6.II. Law Enforcement Vehicle Purchase And Vehicle Disposition

SYNOPSIS: Staff is requesting Commission approval to lease purchase seven (7) police vehicles using
the Bancorp Master Lease Agreement and dispose of ten (10) surplus vehicles.
RECOMMENDATION It is recommended that the City Commission take the following action(s):
1. Approve the sixty (60) month lease-purchase of five (5) fully equipped 2025 Chevrolet police patrol
vehicles and two (2) police K9 vehicles from Alan Jay Fleet Sales based upon the City of Tallahassee
contract 5179-2025 pricing.
2. Authorize the City Manager to execute the necessary documents on behalf of the city.
3. Classify the ten (10) below listed vehicles as surplus.
4. Authorize staff to dispose of the surplus vehicles.
5. Authorize the donation of one the surplus vehicles to the Lake Hamilton Police Department.
BACKGROUND Within the FY 2024/25 annual budget, the City Commission approved $520,000.00 for
purchase of police vehicles. The FY 2024/25 annual budget indicated the vehicles would be leased
versus purchased with commission approval. Staff recommends the lease-purchase of the following
vehicles:
• Seven (7) fully equipped 2025 Chevrolet Tahoe police vehicles. The capital cost of these vehicles, if
purchased outright, would be $538,036.85. Under the lease-purchase agreement, the monthly lease
payment would be $10,414 for sixty (60) months, with a total cost of $624,840. These vehicles will
replace police vehicles being removed from service through reassignment, sale or other means of
disposal.
• The vehicles outlined below no longer serve any useful purpose to the city and staff recommends
approval to dispose of them.

1) Purchase the police vehicles outright at a cost of $538,036.85.
FISCAL IMPACT The FY24/25 lease obligation of $62,484.00 (6 months) provided by Bancorp is based
upon a lease purchase option for public safety vehicles.
If the City Commission approves the vehicle lease agreement, the city is committed to a yearly lease
payment of $124,968.00 for the sixty (60) month lease. If revenues are insufficient in future years, the
city has the option to return the vehicles under the non-appropriation of funds clause. If it becomes
necessary to exercise this option the police department would suffer the loss of the vehicles.

Frank Lumm, resident, asked what disposal and donation means. How are vehicles disposed of?
James Slaton, City Manager, reviewed what disposal means and that the Commission must authorize
this.
Mr. Lumm asked about the what equipment goes into K9 vehicles and cost.
LT. Figueroa, Lake Wales Police Department, reviewed this item and what goes in the K9 vehicles.
Commissioner Gillespie asked if electric vehicles were considered. Lt. Figueroa said they looked into it
and some agencies are trying them, but there is not infrastructure yet such as enough charging
stations. This was discussed.
Commissioner Thompson made a motion to approve this item. Commissioner Williams seconded the
motion.

SYNOPSIS: The City Commission will consider authorizing a contract agreement with CW Roberts,
Inc. for the T-Hangar Taxilane Reconstruction and Taxilane Bravo Rehabilitation project at the Lake
Wales Municipal Airport.
RECOMMENDATION It is recommended that the City Commission take the following action(s):
1. Authorize a contract agreement with CW Roberts, Inc. for the T-Hangar Taxilane Reconstruction and
Taxilane Bravo Rehabilitation project. The contract amount is $871,651.00, which will be fully funded by
the FDOT and FAA.
BACKGROUND The Florida Department of Transportation (FDOT) will cover 10% of the cost of this
project. The Federal Aviation Administration (FAA) with cover the remaining 90% of this project. This
project will reconstruct the taxilane that connects our t-hangars to the taxiway. It will also rehabilitate
taxilane bravo that connects our FBO ramp to the taxiway.
OTHER OPTIONS The City Commission may decline the contract agreement with CW Roberts, Inc.
FISCAL IMPACT This project is fully funded by the Florida Department of Transportation (FDOT) and
the Federal Aviation Administration (FAA).

5K Run. Temporary Street Closings And Alcohol Use.

