COUNCIL CAUCUS MEETING September 25, 2019 Page | 1 Mayor Roach called the meeting to order. Borough Solicitor held a hearing on vacant property located at 427-431-435 Chews Landing Road. The Construction Official was sworn in to describe the condition of the property. He stated that this property was dangerous and unsafe. He does not feel that it can be remediated and recommended demolition. President Randolph-Sharpe asked if the owner was notified which the Borough Solicitor responded affirmatively and the number of attempts that were made. Executive Session 2019:177 BE IT RESOLVED by the Mayor and Council of the Borough of Lindenwold that the Mayor and Council are now going into closed session to discuss legal matters, Personnel-Public Works Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that Resolution 2019:177 be adopted as read. Roll Call of Council Members Present: DiDomenico, Hess, Jackson, Sinon, Strippoli, President Randolph-Sharpe, and Mayor Roach. Resolution 2019:178 Proclamation for Dan O’Rourke Whereas, The Borough of Lindenwold would like to recognize the accomplishments of those that have served this community; and Whereas, Daniel O’Rourke saw a need in the Borough of Lindenwold for the youth and founded Lindenwold Pack 120 in 2015; and Whereas, Daniel O’Rourke served as Pack 120’s first Cub Master growing this unit from 3 members to the current number of 18; and Whereas, under Daniel O’Rourke’s leadership in 2016, Pack 120 dominated in the annual Scout Popcorn Sale as the highest selling unit in their White Horse District and the fourth highest selling unit in the Garden State Council; and Whereas, on May 15, 2017, Daniel O’Rourke earned the Cub Master’s Key Award; and Whereas, Daniel O’Rourke also completed the advanced adult leadership training program known as Wood Badge on October 19, 2017; and Whereas, Daniel O’Rourke has taken extensive training classes in order to mentor to the youth of Lindenwold including special needs children; and Whereas, in addition to his numerous scouting duties, Daniel O’Rourke is an Aikido assistant and works as a nursing home volunteer; and Whereas, Daniel O’Rourke also serves as Vice President of the Good Shepherd Lutheran Church of Lindenwold and currently serves as the Assistant Cubmaster and Chartered Organization Representative of Pack 120 to help focus on the Pack’s growth. Now, Therefore, I, Richard E. Roach, Jr., Mayor of the Borough of Lindenwold, on behalf of myself and the Borough Council on this 25th day of September, 2019, hereby congratulate Daniel O’Rourke on his accomplishments and commend and applaud his commitment to the Lindenwold Pack 120 and for dedicating his time and effort to the youth of our community. RESOLUTION 2019:180 Award Cooperative Pricing for Natural Gas with Camden Co. WHEREAS, N.J.S.A. 40A:11-11(5) authorizes contracting units to establish a Cooperative Pricing System and to enter into Cooperative Pricing Agreements for its administration, and WHEREAS, the County of Camden hereinafter referred to as the Lead Agency has offered voluntary participation in a Cooperative Pricing System under the South Jersey Power Cooperative E8802 for the supply and delivery of Natural Gas for a term of 36 months commencing December 1, 2019 through November 30, 2022, and WHEREAS, the lowest bidder for bid Bid A-37/2019 is with Direct Energy Business Marketing, LLC, 194 Wood Avenue South, Second Floor, Iselin, New Jersey 08830 for Lot 1C and Lot 4C in Appendix A, and WHEREAS, the lowest bidder for bid Bid A-37/2019 is with UGI Energy Services, 1 Meridian Boulevard, Suite 2C01, Wyomissing, Pennsylvania 19610 for Lot 2C, Lot 3C and Lot 5C in Appendix A, and NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Lindenwold as follows: 1. RESOLUTION 2019:181 Corrective Action Plan WHEREAS, the Borough of Lindenwold has received a report of audit for the year ending December 31, 2018; and WHEREAS, the New Jersey Division of Local Government Services requires that the Chief Financial Officer submits a Corrective Action Plan for all findings in the audit within 60 days of receipt of the Report of Audit; and WHEREAS, the Chief Financial Officer has completed a Corrective Action Plan relating to the findings of the 2018 Audit; COUNCIL CAUCUS MEETING September 25, 2019 Page | 7 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Lindenwold, that it does hereby approve the Corrective Action Plan for the 2018 Report of Audit. RESOLUTION 2019:182 Part-Time Laborer WHEREAS, there is a need in the Public Works Department to hire Part-Time Laborer, and WHEREAS, it is the procedure of the Borough of Lindenwold to hire employees by resolution, and WHEREAS, Brandon Stickney has been recommended for this position. THEREFORE BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that Brandon Stickney be hired as a Part-Time Laborer after successfully completing employment screening. Resolution 2019:183 Award Sewer Pump Whereas, the Borough of Lindenwold recognizes that it is imperative to search for efficient means to reduce spending through creative and innovative ideas and programs which benefit their community, and Whereas, the Borough of Lindenwold became a member of the North Jersey Wastewater Cooperative Pricing System, NJWCPS, effective September 26, 2018 under Resolution 2018:216 and Resolution 2019:59 and Whereas, the Borough of Lindenwold, pursuant to N.J.S.A. 52:34-6.2 (B) (3) may, by Resolution and without advertising for bids, purchase any goods or services through the NJWCPS, and Whereas, this equipment is being purchased from Reiner Pump Systems, Inc., 53 US Highway 206, Stanhope, NJ 07874, and Whereas, the Borough of Lindenwold wishes to purchase equipment including Sulzer submersible pump for the Lindenwold Sewer Department for a total of $102,927.75. Now, Therefore, Be It Resolved that the Mayor and Borough Council of the Borough of Lindenwold are hereby authorized to award the purchase of the equipment including Sulzer submersible pump from Reiner Pump Systems, Inc. Resolution 2019:184 Support The Referendum On The Election Ballot For Veterans Or Widowed Spouses