Resolution 2024:164 – 2024:174 Resolution 2024:164 Change Order – Rehabilitation of Pump Station #8 BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that based upon the recommendation of Environmental Resolutions, Inc., that Change Order #1 to the contract for the Pump Station #8 Rehabilitation Project with Level – 1 Construction, Inc., 980 Coles Mill Road, Williamstown, NJ 08094 is hereby approved as follows: Original Contract Amount $325,000.00 Additional Wet Well Modifications 10,248.70 Adjustment Amount Based on Change Order No. 1 10,248.70 Adjusted Contract Amount $335,248.70 The reason for the changes are conditions discovered during construction that were beyond the original scope of work. Resolution 2024:165 Electricity Supply Services A RESOLUTION OF LINDENWOLD BOROUGH AUTHORIZING THE PURCHASE OF ELECTRICITY SUPPLY SERVICES FOR PUBLIC USE ON AN ONLINE AUCTION WEBSITE WHEREAS, Lindenwold Borough has determined to move forward with the EMEX Reverse Auction in order procure electricity for the Local Unit; and WHEREAS, the Local Government Electronic Procurement Act (P.L. 2018, c. 156) (the “Act”) authorizes the purchase of electricity supply service for public use through the use of an online auction service; and WHEREAS, Lindenwold Borough will utilize the online auction services of EMEX, LLC, an approved vendor pursuant to the Act; and WHEREAS, EMEX, LLC is compensated for all services rendered through the participating supplier that a contract is awarded to; and Page 2 of 14 WHEREAS, the auction will be conducted pursuant to the Act. NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of Lindenwold hereby authorize the execution on behalf of Lindenwold Borough any electricity contract proffered by the participating supplier that submits the winning bid in the EMEX Reverse Auction. Resolution 2024:166 Temporary Parking Christmas Parade Whereas, there is a need in the Borough of Lindenwold to institute traffic restrictions on December 6, 2024 from 6:00pm until 8:00pm, and Whereas, The Borough of Lindenwold has the authority to close roads necessary under Title 39:4-94.2 in addition to parking restrictions as per Chapter 220 Section 17 of the Code of the Borough of Lindenwold, and Whereas, the Police Department has authorized parking to be prohibited along the even numbered residences of West Linden for December 6, 2024 from 6:00pm to 8:00pm as well as the closing of any streets for the Lindenwold Christmas Parade route from Chews Landing Road to West Park Ave to East Atlantic Ave to West Linden Ave ending at the Lindenwold Library on East Linden Ave. Now, Therefore, Be It Resolved by the Mayor and Borough Council of the Borough of Lindenwold approves the traffic restrictions as submitted by the Lindenwold Police Department. Resolution 2024:170 RRFB Solar Crosswalk Assemblies A resolution of the Borough of Lindenwold, in the County of Camden and the state of New Jersey, authorizing the installation of three RRFB Solar Crosswalk Assemblies, through the Cherry Hill Cooperative Pricing System, System Identifier No. 37-CHCPS Whereas, the Borough of Lindenwold, pursuant to N.J.S.A. 52:34-6.2 (B) (3) may, by Resolution and without advertising for bids, purchase any goods or services through the Cherry Hill Cooperative Pricing System, and Whereas, the Borough of Lindenwold desires to install RRFB Solar Crosswalk Assembly at the below locations: Laurel Road and the entrance to Stonington Apartments Chews Landing Road and the entrance to School #5 Gibbsboro Road and the entrance to School #4 Through the Cherry Hill Cooperative Pricing System. Whereas, Techna-Pro Electric LLC. has been awarded the contract to install RRFB Solar Crosswalk Assemblies on the needed roads listed above; and Page 5 of 14 Whereas, the Mayor and Council of the Borough of Lindenwold recommend the utilization of this contract on the grounds as the best means available to obtain the construction; and Whereas, the installation RRFB Solar Crosswalk Assemblies listed above shall not exceed the amount of $50,000; and Whereas, funding for this resolution is available by Capital Improvement Ordinance number 2023-11; and Now, Therefore, Be It Resolved by the Mayor and the Borough of Lindenwold, County of Camden and State of New Jersey as follows: 1. The Borough of Lindenwold hereby authorizes the installation RRFB Solar Crosswalk Assemblies on the needed roads listed above from Techna-Pro Electric LLC. through the Cherry Hill Cooperative Pricing System, System Identifier No. 37- CHCPS. 2. The total fee also authorized for this contract shall not exceed $50,000.00 without prior written approval from the Borough Council. 