Deputy City Manager/Finance Director Kennie Hobbs mentioned his staff did a survey of the surrounding cities, which he thought was included in the backup, but it appeared it was not. Based on staff’s findings, the City’s COU fee was comparable, with some coming in higher and lower than Lauderhill’s. Commissioner Dunn sought clarification as to the wide disparity in the amount of the fees, some being as high as $2,000.00, while others were as low as a few dollars. Mr. Hobbs explained the amount of the COU was based on the type of business, for which staff did surveys; many of the current fees were set based on a disparity study done when the City initially set up its COU fees, noting the State only allowed municipalities to increase its COUs fees by five percent every other year. Commissioner Dunn wished to know when was the last time the fees were increased. Mr. Hobbs answered three years ago. Commissioner Dunn asked why the fees were now being raised. Mr. Hobbs responded that the City’s costs to provide the COU services increased, including staff time, and software used to administer those services. Commissioner Dunn requested staff state on the record what the increase meant for the City’s businesses; that is, what a five-percent increase across the board meant. City of Lauderhill Page 11 City Commission Meeting Meeting Minutes - Final September 14, 2023 Mr. Hobbs replied, for example, the COU for a beauty/personal services provider for hair, nails, massage, etc., went up from $191.42, to $200.99; a gas station’s COU went from $173.64 to $182.33; a bar or lounge’s COU went from $446.70 to $469.03. Commissioner Dunn questioned the reason for raising the fee the full five percent, rather than by a lesser percentage. Mr. Hobbs stated the City’s costs went up by more than five percent, so the increase in the COU fee did not actually cover the City’s increased costs, noting only the business paying the COU fee benefited from the COU. To cover the shortfall of the increase, staff tried to lower the cost by becoming more efficient, looking at processes, software, equipment, etc. to see where overall operating costs could be lowered. Martin said this was a program the City started in 2023 when it was identified in several meetings he had with staff that there were hundreds of property owners with open liens placed on their property due to unpaid fines accumulating for not addressing code violations; many owners were unaware of the liens, thought they were on the books for some time. The City began a program to send mailed notices to these property owners, giving them until December 31, 2023, to mitigate those liens, etc.; thus, the program sought to notify and grant owners time to clear up the liens. He wished to know how the program was being promoted, and how well it was going, knowing there was a considerable amount of money the City could gain from clearing up the liens, and the fact that the City had to clean up its books, and not continue to carry open debt, particularly from a county standpoint. The City would take this action once or twice a year to reduce the chance of fines mounting up as they had; some liens dated back to 2014, with millions of dollars’ worth of open violations. Mr. Hobb remarked the reason for the extension until December 31, 2023, was City of Lauderhill Page 14 City Commission Meeting Meeting Minutes - Final September 14, 2023 to allot everyone sufficient time to clear up their case, as all of the letters notifying owners of the liens did not go out at the same time; the letters went out over time, and so the extension would prevent anyone feeling they had insufficient time to mitigate their liens. Commissioner Dunn wished to know how the information was getting out to the community. Mr. Hobbs replied owners were notified via direct mailings, along with posting on the City’s website, at homeowner’s association (HOA) meetings, and on the City’s social media platforms. Commissioner Dunn urged staff to include nontraditional methods of reaching the applicable property owners. Vice Mayor S. Martin wondered how the City’s lien programs identified which property owners had liens on their property and did they differentiate between those who were aware of the lien versus those who were not. He was told by residents they once had a car parked in their backyard, for which they were cited by code enforcement, then fined in the interim of them removing the car, but no one from the City reinspected the property to see that the violation was corrected, so the case remained open, accumulating fines that later became a lien. He asked if the notices from the City were being sent by certified mail, and if there was a difference in how notices were sent to owners who were aware of the lien on their property versus owners who did not know about the lien on their property. Also, he did not recall seeing any appeal process detailed in the backup for owners who knew about the lien on their property, versus those who did not know. The backup also had language that said if it was not paid in 60 days, the amount would go back to the original fine amount, but he believed the City allowed some mitigation, where owners could get on a payment plan, but he saw no details about this in the backup. Mr. Hobbs explained there was no distinction in the program ’s noticing process between owners who were aware of the lien on their property, versus those who did not, adding that for a fine to become a lien on someone ’s property, it went through various stages: a violation was first issued; if left unresolved, the matter went on to the Code Enforcement Board, and, depending on whether the owner appeared or not, a fine could be levied that could become a daily fine that accumulated until the matter was resolved. In a case where the violation was addressed, the property