CITY OF LATHRUP VILLAGE SPECIAL CITY COUNCIL MEETING MINUTES MARCH 1, 2021 MINUTES OF THE SPECIAL CITY COUNCIL MEETING OF THE CITY OF LATHRUP VILLAGE HELD ON REMOTELY ON ZOOM. The meeting was called to order at 6:0 p.m. by Mayor Garrett and Roll Call was taken. Present: Mayor Mykale Garrett and Mayor Pro Tem Bruce Kantor Council members Ian Ferguson and Saleem Siddiqi Excused: Council member Donna Stallings Present: City Administrator, Dr. Sheryl L. Mitchell, City Attorney, Scott Baker, Police Chief, Scott McKee, Treasurer, Pamela Bratschi, Community & Economic Development Manager, Susan Stec, Kelda London, and City Clerk, Yvette Talley Also Present: Patrick McGow, Bobby Bendzinski, Stephen Hydak and Sean Rucker This meeting was held remotely. Roll call was taken and all City Council members present are located in Lathrup Village, MI-Oakland County. Mayor Pro Tem Kantor is located in Harbor Springs, MI – Emmet County. CO-21-61 ROLL CALL WAS TAKEN Motion by Council member Siddiqi, seconded by Mayor Pro Tem Kantor to excuse Council member Stallings from this meeting. Ayes: Ferguson, Garrett, Kantor, Siddiqi No: None Motion carried. CO-21-62 APROVAL OF THE AGENDA Motion by Mayor Pro Tem Kantor, seconded by Council member Ferguson to approve the Agenda and adding Item 2D – to approve the Engagement Letters for the Bond advisors. Ayes: Ferguson, Garrett, Kantor, Siddiqi No: None Motion carried. CO-21-63 PRESENTATION – MICHIGAN INDEPENDENT CITIZENS REDISTRICTING COMMISSION – Julianne Pastula – General Counsel Julianne Pastula -General Counsel from the Michigan Independent Citizens Redistricting Commission- MICRC. They are responsible under the Michigan Constitution for redistricting Congressional seats, Michigan House and Michigan Senate districts. To ensure fair free and impartial maps, MICRC they are  CITY OF LATHRUP VILLAGE SPECIAL CITY COUNCIL MEETING MINUTES MARCH 1, 2021 required to solicit public input before drawing any redistricting plans. This will require a minimum 10 public hearings to be held across the state. Public hearings are to inform the public, solicit information from the public about potential redistricting plans. CO-21-64 CONSIDERATION TO APPROVE 2021 UNLIMITED TAX GENERAL OBLIGATION BONDS - $5.85m STREETS Patrick McGow – Attorney – Miller Canfield – gave an overview and answered specific questions. Voters approved ballot proposal authorizing the issuance of Bonds ($5,845,000) for various street projects in the City. The bonds will be sold at a competitive sale and then the proceeds will available to pay for the project. This will authorize the city to take the remaining steps to sell the bonds and it delegates the authority to various City officials to take action related to the bonds. Motion by Council member Ferguson, seconded by Mayor Pro Tem Kantor to Adopt the Resolution Authorizing 2021 Unlimited Tax General Obligation Bonds for an amount not to exceed $5,845,000, for street improvements. Ayes: Ferguson, Garrett, Kantor, Siddiqi No: None Motion carried. CO-21-65 CONSIDERATION TO APPROVE 2021 CAPITAL IMPROVEMENT BONDS (Unlimited Tax General Obligation) $5.38 million WATER/SEWER Patrick McGow – Attorney – Miller Canfield – gave an overview and answered specific questions. A Notice of Intent was approved and published authorizing the bonds for various improvements – water supply system improvements, replacement water mains, water meters, gate valves, hydrants, service lines, sewer/tank improvements, sidewalk, ditch and drainage improvements. This will be paid by water/sewer revenues. The Notice of Intent stated these bonds can be issued without a vote unless a petition was signed by not less than 10% of the registered voters and filed within 45 days. There were petitions circulated and some signatures submitted to the City Clerk’s office. They were not sufficient signatures to satisfy the 10% threshold. After reviewing the petition forms, they did not meet the requirements under Michigan Election Laws to be a valid petition. The City can move forward with the sale of bonds for this purpose. The bonds can be issued and sold at a competitive sale. It can be sold on the same day as the road bond project. This resolution authorizes various City officials to take action related to the sale of the bonds. Motion by Mayor Pro Tem Kantor, seconded by Council member Ferguson to Adopt the Resolution Authorizing 2021 Capital Improvement Bonds (Unlimited Tax General Obligation), in an amount not to exceed $5.38 million for Water/Sewer public infrastructure related projects. Mayor Pro Tem Kantor stated residents did exercise the right of referendum and City Council will receive at the March 15, 2021 City Council meeting. How are the 2 bonds different: Bonds approved by the voters on the road project, that allows the city to put it on the tax bill in the amount necessary to pay the debt. That will be paid directly from the property tax that will be added to the tax bills July 2021 to pay for the road bonds. The water/sewer bonds city is not allowed to raise taxes at a rate higher than is allowed to levy in order to pay the bonds. The money to pay back these particular bonds have to come from other sources- water/sewer bill for the water projects. CO-21-66 CONSIDERATION TO APPROVE THE ENGAGEMENT LETTERS FROM THE BOND ADVISORS Dr. Sheryl Mitchell Theriot gave an overview and answered specific questions. Bendzinski & Co. were the advisors on the two bonds – General Obligations Bonds relevant to the (Street improvements bond) Capital Improvement Bonds relevant to (Water/Sewer bond) Motion by Mayor Pro Tem Kantor, seconded by Council member Ferguson to adopt the Engagement Letters from the Bond Advisors. Ayes: Ferguson, Garrett, Kantor, Siddiqi No: None Motion carried. CO-21-67 MAYOR AND COUNCIL COMMENTS Mayor Pro Tem Kantor asked residents to attend City meetings to become more informed. All City council can be reached by email/phone.