3. The Mayor, Borough Clerk and/or such other officials as is necessary and proper are hereby authorized to execute documents necessary to implement this resolution. 4. Resolution 2024:171 Traffic Signal & School Flasher RESOLUTION TO UTILIZE THE CONTRACT FOR TRAFFIC SIGNAL AND SCHOOL FLASHER EMERGENCY RESPONSE AND SIGNAL MODIFICATIONS AND MISCELLANEOUS ELECTRIC SERVICE WITH AN OPTION FOR MAINTENANCE AND INSPECTION UNDER THE CHERRY HILL COOPERATIVE PRICING SYSTEM IDENTIFIER #37-CHCPS WHEREAS, pursuant to Cherry Hill Township Resolution 2022-10-19, Techna-Pro Electric, LLC (Techna-Pro), 100 Pike Road, Bldg. B-1, Mt. Laurel, NJ 08054 was awarded a one (1) year contract with two (2) one (1) year renewals upon mutual written consent of Cherry Hill Township and Techna-Pro commencing November 2, 2025 and will include members of Cooperative #37-CHCPS when Resolutions are received by the Township of Cherry Hill; and WHEREAS, pursuant to the Cooperative Pricing Agreement, the Borough of Lindenwold hereby requests that it be allowed to participate in the Traffic Signal and School Flasher Emergency Response and Signal Modifications and Miscellaneous Electric Service with an Page 6 of 14 Option for Maintenance and Inspection under the Cherry Hill Cooperative Pricing System Identifier #37-CHCPS described in the Cherry Hill Township master contract; and WHEREAS, the Borough of Lindenwold acknowledges that it has received and reviewed the Agreement in its entirety, and agrees to be bound by its promises, covenants, terms and conditions as well as by any rules and regulation duly promulgated by the Lead Agency (Cherry Hill Township) and the members of the Cooperative Pricing System; and WHEREAS, the Borough of Lindenwold shall likewise be entitled to all the rights and benefits of a member of the Cooperative pricing System; and WHEREAS, the Borough of Lindenwold contract period shall commence upon the adoption of this Resolution and/or at final execution of a separate contract or purchase order between Borough of Lindenwold and Techna-Pro, with the option for two (2) one (1) year extensions upon written consent from Cherry Hill Township and Techna-Pro and will terminate November 2, 2025; and WHEREAS, the availability of this contract best serves the needs of the Borough of Lindenwold and the Borough Council recommends utilization of this contract; and WHEREAS, the Borough of Lindenwold Controller has certified that sufficient and legally appropriated funds are available under Public Works Other Expenses of $59,300.00 and the Capital Ordinance 2023-11 of $65,186.00 for a grand total amount not to exceed $124,486.00. NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Lindenwold, in the County of Camden, State of New Jersey that the Borough utilize the Traffic Signal and School Flasher Emergency Response and Signal Modifications and Miscellaneous Electric Service with an Option for Maintenance and Inspection under the Cherry Hill Cooperative Pricing System Identifier #37-CHCPS for an amount not to exceed $124,486.00. BE IT FURTHER RESOLVED by the Borough Council of the Borough of Lindenwold, County of Camden, State of New Jersey that the Mayor or designee is authorized to execute such documents consistent with this Resolution and to take such other action on behalf of the Borough in furtherance of this Resolution. Resolution 2024:172 MOU – JAG Grant FY2024 WHEREAS, the Uniform Shared Services and Consolidation Act (N.J.S.A. 40A:65-4 et seq.) permits local units such as counties and municipalities to enter into agreements for the provision of joint services, and WHEREAS, the Borough of Lindenwold was awarded the 2024 Justice Assistance Grant which is a shared service / Inter-local services agreement, and WHEREAS, the Business Administrator is hereby authorized to sign documents for the JAG Grant in the absence of the Mayor. Page 7 of 14 NOW, THEREFORE, BE IT RESOLVED by Mayor and Borough Council of the Borough of Lindenwold that the Lindenwold Police Department is hereby authorized to participate with Camden County in a collaborative effort with Cherry Hill Township, Pennsauken Township, Winslow Township and Camden City in applying to the Bureau of Justice Assistance for the Justice Assistance Grant. The amount for the Borough of Lindenwold is $13,764.00. This contract is to be awarded contingent upon the approval of the Borough Solicitor, NJDOT and monies being available. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that: Page 8 of 14  1. The contract for FY2023 NJDOT Colonial Square Drive and Colonial Square Place be awarded to Think Pavers Hardscaping, LLC., 125 Kings Highway, Mt. Royal, New Jersey 08061 - lowest responsive bidder for Base Bid 1 with the amount of $302,013.00. Adjournment FIRST READING OF ORDINANCES ORDINANCE NO. 2024:28 AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF LINDENWOLD AT CHAPTER 69 (“ALCOHOLIC BEVERAGES”) BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF LINDENWOLD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, AS FOLLOWS: SECTION 1. Purpose and Intent. The amendment(s) set forth herein shall serve the purpose of establishing reasonable and impartial regulations with regard to Alcoholic Beverages within the Borough of Lindenwold. SECTION 2. Amendment(s). The Code of the Borough of Lindenwold at Chapter 69 (“Alcoholic Beverages”) is hereby amended as follows: Section 69-18 is amended as follows: § 69-18 Open containers in public places prohibited. No person shall have in his or her possession any open container containing an alcoholic beverage on any real property generally open to, or accessible by the general public, including but not limited to any roadway, parking lot, sidewalk, playground, park and/or public building. Specifically exempted from this provision is any premises or real property maintaining a valid license for the sale and/or consumption of alcoholic beverages, any validly licensed commercial establishment which invites patrons to consume patron-provided alcoholic beverages, and persons possessing open containers of alcoholic beverages in any vehicle subject to the provisions of N.J.S.A. 39:4-51a. Page 9 of 14  This provision shall apply to all persons within the jurisdiction of the Borough of Lindenwold, irrespective as to whether or not the person is in a state of intoxication. For purposes of this section real property shall mean land and immovable property on land, such as buildings, but shall not include motor vehicles. § 69-19 Open containers in vehicles prohibited. This section is repealed in its entirety. SECTION 3. Repealer. Any and all other ordinances inconsistent with any of the terms and provisions of this ordinance are hereby repealed to the extent of such inconsistencies. SECTION 4. Severability. In the event that any section paragraph, clause phrase, term, provision or part of this ordinance shall be adjudged by a court of competent jurisdiction to be invalid or unenforceable for any reason, such judgment shall not effect, impair or invalidate the remainder thereof, but shall be confined in its operation to the section, paragraph, clause, term, provision or part thereof directly involved in the controversy in such judgment shall be rendered. SECTION 5. Effective Date. This ordinance shall take effect upon final passage and publication as provided by law. ORDINANCE NO. 2024:29 AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF LINDENWOLD AT CHAPTER 240 (“PROPERTY MAINTENANCE CODE”) BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF LINDENWOLD, COUNTY OF CAMDEN, STATE OF NEW JERSEY, AS FOLLOWS: SECTION 1. Purpose and Intent. The amendment(s) set forth herein shall serve the purpose of establishing reasonable and impartial regulations with regard to Property Maintenance within the Borough of Lindenwold. SECTION 2. Amendment(s). The Code of the Borough of Lindenwold at Chapter 240 (“Property Maintenance”) is hereby amended as follows: Inclusion of a new Section 240-34(B) as follows: § 240-34(B) Emergencies. Page 10 of 14  1. A notice shall be served upon the owner of the property upon which any emergent action is taken by either personal service or registered mail, at the address on file for the owner at the Tax Office. The Notice shall include the action(s) taken to protect the public health or safety, and demand payment of any related costs associated with the emergent action. If the whereabouts of the owner is unknown and cannot be ascertained through the exercise of reasonable diligence, any official authorized to act under this section shall make an affidavit to that effect, and serve the Notice upon the property owner by publishing the Notice once in a newspaper circulated within Lindenwold Borough. A copy of the Notice shall be posted in a conspicuous place on the premises subject of the emergent action. A copy of the Notice shall also be duly recorded against the subject premises with the Camden County Clerk’s Office. 