Angelini MINUTES CITY OF LEOMINSTER CITY COUNCIL APRIL 14 , 2025 JOHN P. MAHAN CITY COUNCIL CHAMBERS WAYS AND MEANS INTERVIEW, 6:10 P.M. APPOINTMENT C-53 Dean J. Mazzarella, Mayor; Request the appointment of the following: Board of Assessors – term to expire 4/15/2028 Steve Spagnuolo 25 Sharimar Drive Leominster, MA Rick Dondero , Steve Spagnuolo, and Rena Gagne were present. The interview began at 6:18pm. Councillor Pauline Cormier opened the interview and asked Mr. Spagnuolo to give the council some background information about himself. Mr. Spagnuolo stated that he has been a certified real estate appraiser for 22 years and has appraised over 6,000 properties across Massachusetts. He has been a resident of Leominster for 20 years. Mr. Spagnuolo has taken a course called MAAO Course 200 (a second-level course)however he has no formal assessing background at the time. Mr. Spagnuolo has been considering the assessing field for 15+ years and has ramped up preparation in the past 2 years for a position of this nature. Mr. Spagnuolo also stated that his goal is to earn a designation from the Massachusetts Association of Assessing Officers within 2 years. Councillor Pauline Cormier asked Mr. Spagnuolo if he is tech savvy, with all things being computers now. Mr. Spagnuolo answered that he is very familiar and comfortable with computers. Councillor Ardinger stated that he believes Mr. Ardinger is very well qualified for this position. Councillor also added that he was impressed with how Mr. Spagnuolo set his goals ahead of time. Councilor David Cormier stated that he is very impressed by Mr. Spagnuolo’s resume. Councillor David Cormier asked Mr. Spagnuolo how some of these certifications might differ from what you've done previously to what you need to do going forward. Mr. Spagnuolo explained that it will be assessment administration mostly, the basic principles of evaluation I feel as I have known had that for two decades or more. It is more or less learning the ins and outs of the inner workings of offices and budgets and the paperwork involved. However, I have good help both in and out of city hall if I need it. Councillor David Cormier wished Mr. Spagnuolo all the best and, if confirmed, looks forward to working with Mr. Spagnuolo. Councillor Freda stated that she is familiar with Mr. Spagnuolo, they are fellow appraisers. Councillor Freda stated that Mr. Spagnuolo would be a great addition to the team. Councillor Freda speaks in high support of Mr. Spagnuolo’s appointment. Councillor Pauline Cormier closed the interview at 6:35pm. PUBLIC HEARING, 6:20 P.M. 29-25 Elizabeth Wood, On behalf of the Planning Board Request to amend the zoning ordinance pertaining to the Flood Plain. Federally mandated update to Flood Plain District (EP): Article VI, Section 22-34. Hearing opened at 6:35 P.M. with Councillor Tocci, in Peter Angelini, Chair of the Legal Affairs Committee’s absence. Third member , Councillor Pauline Cormier was present. Councillor Tocci read the petition into the record and stated that we have the ordinance created. Councillor Bodanza added that the city solicitor has approved the form of the ordinance as well as Katie Paight from DCR. Councillor Pauline Cormier recommended that they close the public hearing, Councillor Tocci agreed. The public hearing was closed at 6:40pm. Page 2 PUBLIC HEARING, 6:30 P.M. 24-25 Thomas M. Bovenzi, Esq. on behalf of Steve Boucher, requests to amend the Zoning District map for Parcel 352-6 such that entire parcel will be zoned Residence B. Since a portion is currently zoned Industrial. Hearing opened at 6:41 P.M. Hearing opened at 6:35 P.M. with Councillor Tocci, in Peter Angelini, Chair of the Legal Affairs Committee’s absence. Third member , Councillor Pauline Cormier was present. Thomas Bovenzi , Steve Boucher and Elizabeth Bovenzi were present. Attorney Thomas Bovenzi stated that all the tax liens on the property have been paid off. Attorney Bovenzi also stated that the final asbestos is being removed at this time. He also stated that his client’s intention is to build residential on that site. A handout was passed out showing the site. Attorney Bovenzi explained that the majority of the site is zoned residential. Councillor Pauline Cormier asked Attorney Bovenzi if there was a portion of the building that caved in at one point? Steve Boucher explained that there was a caved in part, however the part that was removed was a lot of the asbestos roofing. Councillor Pauline Cormier asked how long you would expect a project of this sort to take. Steve Boucher replied that to raise the building would take approximately two to two and a half weeks from start to finish. Councillor Pauline Cormier asked Mr. Boucher if he could give the Council any idea what they are looking to do. Mr. Boucher stated that they are still with engineering with that and have not determined what to do there yet. Councillor Pauline Cormier asked if there was any way likelihood that there would be anything industrial going into that building? Mr. Boucher stated no, and that the building is too far beyond its life. Councillor Tocci closed the public hearing at 6:44pm. Page 3 PUBLIC HEARING, 6:45 P.M. 35-25 Kenneth Delgado, 8 Highland Street, Lancaster, MA; Request to amend the current lot width under zoning district RB for two family dwellings. The amendment would consist of changing the minimum required width from 80 ft to 50 ft for two family dwellings. The current frontage requirement for two family dwellings in RB is 50’ and 80’ lot width requirement would create “Pork Chop” lots, which the city does not favor. Lot configuration would be rectangular and consistent if both frontage and lot width were equal. Re: 1420, 1426, 1428, 1432 Central Street, Leominster, MA. Hearing opened at 6:45 P.M Councillor Bodanza opened the hearing by stating that the council is missing one of the referrals requested from the building inspector. Councillor Bodanza also stated that the Planning Board did send back their referral with a 6/1 recommendation. Councillor Tocci, Councillor Pauline Cormier were present, Chair of LEGAL AFFAIRS COMMITTEE, Peter Angelini was absent. Councillor Tocci read the petition into the record. The Legal Affairs Committee recommended that the City Council give the petition FURTHER TIME By a vote of 9-0 the petition was given FURTHER TIME. Councillor Robbins asked through the Chair to the Clerk if all 10 registered voter signatures are required and one of them reads, does not live in Leominster, does this petition have the required 10 registered signatures it needs? LEGAL AFFAIRS Re: Appointment of a Special Legal Affairs Committee for Communication C-50 At the last City Council hearing, it was determined that Council President Mark Bodanza must recuse himself from presiding over matters related to Communication C-50. Additionally, Legal Affairs Chairman Peter Angelini and Legal Affairs Clerk Robert Tocci have conflicts and must recuse themselves from any involvement in this matter. As the current Vice President, I will serve as Acting President for all proceedings related to C- 50. Given that I am the only remaining member of the Legal Affairs Committee, and to ensure compliance with Open Meeting Laws and quorum requirements, I sought and received legal guidance from KP Law. After reviewing City Council Rule 4, which authorizes the President to appoint special committees for specific matters, I am appointing a Special Legal Affairs Committee for the limited purpose of addressing the special permit issued to Middlesex Integrative Medicine at 25 Mohawk Drive and any related matters.
