Subject: Discussion, consideration, and recommendation to the City Council on a request
for a Zone Map Amendment from Downtown Commercial/Retail (C2) zoning to
Downtown Commercial/Retail (C2) with a conditional use permit (CUP)
classification.
The property is locally addressed as 104 Carl Shipp Drive, Liberty Hill TX, being
approximately .488 acres out of the Henry Fields and T.P. Plaster Surveys, Abstract
Numbers 510 and 233, Williamson County, Texas. It is specifically located along
the southeast right-of-way of Carl Shipp Drive and Russell Street and is identified
as Assessor’s Parcel Number R – 022756.

BACKGROUND INFORMATION:
Current Zoning: C2 (Downtown Commercial/Retail)
Proposed Zoning: C2 (Downtown Commercial/Retail) with a CUP
Surrounding Land Use and Zoning:
North: C2 (Downtown Commercial/Retail) – Government Facility, U.S. Post Office
South: C2 (Downtown Commercial/Retail) – Single-Family Residential Dwelling
East: C2 (Downtown Commercial/Retail) – Vacant Residential Property
West: C2 (Downtown Commercial/Retail) – Commercial Business, Germania Insurance
Summary of Request
The request, submitted by Louis Rentals LLC, is to rezone 104 Carl Shipp Drive, approximately
.488 acres, from C2 (Downtown Commercial/Retail) to C2 (Downtown Commercial/Retail) with a
CUP to allow for duplex housing. Should this request be approved, the applicant intends to build
two duplexes on the rear of the lot. They intend to demolish the existing single-family home and
replace it with a third duplex. Currently, the lot is 21,257.28 square feet and can accommodate
the maximum density of 3,000 square feet per dwelling unit. The addition of six dwelling units on
this parcel will allow for 3,542.88 square feet per dwelling unit.

The C2 (Downtown Commercial/Retail) district is intended to control and guide the development
of commercial uses in downtown Liberty Hill. The standards in this district allow continued,
conforming use for existing uses as defined in the Unified Development Code, and encourage
new development in a compact, pedestrian-oriented environment.
In accordance with Chapter 4 of the Unified Development Code, the Planning and Zoning
Commission will review an application for conditional use with consideration of the following
criteria, which may exceed the standards prescribed in Chapter 6, Site Development Standards:
A. Consistency with the Comprehensive Plan.
B. Conformance with applicable regulations in this Code and standards established by the
regulations.
C. Compatibility with existing or permitted uses on abutting sites, in terms of building height,
bulk, scale, setbacks and open spaces, landscaping and site development, and access and
circulation features.
D. Potentially unfavorable effects or impacts on other existing or permitted uses on abutting
sites, to the extent that such impacts exceed those which reasonably may result from use
of the site by a permitted use.
E. Modifications to the site plan which would result in increased compatibility or would
mitigate potentially unfavorable impacts or would be necessary to conform to applicable
regulations and standards and to protect the public health, safety, morals and general
welfare.
F. Safety and convenience of vehicular and pedestrian circulation in the vicinity, including
traffic reasonably expected to be generated by the proposed use.
G. Protection of persons and property from erosion, flood or water damage, fire, noise, glare
and similar hazards of impacts.
H. Location, lighting and type of signs; and relation of sills to traffic control and adverse
effect on adjacent properties.
I. Adequacy and convenience of off-street parking and loading facilities.
RELATIONSHIP TO THE COMPREHENSIVE PLAN:
The most recently adopted Comprehensive Plan for the City of Liberty Hill (adopted August 2014),
states within the Land Use Classifications (Section 3.7.1) that there is very little multi-family
housing presently in the City of Liberty Hill, in any of its forms (townhome, duplex, triplex, fourplex
or apartments/condominiums). Enabling a better offering for this type of housing will help market
choice and affordability issues in the City. It continues to state that the downtown area may wish
to allow limited forms of multi-family, depending on availability of sewer LUEs, design guidelines,
and traffic issues. Multi-family housing can serve as a buffer between single-family housing and

more intense uses such as retail and commercial that is becoming more prevalent as the State
Highway 29 corridor is built out.
The property is designated as ‘Residential’ on the Future Land Use Map (FLUM) of the
Comprehensive Plan.
PUBLIC NOTIFICATION:
Staff notified thirteen (13) surrounding property owners regarding this request. As of date of this
staff report, zero (0) responses have been received in opposition or in favor of this request. All
property owners notified are within the 200-foot notification boundary required by the State.
RECOMMENDATIONS:
The Planning and Zoning Commission may:
Recommend disapproval of the applicant’s request to rezone the property to C2
(Downtown Commercial/Retail) with a CUP to allow for duplex housing.
Recommend approval of the applicant’s request to rezone the property to C2 (Downtown
Commercial/Retail) with a CUP to allow for duplex housing.
Staff finds that the applicant’s request to rezone the property to C2 (Downtown
Commercial/Retail) with a CUP to allow for duplex housing is compatible with the Comprehensive
Plan.
Staff recommends approval of the applicant’s request to rezone the property from C2 (Downtown
Commercial/Retail) to C2 (Downtown Commercial/Retail) with a CUP to allow for duplex housing
with the following condition:
The property may not be subdivided into more than one parcel.
The developer will plant one canopy tree and four 3-gallon shrubs per dwelling unit.
The developer will install landscape and lot lighting in such a way that limits light trespass
onto neighboring properties.
The property will be fully sodded with the exception of driveways, vehicle maneuvering
areas, and planting areas.

Discussion: The application under consideration was submitted on February 24, 2021. If approved,
the final plat will yield thirty-three (33) residential lots and 1,040.08 linear feet of new public street on
approximately 7.3513 acres.

Background: The Stonewall North preliminary plat was approved for a total of 117.403 acres with a
total of five hundred and fifty-nine (559) single-family residential lots over seven sections at completion.
This section will be the third section to be completed leaving sections 11, 13, 14, and 15 to be
developed.
This development is part of the Stonewall Ranch Municipal Utility District (MUD) 35.
The average lot widths are fifty (50) feet.
Construction plans for this section are still under review.
Recommendation: Staff recommends that the Planning and Zoning Commission recommend to
Council that the Final Plat for Stonewall Ranch – North, Section Twelve Subdivision be approved.
