Requests from person with disabilities must be made to the Community Development Department 48 hours in advance of the meeting. 1. CALL TO ORDER/ROLL CALL Meeting convened at 6:15 PM Members present: Jean Allais, David Milam (Chair), Beth Young Members absent: Becce Ford, Aaron Taff There was a quorum present at all times. Staff Present: David Clark, Randy Hunt, Mary Murrieta, Kathleen Wickersham City Council Liaison: Lee Kempert (present) 2. APPROVAL OF AGENDA AND MINUTES 2-A. AGENDA: Changes and Approval of Agenda for July 17, 2014 meeting. Change agenda to discuss item 4-B. Consideration of Pool License issue at The Pointe Prior to 4-A. Review of Inspections. MOTION BY YOUNG, second by Allais, to approve the Agenda with the recommended change. Aye: 3 Nay: 0 Motion carried. 2-B. MINUTES: Thursday, May 15, 2014, Board of Health Minutes MOTION BY YOUNG, second by Allais, to approve the Minutes from the May 15, 2014 Board of Health meeting as written. Aye: 3 Nay: 0 Motion carried. 3. DISCLOSURES None 4. BUSINESS NEW BUSINESS 4-B. Consideration of Pool License issue at The Pointe David Clark, the City Attorney, informed the Board that The Pointe at WYO, LLC is the owner of a student housing project located at 605 South 30th Street. The housing project has a spa and two lap pools that are in use, but not licensed. Laramie Board of Health July 17, 2014 Page 1 of 2 Clark reviewed with the Board the Petition for Order of Immediate Cease Operations and the Affidavit of Mary Murrieta both signed by the Environmental Health Specialist. He stated that the Petition from the Environmental Health Specialist is a request for an Order of Closure of the unlicensed pools and spa. When the Order to Immediately Cease and Desist Operations is signed by the Board of Health, it will be served on The Pointe. If The Pointe requests a hearing, the request must be in writing and filed with the Clerk for the Board of Health. The Board would hold the Hearing and make a decision. If there were a violation of the Order to Immediately Cease and Desist Operations, there would be an injunction by the District Court. In order for The Pointe to reopen the pools and spa they would need to meet the Wyoming Regulations for Swimming Pools, Spas, and Similar Installations of 2003 or request and receive a variance from the Wyoming Department of Agriculture. MOTION BY YOUNG, second by Allais, to approve and sign the Order to Immediately Cease and Desist Operations. Aye: 3 Nay: 0 Motion carried. 4-A. Review of Inspections i. May 9, 2014 – June 12, 2014 ii. June 13, 2014 – July 10, 2014 The Board reviewed and discussed the establishments on the monthly inspection reports. Murrieta answered questions and provided information on various establishments. OLD BUSINESS No items 5. NEXT REGULAR MEETING WILL BE HELD AUGUST 21, 2014. 6. ADJOURN MOTION BY ALLAIS, second by Young, to adjourn the meeting. Aye: 3 Nay: 0 Motion carried. The Board of Health meeting adjourned at 6:52 PM.