Of Veterans Who Reside In Continuing Care Retirement Communities (CCRC) Will Be Eligible For Property Tax Deduction WHEREAS, the State Constitution for New Jersey authorizes veterans and widowed spouses of veterans who served in active duty during war and other times of emergency to receive a property tax deduction, in the amount of $250 per year, in well-deserved recognition of their service to our country; and WHEREAS, veterans and widowed spouses of veterans who reside in Continuing Care Retirement Communities (CCRC) have been unfairly denied eligibility for the $250 property tax deduction because they do not own their units, even though they instead contribute to property taxes through a monthly payment, and even though they have made the same sacrifices as all veterans in our great country; and WHEREAS, there are twenty-five CCRCs in the State which collectively house approximately 2,500 veterans or widowed spouses who are being denied the property tax deduction; and WHEREAS, Senator Vin Gopal has sponsored legislation (SI331), that has been approved by the Senate and General Assembly, to extend the deduction to veterans and their widowed spouses in CCRCs; and WHEREAS, the extension of the deduction, because it requires an amendment to the State Constitution, must be approved by the voters at the ballot in November before it will become valid and effective; and WHEREAS, the Mayor and Borough Council now desire to memorialize their support of the referendum on the ballot in November, and to urge the voters of this State to vote in favor of the property tax deduction for veterans and widowed spouses of veterans who reside in CCRCs. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of Borough of Lindenwold urges voters to support the referendum on the ballot in November 2019, so that veterans and widowed spouses of veterans who reside in Continuing Care Retirement Communities ("CCRC") will be eligible for the $250 property tax deduction; and BE IT FURTHER RESOLVED that the Mayor and Borough Council believes that this small benefit to our veterans and widowed spouses of veterans who reside CCRCs is a proper and warranted acknowledgment of the tremendous sacrifices that veterans have given to protect and serve. RESOLUTION 2019:185 Declaring And Determining That Lot 4, 4.01, & 5 Block 200, Located At 427-431-435 Chews Landing Rd., Lindenwold, NJ 08021, Is In Violation Of Borough Ordinance 160, Prohibiting Dangerous, Damaged, And Unfit Structures WHEREAS, the Borough of Lindenwold having notified the owner of the real property located at Lot 4, 4.01, & 5 Block 200, Located At 427-431-435 Chews Landing Rd., Lindenwold, NJ 08021 of a potential violation of Borough Code Chapter 160, Article VII,, which prohibits dangerous, damaged, and unfit structures, and WHEREAS, notice was provided to the owner of the property, and all lien holders, mortgage holders, and interested parties maintaining an encumbrance and/or lien on the property, consistent with the requisites of Chapter 160, Article VII, and WHEREAS, on September 25, 2019, the Mayor and Council heard testimony from the Construction Official concerning the real property located at Lot 4, 4.01, & 5 Block 200, Located At 427-431-435 Chews Landing Rd., Lindenwold, NJ 08021 concerning the conditions and circumstances of the real property, and no interested party having appeared or otherwise filing opposition to the Notice and Complaint, and WHEREAS, the Mayor and Council of the Borough of Lindenwold after hearing the testimony of the Construction Official, having made a factual determination that Lot 4, 4.01, & 5 Block 200, Located At 427-431-435 Chews Landing Rd., Lindenwold, NJ 08021, is in violation of Borough Code Chapter 160, Article VII,, and maintains conditions on the property to include without limitation the following: Defects increasing the hazard of accident, fire, or other calamities. Dilapidation. Disrepair or structural defects. Lack of adequate light, sanitary facilities or ventilation. Uncleanliness. Failure to comply with the property maintenance code. Failure to comply with applicable Health Ordinances Rules and Regulations. Is otherwise in violation of N.J.S.A. 40:48-1 et seq., and the provisions of Borough Ordinance 160; and NOW THEREFORE, be it resolved by the Mayor and Council of the Borough of Lindenwold, County of Camden, State of New Jersey on this 25th day of September, 2019 that Lot 4, 4.01, & 5 Block 200, Located At 427-431-435 Chews Landing Rd.., Lindenwold, NJ 08021 is in violation of Borough Code Chapter 160, Article VII,. The Borough further finds that it is unreasonable and untenable to remediate the property, given the dilapidated and damaged status of the property. The Borough finds that it is in the best interest of the Community to demolish the property, for the safety and general welfare for the residents of the Borough of _.A ../Jo/e COUNCIL CAUCUS MEETING September 25, 2019 Page | 8 Lindenwold, and the public in general. The Construction Official is authorized to obtain bids to demolish the property, and a lien for all costs associated with demolition and this application shall be placed upon the property to indemnify the Borough for all costs associated with the violation of Borough Code Chapter 160, Article VII,. Mayor Roach opened the meeting to the public. Diane Veteri, resident, requested an updated for the property. President Randolph-Sharpe was unable to obtain any information from the state that is operating the house. Code Enforcement Officer also responded that the state handles all inspections and supersedes the municipality. There being no one else desiring the floor, the Mayor closed the meeting to the public. President Randolph-Sharpe expressed that Lindenwold Day was another success. She said it was a lovely day and well attended. She thanked everyone for their participation including the staff, volunteers, and various departments that attended. Councilwoman Sinon informed the residents that Homeward Bound was offering a program for the chipping of animals for only $30. This service is free for those that adopt a pet from them.
