Resolution 2020:167 Executive Session BE IT RESOLVED by the Mayor and Council of the Borough of Lindenwold that the Mayor and Council are now going into closed session to discuss Legal Updates, Personnel, and Contract Negotiations Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico that Resolution 2020:167 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon to go out of executive session. Voice vote was unanimous in the affirmative. Motion carried. CONSENT AGENDA: The items listed below are considered routine by the Borough of Lindenwold and will be enacted by one motion. There will be no formal discussion of these items. If discussion is desired, this item will be removed from the Consent Agenda and will be considered separately. Resolution 2020:168-173 Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico that Resolution 2020:168 to Resolution 2020:173 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. RESOLUTION 2020:168 Cancellation Of Municipal Taxes WHEREAS, by Ordinance 2017-15, the Borough Council of the Borough of Lindenwold, adopted on August 9, 2017, the Redevelopment Plan as recommended and approved by the Borough of Lindenwold Joint Land Use Board, providing for Redevelopment of those areas of land within the Borough of Lindenwold, as more particularly described as Block 243, Lots 7.01, 7.02, and 7.04, and all Qualifiers thereto on the Official Tax Map of the Borough of Lindenwold, and designated said lands and properties as an “area in need of redevelopment” and designated as a “Condemnation Redevelopment Area” pursuant to N.J.S.A 40A:12A-6; and WHEREAS, the Borough of Lindenwold has acquired, and continues to acquire, title to the Real Properties subject of the referenced Redevelopment Designation and included in the Condemnation Redevelopment Area, known as Block 243, lot 7.01, lot 7.02, and 7.04, and all Qualifiers thereto on the Official Tax Map of the Borough of Lindenwold, by Declarations of Taking filed pursuant to the New Jersey Local Housing and Redevelopment Law, N.J.S.A. 40A:12A-1, et. seq., and the New Jersey Eminent Domain Law, N.J.S.A. 20:3-1, et seq. filed with the clerk of the Superior Court, and filed with the Clerk of Camden County, and WHEREAS, the Borough of Lindenwold maintains and/or maintained municipal tax assessments and/or municipal tax liens on various properties designated within the aforementioned Condemnation Redevelopment Area, subject to acquisition pursuant to the New Jersey Local Housing and Redevelopment Law, N.J.S.A. 40A:12A-1, et. seq., and the New Jersey Eminent Domain Law, N.J.S.A. 20:3-1; and WHEREAS, N.J.S.A. 20:3-19 permits a right to the immediate and exclusive possession and title to a property described in a Declaration of Taking, which shall vest in the condemnor, free and discharged of all right, title, interest and liens of all condemnees, including municipal taxes, without the necessity of further process; and WHEREAS, the municipal tax assessments and/or municipal tax liens existing on various properties located in the aforementioned Condemnation Redevelopment Area may be cancelled pursuant to N.J.S.A. 20:3-19. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Lindenwold, that the Tax Collector is authorized to cancel of record municipal tax assessments and/or municipal tax liens for any property acquired, or to be acquired, by the Borough of Lindenwold, as appropriate pursuant to the Redevelopment Plan and Redevelopment Designation adopted in Ordinance 2017-15, within the defined Condemnation Redevelopment Area, located at Block 243, Lot 7.01, 7.02, and 7.04. RESOLUTION 2020:171 Camden County Purchasing- Paper WHEREAS, N.J.S.A. 40A:11-11(5) authorizes contracting units to establish a Cooperative Pricing System and to enter into Cooperative Pricing Agreements for its administration, and WHEREAS, the County of Camden hereinafter referred to as the Lead Agency has offered voluntary participation in a Cooperative Pricing System for copy, computer paper and envelopes as awarded to the vendors listed below for a term of six months commencing on or about October 1, 2020 through March 31, 2021 with the option of an additional six months extension. NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Lindenwold as follows: 1. This resolution shall be known and may be cited as the Cooperative Pricing Resolution of the Borough of Lindenwold. 2. Pursuant to the provisions of N.J.S.A. 40A:11-11(5) the Mayor is hereby authorized to enter into a Cooperative Pricing Agreement with the Lead Agency. 3. The Lead Agency shall be responsible for complying with the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq) and all other provisions of the revised statutes of the State of New Jersey. 