CALL TO ORDER Chairman Diaz called the meeting to order at 9:00 a.m. 2. PLEDGE OF ALLEGIANCE Chairman Diaz led the Pledge of Allegiance. 3. CORRESPONDENCE AND ANNOUNCEMENTS Planning Division Manager Chris Gilbert provide an update on recent City Council actions: • Approval of the Villas Estates PD/Rezone request for reduced lot sizes. • Approval of the Development Code Text Amendments related to metal siding and storage units in the Mixed Use-General (MU-G) District. 5. MINUTES ID 24-4266 Approval of the Minutes of the May 1, 2024, Planning & Zoning Commission Regular Meeting (Shelby Hennigan) Commissioner Ballard moved to approve the Minutes of the May 1, 2024, Planning & Zoning Commission Regular Meeting, seconded by Commissioner Dzuro. The motion passed with the following vote: Aye: 7 - Ballard, Dzuro, Lehr, Wilson, Harris, Medley and Diaz 6. PUBLIC HEARING Chairman Diaz gave a brief overview of the Public Hearing process. ID 24-4262 A Request for a Minor General Plan Amendment Revising the Future Land Lake Havasu City Page 1 Printed on 6/5/2024 Planning and Zoning Commission Minutes - Final May 15, 2024 Use Map Designations for 2778 and 2786 McCulloch Boulevard N., Tract 121, Block 10, Lots 2 and 3, 0.57 Acres, from Low Density Residential to High Density Residential (Chris Gilbert) Mr. Gilbert explained this is the first of two hearings related to the subject properties. A request for a Planned Development/Rezone will follow. He presented the Staff Report [displayed PowerPoint], highlighting the following: • The subject properties have been in the Low Density Residential (LDR) land use category since the adoption of the 2016 General Plan. • The properties' zoning of Limited Multiple-Family (R-3) District predates the 2016 General Plan adoption. • The zoning of the properties to the north, east, and west is also R-3, despite those areas also being categorized as LDR in the 2016 General Plan. Mr. Gilbert explained the land use plan should be consistent with the zoning and approval of this request will achieve that. He noted there are areas throughout the City with land use plans inconsistent with zoning. This will be corrected when the City adopts the 2026 General Plan update. For now, when applicants come in with rezoning requests, such as the Planned Development request that will be presented next, it is important to address the land use inconsistency at the same time. With no questions from the Commission, Chairman Diaz invited the applicant to the podium. Frank Ortiz, applicant, explained this project has been in the works for several years. The project was planned as an 11-unit complex, but due to changes in the City's parking requirements, it was reduced to 9-units to accommodate the new parking standards. He is happy to answer any questions. Chairman Diaz opened the Public Hearing. Seeing no comments, he closed the Public Hearing. Mr. Gilbert stated that based on the findings, the Development Review Committee recommends the Planning Commission forward a recommendation of approval to the City Council for Land Use Action No. 24-4262, a Minor General Plan Amendment revising the Future Land Use Map Designations for 2778 and 2786 McCulloch Boulevard N., Tract 121, Block 10, Lots 2 and 3, from Low Density Residential to High Density Residential. Commissioner Harris moved to approve recommendation of ID 24-4262. The motion was seconded by Vice Chair Medley and passed with the following vote: Aye: 7 - Ballard, Dzuro, Lehr, Wilson, Harris, Medley and Diaz Lake Havasu City Page 2 Printed on 6/5/2024 Planning and Zoning Commission Minutes - Final May 15, 2024 ID 24-4261 A Request to Approve a General Development Plan and Planned Development Rezone for 2778 and 2786 McCulloch Boulevard N., Tract 121, Block 10, Lots 2 and 3, 0.57 Acres, from Limited Multiple-Family (R-3) District to Limited Multiple-Family/Planned Development (R-3/PD) District, To Allow Nine Dwelling Units Across the Two Lots (Chris Gilbert) Mr. Gilbert reviewed the Staff Report, highlighting the following [displayed PowerPoint]: • The properties are zoned Limited Multiple-Family (R-3) District. • R-3 Zoning and development surrounds the property on three sides, with Residential Single-Family (R-1) District to the south. • The applicant is requesting to allow 9-units to be built on the two parcels, which requires a Planned