., City CITY COUNCIL SPECIAL MEETING & PUBLIC HEARING TUESDAY, APRIL 26, 2022 HELD IN-PERSON & REMOTELY REGULAR CITY COUNCIL MEETING SESSION Prior to invocation, Mayor Kaminskas reviewed the logistics for this evening’s meeting which, under Governor Inslee’s “Washington Ready” plan, was being held in-person at City Hall and remotely via Zoom. INVOCATION: Given by Councilmember Cargill. PLEDGE OF ALLEGIANCE: Led by Mayor Kaminskas, City Council, and City Staff. CALL TO ORDER: Mayor Karninskas called the meeting to order at 7:00 p.m. ROLL CALL: City officials who physically attended the meeting: Mayor Kaminskas, Mayor Pro Tern Folyer, Councilmembers Baird, Cargill, Sahlberg, Kurtz and VanOrman, Lisa Key, Director of Planning & Engineering, Amy Mullerleile, Senior Planner, Sean Boutz, City Attorney and Todd Henderson, IT Technician. City officials who remotely attended the meeting via Zoom: Jen Camp, acting City Administrator Kyle Dixon, Finance Director, David Goehner, Communications Specialist, and Kelsey Hardy, City Clerk. Councilmember VanOrman moved to excuse Councilmember Dunne. The motion was seconded by Councilmember Baird, which carried unanimously. AGENDA APPROVAL: Councilmember Baird moved to approve the agenda as presented. The motion was seconded by Councilmember Sahlberg, which carried unanimously. CITIZEN COMMENTS: No comments at this time. PUBLIC HEARING: Case No. LUA2O2I-0006 Proposed Comprehensive Plan — Amendment and Zone Change for the Meadowwood Technology Campus The public hearing commenced at 7:04 p.m. Lisa Key, Director of Planning & Engineering presented an overview of the requested amendments, reviewed the procedural process, reviewed both written and public testimony received from agencies and the public throughout the process, reviewed the Planning Commission findings and Hearing Examiner findings. Questions asked and answered. Applicant Presentations: Jim Frank, with Greenstone presented on the current status of the Meadowwood Tech Center, adapting to emerging trends and a new framework of work, showed example renderings of possible buildings, reviewed demographics of homeowners and renters, and noted acceptable conditions of approval. Mike Terrell, with Greenstone reviewed the history of development of the site, reviewed allowable uses and the public process to date, shared the vision and opportunities of a mixed use community, addressed the consistency with the Comprehensive Plan and reviewed criteria for approval. Mayor Kaminskas opened Public Testimony at 9:03 p.m. Luke Kiar: a county resident looking to open a school at the Meadowwood Tech Campus, spoke regarding the demand for alternative education. Dci Garcia: a city resident, spoke in favor of the zone change and encouraged council to approve the proposed amendments. Mark Saba: a city resident, spoke in favor of the proposed amendments after hearing Jim Frank speak, but would like to see the conditions noted by Mr. Frank. Public testimony closed at 9:14 p.m. Applicant Rebuttal: Jim Frank briefly spoke regarding misconceptions due to lack of information. Councilmember Baird stated that although she participated in the Planning Commission Hearing, she wouldn’t be recusing herself and stated she can make a fair and impartial decision based upon the totality of the evidence on this matter. Lisa Key reviewed four recommended findings regarding both matters: The required SEPA review has been completed on the proposed amendment. All public and agency notice requirements were met and accomplished in a timely manner. The public was provided the opportunity for early and continuous participation. The public had the opportunity to submit written comments and testify at a public hearing before the Planning Commission, Hearing Examiner and City Council. Councilmember Sahlberg moved to approve all four recommendations as presented, seconded by Mayor Pro Tern Folyer. The motion carried unanimously, 6-0. City Council Deliberations & Decision on the Comprehensive Plan Land Use Map Amendment: Council deliberations ensued and councilmembers agreed that: 1. The proposed amendment is consistent with Comprehensive Plan Goals & Policies. 2. A change has occurred in economic and land use conditions that warrant the proposed amendment. 3. The proposed amendment will be compatible with adjacent land uses, with mitigations proposed by Mr. Frank. 4. The proposed amendment will not negatively impact transportation facilities. 5. The proposed amendment is not detrimental to the public good. Mayor Pro Tern Folyer moved that in the matter of Case No. LUA2O21-0006, regarding the requested amendment to the City of Liberty Lake 2015-2037 Comprehensive Plan Land Use Map, to change the Comprehensive Plan Land Use Designation of the subject property from Light Industrial to Community Center Mixed Use, the Liberty Lake City Council does hereby approve the requested Comprehensive Plan Amendment. The motion was seconded by Councilmember Sahlberg, which carried unanimously, 6-0. City Council Deliberations & Decision on the Re-Zone Request: Council deliberations ensued regarding mechanisms for conditions of approval and suitable conditions of approval. Councilmembers were unanimously in agreement with the three points for the zone change criteria for consideration as presented by Lisa Key. City Council Meeting Minutes April 26, 2022 Page 2 of 3 Mayor Pro Tern Folyer moved that in the matter of Case No. LUA2O21-0006, regarding the re zoning of the subject property from “I” (Light Industrial) to “M-2” (Community Center Mixed Use), the Liberty Lake City Council does hereby approve with conditions the requested zone change. The conditions are maximum of two story free standing residential, no residential on Mission frontage, and to allow two story residential over first floor commercial. The motion was seconded by councilmember Cargill, which carried unanimously, 6-0. The public hearing closed at 9:46 p.m. CITIZEN COMMENTS: No comments at this time.
