Angelini MINUTES CITY OF LEOMINSTER CITY COUNCIL NOVEMBER 12, 2024 JOHN P. MAHAN CITY COUNCIL CHAMBERS WAYS AND MEANS COMMITTEE, 6:00 PM. APPOINTMENT C-19 Dean J. Mazzarella, Mayor; Request the confirmation of the permanent appointment of Ryan Malatos to the position of Chief of Police for the City of Leominster. I certify that said person is qualified to perform the duties which will be required, and I make designation solely in the interest of the City of Leominster. (Ways & Means Committee; Regular Course; 10/28/2024; continued 11/12/2024; at 6;00 PM; Majority Vote) The public hearing opened at 6:00 PM. Councillor Pauline Cormier read the appointment, welcomed Chief Malatos and began the interview. Acting Chief Ryan Malatos provided the City Council with an overview of his experience on the Police Force in Leominster. He informed the Council that he has been part of the Leominster Police Department since November of 2002. Acting Chief explained that he has held the positions of Patrolman, Sergeant, Lieutenant, Captain and now acting Chief. Family is here in Leominster.Acting Chief Malatos expained that his focus will be on the policies and procedures of the Police Force to unsure the best practices for modern day law enforcement. Goal is to 100%, now we are at 19% done. Councillor Ardinger asked, what do you see as your your biggest challenge in the next five years? Acting Chief Malatos answered that he would like to be fully staffed to be able to be focused on serving the needs of the community better. Councillor Ardinger asked how staffing was now. Acting Chief Malatos replied that they are hiring 4 officers right now and awaiting one more in the academy. Acting Chief Malatos stated that he would like to be fully staffed by the end of next year. Acting Chief Malatos also added he would like to focus on officer wellness. Councillor David Cormier commented that Leominster couldn’t have a better candidate for Chief. Councillor Cormier also added that he is happy that someone was promoted from within. Councillor Tocci asked Acting Chief Malatos what he does for hobbies. Acting Chief Malatos replied that he enjoys time with his family, sports, the outdoors, New England sports especially. Councillor Chalifoux-Zephir commented how nice it is to see Acting Chief Malatos’ family there and in support of him as well members of the department. Councillor Chalifoux -Zephir asked Acting Chief Malatos to elaborate about changes in the police force over the past 20 years and how any short term changes may effect the police department. Acting Chief Malatos stated the number one change is the us of body cams and of de-escalation tactics. The body cameras are an extremely useful tool to the officers and the public. They give a full, live transparency of what happened for a jury and the officers like wearing them. Councillor Chailifoux-Zerphir agreed with Acting Chief Malatos. Councillor Chaifoux-Zephir also agreed that Acting Chief Malatos is the most qualified candidate for the position. Councillor Bodanza expressed his agreement with the Mayor’s appointment of Chief Malatos. Mayor Mazzarella commented that the police department is completely different these days. The people in the department are completely different. Mayor Mazzarella also stated that Leominster has seemed to capture the most compassionate and caring people in the police department. Mayor Mazzarella commented on the police forces de-escalation tactics and how things have changed. Mayor Mazzarella commented these are a special group of people. Mayor Mazzarella state that this a special time in the City’s history when it comes to law enforcement. Page 2  Councillor Freda reflected on the past when the Acting Chief was brought to be Sergeant and then Lieutenant. Councillor Freda mentioned that she is looking forward to the police department having the spark they need to bring everyone together. Counillor Freda agrees Acting Chief Malatos is the right person for the job and wishes well for him. Councillor Robbins stated that the leader Acting Chief Malatos already is speaks volumes. Councillor Robbbins expressed his excitement for the appointment. Councillor Angelini congratulated the Acting Chief on his appointment. Councillor Pauline Cormier added that there is no greater calling than to come back & serve the community you grew up in. The interview was closed at 6:17PM. CITY PROPERTY,PUBLIC HEARING AT 6:10 P.M. 14-25 Thomas F. Ardinger, Councillor