RESOLUTION 2019:85 Authorize Co-Op Participation COUNCIL CAUCUS MEETING February 27, 2019 Page | 4 Authorizing Contracts With Certain Approved Cooperative Contract Vendors For Contracting Units Pursuant To N.J.S.A. 40A:11-11(5) WHEREAS, the Borough of Lindenwold, pursuant to N.J.S.A. 40A:11-11(5) specifically authorizes two or more contracting units to establish a Cooperative Pricing System for the provision and performance of goods and services and enter into a Cooperative Pricing Agreement for its administration; and WHEREAS, the Borough of Lindenwold authorized participation with the MIDDLESEX REGIONAL EDUCATIONAL SERVICES COMMISSION under Resolution 2019:61; and WHEREAS, the MIDDLESEX REGIONAL EDUCATIONAL SERVICES COMMISSION requested a name change to the State of New Jersey to The Educational Services Commission of New Jersey to more accurately reflect the clientele served by the Commission(ESCNJ); and WHEREAS, these Cooperative Pricing System is to effect substantial economies in the provision and performance of goods and services; and WHEREAS, the Borough of Lindenwold wishes to participate as an affiliate member of this Co-op to acquire goods and services which may be needed; and WHEREAS, there is no participation fee to be an affiliate member or to use these Co-op; and WHEREAS, the Borough of Lindenwold has entered into a Participation Agreement with this Co-op. NOW, THEREFORE, BE IT RESOLVED that the Borough of Lindenwold, County of Camden and State of New Jersey, that the appropriate municipal officials are hereby authorized to execute a Participation Agreement for Affiliate Membership in the above named Co-op; and BE IT FURTHER RESOLVED, that the governing body of the Borough of Lindenwold pursuant to N.J.A.C. 5:30-5.5(b), the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Finance Officer. RESOLUTION 2019:86 Extend Camden Co. Paper Contract WHEREAS, N.J.S.A. 40A:11-11(5) authorizes contracting units to establish a Cooperative Pricing System and to enter into Cooperative Pricing Agreements for its administration, and WHEREAS, the County of Camden hereinafter referred to as the Lead Agency originally offered voluntary participation in a Cooperative Pricing System for copy, computer paper and envelopes as awarded to the vendors, W.B. Mason and Paper Mart, for a term commencing on September 1, 2018 through February 28, 2019 with the option of an additional six months extension, and WHEREAS, the County of Camden adopted the additional extension for a term commencing on March 1, 2019 through August 31, 2019 under Bid A-27/2018 with W. B. Mason, Office Basics, and Paper Mart, and NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Lindenwold as follows: 1. This resolution shall be known and may be cited as the Cooperative Pricing Resolution of the Borough of Lindenwold. 2. Pursuant to the provisions of N.J.S.A. 40A:11-11(5) the Mayor is hereby authorized to enter into a Cooperative Pricing Agreement with the Lead Agency 3. The Lead Agency shall be responsible for complying with the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq) and all other provisions of the revised statutes of the State of New Jersey. 4. This resolution shall take effect immediately upon passage. RESOLUTION 2019:87- Authorizing Application 2019 Community Development Block Grant WHEREAS, the Camden County Improvement Authority provides funding for certain infrastructure improvements or services under Community Development Block Grant Funding; and WHEREAS, the Governing Body has chosen to submit an application for Program Year 2019; and WHEREAS, the Governing Body has agreed to apply for funding for the following project: Cooper Avenue Roadway Improvements between Gibbsboro Road and Oak Avenue NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Lindenwold, County of Camden, State of New Jersey that the Mayor is hereby authorized to execute the Project Description Form for Program Year 2019 along with the Community Development Grant Agreement. RESOLUTION 2019:88 MEMBER PARTICIPATION IN A COOPERATIVE PRICING SYSTEM COUNCIL CAUCUS MEETING February 27, 2019 Page | 5 WHEREAS, N.J.S.A. 40A: 11-11(5) authorizes contracting units to establish a Cooperative Pricing System and to enter into Cooperative Pricing Agreements for its administration; and WHEREAS, the National Intergovernmental Purchasing Alliance Company, hereinafter referred to as the “Lead Agency” has offered voluntary participation in a Cooperative Pricing System for the purchase of goods and services; and WHEREAS, on February 27, 2019 the Borough of Lindenwold, County of Camden, State of New Jersey duly considered participation in a Cooperative Pricing System for the provision and performance of goods and; and NOW THEREFORE, BE IT RESOLVED as follows:  TITLE: This RESOLUTION shall be known and may be cited as the Cooperative Pricing Resolution of the Borough of Lindenwold  AUTHORITY: Pursuant to the provisions of N.J.S.A. 40A:11-11(5), the Mayor Richard E. Roach, Jr. is hereby authorized to enter into a Cooperative Pricing Agreement with the Lead Agency.  CONTRACTING UNIT: The Lead Agency shall be responsible for complying with the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) and all other provisions of the revised statutes of the State of New Jersey.  EFFECTIVE DATE: This resolution shall take effect immediately upon passage. RESOLUTION 2019:89 Authorizing the purchase of Game Time Playground Equipment Whereas, the Borough of Lindenwold, pursuant to N.J.S.A. 52:34-6.2 (B) (3) may, by Resolution and without advertising for bids, purchase any goods or services through the ESCNJ, and Whereas, the Borough of Lindenwold desires to purchase a Game Time Playground Equipment, through the ESCNJ Contract # 17/18–20. and Whereas, the MRC has been awarded the contract for Game Time Playground Equipment, and Whereas, the Mayor and Council of the Borough of Lindenwold recommend the utilization of this contract on the grounds as the best means available to obtain the necessary playground equipment, and Whereas, the Game Time Playground Equipment to be purchased shall not exceed the amount of $244,524.79 as stated on Quote #147131, and Whereas, funding for this resolution is certified as available below. Now, Therefore, Be It Resolved by the mayor and the Borough of Lindenwold, County of Camden and State of New Jersey as follows: 1. The Borough of Lindenwold hereby authorizes the purchase of Game Time playground equipment from MRC through ESCNJ Contract # 17/18–20. 2. The total fee also authorized for this contract shall not exceed the price quoted above without prior written approval from the Borough Council. 3. The Mayor, Borough Clerk and/or such other officials as is necessary and proper are hereby authorized to execute documents necessary to implement this resolution. 4. A copy of this resolution shall be provided to the Borough Treasurer and MRC for their information and guidance. RESOLUTION 2019:90 Authorizing the purchase of Playground Surface Whereas, the Borough of Lindenwold, pursuant to N.J.S.A. 52:34-6.2 (B) (3) may, by Resolution and without advertising for bids, purchase any goods or services through the ESCNJ, and Whereas, the Borough of Lindenwold desires to purchase a Playground Surfacing, through the ESCNJ Contract # 17/18–20. and Whereas, the RubbeRecycle has been awarded the contract for Playground Surfacing, and Whereas, the Mayor and Council of the Borough of Lindenwold recommend the utilization of this contract on the grounds as the best means available to obtain the necessary playground equipment, and Whereas, the RubberBond Playground Surface to be purchased shall not exceed the amount of $122,930.00 as stated on Quote #147999, and Whereas, funding for this resolution is certified as available below. Now, Therefore, Be It Resolved by the mayor and the Borough of Lindenwold, County of Camden and State of New Jersey as follows: 1. The Borough of Lindenwold hereby authorizes the purchase of RubberBond Playground Surface from RubbeRecycle through ESCNJ Contract # 17/18–20. 2. The Mayor, Borough Clerk and/or such other officials as is necessary and proper are hereby authorized to execute documents necessary to implement this resolution. 4. Joe Amodeo, resident, thanked public works for the repairs to Laurel Road. He questioned the ordinance on snow removal. The Mayor responded that complexes are required to remove snow and to contact Code Enforcement if not removed. Mr. Amodeo also questioned the markings for fire hydrants as only one of three hydrants is properly painted. Councilman DiDomenico will look into this matter. There being no one else desiring the floor, the Mayor closed the meeting to the public. Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that the meeting be adjourned.
