Flag Salute Roll Call of Council Members Present: Jackson, Sinon, President Randolph-Sharpe and Mayor Roach Excused Council Members: DiDomenico, Hess, and Strippoli, Resolution 2021:121 Executive Session BE IT RESOLVED by the Mayor and Council of the Borough of Lindenwold that the Mayor and Council are now going into closed session to discuss Legal Updates and Personnel Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that Resolution 2021:121 be adopted as read. Voice vote was unanimous in the affirmative. Motion carried. Motion was made by President Randolph-Sharpe, second by Councilman Jackson to go out of executive session. Voice vote was unanimous in the affirmative. Motion carried. Motion was made by Councilman Jackson, second by Councilwoman Sinon that the Council Meeting and Executive for May 12, 2021 be adopted as presented. Roll call vote was in the affirmative with President Randolph-Sharpe abstaining as she attended executive session. Motion carried. Motion was made by President Randolph-Sharpe, second by Councilman Jackson that the Council Meeting for May 26, 2021 be adopted as presented. Roll call vote was unanimous in the affirmative. First Reading Ordinance 2021-10 By Title ORDINANCE 2021-10 Non-Contractual Salary Ordinance AN ORDINANCE TO AMEND CHAPTER 52 REGULATING THE SALARIES OF THE OFFICERS AND NON- OFFICERS OF THE BOROUGH OF LINDENWOLD, COUNTY OF CAMDEN AND STATE OF NEW JERSEY Motion was made by President Randolph-Sharpe, second by Councilman Jackson that Ordinance 2021-10 be adopted on first reading, published according to law, with second reading being held at next regular scheduled meeting. Roll call vote was unanimous in the affirmative. Motion carried. CONSENT AGENDA: The items listed below are considered routine by the Borough of Lindenwold and will be enacted by one motion. There will be no formal discussion of these items. If discussion is desired, this item will be removed from the Consent Agenda and will be considered separately. Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that Resolution 2021:122 to Resolution 2021:123 be adopted as read. Roll call vote was unanimous in the affirmative. Resolution 2021:122 Sale of Property to Lindenwold Fire Commission A RESOLUTION OF THE MAYOR AND GOVERNING BODY OF THE BOROUGH OF LINDENWOLD AUTHORIZING THE SALE OF SURPLUS PERSONAL PROPERTY NO LONGER NEEDED FOR PUBLIC USE WHEREAS, the Borough of Lindenwold has determined that the personal property described as Block 91, Lot 10 (garage) and 2.01 (vacant) and incorporated herein is no longer needed for public use; and WHEREAS, the Borough of Lindenwold received a request from the Lindenwold Fire Commission for the purchase of the above named property; and WHEREAS, the sale is being conducted pursuant to N.J.S.A. 40A:11-36 and the guidance set forth in the Division of Local Government Services which allows for the sale of municipal property to any political subdivision, agency, department, commission, or board of the State, interstate agency of which NJ is a member or the US government, department of agency thereof(N.J.S.A. 40A:12-13(b)); and WHEREAS, the terms of the said purchase is the sum of $1.00 with all fees and expenses paid by the Lindenwold Fire Commission. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Governing Body of the Borough of Lindenwold, in the County of Camden, State of New Jersey, that the Borough of Lindenwold is hereby authorized to sell the surplus property as indicated above to the Lindenwold Fire Commission. Resolution 2021:123 Promotion WHEREAS, the Borough of Lindenwold has identified a need to fulfill the position of Deputy Tax Collector I in the Borough of Lindenwold, and WHEREAS, the Tax Collector made this recommendation based on the completion of the certification for Kareemah Sadiq, and WHEREAS, it is the procedure of the Borough of Lindenwold to promote employees by resolution, and WHEREAS, Mayor and Council has accepted the recommendation to appoint Kareemah Sadiq to the position of Deputy Tax Collector I. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that Kareemah Sadiq be appointed to the position of Deputy Tax Collector I. Resolution 2021:124 Authorizing Emergency Motion was made by President Randolph-Sharpe, second by Councilman Jackson that Resolution 2021:124 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. WHEREAS, an emergency has arisen with respect to the wet/well can style pump system at Sewer Pump Station #6 on Whittier Avenue has experienced a catastrophic failure as the existing electrical and mechanical components have completely deteriorated. This situation is jeopardizing the pump station function and the health, safety, and welfare of our residents, and COUNCIL CAUCUS MEETING June 23, 2021 Page | 2 WHEREAS, Environmental Resolutions, Inc. have observed the existing electrical and mechanical components of Sewer Pump Station #6 and determined that the deterioration is beyond repair. Thus, declaring this catastrophic failure an emergency, and WHEREAS, this catastrophic failure has necessitated the services of a bypass pumping contractor Xylem to maintain the station’s flow at a cost of $6,000 per month, plus a one-time mobilization cost of $3,000 with a recommendation from Environmental Resolutions, Inc. for installation of new submersible pumps and controls at Sewer Pump Station #6, and WHEREAS, the monthly appropriation for the bypass pumping services of Xylem will be provided for in the 2021 Sewer Utility Other Expenses and, NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Borough Council of the Borough of Lindenwold hereby approve the emergency that has arisen at Sewer Pump Station #6 and the recommendation from Environmental Resolutions, Inc. for the installation of new submersible pumps and controls. Resolution 2021:125 Authorizing An Agreement With Aw Urban Renewal, LLC Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that Resolution 2021:125 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. WHEREAS, the Borough of Lindenwold entered into a Redevelopment Agreement with AW Urban Renewal, LLC on August 