APPROVED VILLAGE OF LAKE ZURICH COMMITTEE OF THE WHOLE JANUARY 8, 2007 The meeting was called to order at 8:25 p.m. ROLL CALL: Present –Mayor Tolomei, Trustees Bondi, Callahan, Coleman, Gyarmaty, McAvoy, and Taylor. Also present – Administrator Dixon, Village Attorney Burkland, Finance Director Martynowicz, Public Works Director/Engineer Heyden, Police Chief Urry, Fire Chief Mastandrea, and Park and Recreation Director Perkins. APPROVAL OF NOVEMBER 27, 2006 MINUTES: MOTION made by Trustee Gyarmaty, seconded by Trustee McAvoy, to approve the minutes of the November 27, 2006 Committee of the Whole as submitted. Voice vote, all in favor. MOTION CARRIED. NEWSLINE – FEBRUARY EDITION MOTION was made by Trustee Taylor, seconded by Trustee Bondi, to recommend the Board of Trustees approve the February edition of Newsline. AYES: 6 Trustees Bondi, Callahan, Coleman, Gyarmaty, McAvoy, and Taylor NAYS: 0 MOTION CARRIED 21180 RAND ROAD – DEER PARK REQUEST FOR WATER AND SEWER SERVICES In his memorandum dated January 3, 2007, Assistant Village Engineer Lebbos reviewed the request from Mike Taylor, Koenig & Strey Gmac, representing Alfred Christensen, 21180 N. Rand Road, Deer Park, requesting the Village of Lake Zurich to serve water and sewer to the subject property to allow the development of the property without relying on well and septic systems. Assistant Village Engineer Lebbos said the plat indicates a 20-foot easement for sewer and water. The property could be served by extending the water and sewer from East Harbor through the existing easement. Administrator Dixon provided further information. He said annexation had not been considered because the location of the property is outside of the scope of the Village, would be an isolated pocket, and it would be difficult for the police to access the property. Mr. Taylor said he has had several inquiries about the property and needed to address the water and sewer issue so he would know how to proceed. One proposal was to build townhomes. He was also approached about building an assisted living complex. When asked what the benefit to Lake Zurich would be, he said residential development would be more appealing to the nearby Village residents than commercial development. Committee of the Whole Minutes, January 8, 2007 2 Trustee McAvoy said annexation of the property would solve several problems that were discussed and recommended exploring it further. Administrator Dixon said staff could contact the Village of Deer Park to see of they would consider de-annexation. Discussion followed. Some Trustees said more townhomes in the area were not needed and were concerned new developments would compete with the projects already approved in Lake Zurich. Staff was asked about the water and sewer capacity and if the Village had adequate capacity to some give away. Public Works Director/Engineer Heyden said there was adequate water, and this development would be a small user. He was not able to say definitively if there was adequate sewer capacity at this time and was would continue to monitor capacity. Mr. Taylor addressed the location of the utility easement and said he would prefer to bring the lines through the residential area. Regarding egress and ingress, he could approach the bowling alley and ask them about using their entrance and building a frontage road for access. He said Deer Park would be willing to enter into an intergovernmental agreement so the project could have water and sewer service. Police Chief Urry was asked if it would be difficult for the police to service this location. Police Chief Urry responded that if it was a multi-family development, there could be more frequent visits. It would be more difficult to access the property, but there are also other locations that are not easily accessed. He was more concerned about problems with the line of sight on Route 12 because it would be going down hill. Mayor Tolomei polled the Trustees and asked if they would be willing to sell water and sewer outside of the Village limits and if townhomes were an acceptable use. Trustee Bondi said he would only consider selling water and sewer if it was an outstanding high- quality low-density townhome development and would still be reluctant. Trustee Taylor said there were still too many questions unanswered and more details must be provided. Trustee McAvoy said he would approve the sale of water but is concerned about the sewer capacity. Trustee Gyarmaty said she was not in favor of approving the request with the information provided and would need more control over the townhome development before she could feel comfortable. Trustee Callahan said in theory he could approve the sale of water but not the sewer due to questions about the capacity. He does not support the townhome proposal but would consider it if it was lower in density. As presented, he would not vote for the sale of water and sewer. Trustee Coleman said she needed more details and still had questions. If there was adequate water capacity, she could be in favor of selling water, but she would like more control over the townhome development and would want to see low-density high-end townhomes. The Trustees were polled on the annexation of the property. Trustee Bondi said he would consider annexation depending upon the project. Trustee Taylor said annexation makes the selling of water and sewer service more appealing but some problems would need to be Committee of the Whole Minutes, January 8, 2007 3 addressed. Trustee McAvoy did not have any real issues against annexation. Trustee Gyarmaty did not support annexation because there was nothing to be gained. Trustee Callahan was more apt to approve the water and sewer service if it was annexed because the Village would have more control. Trustee Coleman agreed with Trustee Callahan. Mayor Tolomei said the issue of providing water and sewer was problematic because there was some concern about the available population equivalents for sewer and it would be an uphill battle for the developer due to many uncertainties. Annexation would make him view the water and sewer service more favorably. He said it is unlikely that water and sewer service will be provided if it was outside the Village. ADJOURNMENT: MOTION made by Trustee McAvoy, seconded by Trustee Callahan, to adjourn the meeting. Voice vote, AYES have it. MOTION CARRIED.
