HEAD APPROVAL: CVSD Katy Allen, City Administrator EXPENDITURE REQUIRED: $.40 per mile, per van BUDGETED: Under Children’s Programming SUMMARY STATEMENT Since June 16, 2014 the City of Liberty Lake has chartered with Durham Services for transporting CHILL Day Camp participants to various field trips. After experiencing a series of serious performance issues, we needed to identify other transportation options. Central Valley School District agreed to loan the City of Liberty Lake three nine-passenger buses for the duration of CHILL Day Camp, ending on August 22nd. The attached agreement with CVSD allows the City greater flexibility with the transportation needs of the CHILL Day Camp program and allows staff to get the children back to Pavillion Park on time. Driver’s training has been provided for staff and DMV driving records and insurance requirements have been provided to CVSD. This program operates as cost neutral. RECOMMENDED ACTION 1. Authorize Mayor to sign the attached Agreement with CVSD related to the rental of three buses. SUMMARY STATEMENT The City of Liberty Lake’s Interlocal Solid Waste service agreement expires November 16, 2014. In anticipation of the upcoming contract expiration, City staff has diligently worked to identify options for City Council’s consideration related to Solid Waste rates and a service model that best meets the needs of our residents. During our research phase and after conversations with many Cities throughout Washington State, City staff and the City Attorney has become aware of the rate setting and operational complexities involved with negotiating contracts and managing municipal solid waste systems. All jurisdictions that we spoke with retain solid waste management consultant services to assist and advise on collection and disposal contracts. City staff is currently in the process of interviewing solid waste consultants. Due to time sensitivity, staff is requesting the City Council authorize up to $10,000 for solid waste and disposal consulting services, and authorize staff to negotiate and execute a professional services consulting agreement. This request does not require a 2014 budget amendment. RECOMMENDED ACTION 1. Authorize up to $10,000 for Solid Waste Consulting Services. 2. OF ORIGIN: Public Works EXHIBIT: Professional Services Authorization EXPENDITURE REQUIRED: Yes BUDGETED: Yes SUMMARY STATEMENT To ensure the City provides the best and most cost effective design for the needs of our community we are proposing to engage the services of Welch Comer for the Appleway Av / Liberty Lake Rd Signal Redesign project. Our existing signal is 15 – 20 years old and the equipment lacks functionality that could help alleviate our traffic backups at the intersection. The updated equipment will also provide the option of connecting to our regional traffic management center. We plan to pay for most of this through a grant that we are applying for through TIB. The City would have matching funds If we are not successful with the grant application we would propose paying for the signal upgrade with streets dollars. Each of the services provided in the Professional Services Agreement will be authorized by staff before allowing Welch Comer to proceed. RECOMMENDED ACTION 1. Authorize Mayor to sign the agreement with Welch Comer. STAFF REPORT / 2015 BUDGET PUBLIC HEARING City of Liberty Lake Quarterly Financial Report & Mid-Year Report Second Quarter 2014 Overview The Quarterly Financial Report provides a summary of budget-to-actual comparison of revenues and expenditures for each fund through the end of the most recently completed fiscal quarter. The report also provides end-of-year data including a summary budget-to-actual comparison of revenues and expenditures for the year. The information contained in this report is prepared on a cash basis. Please note that these numbers are still preliminary and adjustments may need to be made as the Annual Financial Report is prepared. General Fund / Streets Fund Revenues - Collections of General fund revenues in the second quarter of 2014 increased in comparison to last year. - Retail sales tax revenue for the second quarter increased by 12% compared to last year with increases from Auto/RV Sales and construction. - Property tax revenues are typically received during the second and fourth quarters of the year. Property Tax counts for 33% of the expected General Fund revenue in 2014. - Permitting revenue for the first six months is $225K which is 69% of the anticipated budget for 2014. Note: this is revenue that the City collects first, and then performs the service for inspections. - Utility Tax collection higher