Development overlay for density. They are not requesting any other exceptions to the R-3 District standards. • The Conceptual Plan shows adequate parking. There were no questions for the applicant from the Commission. Chairman Diaz opened the Public Hearing. Seeing no comments, he closed the Public Hearing. Mr. Gilbert stated that based on the findings, the Development Review Committee recommends the Planning Commission forward a recommendation of approval to the City Council for Land Use Action No. 24-4261, of a General Development Plan and a Planned Development Rezone for 2778 and 2786 McCulloch Boulevard N., Tract 121, Block 10, Lots 2 and 3, from R-3 to R-3/PD, to allow nine dwelling units combined across the two lots, with the following conditions: 1. The Minor General Plan Amendment recommended for approval by the Planning Commission as Land Use Action 24-4262 is approved by the City Council; 2. The development of the property shall substantially match the General Development Plan provided with the request, 3. Combine Lots 2 and 3 into one parcel through the City process for lot combinations prior to applying for a building permit, and 4. Building Permits and Design Review for compliance with City Codes are required prior to development of the property. Chiarman Diaz asked the applicant if he understands the conditions. Mr. Ortiz responded affirmatively. Commissioner Ballard moved to recommend approval of Land Use Action No. 24-4261, of a General Development Plan and Planned Development Rezone for 2778 and 2786 McCulloch Boulevard N., Tract 121, Block 10, Lots 2 and 3, subject to the following conditions: Lake Havasu City Page 3 Printed on 6/5/2024 Planning and Zoning Commission Minutes - Final May 15, 2024 1. Combine Lots 2 and 3 into one parcel through the City process for lot combinations prior to applying for a building permit, and 4. Building Permits and Design Review for compliance with City Codes are required prior to development of the property. The motion was seconded by Commissioner Harris and passed with the following vote: Aye: 7 - Ballard, Dzuro, Lehr, Wilson, Harris, Medley and Diaz ID 24-4263 Request for a Rezone of 2305 Victoria Farms Road, APN 120-03-017, a 10-Acre Metes & Bounds Parcel, from Light Industrial (LI) District to Industrial (I) District (Chris Gilbert) Mr. Gilbert reviewed the Staff Report [displayed PowerPoint] noting the following: • The property is approximately 10-acres and located off Victoria Farms Road. It is accessible through an access easement with the adjacent property. • The property is currently zoned Light Industrial (LI) District and is surrounded by properties zoned LI and Industrial (I) District. The adjacent property with the access easement was recently rezoned I District. • The requested change will be consistent with the zoning of the surrounding area. Mr. Gilbert explained the property was rezoned to LI District in 2020 at the request of the applicant, but the intent of the use was not fully understood by Staff at the time. The LI District is not sufficient for the intended use of a recycling business, which falls under the classification of heavy industry. I Zoning is more appropriate for this use, so the applicant is going through the rezoning process at the request of the City. The applicant is attending today's meeting virtually. Gretchen Wilde, applicant, attended virtually via Microsoft Teams. There were no questions for the applicant from the Commission. Chairman Diaz opened the Public Hearing. Seeing no comments, he closed the Public Hearing. Mr. Gilbert stated that based on the findings, the Development Review Committee recommends the Planning Commission forward a recommendation of approval to the City Council for Land Use Action No. 24-4263, a rezone of 2305 Victoria Farms Road, APN Lake Havasu City Page 4 Printed on 6/5/2024 Planning and Zoning Commission Minutes - Final May 15, 2024 120-03-017, a 10-Acre Metes & Bounds Parcel, from LI to I. Chairman Diaz asked the applicant if she had any questions. She did not. Commissioner Harris moved to approve recommendation of ID 24-4263. The motion was seconded by Commissioner Lehr and passed with the following vote: Aye: 7 - Ballard, Dzuro, Lehr, Wilson, Harris, Medley and Diaz 7. FUTURE MEETING The next scheduled meeting of the Planning & Zoning Commission is June 5, 2024. 9.
