The City of Lee's Summit Action Letter Public Works Committee Monday, September 11, 2023 4:30 PM City Council Chambers and Via Video Conference 220 SE Green Street Lee's Summit, MO 64063 Notice is hereby given that the Public Works Committee for the City of Lee’s Summit will meet in Regular Session on Monday, September 11, 2023, at 4:30 pm in person and via video conference as provided by Section 2-50 of the City of Lee’s Summit Code of Ordinances, adopted by the City Council on June 15, 2021, Ordinance No. 9172. Persons wishing to comment on any item of business on the agenda via video conference may do so by sending a request prior to 12:00 p.m. on Monday, September 11, 2023, to the City Clerk at clerk@cityofls.net to attend the meeting on the video conferencing platform. The City Clerk will provide instructions regarding how to attend by this method. The meeting may be viewed on the City’s website at WatchLS.net, and on various cable providers (Spectrum Channel 2, AT&T U-Verse Channel 99 and Comcast Channel 7). 1. Call to Order The September 11, 2023, Public Works Committee meeting was called to order by Chairman DeMoro, at 4:31 p.m. at City Hall, 220 SE Green Street, in the City Council Chambers. Notice had been provided by posting the meeting notice with a tentative agenda, at least 24 hours in advance of the meeting, at both entrances to City Hall and online. 2. Roll Call Present: 3 - Chairperson Fred DeMoro Councilmember John Lovell Councilmember Mia Prier Absent: 2 - Vice Chair Phyllis Edson Alternate Andrew Felker 3. Approval of Agenda A motion was made by Councilmember Lovell, seconded by Councilmember Prier, to approve the agenda as posted. The motion carried by a unanimous 3-0 vote (Vice Chair Edson "Absent"). 4. Public Comments None. 5. Business A. 2023-5826 Approval of the August 14, 2023, Public Works Committee Action Letter A motion was made by Councilmember Lovell, seconded by Councilmember Prier, to approve the Public Works Committee Action Letter dated August 14, 2023. An Ordinance awarding the bid for Project No. 576322-6C for the Stormwater 23-181 Improvements: Phase 2 to Legacy Underground Construction, Inc. in the amount of $1,167,971.10, and authorizing the City Manager to execute an agreement for the same. (PWC 9/11/23) A motion was made by Councilmember Prier, seconded by Councilmember Lovell, that this Ordinance be recommended for approval to the City Council. The motion carried by a unanimous 3-0 vote (Vice Chair Edson "Absent"). C. BILL NO. An Ordinance approving Modification No. 5 to an Agreement dated July 16, 23-182 2019 (RFQ No. 543-32272) for Professional Engineering Services for Four Stormwater Improvement Projects - SW Blazing Star Drive, SW 34th Street, NE Delta School Road, SW Pinnell Drive by and between the City of Lee’s Summit, Missouri, and Lamp Rynearson for an increase of $24,314.68 with an amended not to exceed amount of $379,714.68, and authorizing the City Manager to execute an agreement for the same. (PWC 9/11/23) A motion was made by Councilmember Prier, seconded by Councilmember Lovell, that this Ordinance be recommended for approval to the City Council. The motion carried by a unanimous 3-0 vote (Vice Chair Edson "Absent"). D. BILL NO. An Ordinance authorizing the execution of an Agreement for Easement, Notice 23-183 and Covenant Running with Land, with the Missouri Department of Natural Resources Waste Management Program to grant access to monitoring points and perform inspections, and authorizing the Mayor to execute the same. (PWC 9/11/23) A motion was made by Councilmember Lovell, seconded by Councilmember Prier, that this Ordinance be recommended for approval to the City Council. The motion carried by a unanimous 3-0 vote (Vice Chair Edson "Absent"). E. BILL NO. An Ordinance approving Modification No. 6, to the agreement with Crawford, 23-184 Murphy and Tilly, Inc. for On-Call Professional Planning & Engineering Services for the airport (RFQ No. 2020-067) in the amount of $446,199.28, and authorizing the City Manager to execute an agreement for the same. (PWC 9/11/23) A motion was made by Councilmember Lovell, seconded by Councilmember Prier, that this Ordinance be recommended for approval to the City Council. The motion carried by a unanimous 3-0 vote (Vice Chair Edson "Absent"). F. 2023-5730 Report: Annual Stormwater Regulatory Updates Mr. George Binger, Deputy Director/City Engineer, presented a report for the Annual Stormwater Regulatory Updates. Mr. Binger displayed a power point presentation that summarized what the NPDES (National Pollutant Discharge Elimination System) permit is, what it regulates, components of the FEMA National Flood Insurance Program, and needs for a substantial damage plan. He advised that a Summary Report will be submitted to City Council as part of the staff roundtable to satisfy the NPDES permit requirement. Mr. Binger provided explanation and addressed their questions. 6. Roundtable Councilmember Prier asked if there has been any discussion about other cities or counties sharing the cost in relocating Missouri State Highway Patrol, since Troop A covers several counties. Mr. Park, Director of Public Works, advised he was not aware of any conversations in that regard. He added that when the City came to an agreement with the Office of Administration for the relocation of Troop A the City set a cap for its financial contribution. Therefore, any monies above that are the State’s responsibility and Troop A has indicated that it has the funding to relocate. The State is still seeking additional funds for its firing range. Mr. Park informed the Committee that there is a Public Meeting for the M-291 Hwy & US-50 Hwy north interchange and outer road relocation, scheduled for October 3, 2023, 4:30-7:00 p.m., at City Hall Council Chambers. Additionally, Committee members should have received an invite from The Chamber of Commerce to attend the ribbon cutting for the processing facility at the Resource Recovery Park, on September 28, 2023, at 2:00 p.m. Finally, Mr. Park reminded everyone that this week is the Snow Rodeo and there is still opportunity to join. Chairman DeMoro announced that the next Public Works Committee meeting is scheduled for October 9, 2023, at 4:30 p.m. 7. Adjournment The September 11, 2023, Public Works Committee meeting was adjourned by Chairman DeMoro at 5:21 p.m. at City Hall, 220 SE Green Street, City Council Chambers.