2. The Notice shall include the following language: “In the event you disagree with this Notice, or anything contained therein, and wish to challenge the actions or costs as set forth in the Notice, please send a written request for a hearing to: the Borough of Lindenwold Code Enforcement Office, Lindenwold Municipal Building, 15 N. White Horse Pike, Lindenwold, NJ 08021. In the event you do not request a hearing within 14 days of the date of the Notice, you will waive your right to a hearing. Upon receipt of your request for a hearing, the Borough will notify you of the time, date, and place for the hearing. You have the right to appear at the hearing, present evidence, file a written answer explaining your position, and give testimony at the hearing." SECTION 3. Repealer. Any and all other ordinances inconsistent with any of the terms and provisions of this ordinance are hereby repealed to the extent of such inconsistencies. SECTION 4. Severability. Page 11 of 14  ORDINANCE NO. 2024-30 ORDINANCE OF THE BOROUGH OF LINDENWOLD, COUNTY OF CAMDEN, NEW JERSEY CANCELING CERTAIN FUNDED APPROPRIATION BALANCES HERETOFORE PROVIDED FOR CAPITAL IMPROVEMENTS AND REAPPROPRIATING SUCH FUNDED APPROPRIATION BALANCES FOR OTHER CAPITAL PROJECTS BACKGROUND WHEREAS, the Borough of Lindenwold, County of Camden, New Jersey ("Borough") duly and finally adopted the Bond Ordinances 1018, as amended by ordinances 1024 and 1028; 1055; 1096; 1121; 1201; 1300; 1316; and 2014-03 (collectively, the "Bond Ordinances"); and WHEREAS, the Borough has remaining unspent funds and appropriation balances for certain projects and equipment set forth in the Bond Ordinances in a total amount of $226,049.89; and; WHEREAS, the Borough is desirous of canceling and reappropriating the funded balances set forth above for the acquisition, upgrade, and replacement of a sewer pump station in and for the Borough as set forth herein. NOW, THEREFORE, BE IT ORDAINED by the Borough Council (not less than two- thirds of all the members thereof affirmatively concurring), pursuant to the provisions of the Local Bond Law, constituting Chapter 169 of the Laws of 1960 of the State of New Jersey, as amended and supplemented ("Local Bond Law"), as follows: Section 1. Section 3. The period of usefulness of the Project referred to in Section 2 hereof, within the limitations of the Local Bond Law and according to the reasonable life thereof, is not less than forty (40) years. Section 4. The Capital Budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith, and the resolution promulgated by the Local Finance Board showing full detail of the amended Capital Budget and Capital Program as approved by the Director of the Division of Local Government Services, is on file with the Borough Clerk and available for inspection. Section 5. The Project authorized hereby are not current expenses and are general improvements that the Borough may lawfully make. No part of the cost of the Project authorized hereby has been or shall be specially assessed on any property specially benefited thereby. Section 6. All ordinances, or parts of ordinances, inconsistent herewith are hereby repealed to the extent of such inconsistency. Section 7. This ordinance shall take effect twenty (20) days after the first publication thereof after final passage. ORDINANCE 2024:31 ORDINANCE OF THE BOROUGH OF LINDENWOLD, COUNTY OF CAMDEN AND STATE OF NEW JERSEY AUTHORIZING A SPECIAL EMERGENCY APPROPRIATION FOR THE PREPARATION AND ISSUANCE OF A COMPLETE PROGRAM FOR REVALUATION OF REAL ESTATE WHEREAS, N.J.S.A. 40A:4-53 authorizes a municipality to adopt an ordinance authorizing special emergency appropriations for the purposes of preparation and execution of a complete program of revaluation of real property for the use of the local assessor, or of any program to update and make current any previous revaluation program when such is ordered by the county board of taxation; and Page 13 of 14  WHEREAS, the Camden County Board of Taxation requested that the State Director of Taxation approve a Civil Order mandating that the Borough of Lindenwold conduct a revaluation of all real property within the corporate boundaries of said municipality; and WHEREAS, the Director of Taxation, approved said Civil Order on April 13th, 2023. NOW, THEREFORE, BE IT ORDAINED by the Borough Council of the Borough of Lindenwold, County of Camden, State of New Jersey, that pursuant to N.J.S.A. 40A:4-53, the sum of $400,000 is hereby appropriated for the preparation and issuance of a complete program of revaluation of real estate for use by the Borough of Lindenwold Tax Assessor as provided for in N.J.S.A. 40A:4-53. BE IT FURTHER ORDAINED that such appropriation and “special emergency notes” authorized to finance the appropriation shall be provided for in succeeding annual budgets by the inclusion of at least one fifth (1/5) of the amount authorized pursuant to this act.
