Clark reviewed with the Board the Petition for Order of Immediate Cease Operations and the
Affidavit of Mary Murrieta both signed by the Environmental Health Specialist. He stated that the
Petition from the Environmental Health Specialist is a request for an Order of Closure of the
unlicensed pools and spa. When the Order to Immediately Cease and Desist Operations is
signed by the Board of Health, it will be served on The Pointe.
If The Pointe requests a hearing, the request must be in writing and filed with the Clerk for the
Board of Health. The Board would hold the Hearing and make a decision. If there were a
violation of the Order to Immediately Cease and Desist Operations, there would be an injunction
by the District Court.
In order for The Pointe to reopen the pools and spa they would need to meet the Wyoming
Regulations for Swimming Pools, Spas, and Similar Installations of 2003 or request and receive a
variance from the Wyoming Department of Agriculture.
MOTION BY YOUNG, second by Allais, to approve and sign the Order to Immediately Cease
and Desist Operations.
