HEARING BEFORE THE CITY COUNCIL, OCTOBER 26, 2015 Hearing opened at 7:32 P.M. with Councillor Dombrowski, Chair of the LEGAL AFFAIRS COMMITTEE, presiding. All members were present. The following ORDINANCE was the subject of the hearing: Relative to amending Chapter 13, Section 13-34 of the Revised Ordinances entitled “No Parking on Certain Streets” by inserting Academy Road (both sides), from Hall Street for a distance of fifteen feet and Hall Street (north side), for a distance of fifteen feet in each direction from the entrance to Academy Road. (Legal Affairs- Petition 2-16) No one in the audience spoke in favor or in opposition of this Ordinance. No Councillors spoke. The following ORDINANCE was the subject of the hearing: Relative to amending Chapter 13, Section 13-34 of the Revised Ordinances entitled “No Parking on Certain Streets: by inserting Central Place (south side), from Central Street for a distance of one hundred forty-six feet easterly from the intersection with Central Street. (Legal Affairs- Petition 5-16) No one in the audience spoke in favor or in opposition of this Ordinance. No Councillors spoke. Bouchard, City Clerk and Clerk of the City Council 2 REGULAR MEETING OF THE CITY COUNCIL, OCTOBER 26, 2015 Meeting was called to order at 7:30 P.M. Attendance was taken by a roll call vote; all members were present. The Committee on Records reported that the records through October 13, 2015 were examined and found to be in order. The records were accepted. A recess was called at 7:31 P.M. for the public hearings and to hold a public forum. Meeting reconvened at 7:34 P.M. The following COMMUNICATION was received, referred to the LEGAL AFFAIRS COMMITTEE, given REGULAR COURSE and referred to the Comptroller, the Emergency Management Director, the Purchasing Agent and the Director of Inspections. C-20 Dean J. Mazzarella, Mayor: Request the City Council authorize the Mayor, on behalf of the City, to petition the Massachusetts General Court for special legislation, to make payment on a certain unpaid bill to D-E Corporation. In accordance with Section 3.6 of the Leominster City Charter a vote was taken to request Charlie Coggins and Jim LeBlanc to come to the next meeting regarding C-20. Vt. 9/0 The following PETITION was received, referred to the WAYS & MEANS AND VETERANS AFFAIRS COMMITTEE, given REGULAR COURSE and referred to the Mayor, the Personnel Director and the Comptroller. 8-16 Raymond Racine: Modify Chapter 16, Section 16-32 of the General Ordinances of the City of Leominster by changing the classification of Engineer – Senior to an S-8, and the Public Works Assistant Director to an S-9. In accordance with Section 3.6 of the Leominster City Charter a vote was taken to request Ray Racine to come to the next meeting regarding Petition 8-16. Vt. 9/0 The following PETITION was received, referred to the CITY PROPERTY & PROPERTY OVERSIGHT COMMITTEE, given REGULAR COURSE and referred to Fire Department and the Police Department. 9-16 Richard Marchand, Festival Facilitator: Request the closing of West Street from the intersection of Cottage Street to Main Street, the closing of Park Street at the intersection of Main Street, the closing of Church Street but maintain public safety access. Allow the use of the City Hall parking lot, the parking lot adjacent to City Hall on West Street, the use of the City portion of the parking lot between the First Church Unitarian and the First Baptist Church for handicap parking for the 23rd Annual Johnny Appleseed Arts and Cultural Festival on September 24, 2016 with a rain date of October 1, 2016. Councillor Cormier, Chairman of the Finance Committee, read the Financial Report for the City into the record. Account balances are as follows: Stabilization Account $12,572,665.00 Emergency Reserve $ 100,000.00 Upon recommendation of the FINANCE COMMITTEE, the following COMMUNICATION was RATIFIED. Vt. 7 “yeas” and 2 “nays”, Councillors Nickel and Salvatelli opposed. (Granted with an Emergency Preamble on October 13, 2015; another vote was required.) C-18 Relative to the appropriation of $38,879.31 to the Police Salary & Wages Account; same to be transferred from the Police Salary & Wages Account. Upon recommendation of the FINANCE COMMITTEE, the following