REGULAR MEETING OF THE CITY COUNCIL, APRIL 22, 2013 Meeting was called to order at 7:30 P.M. Attendance was taken by a roll call vote; all members were present except Councillor Marchand. The following COMMUNICATION was received under SUSPENSION OF THE RULES, referred to the FINANCE COMMITTEE and given REGULAR COURSE. Vt. 8 “yeas”. C-108 Relative to the appropriation of $10,000.00 to the Conservation Commission Expense Account; same to be transferred from the Excess and Deficiency Account. The following COMMUNICATION was received with an EMERGENCY PREAMBLE and referred to the LEGAL AFFAIRS COMMITTEE. Vt. 8”yeas”. Upon recommendation of the LEGAL AFFAIRS COMMITTEE the following COMMUNICATION was GRANTED. Vt. 7 “yeas” and 1 “nay”, Councillor Freda opposed. C-109 Dean J. Mazzarella, Mayor: Request the authorization to file a home rule petition to pay a certain unpaid bill for $76,807.36 to S. J. Mullaney Engineering, Inc. for consulting services. AN ACT AUTHORIZING THE CITY OF LEOMINSTER TO PAY A CERTAIN UNPAID BILL Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows: SECTION 1. The comptroller of the city of Leominster may pay from sums appropriated $76,807.36 to S. J. Mullaney engineering, Inc., for consulting services provided to the Leominster City Council in connection with a comprehensive revision of the city’s zoning ordinance, notwithstanding the failure of the city to comply with the laws relative to procurement and competitive bidding in the awarding of the contract. SECTION 2. This act shall take effect upon its passage. /s/ Dean J. Cable TV Advisory Board – Eugene Capoccia – term to expire April 15, 2015 Cultural Commission – Barbara Mahoney – term to expire April 15, 2016 Councillor Robert Salvatelli, Chairman of the Finance Committee, read the Financial Report for the City into the record. Account balances are as follows: Excess and Deficiency Account (Free Cash) $ 2,501,035.00 Stabilization Account $ 12,534,656.65 Upon request of the FINANCE COMMITTEE, the following COMMUNICATION was given FURTHER TIME. Vt. 8 “yeas” The Council requests to have the EMA Director, the Fire Chief and the Police Chief to come down and speak about the Code Red System. C-103 Relative to the appropriation of $13,350.00 to the Emergency Management Agency Expense Account; same to be transferred from the Excess and Deficiency Account. Upon recommendation of the FINANCE COMMITTEE, the following COMMUNICATIONS were GRANTED and ORDERED. Vt. 8 “yeas” C-104 Relative to the appropriation of $60,000.00 to the Gallagher Building Expense Account; same to be transferred from the Gallagher Building Revolving Account. ORDERED: - that the sum of Sixty Thousand Dollars ($60,000.00) be appropriated to the Gallagher Building Expense Account; same to be transferred from the Gallagher Building Revolving Account. 3 REGULAR MEETING OF THE CITY COUNCIL, APRIL 22, 2013, continued C-105 Relative to the appropriation of $2,000.00 to the Personnel Department Expense Account; same to be transferred from the Excess and Deficiency Account. ORDERED: - that the sum of Two Thousand Dollars ($2,000.00) be appropriated to the Personnel Department Expense Account; same to be transferred from the Excess and Deficiency Account. C-106 Relative to the appropriation of $50,000.00 to the Police Department Overtime Account; same to be transferred from the Excess and Deficiency Account. ORDERED: - that the sum of Fifty Thousand Dollars ($50,000.00) be appropriated to the Police Department Overtime Account; same to be transferred from the Excess and Deficiency Account. He said every quarter we test for TTHM’s, which is the byproduct of chlorination. He said levels have been reduced. We are not just meeting the standard of being below the national standard on what the EPA classifies as a potential carcinogen. We are below 80 ppm at individual locations. He said this is a major milestone. We not only met the standards of the past but the new standards also. Councillor Nickel said the President’s Drinking Water Committee that was established by the Past President Councillor Marchand, worked very hard. Councillor Salvatelli, Chair of the FINANCE COMMITTEE, moved that the following COMMUNICATION be removed from the table and placed on the calendar for action. It was so voted. 8/0. Committee reports as follows: C-53 Relative to the appropriation of $50,000.00 to the Building Demolition Expense Account; same to be transferred from the Excess and Deficiency Account.