At-Large; On behalf of the petitioners’ bellow request a sidewalk on the easterly side of Howard St between Lancaster St and Florence St. (City Property Committee; Regular Course; October 15, 2024; Public Hearing November 12, 2024; at 6:10 P.M.; 2/3 Majority Vote) Councillor Ardinger asked three times if anyone wished to speak in favor or in opposition of the petition. No one spoke. Councilloor Freda stated this item does not belong on City Council agenda,the council has no authority. Councillor Freda also stated a conversation with the Mayor would have been the way to go. Councillor Ardinger close the hearing at 6:18PM. Page 3 PUBLIC SAFETY COMMITTEE, PUBLIC HEARING, 6:30 P.M. continued 11-25 Claire Freda, Councillor At-Large; Request on behalf of Paul and Lisa Gove of Gove Farm. Establish a 25 or 30 MPH Speed Zone on Mechanic St from the Bridge at Johnny Ro Park to the Lancaster Town Line. Speed to be determined by the Leominster Traffic Department within the Police Department. Councillor Chailfoux-Zephir read the petition into the record. Concillor Chalifoux-Zephir asked Sergant Robichaud to explain his findings from the research he did on the area. Sergant Robichaud explained the study given to all the councillors is the traffic pattern of one way traffic, going up the hill only toward Gove Farm. Sergeant Robichaud explained the diffrrence between the equipment he used to measure the traffic. Sergeant Robichaud stated that in two weeks approximately 72,000 vehicles went through that area in one direction. Sergeant also stated the average speed was 34.1 mph. Sergeant Robichaud state that if the Mass DOT did a study of the area they speed limit would likely go up to 40mph based on the data. Sergeant Robichaud concluded that people will drive the speed limit most of the time. Sergant Robichaud stated that according to his research on the state’s website , lowering the speed limit is only allowed if the area is zoned as thickly settled or a business district. Councillor Chailfoux-Zephir stated that the City Council has made changes to several streets, all thickly settled areas , all to 25 miles per hour. Councillor Chailifoux-Zephir asked if qualifying the area where Goves Farm is to a business zone might be one way to lower the speed limit. Sergeant Robichaud stated that he would have to see what the statutory definition is to be a business district. Sergeant Robichaid said he would have to do some research. Councillor Chalifox-Zephir asked Sergeant Robichaud if his recommendation in the near term would be a more permanent sign? Sergeant Robichaud agreed. Counncilor Angelini asked Sergeant Robichaud out of 93, 000 vehicles , is 600 a high number? Sergeant Robichaud replied yes it is high. Page 4 PUBLIC SAFETY COMMITTEE, PUBLIC HEARING,cont’d Councillor Freda stated that the premise for this conversation from the beginning was Gove Farm was worried about someone getting seriously hurt or killed in that area. Councillor Freda stated that anything we can do, we should. Councillor Freda also thanked Sergeant Robichaud for all his hard work and research. Councillor David Cormier expressed that some of the speeds in the research are very excessive. Concillor Cormier wonders if the sign wasn’t there if speeds would be even worse. Councillor Cormier expressed his appreciation for all the data that was given. Councillor Chalifoux-Zephir stated she is glad the data was provided. Councillor Chalifoux-Zephir also added that we can now see what Gove Farm sees every day in that area. Councilor Chalifoux-Zephir recommended keeping the hearing open. John Gove , 925 Mechanic Street, stated the signs have worked and expressed his gratitude. Councillor Chalifox-Zephir recommended to keep the public hearing open. LEGAL AFFAIRS, PUBLIC HEARING, 6:50 P.M. 10-25 Peter A. Campobasso, Esquire; On behalf of Five SAC Self-Storage Corporation; Request to amend Section 22-17, Underlying Districts Table of Uses, of the Leominster Zoning Ordinance, under the Business Uses Table of Uses in the Multi-Use 1, MU1, Underlying Zoning District and change the Self-storage facility use from “N, No, not allowed” to either “Y, allowed by right” or SPPB, Planning Board Special Permit required”. According to the Leominster Zoning Ordinance, Self- storage in categorized as a Business Use but is only allowed in the Industrial Zoning District. Councillor Peter Angelini read the petition into the record. Peter Campabasso, 3 Clark