SYNOPSIS: Approval of the Special Event Permit Application for the Lake Wales Mardi Gras
Celebration, Parade, Fireworks and 5K Run on Friday and Saturday, February 28- March 1, 2025.
RECOMMENDATION It is recommended that the City Commission take the following action:
• Approve the Special Event Permit application for the 2025 Lake Wales Mardi Gras Celebration to take
place on Friday evening, February 28, 2025 from 5:00 p.m. until 11:00 p.m. and on Saturday, March 1,
2025 from 11:00 a.m. until 11:00 p.m. in Lake Wailes Park with set-up beginning 8:00 a.m. on Thursday
February 27, 2025.
• Approve the serving of alcohol in Lake Wailes Park during the Mardi Gras Event.
• Approve the Mardi Gras 5K Run to be held on Friday evening, February 28, 2025 from 6:00 p.m. to
8:00 p.m. which will only be on Lake Wailes Trail.
• Approve the temporary street closings on Saturday, March 1, 2025 between the hours of 2:00 p.m.
and 5:00 p.m. for the Mardi Gras parade. Lineup will be on Third Street from Sessoms to Stuart Ave.
and will include a portion of Crystal Ave. between Scenic and Third. Parade will start on Stuart Avenue
and go to First Street, First Street to Central Avenue, Central Avenue east to Lake Shore Blvd. then to
Lake Wailes Park where parade will end.
• Approve the temporary closing of North First Street at 11:30 a.m. on Saturday March 1 for parade line-
up.

Event Permit Application for the 2025 Lake Wales Mardi Gras Celebration, Parade and 5K Run to be
Lake Wailes Park where parade will end.
• Approve the temporary closing of North First Street at 11:30 a.m. on Saturday March 1 for parade line-
up.
BACKGROUND Joshua Curchy, President of the Lake Wales Mardi Gras, has submitted a Special
Event Permit Application for the 2025 Lake Wales Mardi Gras Celebration, Parade and 5K Run to be
held Friday, February 28, 2025 and Saturday, March 1, 2025 in Lake Wailes Park. This application
includes a request to hold a 5K Run on Friday night from 6:00 p.m. to 8:00 p.m. and for the temporary
closing of several streets in the downtown area for the parade.
The events of Mardi Gras such as the food, vendors, children’s activities and alcohol will take place in
Lake Wailes Park this year. The parade will go through downtown streets.
Activities for the 2025 Lake Wales Mardi Gras are proposed as follows:
1. Friday evening, February 28, 2025, 5:00 p.m. to 11:00 p.m. - food and craft vendors, alcohol and
musical entertainment will be in Lake Wailes Park. Set up would begin on Thursday, February 28, 2025
at 8:00 a.m.
2. Friday evening, February 28, 2025, 6:00 p.m. to 8:00 p.m. – 5K Run beginning at the Basketball
Court in Lake Wailes Park. The route goes along Lake Wailes Trail 3. Saturday, March 1, 2025 - the
activities will continue in Lake Wailes Park beginning at 11:00 a.m. with craft and food vendors. Kids’
activities, musical entertainment and alcohol sales will take place in Lake Wailes Park. These activities
will conclude at 11:00 p.m.
4. Fireworks will be Saturday March 1, 2025 at 8:30 p.m.
5. Saturday, March 1, 2025 - the Mardi Gras Parade will begin at 3:00 p.m. which will line up and start
on First Street, North on Orange Avenue and make its way through the downtown area concluding at
Lake Wailes Park at approximately 5:00 p.m.
The parade route involves the following streets:
Lineup will be on Third Street from Sessoms to Stuart Ave. and will include a portion of Crystal Ave.
between Scenic and Third. Parade starts on Stuart Avenue, Stuart Avenue to First Street, First Street
to Central Avenue, Central Avenue east to Lake Shore Blvd. then to Lake Wailes Park where parade will
end.
The Police Department and the Streets Department will coordinate control of vehicular and pedestrian
traffic for the parade. The Streets Department will handle all street closings. Trash barrels with bags will
be placed along the parade route and in the areas of the pre-parade and after parade activities in Lake
Wailes Park. Sanitary facilities, dumpsters, site set up, tent permits, certificates of liability insurance,
FDOT road closing permits and the alcohol beverage permit from the Department of Alcohol Beverage &
Tobacco will be the responsibility of the Lake Wales Mardi Gras Executive Committee. Off duty officers
will be scheduled for the street crossings for the 5K Run and these costs will be paid by the Lake
Wales Mardi Gras.
The 2025 event will end at 11:00 p.m. on both nights.
OTHER OPTIONS Do not approve the two-day event, 5K Run, Fireworks or street closings.
FISCAL IMPACT In-Kind services from the City were budgeted in the FY2024/2025 budget in the
amount of $8,722. The Lake Wales Mardi Gras Committee is responsible for 25% or $2180. Any off-
duty officers requested will be paid at 100% by the sponsor.

