TO: Lakewood City Council & Clover Park School Board FROM: David Bugher, Assistant City Manager/Community Development Director THROUGH: John Caulfield, City Manager DATE: January 28, 2019 SUBJECT: Comprehensive Plan Amendment Process PURPOSE: The purpose of this memorandum is to outline the steps by which the City of Lakewood amends its comprehensive plan and related land use and development code. LIMITATIONS: Under state law, all proposed amendments to the comprehensive plan must be considered by the governing body concurrently and may not be considered more frequently than once every year, so that the cumulative effect of various proposals can be ascertained. PROCESS & ESTABLISHING THE DOCKET: In the July/August timeframe the community and economic development department advertises an opening for property owners and the general public to submit requests to amend the city’s land use policies and regulations for the upcoming year. The advertisement is in the form of a notice in the newspaper of record and on the city’s website. For a period of 60-days, formal and informal applications are accepted. These requests along with any city staff proposals are forwarded to the planning commission for their review and recommendation to the city council. The commission begins their review in late September with a recommendation to the city council in late October. The council reviews the applications along with the commission’s recommendations. The council can approve the applications, deny them from consideration, or in some cases, if they are city-initiated, amend the applications. Once it is resolved what amendments the council accepts for the upcoming year, they approve a resolution. This resolution is known as the comprehensive plan docket. The docket is a calendar of pending land use amendments. Some types of proposed amendments require a significant investment of time and expense on the part of both applicants and the city. A city may specify that certain types of amendments will not be carried forward into the amendment process on an annual basis. This provides potential applicants with advance notice of whether a proposed amendment will be carried forward and can help applicants avoid the expense of preparing an application. Once the docket is established, the city prepares reports, performs environmental review on the cumulative impact of the amendments, and solicits comments from property owners, 2 the general public and public agencies, and interested parties. The commission conducts public hearings and makes recommendations. The body of this work is forwarded to the city council. They too conduct a hearing, and finally, a decision is rendered, which is appealable. This process begins in March and can extend through the summer. 2019 AMENDMENTS: Table 1 lists the 2019 amendments. The attached figures show the related map amendments. To: Lakewood City Council and Clover Park School District Board From: Mary Dodsworth, Parks, Recreation & Community Services Director Through: John Caulfield, City Manager Date: January 28, 2019 Subject: City / CPSD Cooperative Use Interlocal Agreement Summary: The City of Lakewood (City) and the Clover Park School District (CPSD) have shared facilities and resources for many years and have a positive history of cooperative use. Both entities desire to be effective and efficient stewards of public resources and assets and have a mutual interest in supporting youth and families living in the City of Lakewood and surrounding areas. The partnership allows each entity to meet student and community needs beyond what either could do alone. A cooperative use interlocal agreement would memorialize this partnership, clarify expectations and ensure consistency and continuity for current and future agency representatives. Discussion: Cooperative use interlocal agreements (agreement) are common documents for school districts and cities with parks and recreation departments or districts. Although the specific terms and conditions can vary between jurisdictions, there are common topic areas included in most agreements. Topic areas include: Purpose: This section outlines not only why an agreement is needed but often addresses larger goals or common interests of each entity. The most prominent includes efficient use of public resources, improving local or student services and providing more opportunities for the community members they serve. Scheduling: This section provides the method used for reserving and scheduling use of each agencies facilities. The City and CPSD each has their own process for scheduling use and the expectation is that each entity would continue to use their respective established processes. This section may also outline days or hours of use, timelines for reserving space, priority of use by user groups and how disputes may be communicated and/or resolved. Fees and Cost Sharing: This section outlines when and if fees would be charged and how each agency may be reimbursed for services, staffing or damages. This section may also explain how or when fees are established or modified. Often the fee schedule is an agency addendum to the agreement. Currently the City and District 16 allow each other to use facilities free of charge for City or District sponsored programs. Fees are charged when use is before or after regular operating hours or if special equipment, staff or tasks are needed in conjunction with the facility or use. For example: The City doesn’t charge for sport fields, open space, trail use or meeting space but may charge for additional field preps or hiring staff for a weekend meeting. The District doesn’t charge for gyms, field use, classroom space or playground areas for summer camps or after school programs but may charge for a custodian to provide staff support for a special event held on the weekend or if access to a restroom was needed after hours. Term, Renewal and Termination: Some agreements have built in renewal periods (2-5 years), are often automatically renewed for a number of years or until requested by one of the parties to review or active until a party decides to terminate the agreement. A 90 day to 360 day notice to terminate can be included. 90 days allows either entity to properly review the reasons for termination as well as allow any leagues or sporting seasons to finish scheduled use. Gross negligence or illegal activity could be grounds for quicker termination. Capital Improvements: The idea of cooperatively improving City or District resources to expand current programs or provide support to other programs can be its own section, however this is often a special situation which may or may not require a separate agreement. Examples include having the City donate soccer goals or a basketball hoop for the District to install at a school to support a City sponsored league. Use of the equipment could then be available to students during the day and to the community during non-school hours. Another example is in 2009 the City and District partnered to build a playground on District property (Lake Louise Elementary School). A separate agreement was created. Responsibility and Liability: This section can specify levels of staffing, required supervision or other site policies and procedures to ensure safety for facilities and participants. Indemnification and hold harmless language is also standard provisions. Attachments: Attachments, addendums and exhibits typically follow the signature page. These include facility lists, site maps, emergency plans, contact lists, scheduling forms, fee schedules, definitions for priority use, etc. Next steps: • Council and School Board discussion regarding desire to develop and implement an agreement between City and CPSD. If mutually agreeable, • Cooperatively develop a draft agreement for review and consideration. Assign agency liaisons, review options and establish timeline. • Schedule review of draft document at future joint meeting or independent study sessions. 17
