LIBERTY HILL CITY COUNCIL REGULAR MEETING MONDAY – SEPTEMBER 9, 2019 - 6:30 PM Location: 2801 Ranch Road 1869 – Liberty Hill Rick Hall – Mayor Liz Rundzieher – Mayor Pro Tem Kathy Canady – Councilmember Steve McIntosh – Councilmember Tony DeYoung – Councilmember Gram Lankford – Councilmember Notice is hereby given that a Regular Meeting of the City Council of Liberty Hill will be held MONDAY – SEPTEMBER 9, 2019 - 6:30 PM at 2801 Ranch Road 1869 (Council Chambers) to consider items as follows. All items are subject to action. 1) CALL TO ORDER a) Call to Order b) Establish Quorum c) Invocation d) Pledge of Allegiance - “I pledge allegiance to the Flag of the United States of America, and to the Republic for which it stands, one Nation under God, indivisible, with Liberty and Justice for all.” e) Texas Pledge - "Honor the Texas flag; I pledge allegiance to thee, Texas, one state under God, one and indivisible." 2) PUBLIC COMMENTS Liberty Hill City Council accepts public comments regarding the Agenda of Regular Council meetings and Public Hearings. Individuals wishing to speak may sign in by completing a Public Comment Form and presenting the form to the City Secretary prior to the start of the meeting. Each citizen is limited to a maximum of three (3) minutes. Public Comment period will last no longer than a total of fifteen (15) minutes. a) Public Comments 3) REPORTS TO CITY COUNCIL PUBLIC WORKS Review of monthly statistics and activities for the Public Works Department by Director Wayne Bonnet for period ending August 31, 2019: new meter installation; EID; water / WW connects; water / WW routine maintenance; water well maintenance; update on South Fork WWTP; update on WWTP expansion project and street maintenance. There will be no separate discussion of those items unless requested by Council, in which event the item(s) will be removed from the Consent Agenda and considered under Regular Agenda items: a) Discuss and Take Action on approving minutes of the Regular City Council meeting Monday – August 26, 2019 and minutes of the Special City Council meeting held Friday – August 30, 2019 (Attachments). b) Discuss and Consider the approval of the Estates of Liberty Hill Expansion Site Plan located at 190 North Hwy 183 in the City of Liberty Hill City Limits. By: Sally McFeron – Director of Planning c) Discuss and Consider the approval of the Liberty Hill St. Joseph Subdivision Lot 3 Site Development Plan located at 201 St. Joseph Court in the City of Liberty Hill City Limits. By: Sally McFeron – Director of Planning d) Discuss and Consider the Planning and Zoning recommendation for the approval of the Highland Meadows 3A Final Plat located at CR 266 and State Highway 29 in the ETJ of the City of Liberty Hill. By: Sally McFeron – Director of Planning e) Discuss and Consider the Planning and Zoning recommendation for the approval of the Highland Meadows 3C Final Plat located at CR 266 and State Highway 29 in the ETJ of the City of Liberty Hill. By: Sally McFeron – Director of Planning 5) REGULAR AGENDA a) Discuss and Consider a recommendation to City Council by the Liberty Hill Economic Development Corporation to approve Resolution (#19-R-52) adopting the Liberty Hill Economic Development Corporation Budget for Fiscal Year 2019 - 2020; funding Liberty Hill Economic Development Corporation; authorizing; expenditures; providing for findings of fact; enactment; filing of budget; repealer; severability; effective date; and proper notice and meeting (Attachment). By: Rick Hall – Mayor & Liz Rundzieher – Mayor Pro Tem (Requires 60% Quorum) September 9, 2019 2 City Council Regular Meeting b) Discuss and Consider an Ordinance (#19-O-53) of the City Council of the City of Liberty Hill, making appropriations for the support of City services for the Fiscal Year Beginning October 1, 2019 and ending September 30, 2020 appropriating money to a sinking fund to pay principal and interest on the City’s indebtedness; and enacting the Municipal Budget as presented for Fiscal Year 2019 - 2020; providing authorization of City Staff salaries as outlined in said Budget; providing for new Staff positions to include immediate advertising for positions