MAHAN CITY COUNCIL CHAMBERS LEGAL AFFAIRS, PUBLIC HEARING, 03/24/2025, 6:30 P.M. 29-25 Elizabeth Wood, On behalf of the Planning Board Request to amend the zoning ordinance pertaining to the Flood Plain. Federally mandated update to Flood Plain District (EP): Article VI, Section 22-34. Hearing opened at 6:33 P.M. with Councillor Angelini, Chair of the LEGAL AFFAIRS COMMITTEE, presiding. All members were present. Councillor Angelini stated he will keep this public hearing open and will be looking for further time when this comes up later this evening on our agenda. PUBLIC SAFETY AND TRAFFIC, PUBLIC HEARING, 3/24/2025, 6:40 P.M. 32-25 Susan Chalifoux Zephir, City Councillor At-Large: Request the installation of two poles for placement of permanent speed feedback signs on Mechanic St. at approximately the same location as the temporary speed feedback trailer previously place by the Leominster Police Department on Mechanic St. Location to be determined by the Leominster Police Department and DPW. Hearing opened at 6:40 P.M. with Councillor Chalifoux-Zephir, Chair of the PUBLIC SAFETY AND TRAFFIC COMMITTEE, presiding. All members were present. PUBLIC SAFETY AND TRAFFIC, cont’d Councillor Chalifoux-Zephir stated that this petition addresses the ongoing concern that people have expressed to the City Council about traffic on Mechanic Street specifically the hill that leads up to Gove Farm. Councillor Chalifoux-Zephir read into the record a referral both from the Leominster Police Department and from the DPW which both support the petition. Councillor Chalifoux – Zephir stated that the plan at this point is to put in two feedback speed signs, one heading up the hill and one heading down the hill. Councillor Freda stated that she certainly agrees with putting the poles up. Councillor Freda also stated that it was interesting that after her petition was put in, that there was so much police activity up in that area, yet it was determined there wasn't really a need for a speed study due to the police not being able to determine a lot of speed activity. Councillor Freda also said that from speaking with people over the past couple months , there is a traffic issue there and that there is some confusion. Councillor Freda thinks the Council should push to have a traffic study done , it certainly would be a be step in the right direction. Councillor Chalifoux-Zephir stated that the data that Sgt. Robichaud shared proved to her that there was a problem. Councillor Chalifoux-Zephir also said that putting these two signs going in opposite directions, which she thinks will help ascertain and continue to monitor the traffic in that area. Councillor Chalifoux-Zephir asked the public if anyone wanted to speak in favor of or in opposition to this petition. The following people spoke in favor of the petition: Christina Marrama -549 Mechanic St, Jayce Connor -147 Appleseed Lane, Robin Dowling-29 Fifth Ave, Rosemary Kirousis-7 Southers Crossing, Phillip Valeri-639 Mechanic Street. Paul Gove-95 Mechanic St. Sgt. Robichaud did share the idea of speed tables. They are removable, they are not speed bumps. He did reach out for some quotes on what that would cost the city, however, has not received any back. Sgt. Robichaud explained that these tables are made from some sort of recycled rubber. He also said that he believes other New England states have used them as well as Rhode Island. Councillor Chalifoux-Zephir asked Sgt. Robichaud if he is aware of any proposed traffic study or a thorough analysis of that area. Sgt. Robichaud replied no. He also said he has had discussions with the Montachusett Regional Planning Board and was told they could propose a traffic study. Page 2 PUBLIC SAFETY AND TRAFFIC, cont’d Councillor Freda added that these tables are certainly a step in the right direction. However, she feels they should still push for a traffic study in 2025 not wait until 2026. Councillor Chalifoux -Zephir closed the public hearing at 7:06PM. PUBLIC FORUM, 6:55 P.M. Any tract of land where horses or dogs are raced and where any form of betting or wagering on the speed or ability of horses or dogs are permitted or conducted." Amend Article III. LEGAL AFFAIRS Re: Appointment of a Special Legal Affairs Committee for Communication C-50 At the last City Council hearing, it was determined that Council President Mark Bodanza must recuse himself from presiding over matters related to Communication C-50. Additionally, Legal Affairs Chair, Peter Angelini and Legal Affairs Clerk Robert Tocci have conflicts and must recuse themselves from any involvement in this matter. As the current Vice President, I will serve as Acting President for all proceedings related to C-50. Given that I am the only remaining member of the Legal Affairs Committee, and to ensure compliance with Open Meeting Laws and quorum requirements, I sought and received legal guidance from KP Law. PUBLIC SAFETY 32-25 Susan Chalifoux Zephir, City Councillor At-Large: Request the installation of two poles for placement of permanent speed feedback signs on Mechanic St. at