than in 2013 by 9.5% due to increase rates imposed by Avista, colder than average winter for 2014 and growth. In Spokane County, there must be 40 or more units for the tax to apply. The City levies a special excise tax of two percent. Tourism Promotion Area (Tourism Promotion Area Fund)- The City established a tourism promotion area (TPA) that encompasses the entire City of Liberty Lake and has authorized lodging charges within the established area. Lodging businesses in the TPA that have 40 or more units must collect the lodging charge from persons who purchase lodging. The City receives $2.00 per night of stay from lodging businesses with 40 or more units with lodging revenues exceeding five hundred thousand dollars during the preceding calendar year. The City receives $.50 per night of stay from lodging businesses with 40 or more units with lodging revenues below five hundred thousand dollars during the preceding calendar year. Restricted Reserve Fund- The Restricted Reserve Fund is generally maintained at 15% of the General Fund’s projected or actual, if known, operating revenues for the fiscal year. Policies for management and use of the Restricted Reserve Fund are laid out in City of Liberty Lake Ordinance No. 107-D. REET (Capital Projects Fund & Special Capital Projects Fund)- Real Estate Excise Tax (REET) of one-quarter of one percent of the selling price is imposed on each sale of property in the City of Liberty Lake. The tax is deposited into the Capital Projects Fund and is restricted to fund any capital purpose identified in a capital improvement plan and local capital improvements including those listed in RCW 35.43.040. There is an additional one-quarter of one percent on real estate sales within the city limits. According to state law, cities planning under GMA (Growth Management Act) have the authority to levy a second quarter percent tax (REET 2). Funds from REET 2 are placed in a Special Capital Project Fund and used solely for financing capital projects as specified in a capital facilities plan element of the comprehensive plan. Street Capital/Library Capital /Police Capital Funds- These are unreserved dollars set aside for Capital Projects Harvard Road Mitigation Fund - Mitigation fees collected for road improvements. This plan has been updated in 2014 with a fee increase to start May 2014. Townsquare Capital Fund - Project is slated to start in 2014 with funding coming from REET, Stormwater, and General Fund. Stormwater Utility Fund - City collects money from property owners to maintain its stormwater system. Ordinance #88A. Aquifer Protection Fund - City collects money from property owners to protect the Aquifer. Ordinance #208. Golf Course Fund - This is an Enterprise Fund where fees are charged to external users for services. G.O. & LTGO Bond/Note Funds- Debt service funds that track bond and note payments. HEAD APPROVAL: Chief Brian Asmus Resolution for Sole Source Purchase Quote for Automated License Plate Reader EXPENDITURE REQUIRED: Yes BUDGETED: Yes SUMMARY STATEMENT The Liberty Lake Police Department is requesting to purchase an Automated License Plate Reader camera system and corresponding software and software licenses. The camera system will be installed in one of the new patrol cars that is being delivered later this year. The software and licensing component allows for each of the patrol cars to run software that provides an alert and GPS location when the car with the system locates a vehicle that has been entered into the system. (i.e. stolen cars, amber alerts, missing persons, suspect vehicles, etc.) The City of Spokane has agreed to provide us access to their current ALPR server, thereby reducing the overall expense of implementing the system. However, to be able to use the SPD server, we are required to use the same vendor that they are using for the camera hardware. Therefore, the Liberty Lake Police Department is requesting that this purchase be considered a sole source provider. This equipment purchase was approved as an expenditure during the 2014 budget process and will be paid for from the computers and equipment line item. RECOMMENDED ACTION 1. Pass the Resolution to waive the competitive bid requirements based upon a sole source purchase and authorize the purchase of an automated license plate reader camera system. RESOLUTION NO. 14-184 CITY OF LIBERTY LAKE SPOKANE COUNTY, WASHINGTON A RESOLUTION WAIVING THE COMPETITIVE BID REQUIREMENTS DUE TO A SOLE SOURCE PURCHASE AND AUTHORIZING THE PURCHASE OF AN AUTOMATED LICENSE PLATE READER CAMERA SYSTEM WHEREAS, the City Council finds that based upon research by the Liberty Lake Police