OF ORIGIN: EXHIBIT: Bids EXPENDITURE REQUIRED: Yes BUDGETED: Yes SUMMARY STATEMENT Bids were solicited from available qualified contractors for the removal of the old fuel tank at Trailhead Golf Course. We received two bids for this work. This project provides for the removal and disposal of the existing fuel tank and the removal of up to 25 cubic yards of dirt under the tank. The apparent low bidder is Rob’s Demolition. The Grand Total for the work submitted by the low bidder is five thousand four hundred thirty-five and 00/100 dollars ($5,435.00). This price includes sales tax. RECOMMENDED ACTION Staff recommends accepting the proposal and authorizing Mayor Peterson to sign the proposal. AGENDA ITEM NO.: 9bii BUSINESS OF THE CITY COUNCIL, LIBERTY LAKE, WASHINGTON SUBJECT: FOR THE AGENDA OF: Hold Harmless Agreement September 13, 2016 Pavillion Park Rose Trellis Art Donation DEPT. HEAD APPROVAL: Katy Allen, City Administrator EXPENDITURE REQUIRED: N/A BUDGETED: N/A SUMMARY STATEMENT The Schneidmiller family is donating a rose trellis to the Pavillion Park rose garden created by artist, Peter, in honor of Marian Schneidmiller. A Hold Harmless Agreement has been developed for the benefit of the Schneidmiller’s, artist and the City and to provide clarity related to the terms of the donation. The trellis will be installed by City crews near the existing Rose Garden. RECOMMENDED ACTION 1. Authorize the Mayor to sign the Hold Harmless Agreement. HOLD HARMLESS AGREEMENT WHEREAS, Ross D Schneidmiller and Kelli J Schneidmiller, husband and wife, and Rodney G Schneidmiller and Georgette Schneidmiller, husband and wife, and the Ross D Schneidmiller Trust have agreed to donate to the City of Liberty Lake (“City”), a Washington municipal corporation, a certain art piece (“Art”) that will be placed and/or displayed in the City’s Pavillion Park; WHEREAS, prior to the Schneidmillers’ and the trust donating the Art to the City, they have requested that the parties enter into this Hold Harmless Agreement (“Agreement”) concerning the use of and future ownership of the Art after donation; and WHEREAS, the City is agreeable to entering into the Agreement in order to accept the Art donation pursuant to the terms set forth in this Agreement. NOW THEREFORE, the parties hereby agree to enter into this Agreement, pursuant to the terms set forth herein, arising out of the donation of the Art to the City as follows: The City agrees to indemnify, defend and hold harmless Ross D Schneidmiller, Kelli J Schneidmiller, Rodney G Schneidmiller, Georgette Schneidmiller and the Ross D Schneidmiller Trust and Peter Goetzinger from any and all claims and causes of action of any kind arising out of the use of and/or future ownership of the Art after its donation to the City, or to enforce any of the covenants and obligations in this Agreement. Further, the parties agree that in the event the City removes the Art from display in Pavillion Park, the ownership of the Art shall revert back to the donating parties unless such parties disclaim ownership. The Ross D Schneidmiller Trust was used for interim financing of the Rose Trellis so it is included in the Hold Harmless Agreement. My mother had climbing roses and she loved tending to them. At sunrise when my father would leave to work on the farm my mother would go outside to work on her roses. When she passed away in 1998 my brother Rod and I decided to fund the Rose Garden at Pavillion Park in her honor. The backdrop to my mother's roses was a rock wall, which is why a wall was incorporated into the garden's design. After a number of years without proper pruning and care the roses struggled and other plantings took over the garden. In 2013 Joice Cary, the Gardener for the City of Liberty Lake, contacted me and expressed an interest in returning the rose garden to its original design. My brother and I agreed to partner with the City in purchasing a number of roses to help restore the garden. Learning of my mother’s passion for climbing roses one of Joice’s goals became to add one to the rose collection. Discussions of an arbor or trellis ensued which eventually led my family to commission Peter Goetzinger to design and build the Rose Trellis. We wanted the trellis to be historically significant to Liberty Lake Park where the original Pavillion was located. I provided Peter photos of landscape and architectural elements from there. In the end after various designs were considered all parties agreed that incorporating the Pavillion’s roofline into the trellis was the best fit for the Rose Garden and Pavillion Park. One set would be installed at the intersection of Country Vista and Wright (near Pavillion Park), the other at the trail beginning on Appleway Av and Country Vista Blvd (the map gives you a better idea). The attached quote is for materials only and the total is $23,466.83. The installation will be performed by our on call contractor, Peplinski Excavation. The approximate install cost is about $6,000 for both units (based on the last installation Peplinski performed). Lighting should cost less than $8,000. Some of that cost is for getting power to the light. A maximum of four lights would be included for both crossings. We will have Spokane County stripe the crosswalk at the Appleway location once the crossing unit is functional. Avista is producing quotes for street lighting at both locations. The lights will be overhead cobra style lights. The crossing lights are being ordered ahead of the overhead lights due to long lead times. The crossings are within our budget. RECOMMENDED ACTION Staff recommends: 1. Authorizing the purchase and installation of RRFB’s and street lighting for the prices above, totaling $37,466.83. 2.
