezoned the property to
Residential Single-Family (R-1) District in 2021.
• This subdivision process is required per Subdivision Code Title 13, because Parcel A
has already been created as part of Tract 2240 and is being split into more than two
lots.
• The proposed subdivision plat will allow the proposed three lots to be individually
owned.
Lee Johnson, APL Surveying, provided more background history. Mr. Johnson initially
brought this property to Staff with a parcel plat to create Parcels A-1, A-2, and Parcel A-3
was actually going to be combined with the adjoining Lot 1. Due to financing issues with
the bank that has the Note on Lot 1, they did not want it married, we had to go away from
a lot alteration and go through the subdivision process. Parcel A-3 will ultimately be owned
by the adjoining neighbor to protect his view. Parcel A-1 will be the owner's primary
residence and A-2 was going to be his garage & casita but, per City Code, double frontage
lots are not allowed- where they have access off both streets. The reason the applicant
wants to split this is so that he can have access off of both streets for his house on the
main road and then his garage off of Amigo Drive. That is the main crux of why we are
here today with a subdivision process and not a parcel plat process.
Chairman Harris asked if this was kicked back because Parcels A-1 and A-2 were going to
be a single parcel? Mr. Johnson affirmed and said A-1 was going to have his main
residence facing Simitan Drive and then ultimately he had an idea of a garage facing
Amigo with guest quarters down there. Chairman Harris stated he understands why there
might have been a concern as, typically in the past, anytime a property borders two streets
it has the potential of creating an alley way or a thoroughfare through that property
between the two streets. Mr. Johnson said that typically under those circumstances, Staff

will have you put in a 1-foot, non-vehicular access on one of the roads where you cannot
use it as a drive. Chairman Harris stated there have been parcels in the past the have
been allowed this to happen, primarily because of topography. In this particular case,
topography would be a mitigating issue prohibiting that alley way or dual access situation.
Mr. Morris elaborated and stated that in some cases there have been a request to ask for
an exemption from the subdivision code. The subdivision code is not under the purview
of the Planning Commission. In instances like that, they would go to City Council. He
mentioned an instance he is aware of where there were a couple of lots that were
individually created but when someone wanted to combine them, it would create a double
frontage lot. Cases like that, where they are unusual situations, could go to the City
Council for an exemption to the Subdivision Code. There is a mechanism in place but that
does not involve the Planning Commission. In this case, the applicant is not asking for
that. Mr. Johnson stated the other thing this does is relieves the owner from the limited
guest quarter restrictions.
Mr. Diaz asked Mr. Morris if he could provide an update, for the record, as to why this
property came before the Commission last month. Mr. Morris stated in past, this property
came before the Commission for a rezone. The Commission is a recommending body to
the City Council. City Council approved a straight up rezone from P-1 to R-1, no
conditions or planned development. The property is currently zoned for an R-1,
Single-Family Residential entitled to all development rights to R-1. Mr. Johnson stated
that was done a couple of years ago in 2021.
Mr. Lehr asked if there are any exceptions to the City Code, dimensionally to the frontage
or anything? Mr. Johnson said no, all standards of development code are being
exceeded/met.
Chairman Harris opened the Public Hearing, hearing none, he closed the Public Hearing.
Mr. Morris stated that based on the he Development Review Committee recommends
approval of Land Use Action 23-3697, a Preliminary Subdivision Plat for Hudson
Subdivision for 2972 Amigo Drive, Tract 2240, Block 1, Parcel A, creating 3 residential
lots in the Single-Family Residential (R-1) District.
Ms. Dzuro made a motion to approve Land Use Action 23-3697, a Preliminary
Subdivision Plat for Hudson Subdivision for 2972 Amigo Drive, Tract 2240, Block 1,
Parcel A, creating 3 residential lots in the Single-Family Residential District. The
motion was seconded by Mr. Lehr and carried by the following vote:
