Resolution 2020:89 Executive Session BE IT RESOLVED by the Mayor and Council of the Borough of Lindenwold that the Mayor and Council are now going into closed session to discuss legal matters, Personnel-Code Enforcement/Construction Office, and Handbook update Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico that Resolution 2020:89 be adopted as read. Resolutions for Police Promotions: Resolution 2020:90 Promotion to Police Captain WHEREAS, the Borough of Lindenwold has identified a need to fulfill the position of Captain in the Lindenwold Police Department, and WHEREAS, Civil Service Certification has been requested, and WHEREAS, it is the procedure of the Borough of Lindenwold to promote employees by resolution, and WHEREAS, Mayor and Council has accepted the recommendation to appoint Lt. Michael Cavallaro to the position of Police Captain. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that Lt. Michael Cavallaro be promoted to the position of Police Captain upon certification by New Jersey Civil Service Commission. Resolution 2020:91 Promotions to Police Lieutenant WHEREAS, the Borough of Lindenwold has identified the need to fulfill two positions in the Lindenwold Police Department for Police Lieutenants, and WHEREAS, Civil Service Certification has been requested, and WHEREAS, it is the procedure of the Borough of Lindenwold to promote employees by resolution, and WHEREAS, Mayor and Council has accepted the recommendation to appoint Sgt. Robert Helveston and Sgt. Kenneth Balmer to the position of Police Lieutenant. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that Sgt. Robert Helveston and Sgt. Kenneth Balmer be promoted to the position of Police Lieutenant upon certification by New Jersey Civil Service Commission. Resolution 2020:92 Promotions to Police Sergeant WHEREAS, the Borough of Lindenwold has identified the need to fulfill two positions in the Lindenwold Police Department for Sergeant, and WHEREAS, Civil Service Certification has been requested, and WHEREAS, it is the procedure of the Borough of Lindenwold to promote employees by resolution, and WHEREAS, Mayor and Council has accepted the recommendation to appoint Officer Edward Slimm and Officer Anthony Pizzo to the position of Police Sergeant. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that Officer Edward Slimm and Officer Anthony Pizzo be promoted to the position of Police Sergeant upon certification by New Jersey Civil Service Commission. He recognized the former officers who were present including members of the Fire Department who were present. Mayor Roach requested a five minute recess. Mr. Johnson of the Lindenwold High School made a presentation to the Environmental Commission in recognition of the joint effort for Arbor Day and the planting of trees and other endeavors to improve the environment. Mr. Johnson thanked Mayor and Council and the Environment Commission for their support over the years. Second Reading Ordinance 2020-1 Amend Chapter 260 Sewer Use ORDINANCE AMENDING CHAPTER 260 SEWER USE OF THE CODE OF THE BOROUGH OF LINDENWOLD WHEREAS, the Borough of Lindenwold recommends revising the Codes pertaining to Chapter 260 Sewer Use, and WHEREAS, this recommendation addresses residential properties in the Borough of Lindenwold that are vacant/abandon, and WHEREAS, there is a need for oversight pertaining to these properties in the Borough of Lindenwold. NOW, THEREFORE, BE IT ORDAINED by the Borough of Lindenwold that ARTICLE II for Chapter 260 be added as follows: ARTICLE II 260-46. Abandoned Properties Sewer Lines A. If the property owner wishes to abandon the sewer line on the property, sewer personnel must attest to the sewer lateral being properly abandoned or capped with the proper means and materials. It is mandatory that all sewers shall be capped as close to the curb line as possible. If no curb line is present, then an attempt shall be made to be as close to the road surface or easement as possible. All paperwork must be acquired by the Lindenwold Sewer Department prior to abandoning sewer lines. Upon inspection, the owner of said property shall no longer receive a sanitary sewer bill. The reason for abandonment shall be noted with the Lindenwold Sewer Department. B. If the property owner wishes to keep a sewer connection present for future building or occupancy, the property owner must inform the Lindenwold Sewer Department. This will ensure that said owner shall continue to receive a sanitary sewer bill for said property. This will alleviate the need for a new connection fee. The reason for abandonment shall be noted with the Lindenwold Sewer Department. C. If the existing sanitary sewer line is present and the account is up to date, a sanitary sewer connection permit is not necessary. If the current account is paid and up to date, the resident would not be required to pay a connection fee. This is not to be confused with a plumbing permit. D. For any new or existing property meeting the above criteria, the Lindenwold Sewer Department must receive a copy of the final engineer’s drawings. The