owner needed to call the City to request a reinspection, though code staff reinspected the property for the violation just prior to the matter going before the Code Board; after the daily fine was levied, code officers did not check the property periodically to see if the violation was resolved. Under the subject program, the fines were being reduced across the board, as long as the property came into compliance in a timely manner. He noted, as to the amount owed, there still remained additional opportunities for property owners to apply for mitigation, such as if they could show they met low income qualifications, the amount owed could be reduced to one percent of the lien amount. As long as there was a good-faith effort to make the payments, and stay on track, City staff would work with the property owner. With regard to mailing the notices, they were sent via certified mail, but sometimes owners still City of Lauderhill Page 15 City Commission Meeting Meeting Minutes - Final September 14, 2023 claimed not to have received a notice, even if the City received the return receipt showing someone did receive it. City Attorney Rosenberg said, along with being sent via certified mail, notices were sent by regular mail, and posted at the property, and City staff had to prove to the Code Board that required noticing avenues were met before placing a lien on a property. She stressed the obligation was not on code officers to repeatedly check properties to see if a violation was addressed. When a violation was corrected, the onus was on the property owner to call the code officer for a reinspection in order to close the case. She said code officers worked with owners, so if the latter corrected the violations, and they could show paperwork or other proof this was done, the matter was resolved. Vice Mayor S. Martin asked about processes for mitigating liens after December 31, 2023. Mr. Hobbs responded the liens would remain on the system, but there were still mitigation processes available, but the difference would be the percentage of the lien that would be mitigated, which could go down to as low as 2.5 percent. City Attorney Rosenberg pointed out Lauderhill’s mitigation percentages were lower than most other cities. Commissioner Grant asked how much was still outstanding, with the City already collecting some $300,000.00. Mr. Hobbs stated the City had tens of millions of dollars in uncollected fines . The City offered a mitigation program about 20 years ago, and staff was working on making policy changes, including notifying owners with outstanding fines and liens annually, in order to prevent further fine accumulation. He noted when some people tried to sell their property, that was when they discovered there were liens on their property. Commissioner Grant wondered if there was anywhere online an owner could enter their information to find out if there was a lien on their property. Mr. Hobbs answered yes; property owners could go to the City’s website on the code check link to see if they had any fines or liens on their property. Commissioner Grant asked staff how many homes were mailed notices. Mr. Hobbs responded the City had 10,000 residences, of which probably over 1,000 had liens on them, and some liens totaled millions of dollars. To date, letters were sent to all property owners in the City with liens on their property, and the City sought to give everyone sufficient time to take care of their liens, but it was up to the property owners making contact with code staff to go through the mitigation process. Mr. Hobbs stated the rentals would be used on an as-needed-basis; currently, whenever the City needed tents and chairs, whether it was for a City or Commission-sponsored event, staff had to get pricing; with the subject resolution, staff did the procurement ahead of the events, so whenever the need arose, they did not have to go through the pricing process. He said whether for a City or Commission event, the funds for the supplies were charged to the department and/or commissioner utilizing the rentals. Martin thought the subject resolution was a great opportunity to attract first responders and persons of that caliber to live in the Lauderhill community, and the U.S. Congress put forward an initiative to help them purchase a home. City Attorney Rosenberg explained federal lawmakers introduced the HELPER (Homes for Every Local Protector, Educator and Responder) Act to amend the National Housing Act to create a dedicated mortgage insurance program for first responders and teachers. The program helped provide favorable mortgage rates, and terms to eliminate the traditional mortgage downpayment requirement; it eliminated the requirement for the monthly mortgage insurance premium, and to make homeownership more affordable for qualified individuals . The hope was that by passing the act, it would help improve the accessibility for first responders and teachers to purchase homes at a lesser rate. Commissioner L. Martin urged the public to speak in support of the subject initiative to their U.S. lawmakers, as nobody deserves a good hand up like first responders and teachers. A motion was made by Commissioner L. Martin, seconded by Vice Mayor S. Martin, that this Resolution be approved. The motion carried by the following vote: Yes: 4- Commissioner M. Commissioner L. Martin congratulated Commissioner Dunn, who traveled to Chicago to be honored by the Sierra Club on a national level; she was among some 16 people honored nationally, urging her to continue her efforts to address the world’s climate crisis. Mayor Thurston and he met with the principal of Parkway Middle School. Angeline Flowers, along with Broward School District Superintendent Dr. Peter Licata, School Board member Dr. Jeff Holness, and others. The City now had school resource officers (SRO) who