8, 2018; and WHEREAS, Paragraph 2, Sub-paragraph c, of the Redevelopment Agreement providesthat Redeveloper shall be responsible to reimburse the Borough for Project Costs (as defined in the Redevelopment Agreement), including but not limited to attorneys’ fees, professional services, expert fees, inspections, appraisals, environmental investigations, and the costs associated with the relocation of existing owners, occupants, and tenants under N.J.S.A. 20:4-1; and WHEREAS, Redeveloper has requested a concession from the Borough, with respect to Project Costs, to include a reduction in outstanding legal fees charged by the Borough professionals; and WHEREAS, the Borough has determined that the requested concession for Project Costs will be in the best interests of furthering the completion of the Arborwood Redevelopment project, at no additional cost to the Borough, and WHEREAS, the Parties have agreed to execute an Agreement in connection therewith. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Lindenwold, that the Mayor is authorized to negotiate and execute an Agreement with AW Urban Renewal, LLC concerning a concession of Project Costs for the Redevelopment Agreement of the Arborwood Redevelopment area. Resolution 2021:126 Authorizing the Purchase Through the North Jersey Wastewater Cooperative Pricing System Contract # B195-4 Motion was made by President Randolph-Sharpe, second by Councilman Jackson that Resolution 2021:126 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. Whereas, the Borough of Lindenwold, pursuant to N.J.S.A. 52:34-6.2 (B) (3) may, by Resolution and without advertising for bids, purchase any goods or services through The North Jersey Wastewater Cooperative Pricing System; and Whereas, the Borough of Lindenwold desires to purchase of (3) Sulzer/ABS XFP100E-CBI wet/dry pit submersible pumps with all needed attachments through The North Jersey Wastewater Cooperative Pricing System Contract # B195-4; and Whereas, The North Jersey Wastewater Cooperative Pricing System has been awarded the contract of (3) Sulzer/ABS XFP100E-CBI wet/dry pit submersible pumps with all needed attachments; and Whereas, the Mayor and Council of the Borough of Lindenwold recommend the utilization of this contract on the grounds as the best means available to obtain the equipment; and Whereas, of (3) Sulzer/ABS XFP100E-CBI wet/dry pit submersible pumps with all needed attachments shall not exceed the amount of $ $35,000.00; and Whereas, funding for this resolution is available from the Borough of Lindenwold Sewer Department Sewer Capital Account; and Now, Therefore, Be It Resolved by the mayor and the Borough of Lindenwold, County of Camden and State of New Jersey as follows: 1. The borough of Lindenwold hereby authorizes the purchase of (3) Sulzer/ABS XFP100E-CBI wet/dry pit submersible pumps with all needed attachments through The North Jersey Wastewater Cooperative Pricing System Contract # B195-4 2. The total fee also authorized for this contract shall not exceed $35,000.00 without prior written approval from the Borough Council. 3. The Mayor, Borough Clerk and/or such other officials as is necessary and proper are hereby authorized to execute documents necessary to implement this resolution. 4. A copy of this resolution shall be provided to the Borough Treasurer and The North Jersey Wastewater Cooperative Pricing System for their information and guidance. Mayor Roach opened the meeting to the Public. Diane Veteri, resident, questioned the way Councilman DiDomenico addressed her as well as the efforts by Council members to assist the community. President Randolph-Sharpe responded by informing the resident of her efforts assisting the homeless and other numerous residents in Lindenwold. Dan Brittain, resident, questioned the resolution regarding the property, which the Mayor addressed, and recommending contacting the Fire Commission for direct information. He asked about the follow up to the damage on his property by South Jersey Gas. The Public Works Supervisor addressed with their attempts to correct the situation with the utility company. The Business Administrator will address with South Jersey Gas. He also questioned the Borough’s action regarding the incident of the dog bite. The Mayor responded that it is a court matter. Currently, the court is still operating under the guidelines of the State for appearances and trials. Resident continued to discuss. Mayor also recommended contacting Code Enforcement for possible updates. The Police Chief also responded that an investigation did take place with the information being provided to the court. COUNCIL CAUCUS MEETING June 23, 2021 Page | 3 Anthony Kraus, resident, informed Council of his property damage on Bentley Road that he feels resulted from the sewer and water lines being installed. Mayor discussed the situation with the resident. The Borough will look into the matter. Ray Morrisey, resident, discussed trash disposal. He questioned the payment of containers. Business Administrator explained that the Borough has a Trust Account. He questioned about information regarding ordinances. The Borough Clerk responded to the procedure and the availability of ordinances upon request. Sarah Vellnor, resident, questioned the date for Christmas in July. Police Chief responded that it was a joint venture with the Fire Department. She asked Council whom she should present her health concerns regarding within the condominium community. Mayor responded to contact the Condo Association. She can also contact Code Enforement. Trevor Shaw, resident, again addressed Council regarding a welcome packet for new residents. President Randolph- Sharpe stated that Council is working on this project and trying to address the many challenges in the community. Resident also informed Council of the information provided by Cherry Hill on their trashcans. Business Administrator addressed resident regarding the update to the website. There being no one else desiring the floor, Mayor Roach closed the meeting to the public. President Randolph-Sharpe congratulated the Class of 2021.
