CALL TO ORDER Chair Harris called the meeting to order at 9:01a.m. 2. PLEDGE OF ALLEGIANCE Chair Harris led the Pledge of Allegiance. 3. ROLL CALL Present: 9- Suzannah Ballard, Joan Dzuro, Paul Lehr, Tiffany Wilson, Lonnie Stevenson, Jim Harris, Gabriele Medley, David Diaz and Mary Costa Absent: 1- JP Thornton 4. CORRESPONDENCE AND ANNOUNCEMENTS Planning Division Manager Chris Gilbert gave an update on recent City Council actions, noting the Development Code text amendments presented on July 17, 2024, were adopted on August 13, 2024, and will go into effect 30 days after adoption. 5. MINUTES ID 24-4430 Approval of the Minutes of the August 7, 2024, Planning & Zoning Commission Regular Meeting (Shelby Hennigan) Commissioner Diaz moved to approve the Minutes of the August 7, 2024, Planning & Zoning Commission Regular Meeting, seconded by Vice Chair Wilson. The motion passed with the following vote: Aye: 7 - Ballard, Dzuro, Lehr, Wilson, Harris, Medley and Diaz 6. PUBLIC HEARING Chair Harris provided an overview of the Public Hearing process. ID 24-4423 A Request for a Minor General Plan Amendment Revising the Future Land Use Map Designation for a Portion of 2540 Plaza Hermosa, Tract 2315B, Lake Havasu City Page 1 Printed on 10/2/2024 Planning and Zoning Commission Minutes - Final August 21, 2024 Block 1, Lot 3A, Approximately 1,054 Square Feet, from Open Space and Park (OSP) to Low Density Residential (LDR) (Trevor Kearns) City Planner Trevor Kearns reviewed his Staff Report [displayed PowerPoint] highlighting the following: • The subject property abuts the Lake Havasu Golf Course and is located between Saratoga Ave and Bahia Hermosa. • The property owner purchased a small portion of property from the Golf Course and combined it with their residential property, resulting in the property having both Open Space and Park (OSP) and Low Density Residential (LDR) Land Uses. • This request will change the Future Land Use Designation of the golf course portion of the property from OSP to LDR, so it will match the balance of the residential lot and permit residential uses that would not otherwise be allowed. • This is the first part of a two-part request. Immediately following this hearing, Staff will present a rezone request related to this same property. • Staff received no objections from any reviewing agencies. • This request will be presented to City Council on September 24, 2024. Stuart Schmeling, applicant, is present on behalf of the property owners. The Staff Report adequately explains the request and he is happy to answer any questions. There were no questions from the Commission. Chair Harris opened the Public Hearing. Seeing no comments, he closed the Public Hearing. Chair Harris asked if there were any conditions for this item. Mr. Kearns stated there were not. Seeing no further discussion, Chair Harris asked if there was a motion. Commissioner Ballard moved to recommend approval of Land Use Action No. 24-4423, a Minor General Plan Amendment revising the Future Land Use Map Designations for a portion of 2540 Plaza Hermosa, Tract 2315B, Block 1, Lot 3A, from Open Space and Park to Low Density Residential. The motion was seconded by Commissioner Dzuro and passed with the following vote: Aye: 7 - Ballard, Dzuro, Lehr, Wilson, Harris, Medley and Diaz ID 24-4425 A Request to Rezone a Portion of 2540 Plaza Hermosa, Tract 2315B, Block 1, Lot 3A, Approximately 1,054 Square Feet, from Golf Course (GC) to Residential Estates (R-E) District for the Portion that was Purchased from the Golf Course (Trevor Kearns) Lake Havasu City Page 2 Printed on 10/2/2024 Planning and Zoning Commission Minutes - Final August 21, 2024 Mr. Kearns reviewed his Staff Report [displayed PowerPoint], noting it is the companion request for the previously discussed item. He explained that due to the purchase of land from the Golf Course, the property currently has two zoning districts, Residential Estates (R-E) and Golf Course (GC). This request is to rezone the golf course portion of the property from GC to R-E,so it will match the balance of the residential lot. This will permit the property owner to use the added land for residential uses and accessory structures not be permitted in the GC District and to apply R-E setbacks. The request complies with all required findings of the Development Code and will be presented to City Council Tuesday, September 24, 2024. Commissioner Diaz stated rezoning land purchased from the Golf Course has happened before and will allow the property owner the ability to fully utilize the land they purchased. There were no questions from the Commission for the applicant. Chair Harris opened the Public Hearing. Seeing no comments, he closed the Public Hearing. Chair Harris asked if there were any conditions for approval. Mr. Kearns confirmed there were not. With no further discussion, Chair Harris called for a motion. Commissioner Ballard moved to recommend approval of Land Use Action No. 24-4425, rezoning a portion of 2540 Plaza Hermosa,Tract 2315B, Block 1, Lot 3A, from Golf Course District to Residential Estates District. The motion was seconded by Commissioner Dzuro and passed with the following vote: Aye: 7 - Ballard, Dzuro, Lehr, Wilson, Harris, Medley and Diaz 7. CALL TO PUBLIC Chair Harris provided a brief overview of Call to Public and opened Call to Public. Seeing no comments, he closed Call to Public. 8. FUTURE MEETING The regular meeting of the Planning & Zoning Commission scheduled for Wednesday, September 4, 2024, has been cancelled. The next regular meeting is scheduled for Wednesday, September 18, 2024. There are no items for the agenda at this time. If the meeting is cancelled, a cancellation notice will be posted. 9.