and with no start date before October 1, 2019; providing authorization to pre-order City vehicles with scheduled delivery to be made after October 1, 2019; providing for findings of fact; enactment; filing of budget; repealer; severability; effective date; and proper notice and meeting (Attachment). By: Rick Hall – Mayor & Liz Rundzieher – Mayor Pro Tem (Requires 60% Quorum) c) Discuss and Consider a Resolution (#19-R-54) of the City Council of the City of Liberty Hill ratifying the Municipal Budget for Fiscal Year 2019 - 2020; funding municipal purposes; authorizing expenditures; providing for findings of fact; enactment; filing of budget; repealer; severability; effective date; and proper notice and meeting (Attachment). By: Rick Hall – Mayor & Liz Rundzieher – Mayor Pro Tem (Recorded Vote / Requires 60% Quorum) d) Discuss and Consider an Ordinance (#19-O-55) adopting an Ad Valorem Tax Rate of $0.490187 for the City of Liberty Hill, Texas; levying Ad Valorem Taxes for use and support of the Municipal Government for the City of Liberty Hill, Texas, as may be necessary to promote the general health, safety and welfare for the 2019 – 2020 Fiscal Year; providing for apportioning each levy for specific purposes; and providing when taxes shall become due and when same shall be delinquent if not paid (Attachment). By: Rick Hall – Mayor & Liz Rundzieher – Mayor Pro Tem (Recorded Vote / Requires 60% Quorum) e) Discuss and Consider appropriate action to approve a Resolution (#19-R-51) of the City Council of Liberty Hill authorizing the submission of a grant application to Hazard Mitigation Grant Program, appointing an authorized City official to act on behalf of the City in all matters regarding the FEMA Mitigation Project, and committing 25% of the project funds as local match (Attachment). By: Rick Hall – Mayor & Casey Cobb – Emergency Management f) Discuss and Consider a Professional Services Agreement between the City of Liberty Hill and consultant Jed Buie of Buie & Company; providing for services pertaining to public relations, governmental affairs, community outreach and other governmental resources; providing for compensation as outlined in EXHIBITS herein (Attachment). By: Rick Hall – Mayor g) Discuss and Consider approval of a General Operating Fund Reserve Policy for the City of Liberty Hill; providing for a prudent level of financial resources to guard its stakeholders against service disruption in the event of unexpected temporary revenue shortfalls or unpredicted one time expenses; said policy shall apply to all General September 9, 2019 3 City Council Regular Meeting Fund operating funds under the budgetary and fiscal control of the City Council of the City of Liberty Hill (Attachment). By: Rick Hall – Mayor k) Discuss and Consider appointing a Council Member of the City of Liberty Hill to serve on the Summerlyn West Tax Increment Reinvestment Zone Board of Directors #2; providing for a two-year term effective immediately. By: Rick Hall – Mayor 6) CONVENE - EXECUTIVE SESSION Mayor Rick Hall will convene City Council to Executive Session for Consultation with Legal Counsel pursuant to Texas Government Code §551.071 – Consultation with Legal Counsel and Texas Government Code §551.072 – Real Property. City Council will entertain discussion related to the matter shown below. No action will be taken in Executive Session. a) Consultation and follow-up with Legal Counsel concerning MUD No. 13 related to the City’s utility rate study. (Legal Advice pursuant to Tex. Gov’t. Code Sec. §551.071). b) Consultation with Legal Counsel concerning negotiation of the City’s electric franchise agreement. (Legal Advice pursuant to Tex. Gov’t. Code Sec. §551.071). c) Consultation with Legal Counsel concerning litigation by Burkett Media regarding sign permit. (Legal Advice pursuant to Tex. Gov’t. Code Sec. §551.071). September 9, 2019 4 City Council Regular Meeting d) Consultation regarding real property owned by the City of Liberty Hill and possible acquisitions. Code Sec. §551.071). f) Consideration of the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of the following positions: (Personnel Matters pursuant to Tex. Gov’t.