approximately the same location as the temporary speed feedback trailer previously place by the Leominster Police Department on Mechanic St. Location to be determined by the Leominster Police Department and DPW. The Public Safety Committee recommended that the City Council GRANT the petition. By a vote of 9-0 the petition was GRANTED. XIII. NEW BUSINESS Page 17 XIV. OLD BUSINESS Councillor Chalifoux-Zephir recalled that when scheduling the hearing date for petition 41-25, that May 15th is a Thursday, which will not work. Councillor Chalifoux – Zephir also stated that she has a note stating that the first time the Planning Board would have a chance to look at this petition would be at their May 5th meeting. Councillor Chalifoux – Zephir asked if the Planning Board said that they cannot have this on their April 7th agenda. President Bodanza assured Councillor Chalifoux – Zephir that May 5th was the first possible date that Stephanie Whitten from Planning said they can hear it due to advertising that they must put out. President Bodanza said that the City Council needs to change our date from May 15th to May 12th. A vote was taken to change the public hearing from May 15, 2025, to May 12, 2025, at 6:30pm. By a vote of 9-0 , the hearing was rescheduled. XV. COMMUNITY CALENDAR Councillor Claire Freda asked why the City Council received a petition in January about having a petition put on the agenda about the Fallbrook School Project, why wasn’t it put on sooner and why did we wait until a presentation was done and then tie it in without more public knowledge to the meals tax. They are two separate items. Councillor Freda also stated that when something comes to the City Council, it comes to the City Council not just the City Council President. The Council President makes the decision whether something gets on the agenda. Councillor Freda also said, however, if something is addressed to the City Council, it should be provided to all of us. Councillor Freda formally requested that when the City Council gets any information, it comes to all of us. President Bodanza stated that coordination with the school committee in that request to come down here was not communicated to the mayor. President Bodanza suggested that the mayor being the chief executive of the city should be involved. President Bodanza also stated that the gentleman from Left Field, Mr. DiCarlo asked me to contact the mayor and coordinate it with the mayor and that is what he did. Councillor Freda asked President Bodanza if he should have communicated that to the City Council and said that we were requested to have an update on this project in January and that you wanted to hold off until the mayor could bring it in. Councillor Freda Page 18  expressed her concern about finding things out on the street from people instead of knowing ahead of time. COMMUNITY CALENDAR, cont’d Councillor Chalifoux-Zephir asked why would the school department have had to send a petition to schedule a meeting with the city council in petition form? President Bodanza stated that that the Mayor was not included in the communication so President Bodanza informed Mr. DiCarlo that he thought he should have the mayor involved. He agreed and asked President Bodanza to coordinate it with the mayor, so that is what President Bodanza did. Councillor Chalifoux-Zephir stated that she agrees with Councillor Freda, anything that comes to the city council and the city clerk's office should be distributed to everybody on the city council. City Clerk, Elizabeth Doiron assured the Council on the record it was her instruction when she became City Clerk for the City of Leominster that when we get something that needs to go to the city council, if it is a petition it goes to the city council president for him to decide if that petition gets onto the agenda. If anything is given to Maribel, the Assistant City Clerk, follows course that she always has but if that changes, we certainly will do anything that we are asked to do. Councillor Freda stated that this is not looking at you, the City Clerk, this is something that's been happening for a long time. We don't get information that comes to us, that's not a city council president prerogative when information comes to the city council. Councillor Freda added that it is the Council President’s prerogative to put it on the agenda and to determine when it goes on the agenda. However, Councillor Freda stated that it is not the President’s prerogative if we get mail that came into the office for the city council to consider if it goes to all of us or not. President Bodanza stated that he has never for a second suggested to the clerk's office not to distribute a document that came to the city council or to me even personally never. Councillor Freda stated that however it is not getting to us it needs to start getting to us. Councillor Bodanza replied that he has no difficulty with that. President Bodanza continued to add that he was explaining why that meeting did not happen in January, which was one specific item, so he responded to it. Page 19 XVI.
