CITY OF LATHRUP VILLAGE CITY COUNCIL MEETING MINUTES NOVEMBER 18, 2019 MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF LATHRUP VILLAGE HELD ON MONDAY, NOVEMBER 18, 2019 IN THE CITY COUNCIL CHAMBERS IN THE MUNICIPAL BUILDING 27400 SOUTHFIELD ROAD, LATHRUP VILLAGE, MICHIGAN. The meeting was called to order at 7:04 p.m. by Mayor Garrett and Roll Call was taken. Present: Mayor Mykale Garrett and Mayor Pro Tem Bruce Kantor Council members Ian Ferguson, Saleem Siddiqi and Donna Stallings Also Present: City Administrator, Dr. Sheryl L. Mitchell, City Attorney, Scott Baker, Police Chief, Scott McKee, Pamela Bratschi, Treasurer and City Clerk, Yvette Talley MAYOR INVITED ALL PRESENT TO JOIN IN THE PLEDGE OF ALLEGIANCE CO-19-189 OFFICIAL COMMENTS Council member Ian Ferguson thanked all of the residents for their support in his re-election. Civility will be his primary focus. Council member Saleem Siddiqi thanked all of the residents for their support in his re-election. Council member Donna Stallings appreciative of the vote of confidence from the residents. Look forward to serving with her colleagues. Mayor Mykale Garrett thanked all of the residents for their support of her going into her 9th year on City Council. They will work together to make Lathrup Village the best city possible. CO-19-190 ADJOURNED SINE DIE The meeting was adjourned sine die. The re-elected City Council members were welcomed. Clerk Talley administered the Oath of Office to the re-elected City Council members. Mykale Garrett was re-elected to a four-year term. Donna Stallings was re-elected to a four-year term, Ian Ferguson was re-elected to a two-year term and Saleem Sidiqi was elected to a two-year term. Motion by Mayor Pro Tem Kantor, seconded by Council member Siddiqi to appoint Council member Mykale Garrett as Mayor. Yes: Ferguson, Garrett, Kantor, Siddiqi No: Stallings Motion carried. Yes: Ferguson, Garrett, Kantor, Siddiqi, Stallings No: None Motion carried. Clerk Talley announced Mykale Garrett received 4 votes to 1 for Mayor. Bruce Kantor received a unanimous vote for Mayor Pro Tem. Clerk Talley administered the Oath of Office to Mayor Garrett and Mayor Pro Tem Kantor and they both were congratulated. Yes: Ferguson, Garrett, Kantor, Siddiqi, Stallings No: None Motion carried. 3  CITY OF LATHRUP VILLAGE CITY COUNCIL MEETING MINUTES NOVMEBER 18, 2019 CO-19-197 APPROVAL OF DISBURSEMENT REPORTS Motion by Council member Kantor, seconded by Council member Ferguson to approve the Disbursement Report of October 1, 2019 through October 15, 2019 totaling $62,714.03. CO-19-200 PUBLIC COMMENTS Henry Swift – 18535 Santa Ann Ave, said he has a problem with his storm ditch with water settling and remaining in the ditch. What will happen now that the proposal did not pass on November 5th? There’s a transformer on his property which caused a severe transformer surge. Which disabled the furnace, air conditioner, garage door openers and other appliances. It also affected other homes in the neighborhood. Thanked Mayor Garrett for her assistance with assisting him in this matter. Mayor Pro Tem Kantor said he should speak with Dr. Mitchell to get the City Engineers out to inspect his problem. Infrastructure committee will meet to discuss other options. Council member Ferguson said DTE will be updating the transformers and there will be a follow-up meeting with DTE. Thanked Mayor Pro Tem Kantor for his hard work on the road millage ballot proposal. 4  CITY OF LATHRUP VILLAGE CITY COUNCIL MEETING MINUTES NOVMEBER 18, 2019 Council member Stallings thanked Mayor Pro Tem for his hard work that he put into the road ballot proposal. Joy Powell – 27780 California Dr. N. E. said the road millage ballot proposal is a good idea and it’s what we should do. Property values depend on the quality of the infrastructure and if it’s allowed to decline it will affect everyone who lives here. They have problem with standing water which is not a healthy environment and it would be wonderful to do something about it. Thanked City council on how the road ballot proposal was presented. Andre & Carla Hardaway -27315 Lathrup Blvd. said they continue to deal with intimidation and harassment. He provided a copy video footage to City Council and the Police Chief. CO-19-201 PUBLIC HEARING -2020 Community Development Block Grant (CDBG) Dr. Sheryl Mitchell gave an overview and answered specific questions from City Council. Mayor Garrett opened the public hearing at 7:47 p.m. There were no public comments Mayor Garrett closed the public hearing at 7:49 p.m. CO-19-202 ACTION REQUESTS A. Consideration of Approval for Jagged Fork Holdings, LLC Class C Liquor License Scott Baker, City Attorney gave an overview and answered specific questions. Motion by Council member Stallings, seconded by Mayor Pro Tem Kantor to approve the Application of Jagged Fork Holdings, LLC’s Class C Liquor License and authorize to submit the proper documentation to the Michigan Department of Licensing and Regulatory Affairs – Liquor control Commission. Yes: Ferguson, Garrett, Kantor, Siddiqi, Stallings No: None Motion carried. B. Consideration to Approve the Code of Conduct and Ethics Dr. Sheryl Mitchell gave an overview and answered specific questions. Consideration to Approve the Use of 2020 Community Development Block Grant (CDBG) Funds Dr. Sheryl Mitchell gave an overview and answered specific questions. Motion by Council member Ferguson, seconded by Council member Siddiqi to approve the Use of 2020 Community Development Block Grant (CDBG) Funds. Yes: Ferguson, Garrett, Kantor, Siddiqi, Stallings No: None Motion carried. D. Consideration to Approve the 2020 Fee Schedule Dr. Sheryl Mitchell gave an overview and answered specific questions. Chief Scott Mckee gave an overview on the gun permit fee and answered specific questions. Motion by Council member Stallings, seconded by Council member Ferguson to approve the Lathrup Village Fee Schedule with an effective date of January 1, 2020. Consideration for Approval of the 2020 Indoor/Outdoor Rental Rates and Community Service Credits Motion by Mayor Pro Tem Kantor, seconded by Council member Ferguson to remove this item from the table. Proclamation Recognizing January 26 to February 1, 2020 as School Choice Week in the City of Lathrup Village Mayor Garrett read the proclamation recognizing January 26 to February 1, 2020 as School Choice Week in the City of Lathrup Village. CO-19-203 CITY ADMINISTRATOR REPORT Dr. Mitchell said: Congratulations to all whom were re-elected on November 5, 2019 Election.  