Quorum was established and all members were present, except Chad Cormack. Commissioner Barreras took his Oath of Office before the start of the meeting, so he counted toward the quorum of 3. Commissioner Keller volunteered to preside over the meeting tonight, this was agreeable to the Commissioners. Commissioner Vyner volunteered to give the invocation. Devin Vyner led the invocation and led the pledges of allegiance to US and Texas flags, respectively. 2) PUBLIC COMMENTS Public Comments are welcome. You may submit Public Comments in person, or you may submit them to the City Secretary at esimpson@libertyhilltx.gov before 3:00 PM, the day of the meeting. There were no citizen comments. Planning & Zoning Commission Meeting minutes Page 1 of 6 July 2, 2024 7 3. CONSENT AGENDA a) Approval of the minutes for the June 4, 2024, Planning and Zoning Commission Regular Called Meeting. (E. Simpson) Motion: Motion by Commissioner Vyner, seconded by Commissioner Barreras, to approve the meeting minutes in agenda item 3a., as presented. Vote on the Motion: Motion passed with a vote of 2-0-1. Ayes: Vyner and Barreras, Nays: 0, Abstention: Keller. b) Disapproval of the Replat of Lot 6, Block A, Butler Farms Phase 1, consisting of approximately 28.07 acres of land, and legally described as part of and out of the John B. Berry Survey, Abstract No. 56, Liberty Hill, Williamson County, Texas. (M. Hicks) Interim Planning and Development Director Hicks introduced the item and presented the staff report. She explained to the new Commissioners that the city must monitor these plats at all times because of the ‘shot clock.’ By state law, the city staff has a limited amount of time to act on a plat before it is automatically approved. Staff recommends disapproval status for this plat. Butler Farms is working to get several things corrected. There are still engineer’s comments that have not been resolved on this plat. This is also the same situation with item 3.c.) Item 3.c. was opened. c) Disapproval of the Replat of Lot 1, Block D, Butler Farms Phase 1, consisting of approximately 51.20 acres of land, and legally described as part of and out of the John B. Berry Survey, Abstract No. 56, Liberty Hill, Williamson County, Texas. (M. Hicks) Motion: Motion to disapprove both the replats requested in agenda items 3b. and 3c.. Motion by Commissioner Vyner, seconded by Commissioner Barreras. Motion carried unanimously by a 3- 0 vote. Ayes: Keller, Vyner, Barreras. Nays: 0. 2) REGULAR AGENDA a) Discussion and a possible recommendation regarding a proposed ordinance to amend Article 2.12 of the City of Liberty Hill Code of Ordinances with the addition of Division 4, Hotel Occupancy Tax (HOT). (M. Hicks/J. Crawford) Planning & Zoning Commission Meeting minutes Page 2 of 6 July 2, 2024 8 City Attorney Crawford introduced the item and provided the staff report. He explained that this item was requested earlier. It is usually associated with Short Term Rentals issues, but this Ordinance, as proposed tonight, makes no specific mention of Short Term Rentals (STRs). This ordinance is standard and contains provisions that the city is allowed to adopt. The HOT tax is derived from Chapter 156 of the Tax Code. Mr. Crawford explained that this is a tax paid to the city on short stays in hotels or bed and breakfast establishments, or in STRs. A stay less than a month is taxed. It is 7%. There is a limitation for collection of the tax in the extra-territorial jurisdiction (ETJ), the city’s rate is reduced so the total taxed rate cannot be more than 15%. When drafting this proposed draft Ordinance, Crawford included an option to allow the city to re-imburse 1% of the tax back to the taxpayer (the hotel or owner of the rental). This may encourage better response and participation. It is entirely optional, as an incentive to collections. The city gives up 1% of the HOT money, however. This is not a common incentive, but the city can grant it if City Council desires. There was a brief discussion of STR’s. Some of the larger referral sites, like Air BNB, and VRBO, offer cities the ability to contract with the site and the site will collect the tax. Motion: Motion by Commissioner Vyner, seconded by Commissioner Keller, to forward a favorable recommendation to the City Council regarding the proposed HOT Ordinance, with the removal of the 1% reimbursement discount. Motion: Motion passes 2-1. Ayes: Keller and Vyner. Nays: Barreras. City Attorney Crawford will continue to research the process of contracting for the collection of taxes through referral sites. b) Discussion, consideration, and possible action regarding City Code of Ordinances Exhibit 9A, Chapter 5, Section 5.04 Adequate Public Facilities Processing Procedures, and Chapter 6, Section 6.04 Content of the Site Development Permit Application. (M. Hicks/J. Crawford) Interim Director Hicks introduced the agenda item and provided the Commission with some brief background on this item. Recently the City changed Engineers. The previous engineers calculated utility reserve capacity differently than the new/current engineers. The current engineering firm estimates that we have no capacity. We are now denying applications for new developments, due to the new calculations. This item will allow us to use the priorities of City Council to consider requests for utility service to be provided out of reserve capacity. Planning & Zoning Commission Meeting minutes Page 3 of 6 July 2, 2024 9 New capacity will be available at end of year. The city is building new facilities. This Ordinance will allow the City Council to approve water reserve capacity to applicants who meet five specific criteria. The criteria are derived from the city’s LHTX 2040 Plan. Only applicants who score best on the development matrix, as priority or preferred, will be considered. If applicants meet all five criteria they may be allowed to progress in their projects, by a vote of City Council. Council will consider it on a case-by-case basis. The Commissioners discussed the 5 criteria in item ‘E’ at length, asking whether or not being able to ‘Likely to create jobs in the community’ (item 4), was important enough to be a requirement. Also, if a business was moving from one place inside the city to another place in the city, it may not be expanding necessarily or creating additional jobs. “ E. Copies of letters from utility providers stating that utility service is available at the site. In the event that the City will provide water or sewer services to the site, and the City’s engineer determines that there is insufficient unreserved capacity in such systems to serve the site, then City Council may, by ordinance, authorize approval of the site development permit despite such insufficient unreserved capacity upon a determination that the proposed development is: 1. Classified as a “priority” project under the City’s Development Matrix; 2. Consistent with the City’s Comprehensive Plan; 3. Likely to provide adequate sales and use tax, property tax, and utility fee payments in light of the costs of providing service to the site; 4. Likely to create jobs in the community; and 5. Unlikely, in light of the amount of capacity requested, to cause the City to be unable to serve other properties that have reserved capacity, or to whom the City has committed capacity.” Interim Director Hicks estimated that there are approximately fifteen (15) projects being held up at this time due to the lack of water capacity. City Attorney Crawford explained that number 4 could be reclassified as a consideration, instead of a requirement. Motion: Motion by Commissioner Vyner, seconded by Commissioner Keller, to forward a favorable recommendation on the proposed amending Ordinance regarding City Code of Ordinances Exhibit 9A, Chapter 5, Section 5.04 Adequate Public Facilities Processing Procedures, and Chapter 6, Section 6.04 Content of the Site Development Permit Application, with the following modification: The removal of criteria #4 from item #E. as a requirement and changing the status of #4 to being a consideration.