SYNOPSIS: Corby Myers., authorized agent for owner, requests approval of City Commission to annex
29+/- acres of land into the city limits, and to amend the Future Land Use Map and Zoning Map on
parcels of land totaling approximately 76+/- acres.
RECOMMENDATION Staff recommends of approval of City Commission, to annex 29+/- acres of land,
and to assign the following land use and zoning designations, finding that the properties are located
within our utility service area, and finding that the recommended Future Land Use and Zoning Map
designations are compatible with the surrounding area, and are consistent with the City Comprehensive
Plan and Land Use Regulations:

proposed future land use and zoning map designations on August 27, 2024. These ordinances were
approved by City Commission at 1st reading on September 17, 2024.
BACKGROUND The subject properties are located south of Hunt Brothers Road, west of Scenic
Highway South, and east of US Highway 27. The 29 acres still located in Polk County are requested to
be annexed. The 47 acres already incorporated into the city limits were assigned a Business Park
designation in 2023 per the applicant’s request; however, after coordinating closely with the Lake Wales
Economic Development Council, it was determined that an Industrial zoning designation may be more
attractive to potential manufacturing businesses and large employers. No development plans for the
properties have been submitted at this time.
Comprehensive Plan: IND Industrial Policy I.1.2.9 The primary function of the Industrial (IND)
classification is to accommodate the facilities necessary for the processing, fabrication, manufacturing,
recycling, or wholesale distribution of goods. Typical uses/intensity: Manufacturing and processing
plants, truck terminals, bulk products storage or sales facilities, heavy machinery sales or repair.
Maximum FAR = .75. Location and development criteria:
• Access to primary shipping routes, (highway and/or rail). Access to site by arterial or major collector
only.
• Spatially separated and buffered from residential areas.
• Must be located outside of Wellhead Protection Areas and buffered from Conservation areas, wetlands

The primary function of the Business Park Center (BPC) classification is to promote employment
opportunities within the region by allowing for the establishment of office parks, research and
development parks, light-industrial facilities, distribution centers, and mixed-use employment parks. The
BPC classification is intended for well planned, extensively landscaped business park development
rather than piecemeal development of individual lots. Typical uses/intensity: light manufacturing and
assembly plants, warehouses, office centers. Maximum FAR = .75. Location and development criteria:
Access to primary shipping routes (highways and/or rail). Access to site by arterial or major collector
only. Spatially separated and buffered from residential areas. Support commercial to serve employees
of a business park shall not exceed 25% of any single contiguous BPC district. Where City water and
sanitary sewer are available. Minimum BPC area shall be 10 acres. A master plan shall be required
prior to the subdivision of any land for business park development. The plan shall show an overall lot and
road layout, landscaped buffers to adjacent lands, extensive landscaping within the park, and design
guidelines for site development.
Zoning: BP Business Park Sec. 23-401 District Classifications BP Business park. This district is
intended for discrete areas established and designed for a mixture of professional, light industrial,
wholesale, and professional uses, including hotels and motels and car dealerships, and excluding retail,
drive-up restaurants, service and other commercial uses catering directly to consumers except those
accessory to a principal use.
Section 23-802 Definitions Manufacturing. A facility engaged in processing or fabricating and finishing
non-hazardous products or components from raw materials or prepared parts. Non-hazardous materials
contain no items or agents which have the ability to cause harm to humans, animals, or the
environment. Manufacturing may include the assembly of products from components and the packaging
of products. Manufacturing does not include processing of food or drinks. See also food processing
under food businesses. Heavy. A facility engaged in processing or fabricating and finishing of non-
hazardous products or components from raw materials or prepared parts that may or may not be
packaged.

