Roll Call of Council Members Present: DiDomenico, Hess, Jackson, Sinon, Strippoli, President Randolph-Sharpe, and Mayor Roach. Resolution 2020:115 Executive Session BE IT RESOLVED by the Mayor and Council of the Borough of Lindenwold that the Mayor and Council are now going into closed session to discuss Legal Updates, Personnel Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico that Resolution 2020:115 be adopted as read. Voice call vote was unanimous in the affirmative. Motion carried. Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico to go out of executive session. Voice vote was unanimous in the affirmative. Motion carried. RESOLUTION 2020:116 Introduce Budget by Title Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico that Resolution 2020:116 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. WHEREAS, N.J.S. 40A:4-8, as amended by L.2015, c. 95, § 14, 2015 provides that the budget may be read by title only at the time of the public hearing if a resolution is passed by not less than a majority of the full governing body, providing that at least one week prior to the date of hearing, a complete copy of the budget has been made available for public inspection, and has been made available to each person upon request; and WHEREAS, these two conditions have been met; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that the budget shall be read by title only. Public Hearing on the 2020 Budget was conducted by the Lindenwold Business Administrator. She started by reviewing the financial status of 2019. Next, she presented the projections for the 2020 budget year including the General Fund, Sewer Utility Fund, and Capital projects. The presentation was also available on the Borough website for residents to view. RESOLUTION 2020:117 - Adopt 2020 Budget Motion was made by President Randolph-Sharpe, second by Councilman Strippoli that Resolution 2020:117 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. President Randolph-Sharpe thanked the Administrator for all her hard work on the budget and presentation. BE IT RESOLVED that the following statements and revenues and appropriations shall constitute the Municipal Budget for the year 2020, and 1. Appropriations within “CAPS” (a) Municipal Purposes $13,937,287.16 2. Appropriations excluded from “CAPS” (a) Municipal Purposes 1,344,896.90 Total General Appropriations excluded from “CAPS” 1,344,896.90 Reserve for Uncollected Taxes 1,391,809.94 4. Total General Appropriations 16,673,994.00 5. Less: Anticipated Revenues Other than Current Property Tax 6,532,752.86 6. Difference: Amount to be Raised by Taxes for Support of Municipal Budget: (a) Local Tax for Municipal Purposes Including Reserve for Uncollected Taxes 10,141,241.14 BE IT FURTHER RESOLVED that the Governing Body of the Borough of Lindenwold does hereby adopt the budget for the year 2020. CONSENT AGENDA: The items listed below are considered routine by the Borough of Lindenwold and will be enacted by one motion. There will be no formal discussion of these items. If discussion is desired, this item will be removed from the Consent Agenda and will be considered separately. RESOLUTION 2020:118 Adopting The 3-Year Cooperation Agreement With The County Of Camden WHEREAS, the Borough of Lindenwold and the County of Camden wish to establish a cooperative means of conducting certain eligible community development and affordable housing activities; and WHEREAS, the Uniform Shared Services and Consolidation Act (N.J.S.A. 40A:65-4 et seq.) permits local units such as counties and municipalities to enter into agreements for the provision of joint services; and WHEREAS, Title 1 of the Housing and Community Development Act of 1974, the Housing and Urban-Rural Recovery Act of 1983, the HOME Program Acct of 1991, and the Emergency Solutions Grant, as amended, provides COUNCIL CAUCUS MEETING May 27, 2020 Page | 2 federal funds being made available to Camden County for use to carry out eligible Community Development Activities therein; and WHEREAS, the Borough of Lindenwold will propose certain activities to be carried out under the 2021, 2022 and 2023 Community Development, HOME Programs and Emergency Solutions Grant programs; and WHEREAS, the aforesaid activities are in the best interest of the Borough of Lindenwold and the County of Camden; NOW, THEREFORE, BE IT RESOLVED, by the GOVERNING BODY of the Borough of Lindenwold that the 2021 to 2023 Cooperation Agreement be adopted; BE IT FURTHER RESOLVED that this Resolution shall take effect immediately upon its enactment. RESOLUTION 2020:119 Award Traffic Signal Upgrades WHEREAS, the Borough Clerk did advertise for and receive bids on May 20, 2020 at 10:00 a.m. for the FY20 NJDOT State Aid Program for Traffic Signal Upgrades at Intersection of Clementon-Gibbsboro and Egg Harbor Rd/Carlton Avenue and Berlin Avenue, and WHEREAS, the Certificate as to Availability of Funds is annexed hereto, and WHEREAS, Addendum A is a list of the bidders, and WHEREAS, Remington & Vernick Engineers has recommended that the contract for the FY2020 NJDOT State Aid Program for Traffic Signal Upgrades at Intersection of Clementon-Gibbsboro and Egg Harbor Rd/Carlton Avenue and Berlin Avenue be awarded to Kane Communications, LLC, 572 Whitehead Road, Suite 201, Trenton, New Jersey 08619, lowest responsive bidder for Base Bid Items 1 through 48 with the amount of $228,640.00. This contract is to be awarded contingent upon the approval of the solicitor and the monies being available. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that: 1. RESOLUTION 2020:120 Property Maintenance Lien WHEREAS, the following property in the Borough of Lindenwold had property maintenance work done by the Lindenwold Public Works for Code Compliance, and WHEREAS, lien should be put on the following property for the cost of performing this work: Invoice Date Block Lot Address Amount 5/13/20 133 2 505 Irving(hole) $178.00 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that lien be put on this property. Resolutions: RESOLUTION 2020:121 –Extend Recycling to FCR Camden, LLC Motion was made by President Randolph-Sharpe, second by Councilman Jackson that Resolution 2020:121 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. WHEREAS, the Borough of Lindenwold participated with Camden County for recycling services, and WHEREAS, Camden County requested proposals for recycling services #17-10, and WHEREAS, FCR Camden, LLC (d/b/a ReCommunity) was awarded this contact by Camden County and adopted by the Borough of Lindenwold under Resolution 2017:137, and WHEREAS, the Borough of Lindenwold is a participating member of the Camden County Cooperative Pricing System Identifier #57-CCCPS, and WHEREAS, the Borough of Lindenwold has reviewed the proposal and wishes to enter into an additional year agreement with FCR Camden LLC (d/b/a ReCommunity) for recycling services. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold to accept and sign the contract received by the Camden County Cooperative with FCR Camden, LLC (d/b/a ReCommunity) for recycling services. RESOLUTION 2020:122 Authorize R & V Repaving of Linden Town Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico that Resolution 2020:122 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. WHEREAS, the Borough of Lindenwold desires to apply to the New Jersey Department of Transportation for a grant for the Repaving of Linden Town; and WHEREAS, The Borough of Lindenwold formally authorizes Remington & Vernick Engineers to prepare the grant application. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Lindenwold approves the grant application for the project stated above BE IT FURTHER RESOLVED, that the appropriate officials are hereby authorized to submit an electronic grant application for the Repaving of Linden Town to the New Jersey Department of Transportation on behalf of Lindenwold Borough. BE IT FURTHER RESOLVED, that the appropriate officials are hereby authorized to sign the grant agreement on behalf of Lindenwold Borough and that their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement. COUNCIL CAUCUS MEETING May 27, 2020 Page | 3 RESOLUTION 2020:123 Authorizing The Tax Collector To Process Third Quarter “Estimated” Tax Bills Motion was made by President Randolph-Sharpe, second by Councilman Strippoli that Resolution 2020:123 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. WHEREAS, in light of the disruption caused by the coronavirus outbreak, the State delayed the adoption of the State Fiscal Year 2021 Budget to September 30, 2020; and WHEREAS, the Division of Local Government Services (DLGS) cannot certify State Aid allocations to municipal budgets until State Aid Appropriations are known; and WHEREAS, the DLGS cannot approve municipal budgets and the County Board of Taxation cannot certify taxes until long after the June 30, 2020 deadline to process third quarter tax bills due August 1, 2020; and WHEREAS, without an adopted 2020 Municipal Budget and without a 2020 Certified Tax Rate, the Tax Collector cannot process the final 2020 Tax Levy; and WHEREAS, the DLGS “strongly recommends” under Local Finance Notice 2020-07 “that municipalities prepare to issue estimated property tax bills for 2020;” and WHEREAS, the Tax Collector, in consultation with the Chief Financial Officer, computed and certified an estimated Tax Levy necessary to bill third quarter taxes due August 1, 2020 NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Lindenwold, in the County of Camden and State of New Jersey on this 27th day of May, 2020 that the Tax Collector is hereby authorized and directed to process estimated tax bills for the third quarterly installment of 2020 taxes; and BE IT FURTHER RESOLVED that, the third quarterly installment of 2020 taxes shall not be subject to interest until the later of August 10, 2020 or the twenty-fifth (25) calendar day after the date the estimated tax bills were mailed. The estimated tax bills shall contain a notice specifying the date on which interest may begin to accrue. BE IT FURTHER RESOLVED, that the Borough of Lindenwold Tax Collector is hereby authorized to prepare and issue estimated tax bills for the third installment of 2020 based upon an annualized levy analysis totaling $30,391,828. The Tax Collector shall proceed and take such actions as are permitted and required by P.L. 1994, c.72 (N.J.S.A. 54:4- 66.2 and 54:4-66.3). RESOLUTION 2020:124 Appropriation Reserve Transfer Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico that Resolution 2020:124 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. Diane Veteri, resident, complained about neighbor’s property but stated the grass was cut today. Next, she stated that at a prior meeting she was told that employees are still working even though the Borough is closed. However, on Facebook she is seeing posts that no one is responding to the residents. The Mayor said for her to send it as he is not seeing that. There being no one desiring the floor, the Mayor closed the meeting to the public. Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that the meeting be adjourned. Voice vote was unanimous in the affirmative. Motion carried. Mayor Roach provided an update to the number of cases. The numbers are coming down but unfortunately there was a death today for a total of five. He reminded everyone to stay off the playground equipment.