Department, the purchase of an automated license plate reader camera system is appropriate due to the exclusiveness and quality of the product; and WHEREAS, RCW 39.04.280 provides that a local agency, by Resolution, may waive the competitive bidding requirements when the purchase is clearly and legitimately limited to a single source of supply, or when the purchase involves special facilities or market conditions; and WHEREAS, the City Council finds that there is an automated license plate reader camera system supplier that will meet the specific facilities of the Liberty Lake Police Department by utilizing the current computer server and facilities located at the Spokane Police Department; and WHEREAS, the manufacturer of the computer software is the sole source of supply, and such software creates a special market condition because of the compatibility of the sole source supplier and facilities; and WHEREAS, it is appropriate for the City Council under RCW 39.04.280 to waive the bidding requirements for the above reasons; and NOW, THEREFORE, it is hereby resolved by the City Liberty Lake City Council the following: 1. Originally purchased in 2011 for $10,326 as one of the attachments to the tractor that was purchased at the same time, the mower has had little use since that time. The City has other mowers in its fleet that performs faster and more efficient. The mower has around 20 hours of use. The vendor has suggested a selling price of $7500 to $8000. The pump was overheating causing it to shut down at any time. The Golf Course requires keeping this pump working when in use and not shut down. Staff attempted to cool the machine with fans, however, with wet conditions and having to leave the pump panel open creates an unnecessary risk to staff. The recommendation to fix the issue was to install a 75 hp Soft Start Pump Controller that would better monitor the pump and the ability to restart the pump if it was to shut down. Per Financial Management Policy (Purchasing 1610 – VI) Staff is recommending that City Council acknowledge that an emergency existed through the passage of the attached resolution. RECOMMENDED ACTION 1. Pass the Resolution to acknowledge an emergency existed for the purchase of the 75 HP Soft Start Pump Controller. RESOLUTION NO. 14-186 CITY OF LIBERTY LAKE SPOKANE COUNTY, WASHINGTON A RESOLUTION WAIVING THE COMPETITIVE BIDDING REQUIREMENTS DECLARING AN EMERGENCY EXISTED AND AUTHORIZING THE PURCHASE OF A SOFT START PUMP CONTROLLER WHEREAS, the City Council finds that based upon the nature of the condition of the well pump located at the Trailhead Golf Course and the safety of City employees, the emergency purchase of a 75 hp soft start pump controller was necessary to keep the pump running accurately, safely, and preventing material damage or loss to the golf course; and WHEREAS, RCW 39.04.280 provides that a local agency, by Resolution, may waive the competitive bidding requirements when the purchase is in the event of an emergency in order to provide the ability to respond and not compromise the safety of City staff, the irrigation needs of the golf course, and preventing material damage or loss to the golf course; and WHEREAS, the City Council finds that an emergency existed to purchase a 75 hp soft start pump controller for the well pump to function accurately, safely, and preventing the material damage or loss to the golf course; and WHEREAS, it is appropriate for the City Council under RCW 39.04.280 to waive the competitive bidding requirements for the above reasons; and NOW, THEREFORE, it is hereby resolved by the City Liberty Lake City Council the following: 1. Boutz FIRST READ ORDINANCE CITY OF LIBERTY LAKE SPOKANE COUNTY, WASHINGTON ORDINANCE NO. 212 AN ORDINANCE OF THE CITY OF LIBERTY LAKE, WASHINGTON EXTENDING FOR SIX MONTHS A MORATORIUM PROHIBITING ACCEPTANCE OR PROCESSING OF APPLICATIONS, OR ISSUANCE OF PERMITS OR LICENSES, AND APPROVALS, AND USES OR ACTIVITIES ASSOCIATED WITH THE PRODUCING, PROCESSING, OR RETAILING OF MARIJUANA AND MARIJUANA- INFUSED PRODUCTS. WHEREAS, in November 2012 the voters of the State of Washington approved Initiative 502, providing a framework whereby individuals and business entities may be granted a state license authorizing them to produce, process, or sell marijuana and marijuana-infused products for recreational use; and WHEREAS, pursuant to Initiative 502, the Washington State Liquor Control Board has developed and implemented regulations governing the licensing and operation of recreational marijuana or marijuana-infused producers, processors, and retailers; and WHEREAS, the Washington State Liquor Control Board has