COMMUNICATION was GRANTED and ORDERED. Vt. 9 “yeas” C-19 Relative to the appropriation of $60,000.00 to the Police Department Expense Account; same to be transferred from the Stabilization Fund. ORDERED: that the sum of $60,000.00 be appropriated to the Police Department Expense Account; same to be transferred from the Stabilization Fund. RE: Bullet proof vests. Reimbursement from State and Federal Grants Upon recommendation of the WAYS & MEANS AND VETERANS AFFAIRS COMMITTEE, the following APPOINTMENTS were CONFIRMED. St. Laurant, Karen Tata and Ralph Sacramone 3 REGULAR MEETING OF THE CITY COUNCIL, OCTOBER 26, 2015, continued The following LOAN ORDER was read a second time, ADOPTED as presented and passed to be ordained. CITY OF LEOMINSTER LOAN ORDER 1st Reading Loan Order: October 13, 2015 2nd Reading Loan Order: October 26, 2015 BE IT ORDERED: - that the sum of Two Million Dollars ($2,000,000.00) for the purpose to pay costs of the repair and upgrade of the Morse Dam and the Pond Street Pump Station, including the payment of costs incidental or related thereto; that to raise this appropriation, the Treasurer, with the approval of the Mayor, is authorized to borrow said amount under and pursuant to Chapter 44, Section 7 or 8 of the General Laws, and amended, or pursuant to any other enabling authority, and to issue and sell bonds or notes of the City therefore. CITY OF LEOMINSTER LOAN ORDER 1st Reading Loan Order: October 13, 2015 2nd Reading Loan Order October 26, 2015 BE IT ORDERED: - that the sum of One Million Five Hundred Thousand Dollars ($1,500,000.00) for the purpose to pay costs of converting City streetlights to LED, including the payment of costs incidental or related thereto; that to raise this appropriation, the Treasurer, with the approval of the Mayor, is authorized to borrow said amount under and pursuant to Chapter 44, Section 7 of the General Laws, as amended, or pursuant to any other enabling authority, and to issue and sell bonds or notes of the City therefore. CITY OF LEOMINSTER LOAN ORDER 1st Reading Loan Order: October 13, 2015 2nd Reading Loan Order: October 26, 2015 ORDERED: - that that in order to reduce interest costs, the Treasurer, with the approval of the Mayor, is authorized to issue refunding bonds, at one time or from time to time, pursuant to Chapter 44, Section 21A of the General Laws, or pursuant to any other enabling authority, to refund all or any portion of the City’s general obligation bonds outstanding as of the date of adoption of this order and that the proceeds of any refunding bonds issued pursuant to this vote shall be used to pay the principal, redemption premium and interest on the bonds of the City to be refunded, and costs of issuance of the refunding bonds; and that the Treasurer is authorized to execute such documents as may be necessary or desirable to carry out this transaction, including one or more refunding trust agreements with a bank or trust company. 4 REGULAR MEETING OF THE CITY COUNCIL, OCTOBER 26, 2015, continued APPROVED-MAYOR 1st Reading: /s/ Dean J. Vt. 9 “yeas” THE CITY OF LEOMINSTER In the year two thousand and fifteen AN ORDINANCE Amending Chapter 22 of the Revised Ordinances, entitled “Zoning.” Be it ordained by the City Council of the City of Leominster, as follows: Chapter 22 of the Revised Ordinances, entitled “Zoning,” Article I, Section 22-10, Recorded Lots, is hereby amended by deleting the word “vacant” from Section 22-10.1.1. ______________________ The following ORDINANCE was read a second time, ADOPTED as presented and passed to be ordained. Vt. 9 “yeas” THE CITY OF LEOMINSTER In the year two thousand and fifteen AN ORDINANCE Amending Chapter 13 of the Revised Ordinances entitled “Motor Vehicles and Traffic.” Be it ordained by the City Council of the City of Leominster, as follows: Chapter 13, Section 13-34 of the Revised Ordinances entitled “No Parking on Certain Streets” is hereby amended by inserting the following phrase: Academy Road (both sides), from Hall Street for a distance of fifteen feet. Hall Street (north side), for a distance of fifteen feet in each direction from the entrance to Academy Road. ___________________________ The following ORDINANCE was read a second time, ADOPTED as presented and passed to be ordained.