4. This resolution shall take effect immediately upon passage. RESOLUTION 2020:172 Camden County Purchasing-Sodium Chloride WHEREAS, N.J.S.A. 40A:11-11(5) authorizes contracting units to establish a Cooperative Pricing System and to enter into Cooperative Pricing Agreements for its administration, and WHEREAS, the Borough of Lindenwold participated with the County of Camden hereinafter referred to as the Lead Agency originally offered voluntary participation in a Cooperative Pricing System for Sodium Chloride and Pre- treated Liquid Enhanced Sodium Chloride as awarded to various vendors as listed under the Camden County Cooperative Pricing System #57-CCCPS for the first year with an option to renew in the second year, and WHEREAS, Camden County Board of Chosen Freeholders has authorized the first year option, and WHEREAS, Atlantic Salt, Inc. was the lowest responsible bidder for Sodium Chloride at the price of $48.00 per ton for the first year, and WHEREAS, Atlantic Salt, Inc. was the lowest responsible bidder for Pre-treated Liquid Enhanced Sodium Chloride at the price of $62.00 per ton for the first year, and WHEREAS, there is a second year option to renew. NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Lindenwold as follows: 1. This resolution shall be known and may be cited as the Cooperative Pricing Resolution of the Borough of Lindenwold. 2. Resolution 2020:173 Cooperative Vendors Authorizing Contracts With Certain Approved Cooperative Contract Vendors For Contracting Units Pursuant To N.J.S.A. 40A:11-11(5) WHEREAS, the Borough of Lindenwold, pursuant to N.J.S.A. 40A:11-11(5) specifically authorizes two or more contracting units to establish a Cooperative Pricing System for the provision and performance of goods and services and enter into a Cooperative Pricing Agreement for its administration; and WHEREAS, the Cherry Hill Cooperative Pricing System, System Identifier No. 37-CHCPS is conducting a voluntary Cooperative Pricing System with other contracting units; and WHEREAS, this Cooperative Pricing System is to effect substantial economies in the provision and performance of goods and services; and WHEREAS, the Borough of Lindenwold wishes to participate as an affiliate member of the Cherry Hill Cooperative Pricing System, System Identifier No. 37-CHCPS to acquire goods and services which may be needed; and WHEREAS, there is no participation fee to be an affiliate member or to use the MRESC, Co-op; and WHEREAS, in order to participate as an affiliate member, the Borough of Lindenwold must enter in to a Participation Agreement. NOW, THEREFORE, BE IT RESOLVED that the Borough of Lindenwold, County of Camden and State of New Jersey, that the appropriate municipal officials are hereby authorized to execute a Participation Agreement for Affiliate Membership in the Cherry Hill Cooperative Pricing System, System Identifier No. 37-CHCPS; and BE IT FURTHER RESOLVED, that the governing body of the Borough of Lindenwold pursuant to N.J.A.C. 5:30-5.5(b), the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Finance Officer. Mayor Roach opened the meeting to Council President Randolph-Sharpe thanked the Business Administrator, Library Supervisor, Mayor, Councilwoman Hess, Public Works and all who helped with the Census Day of Action. It was an awesome turnout. She also thanked the school for the robocall for completing the Census. Mayor also thanked the Police Department and Census officials who participated as well as Deterdings. Business Administrator acknowledged it was a great turnout with a book bag giveaway and refreshments. The numbers increased to 55.6% which is still lower than the 2010 response. She also thanked everyone for all their support for this successful event and encouraged everyone to complete their census as time is running out. She is also working on an event at one of the apartment complexes in order to encourage more residents to complete their census. Mayor Roach informed residents that information is updated on the website. Also, in front of the Borough Hall, there is a drop box for ballots with a camera as a safety measure. Next, he stated that the total confirmed cases are 557 with 11 deaths. He recommends everyone to take precautions and wear a mask. Mayor Roach opened the meeting to the Public. Diane Veteri, resident, asked about the Council updates that have not been provided during the virtual meetings. Mayor Roach will resume at the next Business Meeting. There being no one desiring the floor, the Mayor closed the meeting to the public. Motion was made by President Randolph-Sharpe, second by Councilman Jackson that the meeting be adjourned.
