REGULAR MEETING OF THE CITY COUNCIL, JULY 22, 2013 Meeting was called to order at 7:33 P.M. Attendance was taken by a roll call vote; all members were present. A recess was called at 7:34 P.M. to discuss the Host Agreement BETWEEN THE City of Leominster and PPE Casino Resorts MA, LLC with Mayor Mazzarella and Attorney Silverstein from the law office of Kopelman & Paige. The meeting reconvened at 8:00 P.M. The Committee on Records reported that the records through July 8, 2013 were examined and found to be in order. The Records were accepted. The following PETITION was received, referred to the LEGAL AFFAIRS COMMITTEE, given REGULAR COURSE and referred to the Police Department Traffic Division. 5-14 Claire Freda: Request that a truck exclusion be authorized by Mass DOT for the residential neighborhoods of Debbie Drive, Beth Avenue, Barry Lane, Jay Avenue, Old Mill Road and the Legate Hill Estates subdivision. The following APPOINTMENTS were received, referred to the WAYS & MEANS COMMITTEE and given REGULAR COURSE. Disability Commission – Paul Mushrush - term to expire April 15, 2016 Leominster Police Department – Permanent Sergeant - John D. Fraher Election Officers for 2013 - 2014 Upon request of the LEGAL AFFAIRS COMMITTEE, the following PETITION was given FURTHER TIME. Vt. 9/0 1-14 Robert Salvatelli: Place a stop sign on the corner of Norfolk Drive and Cumberland Road. Upon request of the LEGAL AFFAIRS COMMITTEE, the following PETITION was given LEAVE TO WITHDRAW WITHOUT PREJUDICE. Vt. 9/0 2-14 Nancy and Raymond Cormier: Place a “No Parking” sign in front of the property adjacent to 12 Roosevelt Avenue. Upon recommendation of the CITY PROPERTY COMMITTEE, the following COMMUNICATION was RATIFIED. Vt. 9/0 C-1 Dean J. Mazzarella, Mayor: Grant an easement to National Grid for the placement of utility lines at the Southeast School located at 95 Viscoloid Avenue (Granted with an Emergency Preamble on July 8, 2013; another vote is required). Upon request of the CITY PROPERTY COMMITTEE, the following COMMUNICATION was given FURTHER TIME. Vt. 9/0. Recommendation letters were read from the Treasurer, the Director of Inspections and the Mayor which are on file in the City Clerk’s office. 3-14 Robert Salvatelli: Review and develop a fee schedule for the Municipal Garage that reflects current costs and maintenance associated with repair of facility. Upon recommendation of the WAYS & MEANS COMMITTEE, the following PETITION was GRANTED. Vt. 9/0 4-14 Susan Chalifoux Zephir: Amend Rule 32 of the City Council’s Rules and Procedures – Order and Committees, by adding to the end of the second sentence “specifically on the petition or communication under consideration by the Council. Furthermore, he/she will not be allowed to interrupt the City Council meeting but will be recognized by the Council President upon the meeting being called to recess.” Upon recommendation of the WAYS & MEANS COMMITTEE, the following request was ADOPTED. Vt. 9 “yeas” Request from PPE Casino Resorts MA to set a date for an election on September 24, 2013 relative to a Category 2 Gaming Facility on Jungle Road. Upon recommendation of the WAYS & MEANS COMMITTEE, the following ELECTION ORDER was given FURTHER TIME. Vt. 9 “yeas”. It was requested by the Council to return the Election Order back to Kopelman & Paige to correct four changes. Election Order- Special Municipal Election – September 24, 2013  2 REGULAR MEETING OF THE CITY COUNCIL, JULY 22, 2013, continued The following ORDINANCE was read once, ADOPTED as presented and ordered published. A hearing was set for August 12, 2013 at 7:00 P.M. Vt. 9 “yeas”. 1st Reading Ordinance- Amend Chapter 21, Section 21-47.4(b) of the Revised Ordinances entitled “Permit- Conditions” by adding conditions 12 and 13 to said section. Under New Business, Councillor Freda said in today’s Banker & Tradesman there was an article “MassDEP Fines N.C. Company $40k For Environmental Violations in Leominster”. She said the spill took place on Nashua Street on March 7, 2011 and the company, South/Win’s was just recently fined. She said she did not know this happened. Other Councillors said they have not heard of it. Councillor Freda suggested the Fire Chief and the Health Director meet with the Council. The article is on file in the City Clerk’s office. In accordance with Section 3.6 of the Leominster City Charter a vote was taken to request the Fire Chief and the Health Director to come down to the Council at the next meeting for an informational meeting regarding the violation. Vt. 9/0 A City Property Committee meeting was scheduled for August 26, 2013 at 6:30 P.M. In accordance with Section 3.6 of the Leominster City Charter a vote was taken to request the Director of Inspections and the Treasurer come down to the City Property Committee meeting on August 26, 2013 at 6:30 P.M. to discuss the parking garage. Vt. 9/0 Councillor Nickel said that he investigated a noise complaint from his Ward and wanted to let the residents know that he spoke with the people at Whitney Mall about the situation and they will be very cautious who they let in for events.