Administration o Setting up business accounts with Staples and Amazon for additional discounts and incorporating an approval process before confirming orders. o City Hall Closed Thanksgiving – Thur, Nov. 28 and Fri, Nov. 29 o Employee Appreciation - Friday, Dec. 20th, 12noon-4:30pm – request to close office o Met with Comcast to discuss service offerings o Student intern - Jakryi Chapman has started helping out 1 day a week & elections o Schools - Council held joint meeting with Southfield Public Schools. A links to SPS is now on the city website. We are receiving their email communications. o Met with MERS regarding their OPEB options. o Will be attending ARC meeting in Inkster on Wed, Nov. 20th at 1pm. o South Oakland County Mayor’s Assn – attended with Mayor Pro Tem Kantor on Nov. 13th. Hosted by City of Southfield o Michigan Municipal Executives – attended Nov. 8th training and presented on Council/Manager relations o Monthly Staff Meeting – was held on Nov. 12th. Next is Dec. 10th  DPS / Lathrup Services o The leaf pickup was delayed due to the early snowfall. With the warming temperatures, crews are attempting to resume service. However, can NOT pick up leave that have snow or are frozen. o New truck has been delivered and is in service. 7  CITY OF LATHRUP VILLAGE CITY COUNCIL MEETING MINUTES NOVMEBER 18, 2019  Finance Department o Board of Review meets on Tuesday, Dec. 10th for the purpose of correcting clerical errors and mutual mistakes of fact in the Roll. o Winter tax bills will be going out. Payments accepted Dec. 1, 2019 to Feb. 14, 2020. Unpaid bills are turned over to the County on March 1, 2020. o Police Department o Chief McKee attending the International Association of Chiefs of Police training in Chicago. The City received a Byrne Justice Assistance Grant (JAG) in the amount of $2,093.32 to cover some of the travel expenses. o Police vehicle was damaged by driver running a light. o Alarms – beginning in January 2020, the LVPD will be enforcing the Alarm Ordinance. Residents and businesses are to register their alarms systems ($20 for 3 years). More than 3 false alarms in a 12-month period are subject to being ticketed or fined. o Thanksgiving Dinner – Potluck dinner for neighbors coordinated by the LVPD on November 22nd, 6-8pm. $10 or bring a dish. Meeting on Nov. 18th with the Road Commission 8  CITY OF LATHRUP VILLAGE CITY COUNCIL MEETING MINUTES NOVMEBER 18, 2019  to discuss Southfield Road. Environmental Assessment is underway. Engineers to meet on Dec. 3rd to reach agreement on the parking mitigation. City will need to adopt a resolution acknowledging local match for federal funds for the parking mitigation and acceptance of the Environmental Assessment (estimated by Jan. 2020). Next meeting to include the Road Commission and communities is scheduled for January 23, 2020, estimated time is 4pm-6pm. Estimated time from for federal and MDOT approval is early  2022.  Light House Pantry Wish List – The City is partnering with the Lathrup Village Community Foundation to accept donations of food and other items for Lighthouse of Oakland County, through December 15th. The donation box is in the lobby of city hall.  South Oakland County Mayor’s Association Meeting – Attended with Mayor Garrett on Oct. 16th at 6:30pm. Hosted by Hazel Park. Lathrup Village is partnering with Berkley and Birmingham to host the next quarterly meeting.  MEDC - Certified RRC Photography Project – Has intended an offer to Lathrup Village, as part of the RRC program, to have 2 freelance photographers take photos to focus on visuals to capture our “local flavor” in high-resolution images to be used for marketing and promotion efforts. Meeting scheduled for Wed or Thursday, this week. UPCOMING EVENTS  Lathrup Village Women’s Club – Holiday Fund for children of Officer Imber. Luncheon on December 2nd in the Community Room. Council Updates:  28505 Southfield – brick wall. The attorney and city administrator met with the property owner and her attorney on Oct. 15, 2019. Agreed that they would submit permit application and signed engineer drawings for the reconstruction by Oct. 25th. Work to be completed by Nov. 15th. The revised plans were submitted. The plans did not address how the new construction with connect to the wall of the adjacent property. Nov. 4th, received FOIA request for original specs for the brick wall. Nov. 18th, Scott Ringler met with engineer for the project. Scott reported the two main issues / concerns were: 1. That the new wall needs to be connected to the existing wall to the north at a location where the existing wall is vertical. Based on my observation, that location is approximately 10 feet south of where the wall meets the 5’ high wall to the north. 2. That the new wall must be installed within the City’s alley right of way and this includes the foundation. They do not have a boundary survey complete.