Lindenwold Sewer Department should be notified of any changes made to the existing plans. If any section, subsection, paragraph, sentence, clause or phrase of the Ordinance shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this Ordinance which shall continue in full force and effect, as to this end the provisions of the Ordinance are hereby declared to be severable. This ordinance shall take effect immediately upon passage and publication as required by law. Mayor Roach opened the meeting to the public. First Reading Ordinances:2020-05 to 2020-07 Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico that Ordinance 2020-05 to Ordinance 2020-07 be adopted on first reading, published according to law, with second reading being held at next regular scheduled meeting. Ordinance 2020-05 Redevelopment Ordinance Of The Borough Of Lindenwold, County Of Camden And State Of New Jersey Approving The Acquisition Of Certain Land By The Borough Of Lindenwold From Milred Jackson, And Authorizing The Litigation Necessary To Implement Said Acquisition Ordinance 2020-06 Ordinance Amending Chapter 365 Signs of the Code of the Borough of Lindenwold WHEREAS, the Municipal Governing Body of the Borough of Lindenwold wishes to ensure consistency in its provisions, and WHEREAS, a review of Chapter 365 Sign Regulations for the Borough of Lindenwold have been reviewed, and WHEREAS, the Mayor and Governing Body have approved these recommendations to Chapter 365-88 Permitted Signs, Section L regarding temporary signs of the Code of the Borough of Lindenwold as follows: L. Temporary signs announcing or advertising any political, educational, charitable, civic, professional, religious or like campaign or event for a consecutive period not to exceed 30 days in any calendar year, provided that they do not exceed 50 square feet in size, and must be removed 5 days after the date of event. 1. Temporary election signs shall not be erected, installed, posted and/or placed in any municipal right-of-way. 2. Temporary election signs shall be limited to one sign per lot per campaign and shall contain no commercial message of logo. For purposes of this section, the term “campaign” shall mean a candidate or group of candidates running together for one office or position or several seats on one governmental or quasi-governmental body or board. COUNCIL CAUCUS MEETING February 26, 2020 Page | 3 3. All temporary election signs shall be ground-mounted. No temporary sign shall be temporarily or permanently affixed to a utility pole, telephone pole, light standard, traffic sign, fire hydrant, fence or other public utility or structure or posted, painted or otherwise affixed to trees, rocks or other natural features on any lot or within any street right-of-way or in another manner placed within any street right-of-way or placed on any property owned by the Borough. If any section, subsection, paragraph, sentence, clause or phrase of the Ordinance shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this Ordinance which shall continue in full force and effect, as to this end the provisions of the Ordinance are hereby declared to be severable. This ordinance shall take effect immediately upon passage and publication as required by law. Ordinance No. 2020-07 Ordinance Amending Chapter 296 Streets And Sidewalks Of The Code Of The Borough Of Lindenwold WHEREAS, the Municipal Governing Body of the Borough of Lindenwold wishes to ensure consistency in its provisions, and WHEREAS, a review of Chapter 296, Section 46 Failure to Comply for the Borough of Lindenwold has been reviewed, and WHEREAS, the Mayor and Governing Body has approved the recommendations to Chapter 296-46 Failure to Comply with the Code of the Borough of Lindenwold as follows: § 296-46 Failure to Comply If the owner of the lands in question shall refuse or neglect to abate or remedy the condition within the time allowed following receipt of notice pursuant to this article, the Director of Public Works may, at their discretion, cause the condition to be remedied and shall certify the cost to the Borough Administrator or representative, who shall cause the costs as shown to be charged against the lands. The amount so charged shall forthwith become a lien upon such lands and shall be added to and become and form a part of the taxes next to be assessed and levied upon such lands, and such amount shall bear interest at the same rate as taxes and shall be collected and enforced in the same manner as taxes. If any section, subsection, paragraph, sentence, clause or phrase of the Ordinance shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this Ordinance which shall continue in full force and effect, as to this end the provisions of the Ordinance are hereby declared to be severable. RESOLUTION 2020:93 Promotion to Public Works Supervisor WHEREAS, the Borough of Lindenwold has identified the need to fulfill the position of Public Works Supervisor, and WHEREAS, Civil Service Certification has been requested, and WHEREAS, it is the procedure of the Borough of Lindenwold to promote employees by resolution, and WHEREAS, Mayor and Council has accepted the recommendation to appoint George Turner to the position of Public Works Supervisor with an annual salary of $75,000. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that George Turner be promoted to the position of Public Works Supervisor upon certification by New Jersey Civil Service Commission. RESOLUTION 2020:94 Promotion to Public Works Crew Supervisor WHEREAS, the Borough of Lindenwold has identified the need to fulfill the position of Public Works Crew Supervisor due to a vacancy, and WHEREAS, it is the procedure of the Borough of Lindenwold to promote employees by resolution, and WHEREAS, Mayor and Council has accepted the recommendation to appoint Kevin Wells to the position of Public Works Crew Supervisor with an annual salary of $68,000. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that Kevin Wells be promoted to the position of Public Works Crew Supervisor. RESOLUTION 2020:95 Refund Tax and Sewer Overpayment WHEREAS, Terry Migrala requested a refund for payment of the sewer bill for 4117 Arborwood, and WHEREAS, the Borough Solicitor has confirmed that this property is part of the Redevelopment process with a complaint filed on May 23, and WHEREAS, the Tax Collector has recommended a refund for taxes that were paid during the 2019 fourth quarter and 2020 first quarter, and WHEREAS, Terry Migrala is due a refund totaling $514.80 for taxes and sewer fees that were overpaid. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that the amount of $514.80 for the overpayment of sewer and taxes be refunded to Terry Migrala. RESOLUTION 2020:96 Appoint Library Board Member WHEREAS, there is a need for a member to the Library Advisory Board for the Borough of Lindenwold. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold, New Jersey that the following be and are hereby appointed as a member to the Library Advisory Board: Dawn Dreher 2/26/20 to 12/31/22 RESOLUTION 2020:97 Appointment of Representatives for Drug and Alcohol Policy COUNCIL CAUCUS MEETING February 26, 2020 Page | 4 WHEREAS, the Borough of Lindenwold is committed to maintaining a safe, pleasant, and productive working environment, and WHEREAS, the Borough of Lindenwold has adopted a Drug and Alcohol Testing Policy, and WHEREAS, there is a need for the Borough of Lindenwold to appoint representatives as part of the Drug and Alcohol Testing Policy, and WHEREAS, the Public Works Supervisor, Craig Wells, has been recommended as the Designated Employer Representative(DER), and WHEREAS, Kevin Wells has been recommended as the Alternative Designated Employer Representative. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold, New Jersey that Craig Wells be appointed as the Designated Employer Representative and Kevin Wells as the Alternative Designated Employer Representative. Resolution 2020:98 Authorize Engineering for FY2020 NJDOT Trust Fund for Signalized Intersection Improvements WHEREAS, there is a need for the Borough of Lindenwold to have a review, preparation of specifications and construction oversight for the FY2020 NJDOT Trust Fund for Signalized Intersection Improvements at Clementon-Gibbsboro Road (CR 686) and Egg Harbor Road (CR 702)/Carlton Avenue/Berlin Avenue (CR 702 )in the Borough of Lindenwold; and WHEREAS, under the Fair and Open process, the Borough of Lindenwold received and awarded an Engineering Services contract for the year 2020 to Remington and Vernick of which includes writing of specifications and contract administration in their scope of work, and WHEREAS, Remington and Vernick submitted a cost proposal on February 6, 2020. THEREFORE, BE IT RESOLVED by the Mayor and the Borough Council, County of Camden, State of New Jersey to authorize Remington & Vernick Engineers to prepare the review specifications for FY2020 NJDOT Trust Fund for Signalized Intersection Improvements at Clementon-Gibbsboro Road (CR 686) and Egg Harbor Road (CR 702)/Carlton Avenue/Berlin Avenue (CR 702) with a cost for engineering and construction oversight to be funded by the grant with the estimated cost to the Borough for the amount awarded by the New Jersey Department of Transportation with a not to exceed cost of $42,700 for Engineering/Surveying and a not to exceed cost of $27,100 for Contract Administration/Construction Inspection. Motion was made by President Randolph-Sharpe, second by Councilman Jackson that Resolution 2020:98 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. Mayor Roach opened the meeting to the public. Diane Veteri, resident, asked for the status of the investigation. She also asked about any information on the resident who spoke last week of being stalked since the elections. Mayor stated that nothing was submitted regarding the matter. President Randolph-Sharpe thanked the Business Administrator and Sorority Sisters for their donation of toys for the Lindenwold Preschool that they presented to the Lindenwold School Board. Councilwoman Hess informed the residents that flyers are available for the first Lindenwold Community Yard Sale April 25.