CODE REFERENCES AND REVIEW CRITERIA The City Commission assigns future Land Use and
Zoning designations by ordinances upon a recommendation from the Planning & Zoning Board. The
adopted land use amendment ordinance is transmitted to the state’s Department of Economic
Opportunity (DEO) for review. The DEO reviews the land use designations as appropriate with reference
to the City’s Comprehensive Plan.
The total acreage will be transmitted to DEO as a large-scale Future Land Use Map Amendment (50+
acres of land).
FISCAL IMPACT Assignment would enable the future development of these properties and the potential
increase in property value

Comprehensive Plan Future Land Use Element: LCI Limited Commercial Industrial The
primary function of the Limited Commercial-Industrial classification is to allow low traffic
generating commercial and industrial uses fronting on major roadways that will not result in
commercial strip development. Location criteria: This classification will be used along major
roadways outside of Commercial Activity Centers (CACs) and Regional Activity Centers (RACs).
Typical uses/intensity: auto dealerships, storage facilities, light manufacturing and assembly
plants. Types of uses not appropriate to LCI areas are high traffic generating uses such as
retail stores, gasoline stations, banks, and restaurants. Up to 200,000 GLA. Maximum
FAR .60. Development criteria: Cross access easements shall be required.

Staff Findings:
1. The site is located within the City’s utility service area and will maximize existing
infrastructure investments by connecting to municipal water and sewer.
2. The proposed map amendments are compatible with the Comprehensive Plan and Land
Development Regulations.
3. The area is infill in nature and may potentially serve the new residential units underway to
the east.
4. Approval of the Major Site Plan by Planning and Zoning Board shall be contingent upon

Albert Galloway, Jr., City Attorney, reported that the purchase of the property for the fire station has been
completed.
10. CITY MANAGER
James Slaton, City Manager, said the street repaving is continuing and will be done Friday. Tillman Ave is
included. Commissioner Thompson said they are on Johnson now. Mr. Slaton said 23 streets will be
completed since December.
Mr. Slaton reported that the Government Finance Officers Association reported that we won their budget
and audit awards.
Mr. Slaton said there is a Panara Bread opening on the 15th. That was built fast.

Mr. Slaton said he is working with the Mardi Gras Committee to include the reopened Park Avenue as part
of the parade route to show off the new downtown. So that may come back to Commission.
Commissioner Gillespie asked about the linear park and sculpture garden. Mr. Slaton said its coming along
and looking beautiful.
Commissioner Gillespie asked about the Scenic Hwy Anniversary celebration in February. Is the City
involved in this? Mr. Slaton said yes and that Jennifer Nanek, City Clerk, is the City representative to this.

11. CITY COMMISSION COMMENTS
Commissioner Gillespie said she is looking forward to the Mardi Gras celebration and is glad the City is
participating.
Commissioner Thompson said he agreed with the possible route change to help our downtown and the
businesses downtown. He said the linear park is looking beautiful. Our staff is doing a great job.
Commissioner Thompson said that issuing proclamations is part of the Mayor's job. The Commission
doesn't have the authority to change this as it is in the charter.
Deputy Mayor Gibson said there has been some bad conduct during comments and petitions. He said he
is glad that the comments earlier were courteous but cautioned that there should not engage in back and
forth discussions between citizens, commission and staff. Citizens should address questions to staff
outside of the Commission meeting. We don't need to have discussions deteriorate into arguments during a
meeting.

Mayor Hilligoss said he is looking forward to 2025. Keep up the good work.
