MINUTES CITY OF LARAMIE, WYOMING CITY COUNCIL MEETING SEPTEMBER 21, 2021 1. CALL TO ORDER Regular Meeting of the City Council was called to order by Mayor Weaver at 6:30 p.m. 2. Pledge of Allegiance Mayor Weaver led the Pledge of Allegiance. 3. Roll Call Roll call showed present: Cumbie, Gabriel, Harrington, O'Doherty, Schmechel, Shuster, Summerville (arrived at 7:39 pm), Pearce, and Weaver. Absent: None. Directors and City Clerk present: Janine Jordan, City Manager; Todd Feezer, Assistant City Manager; Nancy Bartholomew, City Clerk; Bob Southard, City Attorney; Malea Brown, Chief Operating Officer; and Dan Johnson, Fire Chief. 4. Public Comment on Non-Agenda Items (Aggregate time limit 30 minutes) (Limit of 3 minutes per speaker.) None. 5. Consideration of Changes in Agenda and Setting the Agenda A MOTION BY PEARCE, seconded by Shuster, that the following changes to the Agenda be approved: to move Item 9.C. from consent agenda to 17.A. MOTION CARRIED by voice vote and raised hands. B. MOTION BY PEARCE, seconded by Shuster, that the Agenda be set as changed. MOTION CARRIED by voice vote and raised hands. 6. Approval of Consent Agenda Items listed on the Consent Agenda are considered to be routine and will be enacted by one motion in the form listed below. There will be no separate discussion of these items unless a Councilor or citizen so requests, in which case the item will be removed from the Consent Agenda and will be considered on the Regular Agenda. MOTION BY PEARCE, seconded by Harrington, that the Consent Agenda be approved and that each specific action on the Consent Agenda be approved as indicated. MINUTES: City Council Meeting Minutes from September 7, 2021 Action: that Council approve the Minutes of the following City Council meetings: the Regular Meeting of September 7 2021, and have them placed on file for public inspection. 9.B. CEMETERY DEEDS: Cemetery Deeds for September 1-15, 2021 Action: that the Cemetery Deeds for June 16-30, 2018 be accepted, and the Mayor and City Clerk be authorized to sign and have them recorded in the Office of the County Clerk 9.C. Moved to Item 17.A. RESOLUTION: Resolution 2021-62, Recognizing the City of Laramie's Commitment to Solar Initiatives through the Participation in the US Department of Energy's SolSmart Program 9.D. LICENSE: License Agreement with Laramie Public Arts Coalition to Install & Maintain Vinyl Mural Wraps Action: move to approve the license agreement with the Laramie Public Arts Coalition and authorize the Mayor and City Clerk to sign. 9.E. SCHEDULE MEETINGS: Action: that the following meeting be scheduled: a. Consideration of Memorandum of Understanding between Albany County and the City of Laramie for the High Priority Growth Area MOTION BY HARRINGTON, seconded by Pearce, to approve the replacement Memorandum of Understanding between the County of Albany, Wyoming, and the City of Laramie, Wyoming for Collaborative and Coordinated Growth Management through establishment of a Joint Growth Area Agreement and authorization of amendment of the fiscal year 2021-22 Budget to support this effort, and authorizing the Mayor and Clerk to sign. Public Comment: None. Roll call showed Aye: Cumbie, Gabriel, Harrington, O'Doherty, Schmechel, Shuster, Pearce, and Weaver. Nay: None. Absent: Summerville. MOTION CARRIED. 12. New Restaurant Liquor License No. R67 for Guerin Enterprises, Inc dba Coal Creek Coffee located at 2317 Grand Ave MOTION BY CUMBIE, seconded by Pearce, to approve the application for a Restaurant Liquor License No. R67 to Guerin Enterprises, Inc dba Coal Creek Coffee located at 2317 Grand Ave, Laramie, WY, for the licensing term September 22, 2021 thru May 07, 2022, and authorize the Mayor and City Clerk to sign. Public Comment: None. Roll call showed Aye: Cumbie, Gabriel, Harrington, O'Doherty, Schmechel, Shuster, Pearce, and Weaver. Nay: None. Absent: Summerville. MOTION CARRIED. 