PLANNING COMMISSION MEETING MINUTES WEDNESDAY, JUNE 9TH, 2021 HELD REMOTELY Planning Commission Members Present: Tim Olsen, Jamie Baird, Richard Siler, Chris Cargill & Joe Mann Adjunct Member(s) Present: Marilyn Van Degrift & Conrad Band Absent: Stephen Ramirez & Marc Rubin Staff Present: Lisa Key, Kelsey Wright & Megan Abhold Call to Order: Meeting was called to order at 4:02 p.m. Roll Call: A quorum of members was present. All Commissioners introduced themselves to the two new Planning Commissioners; Commissioner Cargill and Commissioner Band. Commissioner Siler motioned to excuse the absence of Commissioner Ramirez and Commissioner Rubin. Motion moved by Commissioner Baird seconded by Commissioner Olsen. The motion carried unanimously. Review of Agenda & Approval of Minutes: Commissioner Olsen moved that the April 14th minutes be approved, seconded by Commissioner Baird. The motion carried unanimously. Presentation/Workshop: 2nd Workshop on 2021 Proposed Comprehensive Plan & Code Amendment: Kevin Schneidmiller presented on proposed Comprehensive Plan and Code Amendment changes for Meadowwood Technology Park. Kevin discussed the buildings already constructed at the MTP site, as well as the proposed of change zoning an M2 zone from Light Industrial. Commissioner Cargill inquired about how many parking stalls are being used at the existing site. Kevin informed the Commissioners that prior to COVID, the majority of the parking stalls were used. Kevin discussed the amenities that Companies are starting to look for in regard to future locations. The potential mixed use opportunities include services for onsite employees and neighborhood residents, neighborhood retail, small office, and restaurants, as well as residential in-fill options. Questions were answered regarding minimum and maximum density, existing campus amenities, potential redeveloped parking areas, potential traffic impact, as well as the possibility of a developer agreement. Commissioner Baird inquired about whether Huntwood would be interested in adding their parcel into the Comprehensive Plan and Code Amendment change. Director Key informed the Commission that at this present time, the owners of Huntwood are not interested in changing the zoning of their parcel. Planning Commission Meeting Minutes Page 1|3 June 9th, 2021 Commissioner Van DeGrift asked if the makeup of the proposed residential units would mostly be rental. Kevin stated that the makeup of the residential units would be for sale and sold at the market rate; there would not be any low-income housing. Commissioner Cargill asked what the ratio of residential space would be compared to commercial space. Kevin stated that there could be roughly be 200 units with no more than 450,000 square feet of commercial space due to the Code requiring a 1:1 ratio of uses. Kevin stated that he anticipated the site to be more of a 35 percent residential with a 65 percent commercial due to trends that occurred as a result of COVID. Commissioner Siler was curious to know why the residential aspect was important to Greenstone. Kevin stated that the model of businesses is going to change from office spaces to more “work from home” situations. Greenstone is looking to utilize the space as best as possible while providing the desired amenities. Director Key informed the Planning Commission the timeline and process for a Comprehensive Plan Amendment and Zoning Amendment request. Commissioner Mann was concerned about there being only two accesses into the site, and whether there were additional entrances proposed to be constructed. Director Key informed the Commissioners that the egresses and ingresses would be addressed during the development phase of the project not the during the zone change process. Commissioner Van Degrift was concerned about the removal of the present landscape berm on the SW corner of the site. Kevin informed the Commissioners that some of the landscaping would be removed, however the placement of the potential building locations in the presentation are a rough estimate and not an exact location. The buildings would have to follow the Development Code’s standard requirements. Presentation on CVSD Propose Annexation of the Spokane Gun Club Property: Director Key presented on Central Valley School District’s proposed annexation of the Spokane Gun Club Property. The zoning designation that CVSD is proposing is an R2 zone, which allow residential and a middle school or an elementary school. Director Key also informed the Commissioners that the surrounding zones in Spokane Valley is R3, in Spokane County the zone is Low Density Residential, and in Liberty Lake the surrounding zone is Park. Director Key presented the Comprehensive Plan Policy regarding criteria to evaluate a proposed annexation, as well as the procedural timeline of the annexation. The Proposed Annexation is currently under SEPA review. Director Key presented the comments that the City of Liberty Lake has received to date; including comments received from the Spokane Tribe. Commissioner Siler voiced concern over the potential remediation over the land if the annexation is approved. Director Key informed the Commissioners that the land will not be owned by the City but will be owned by CVSD and there would be no impact to the City. Commissioner Van Degrift voiced her support for a potential Middle School adjacent to the Ridgeline High School and the potential of teachers going back and forth between the two schools. Presentation/Workshop: 2021 Proposed Comprehensive Plan & Code Amendment: Kevin Schneidmiller and Michael Terrell presented on the proposed Comprehensive Plan and Code Amendment changes for Meadowwood Technology Park. Kevin Schneidmiller presented background history on the original development of the Meadowwood Technology Campus. Michael Terrell discussed the present state of the site as well as the proposed vision for the Meadowwood Technology Campus including a change of zoning to M2 from Light Industrial. Various questions were asked and answered regarding the proposed development of the site, parking lot redevelopment, current vacancies, and maximum future densities. Director Key stated that there will be additional requirements that will be looked at during the SEPA process if this proposed Comprehensive Plan change was to move forward. Planning Commission Meeting Minutes Page 1|2 April 14, 2021 Director Key stated that she will reach out to Huntwood, the adjacent property owner, and gather information on the possibility of changing the zoning of their parcel at the same time as the Meadowwood Technology Campus zone change. Director Key also requested that Kevin Schneidmiller calculate and present