begun issuing licenses authorizing individuals and businesses to produce, process, and sell recreational marijuana and marijuana-infused products; and WHEREAS, under Initiative 502 the only limitation on where a producer, processor, or retailer can exist is that any such premise cannot be within 1,000 feet of the perimeter of the grounds of any elementary or secondary school, playground, recreation center or facility, child care center, public park, public transit center or library, or any game arcade where persons under twenty-one (21) years old may enter; and WHEREAS, the City of Liberty Lake does not currently have any regulations addressing the type and location of facilities or premises used for the production, processing, and retail sales of marijuana and marijuana-infused products; and WHEREAS, on January 16, 2014, the Attorney General of Washington issued a legal opinion, AGO 2014 No. 2, that Initiative 502 does not preempt counties, cities, and towns from banning marijuana and marijuana-infused producers, processors, and retailers within their jurisdictions; and WHEREAS, the City is authorized pursuant to RCW 35A.63.220 and RCW 36.70A.390 to renew an existing moratorium for up to six-months as long as the City adopts findings of facts and holds a public hearing before renewing a moratorium; and WHEREAS, the City Council adopted Ordinance 210 on January 21, 2014, that imposed a six-month moratorium prohibiting the production, processing, and/or retail sale of recreational marijuana and marijuana-infused substances by state-licensed individuals or businesses within all zoning districts in the City of Liberty Lake, and within such ordinance included findings of fact to support imposition of the moratorium; and WHEREAS, the City Council held a public hearing on February 18, 2014 regarding the moratorium imposed by Ordinance 210; and WHEREAS, the moratorium should be extended or cancelled before August 4, 2014; and WHEREAS, legislation was introduced in the Washington State Legislature’s 2014 session that pertained to state-licensed marijuana business and could have impacted the City’s approach to this matter, but was not adopted by the Washington State Legislature; and WHEREAS, the City of Liberty Lake may develop appropriate zoning, land use regulations, business license regulations, and other appropriate regulations to address the production, processing, and retail sales of recreational marijuana and marijuana-infused products; and WHEREAS, an extension of the moratorium is necessary in order to provide the City with sufficient time to study the potential impacts of these new types of businesses and to develop and adopt appropriate zoning regulations, including a review by the City’s Planning Commission for suggested recommendations to the City Council; and WHEREAS, a renewal of the moratorium is in the best interests of the City and is needed to preserve the public health, safety, and welfare of the residents of the City. NOW, THEREFORE, the City Council of the City of Liberty Lake, Washington, do ordain as follows: Section 1. Findings of Fact. The City Council adopts the above recitals as findings of fact in support of this ordinance. Section 2. Moratorium Extension. The City Councils hereby extends, for six additional months from the expiration of the current six-month moratorium on August 4, 2014, the six- month moratorium imposed by Ordinance 210 prohibiting the production, processing, and/or retail sale of recreational marijuana and marijuana-infused substances by state-licensed individuals or businesses within all zoning districts in the City of Liberty Lake. The moratorium is imposed on the issuance of any City of Liberty Lake building permit, development permit, business license, or any other permit or license to any state-licensed individual or business that seeks to produce, process, and/or sell recreational marijuana or marijuana-infused products in the City of Liberty Lake. Section 3. Term of Moratorium. The moratorium established by this Ordinance shall be in effect for a period of six (6) months from August 4, 2014, unless repealed, extended, or modified by the City Council after a public hearing and the entry of appropriate findings of fact as required by RCW 35A.63.220 and/or RCW 35A.70A.390. Section 4. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or unconstitutionality of any other section, sentence, clause or phrase of this Ordinance. Section 5. Effective Date. This Ordinance shall be in full force and effect five (5) days after publication of this Ordinance or a summary thereof in the official newspaper of the City of Liberty Lake as provided by law.
