The City of Lee's Summit Action Letter - Final City Council Rules Committee Wednesday, January 19, 2022 12:00 PM Via Video Conference Notice is hereby given that the Rules Committee of the City of Lee’s Summit will meet on Wednesday, January 19, 2022 at 12:00 pm via video conference as provided by Section 2-50 of the City of Lee’s Summit Code of Ordinances, adopted by the City Council on June 15, 2021, Ordinance No. 9172. Persons wishing to comment on any item of business on the agenda may do so by sending a request prior to 5:00 p.m. on Tuesday, January 18, 2022, to the City Clerk at clerk@cityofls.net to attend the meeting on the video conferencing platform. The City Clerk will provide instructions regarding how to attend by this method. The meeting may be viewed on the City website at www.WatchLS.net, and various cable providers (Spectrum channel 2, Google TV channel 143, AT&T U-Verse channel 99 and Comcast channel 7) for those whose cable providers carry the City of Lee’s Summit meetings. 1. Call to Order Chairperson Felker called the meeting of the City Council Rules Committee to order at 12:00 p.m. 2. Roll Call Guests in Attendance: Brian Head Jina Bellamy Present: 4 - Chairperson Andrew Felker Vice Chair Fred DeMoro Councilmember Trish Carlyle Councilmember Diane Forte 3. Approval of Agenda Councilmember Forte made a motion to Approve the Agenda for the City Council Rules Committee meeting for January 19, 2022. Motion was seconded by Councilmember DeMoro. Business A. 2022-4641 Approval of the Action Letter for the December 20, 2021 City Council Rules Committee meeting. Councilmember Carlyle made a motion to approve number 2022-4641 - Approval of the Action Letter for the December 20, 2021 City Council Rules Committee. Motion was seconded by Councilmember DeMoro. Vote: 4-0. Motion passed. Aye: 4 - Chairperson Felker Vice Chair DeMoro Councilmember Carlyle Councilmember Forte B. BILL NO. An Ordinance amending the Code of Ordinances of the City of Lee's Summit, 22-59 Missouri by enacting a new Section 2-253. Members to be qualified voters - exceptions, providing generally for the qualifications for members of City boards, committees, and commissions. (Rules 3/14/22) Brian Head introduced the topic by mentioning a report that was emailed to the Committee regarding the Boards and Commission membership list (also attached to the packet). He mentioned that the City currently has 5 individuals who are not residents of the City of Lee's Summit. General discussion centered around the draft language presented at the previous meeting. After general discussion: The Committee discussed a few more things for consideration. 1. To ensure that due diligence is done when trying to fill Committee vacancies by trying to find Lee's Summit residents to fill the position(s). A suggestion was made to make the full Council aware of upcoming vacancies so they may submit names for consideration prior to the deadline of making the appointment. 2. To provide the Council with and explanation in advance of requesting their approval for a non-resident being considered for appointment to a Board. The following language is a rough draft that was formatted by staff during the meeting incorporating the discussion points: "All proposed appointees to a Boards and Commissions shall be residents and qualified voters if the City except as otherwise provided by Ordinance or Statute. Any proposed appointee to a Board or Commission seat that requires the seat be filled by a resident and qualified voter who is not a resident or a qualified The City of Lee's Summit Page 2 Printed on 3/31/2022  City Council Rules Committee Action Letter - Final January 19, 2022 voter of the City shall not be appointed unless he or she shall be approved by 2/3 vote of the entire City Council." The information provided to the City Council at the time that an appointment is recommended shall include whether or not the individual is a resident and qualified voter. A non-resident should not be appointed to a seat, that otherwise requires residency unless due diligence has occurred first." After further discussion, consensus of the Committee, was to have Staff draft final language and email it to the Committee to be discussed at the February 28, 2022 Rules Committee meeting with the intent of forwarding it to the full Council at their first meeting in March. This discussion Item was continued.to the City Council Rules Committee due back on 2/28/2022. 6. Roundtable The next meeting will be held via Zoom on February 28, 2022 at noon. 7.