were fully funded and posted at two Lauderhill schools, with Parkway Middle being one . Dr. Licata pledged that Parkway Middle was on track to be rebuilt, and the immediate attention the school needed would be coming soon; he agreed the students should not have to attend a school under such conditions. Mayor Thurston and he told Dr. Licata the City already heard such feedback that resulted in no significant change, so they hoped this time it would be different . He said the meeting was a good one, and they toured the school; there would be immediate construction to cover some of the walkways, etc. Commissioner L. Martin remarked at the Environ Cultural Center there was a wonderful health fair the previous week; Commissioner Dunn and he helped cosponsor some of the activities at the event. There were some 20 vendors, and there was a lot of outpouring, and a significant exchange of information, with over 300 attendees passing through the event. He mentioned the glow pickleball event, commending Parks & Recreation staff for thinking outside the box, stating it was a fun experience that he looked forward to seeing happen again, noting he asked staff to survey the attendees, as they appeared to be having a very good time. United Way of Broward County held a housing heroes mixer in the City of Hollywood, as they sought to attack the homeless veterans situation; they would be reaching out to veterans in all Broward cities to help them, as they had funding to help veterans secure housing. He encouraged them to come to Lauderhill to do a presentation to the Commission, so the Lauderhill public could City of Lauderhill Page 22 City Commission Meeting Meeting Minutes - Final September 14, 2023 know what was available. Commissioner L. Martin mentioned having the chance to hang out with a few of the City’s seniors in St. George, stating the 55 plus walking program was very healthy and alive over there; the senior residents were out walking every morning, getting coffee, etc. Every three months they moved the walking program around the City to encourage healthy living, and acknowledge senior residents who worked on tracking their miles. He attended an event, BRCAStrong, a gala hosted by Tracy Milgram, who did the free mammograms some months prior in Lauderhill; Ms. Milgram recently held an event at the Signature Grand at which there were over 300 people, some of whom were breast cancer survivors; he hoped to see the City partner with her on more initiatives. The City teamed up with her to go on the Jawan Strader show on NBC6 that should air the coming Saturday on Voices; they discussed Lauderhill’s Pink Up Breast Cancer Awareness initiative, along with teaming up with Lauderhill on a number of free events related to men ’s and women’s health. Regarding the upcoming Pink Up Lauderhill event, he urged everyone inside and outside the City to sign up to participate, along with riding a bike in the event, there were many other activities, including on Friday night, September 29th, the City would light up City Hall in pink, and display the large pink ribbon, as was done every year. The grand marshal at the bike-riding event would be Congress Woman Sheila Cherfilus-McCormick, and on Friday night, the event’s MC would be Ms. Milgram. He urged City staff to sign up to participate. All the money raised from the Pink Up events went back to cancer survivors. Commissioner Dunn mentioned on September 13, 2023, the first small business boot camp was held that was a part of a larger initiative the City ’s economic team was working on with the National League of Cities, and Harvard University, looking at the City’s procurement process. There were 143 attendees, and Mr. Hobbs was thanked for sharing the projections, and being one of the speakers, along with the support of the Mayor, Vice Mayor, and City Manager for their show of support. She said representatives for the City of Miami, and both the Dade and Broward School Boards attended; and one of the Lauderhill Health & Prosperity (LHPP) investors, the president of the Health Foundation of South Florida attended, and was very pleased with the event that was done in collaboration with the South Florida Anchor Alliance. She thanked Niah, Fatima, and Lisema, young women who did a lot of work to make the event a success, commending the City Manager for having such a good team . Commissioner Dunn mentioned Lauderhill Shines began under the LHPP, and they were currently holding a hygiene drive for Lauderhill Schools, referring to a box in the City Hall lobby to receive donations of personal hygiene items, as schools shared with the health sub-council that some students really struggled with getting hygiene products. There was a list, and boxes at the City ’s parks and facilities for persons wishing to donate unused personal hygiene items, such as deodorant, etc.; the items would be collected until September 30. She mentioned the Dine In Lauderhill initiative would kicked off in October, and it would be held on the second Friday of each month. The Leading Lady Circle would continue on the second Friday of each month. Vice Mayor S. Martin thanked Commissioner L. Martin for his initiative to address getting help for homeless veterans. He invited the community out to the Florida Department of Transportation (FDOT) public hearing regarding extending and widening the Turnpike that might affect the golf course area of the City of Lauderhill Page 23 City Commission Meeting Meeting Minutes - Final September 14, 2023 City with the plans to install an entrance to the Turnpike from Oakland Park Boulevard. The hearing would be held next Thursday at 5:30 p.m. at the Chateau Mar Golf Resort. City Manager Giles-Smith wished to send the LHPP some unusual tips for a health heart, such as getting seven to eight hours of sleep a night; snuggling; and laughing.
