The City of Lee's Summit Action Letter - Final City Council Rules Committee Monday, December 20, 2021 12:00 PM Via Video Conference ***AMENDED*** Notice is hereby given that the Rules Committee of the City of Lee’s Summit will meet on Monday, December 20, 2021 at 12:00 pm via video conference as provided by Section 2-50 of the City of Lee’s Summit Code of Ordinances, adopted by the City Council on June 15, 2021, Ordinance No. 9172. Persons wishing to comment on any item of business on the agenda may do so by sending a request prior to 5:00 p.m. on Friday, December 17, 2021, to the City Clerk at clerk@cityofls.net to attend the meeting on the video conferencing platform. The City Clerk will provide instructions regarding how to attend by this method. The meeting may be viewed on the City website at www.WatchLS.net, and various cable providers (Spectrum channel 2, Google TV channel 143, AT&T U-Verse channel 99 and Comcast channel 7) for those whose cable providers carry the City of Lee’s Summit meetings. 1. Call to Order Chairperson Felker called the December 20, 2021 Rules Committee meeting to order at 12:00 p.m. 2. Approval of Agenda Councilmember DeMoro made a motion to approve the Agenda for the December 20, 2021 Rules Committee meeting. Seconded by Councilmember Carlyle. Motion Passed 3-0 (Councilmember Forte absent). Public Comments There were no public comments. 5. Items for Discussion A. 2021-4605 Approval of the Action Letter for the October 18, 2021 CIty Council Rules Committee Meeting. Councilmember Carlyle made a motion to approve the Action Letter for the October 18, 2021 City Council Rules Committee meeting. Seconded by Councilmember DeMoro. Motion passed with vote 3-0 (Councilmember Forte absent). Aye: 3 - Chairperson Felker Vice Chair DeMoro Councilmember Carlyle Absent: 1 - Councilmember Forte B. 2022-4715 An Ordinance amending the Code of Ordinances by enacting a new “Section 2-253. Members to be qualified voters - exceptions.” of the Code of Ordinances of the City of Lee’s Summit, Missouri providing generally for the qualifications for members of city boards, committees, and commissions. Brian Head gave a brief summary of the three options mentioned in the packet and added a fourth for the Committee's consideration. 1. Members to be registered voters. No person shall be appointed as a member of a city board or commission unless such person shall be, at the time of appointment, registered to vote in the state. City residency shall be preferred, but, if there is no qualified individual to fill such city board or commission who is a resident of the city, then, a nonresident of the city may be appointed. OR 2. Members to be registered voters and residents of the City. No person shall be appointed as a member of a city board or commission unless such person shall be, at the time of appointment a resident of the City and a registered voter of the City. Except that the City Council may provide for an alternate qualification and shall include special provisions in any ordinance authorizing such board or commission. OR 3. Members to be registered voters and residents of the City. No person shall be appointed as a member of a city board or commission unless such person shall be, at the time of appointment a resident of the City and a registered voter of the City. Any person serving as member of any board or commission at the time of the approval of this ordinance who is not a resident of the City shall continue to serve until the end of his or her term but shall not be eligible for reappointment. Everyone is required to be a resident and qualified voter of the city, unless the Council gives consent by 2/3 majority for an individual to be appointed that is not a qualified voter or resident of the city. After discussion of the suggested options, and before taking any recommendation to the full Council, the Committee asked Staff to provide more information regarding the current Committee memberships. The Committee would like to know the following: 1. The number of individuals that are not a resident or qualified voter that are currently serving, and 2. which Committee they are currently serving on, and 3. when their terms expire. Once they have that information, they will have a better idea on what they would like to propose going forward, specifically regarding what to do in situations where we currently have people in positions that aren't qualified voters or city residents. The overall consensus of the Committee is to eventually have only qualified voters AND residents of the City of Lee's Summit fill the Boards and Commission membership (except those that are statutory in nature) and have the option of a 2/3 majority vote by the Council in the event a position needs to be filled and no one meeting the requirements is seeking an appointment. This Discussion Item was continued.to the City Council Rules Committee due back on 1/19/2022 6. Roundtable The next meeting will be held via Zoom on Wednesday, January 19, 2021 at noon. 7.