the total number of possible units that can be built in the undeveloped land for a better understanding for maximum allowed density. Presentation on City of Liberty Lake 2020 Development Statistics: Kelsey Wright presented on the 2020 Development Statistics for the City of Liberty Lake. Commissioner Ramirez asked if there were any slowdowns due to COVID or if everything continued as status quo. Kelsey stated that everything seems to keep moving along regardless and that commercial uses are substantially increasing. Commissioner Olsen asked where the location of The Point BSP is. Director Key stated that The Point BSP is located at the end of Country Vista where it turns into Appleway, adjacent to Broadway. Secretary’s Report: Lisa Key reported on the below listed items: • Landscape Code Public Hearing before City Council scheduled for April 20, May 4th • Sign Code Workshop with City Council scheduled for May 4th with Public Hearing scheduled for May 18th • The two candidates to fill the vacancies for the Planning Commission have been recommended by Mayor Kaminskas and will go forward for confirmation at the next Planning Council. The new Commissioners will potentially be present at the next Planning Commission meeting. • CVSD is petitioning to annex the Spokane Gun Club parcel. City Council will be holding hearings on the annexation. RCW 35A.14.120: Direct petition method: Provides the procedures for the direct petition method of annexation for non-charter code cities like Liberty Lake, including the required notice to the legislative body, and contents of the petition. RCW 35A.14.120: Direct petition method – Notice of hearing: Provides that the legislative body of the city fix a date for a public hearing and cause notice to be published in one or more issues of a newspaper of general circulation in the City, upon receipt of a petition meeting the requirements detailed in RCW. RCW 35A.14.330: Proposed zoning regulations: Provides that the legislative body of a non-charter code city may prepare and establish zoning regulations for the property proposed for annexation, to become effective upon annexation. RCW 35A.14.340: Notice and hearing – Filings and recording Requires two hearings regarding the proposed zoning regulations, to be held at least 30 days apart, with notice published in a newspaper of general circulation. A certified copy of the ordinance adopting the zoning regulation, or any part thereof, shall be filed with the County Auditor with a certified copy of any map or plat referred to or adopted by ordinance. The auditor shall record the ordinance and keep the map on file. Page 2 of 4 RCW 35A.14.700: Determining population of annexed territory. Within 30 days of the effective date of annexation, the City is required to submit a certificate of the population of the area annexed by the City. The requirements of the certificate are detailed therein. RCW 35A.14.801: Notification of annexation. Provides notification requirements when annexed territories are part of a fire district, library district, etc. Of note, the City must provide notification of the list of annexed parcel numbers and the street addresses of properties annexed, by certified mail or electronic means, to the county treasurer and assessor, as well as to light, power, and gas distribution businesses at least 60 days prior to the effective date of annexation. Additionally, in counties that do not have a boundary review board, the code city must provide notice to the fire district and the library district by certified mail, within seven days of the passage of the annexation ordinance. WAC 197-11: State Environmental Policy Act (SEPA) Rules: While annexations are exempt from SEPA, Comprehensive Plan Land Use and Zoning Designations are subject to SEPA review as a non-project action, in accordance with procedures established in WAC 197-11. The City of Liberty Lake issued a Notice of Application and disseminated the SEPA checklist for review and comment on May 21, 2021. The City anticipates issuing a Determination of Nonsignificance (DNS) for this project on June 4, 2021 following the close of the agency comment period. Any SEPA appeal is governed by the City of Liberty Lake Environmental Ordinance and such appeal shall be filed within fourteen (14) days after the notice that the determination has been made. The appeal period is anticipated to close at 4 p.m. on June 18, 2021. The optional DNS process in WAC 197-11-355 was used in this review, and a copy of the threshold determination for this proposal will be provided to reviewing agencies after the close of the comment period. A project- specific SEPA review will be required prior to development of the subject property. Page 3 of 4 COMMENTS RECEIVED: Randy Abrahamson, Tribal Historic Preservation Officer for the Spokane Tribe of Indians commented that a Cultural Resource Survey will be required on the site before any project - specific action is undertaken. REQUESTED ZONING DESIGNATION: The applicant has requested a zoning designation of “R-2” (Mixed Residential). The 2015 – 2037 City of Liberty Lake Comprehensive Plan defines this land use category as follows: “The Mixed Residential designation provides for a moderate increase in density using a variety of urban housing types and designs. This design oriented designation promotes residential renewal to small lot single family homes, townhouses, duplexes and small apartment buildings. The mix of housing make take a variety of forms, either mixed within a single site or mixed within the general area, with varied dwelling types. Developments in this zone should have a net density of no less than 6 units per acre.” The maximum net density allowed in this zone is 12 units per acre. Other permitted uses include both elementary schools and middle schools. Given the intended uses of the subject property, this appears to be an appropriate Comprehensive Plan Land Use and Zoning designation. RELEVANT COMPREHENSIVE PLAN GOALS & POLICIES: Comprehensive Plan Governance Policy # 3: Evaluate proposed expansions to the UGA and potential annexation areas based on the following criteria: 1. The ability to provide public services at the City's adopted levels of service; 2. Whether annexation would eliminate an unincorporated island or could be expanded to eliminate an unincorporated island; 3. Whether the annexation would follow logical boundaries, such as streets, waterways, parcels, sections, or substantial topographic features; 4. Whether the annexation would eliminate an irregularity or irregularities in the City's boundaries, thereby improving service delivery; and 5. Consistency with the Goals and Policies of this Comprehensive Plan. Page 4 of 4