13. Resolution 2021-61, Budget Amendment -Amendment Pertaining to American Rescue Plan Act (ARPA) Funding MOTION BY SHUSTER, seconded by O'Doherty, to approve Resolution 2021-61, amending appropriations totaling $5,673,340 for the American Rescue Plan Act (ARPA) for the fiscal year 2021-2022 budget of the City of Laramie, WY, and authorize the Mayor and City Clerk to sign. Resolution 2021-63, Extending the Dates of Resolutions 2021-30 and 2021-36 Related to the Establishment of the Open Container Area and Downtown Economic Enhancement Initiatives. MOTION BY PEARCE, seconded by Harrington, to approve Resolution 2021-63, extending the dates of Resolutions 2021-30 and 2021-36 related to the establishment of the open container area and downtown economic enhancements initiatives, and authorize the Mayor and Clerk to sign. Public Comment: None. Roll call showed Aye: Cumbie, Gabriel, Harrington, O'Doherty, Schmechel, Shuster, Pearce, and Weaver. Nay: None. Absent: Summerville. MOTION CARRIED. 15. Consideration of a request to name the disc golf course in LaPrele Park in honor of Scott Ebinger. MOTION BY GABRIEL, seconded by Cumbie, to certify the action of the Parks, Tree & Recreation Advisory Board by approving the request to name the disc golf course in LaPrele Park "Scotty's Disc Golf Course" in honor of Scott Ebinger. Public Comment: None. Roll call showed Aye: Cumbie, Gabriel, Harrington, O'Doherty, Schmechel, Shuster, Pearce, and Weaver. Nay: None. Absent: Summerville. MOTION CARRIED. 16. Original Ordinance No. 2030, vacating a portion of Lewis Street, 11th Street, 12th Street and the Alley within and adjacent to Block 2, University Place Addition Second Reading. (Introduction by Harrington) MOTION BY HARRINGTON, seconded by Schmechel, to approve Original Ordinance No. 2030 on second reading, vacating approximately a 102,500 square foot area ofright-of-way including a portion of Lewis Street, 11th Street, 12th Street and the Alley within and adjacent to Block 2, University Place Addition, as recommended by the Planning Commission; based on findings of fact and conclusions of law, and postpone 3rd and Final Reading until the October 19, 2021 regular Council meeting. Public Comment: None. Roll call showed Aye: Cumbie, Gabriel, Harrington, O'Doherty, Schmechel, Shuster, Pearce, and Weaver. Nay: None. Absent: Summerville. MOTION CARRIED. Consideration of a bid award to Shepard Construction, Inc., Rawlins, WY for the Interfaith Food Pantry Addition. MOTION BY SHUSTER, seconded by Pearce, to award the bid for the Interfaith Food Pantry Addition to Shepard Construction, Inc., Rawlins, WY including the base bid, along with alternates number 1 and 2 in an amount not to exceed $698,525, and authorize the City Manager to sign bid and the Mayor and Clerk to sign construction contract. Public Comment: None. Roll call showed Aye: Cumbie, Gabriel, Harrington, O'Doherty, Schmechel, Shuster, Pearce, and Weaver. Nay: None. Absent: Summerville. MOTION CARRIED. 17.A. Moved from 9.C. RESOLUTION: Resolution 2021-62, Recognizing the City of Laramie's Commitment to Solar Initiatives through the Participation in the US Department of Energy's SolSmart Program MOTION BY O'DOHERTY, seconded by Harrington, to approve City Council Resolution 2021- 62, recognizing the City of Laramie's commitment to solar initiatives through the participation in the US Department ofEnergy's SolSmart Community, and authorize the Mayor and Clerk to sign. Public Comment: None. Councilor Summerville joined at 7:39 pm. Roll call showed Aye: Cumbie, Gabriel, Harrington, O'Doherty, Schmechel, Shuster, Summerville, Pearce, and Weaver. Nay: None. Absent: None. MOTION CARRIED. 18. Public Comments on Non-Agenda Items None. 19. Consideration of future Council work session topics Gabriel (Shuster)- Census review. Summerville (Schmechel)- Joint with Albany County Commissioner, LCCC Albany Campus future (long term planning). 20. Adjourn to Executive Session regarding Personnel, WY§ 16-4-405(a)(x) and Litigation WY§ 16-4-405(a)(iii) MOTION BY SHUSTER, seconded by Harrington, to adjourn to Executive Session regarding Personnel, WY§ 16-4-405(a)(x) and Litigation WY§ 16-4-405(a)(iii).