Street, Mathew Pepin & Josh Alexander of U-Haul Self Storage were present. Councillor Angelini asked for a site plan. Peter Campabasso replied that his client is not at that stage yet. Page 5 LEGAL AFFAIRS, PUBLIC HEARING, cont’d Councillor Tocci asked if there are current truck rentals at the property. Councillor Pauline Cormier expressed her concern about no site plan but asked for an idea of what they want to do there. Peter Campabasso’s team responded it will be just self storage that will be monitored from across the street. Councillor Pauline Cormier expressed her concern for about entrances to the facility due to traffic in that area. Councillor Cormier also asked if it will be just storage. Councillor Bodanza asked how many units & new jobs will this building create. Peter Campabasso’s team said about 600 units and around maybe 10 jobs. Those jobs would be housekeepers, custodians, on site assistant manager. Councillor Freda stated she is the one who asked about the site plan . There is a lot of traffic coming from the mall as it is. Peter Campabasso stated that the storage floor plan that they distributed will show the plan style. Councillor Chalifoux-Zephir asked if the Central Street location would be closing and have all the business now go to this location or have all three locations. Peter Campabasso replied all 3 locations would be open for business. Councillor Chalifoux-Zephir asked about the square footage of the building. Peter Campabasso state they are trying to present this project as a business type use. Peter Campabasso also stated that all these issues tonight will need to be raised before the planning board. The request of the council is to allow this type of use in this district not so much the building yet. Councillor Robbins asked if access to this building would be 24 hour access or will it be set business hours. Councillor Robbins also asked about how many vehicles. Peter Campabasso stated that the study they provided on other facilities was about 31 trips per day and weekends 53 trips per day. Page 6 LEGAL AFFAIRS, PUBLIC HEARING, cont’d Councillor Ardinger expressed concern about the traffic issues and how now it is already a mess. Councillor Ardinger asked if they could use any space across the street or even at the Central Street location. Peter Campabasso stated that self storage has relly changed over the years. Councillor Ardinger stated that they knew when the property was purchased that this type of usage was not allowed. Peter Campabasso replied yes. Peter Campabasso stated the tax revenues would be rather considerable for this property. Councillor Pauline Cormier commented that is easier to get a conceptual picture to be able to understand this is a zoning issue first. Councillor Angelini asked if anyone member of the public would like to speak in favor of or in opposition to this petition. John Souza, 347 Prospect Street, Chairman of the Planning Board stated he and a few others form the Planning Board did a site walk of the area tot see if this MU1 use should be excepted. Mr.Souza stated that of all the sites this is the site it woud be least excepted at. No one else from the public spoke. Councillor Angelini closed the petition. PUBLIC FORUM, 6:55 P.M. OLD BUSINESS Second Reading of an Ordinance 7-25 Elizabeth Wood, On behalf of Planning Board; Request to Amend the zoning ordinance pertaining to Upper Story Dwelling Units. (see attached) (Legal Affairs Committee; Regular Course 08/26/2024; Public Hearing September 23, 2024; continued October 15, 2024, at 6:40 PM; 2/3 Majority Vote) The Legal Affairs Committee recommended that the City Council ADOPT the second reading of the ordinance. COMMUNITY CALENDAR Councillor Ardinger – November 24, 2024 at 8:00AM The Roatry Club Fitchburg is holding their annual breakfast for the bands at Leominster High School. If interested , tickets can be purchased at the High School , through a band member or in the Mayor’s office. Councillor David Cormier stated that there will be a meeting on site visit at 200 Tanzio Road on November 13, 2024 at 4:00PM. A follow up meeting will will be held at the Franco American War Veterans Hall at 300 Water Street at 6:00PM. Councillor Freda inquired if there were any KP Law invoices. President Bodanza shared that he will be at the Leominster Historical Society on November 19, 2024 at 7:00PM presenting his new book, Enlightenment and Enchantment, Two men who shaped American culture.
