SPECIAL TELECONFERENCE NOTICE
Pursuant to Executive Order N-29-20:
The Brown Act, Government Code Section 54953, contains special requirements that apply when members of a
legislative body participate in a public meeting by telephone. Certain of these requirements have been suspended by
Paragraph 3 of Executive Order N-29-20, executed by the Governor of California on March 17, 2020 to mitigate the
spread of the coronavirus known as COVID-19. In particular, the Executive Order suspends that provision of the Brown

The Regular Site Plan and Architectural Review Committee meeting of Wednesday, March 10,
2021 was called to order by Chair Slater at 5:15 p.m.

hearing to consider the request of Site Plan and Architecture Review Committee (SPARC)
to consider Site Plan and Architectural Review for the existing Kettleman Station Shopping
Mall for façade improvements at 400 E. Kettleman Lane (Applicant: John A. Vierra for
Matt Teresi; File Number: 2021-002 SP; CEQA Determination: Exempt Per Section 15301)
John Della Monica, Community Development Director, introduced contract Planner Joann
Martinez, to present the item.
Joann Martinez, Contract Planner, gave a brief presentation based on the staff report.
Staff is recommending approval of the project as conditioned with a minor change to
reflect the phasing to condition number five.
Chair Slater asked about lighting for the site. Ms. Martinez stated that there will be
upgrades to lighting and the applicant can answer the specific questions regarding the
sign lighting.
Member Diehl stated his support with how the project looks and the improvement it will
make to the center.
Member Stafford stated that most of his questions were answered by the presentation.
He asked what safety measures were being taken to protect the dinners sitting in the new
outdoor space. Ms. Martinez stated that she would prefer the applicant to answer that
question. Mr. Stafford stated his appreciation of the design of the awnings.

Hearing Opened to the Public
• John Vierra, NJA Architect and representative for the applicant, came forward to
address questions. He introduced Enrique Martinez, NJA project manager, and Matt
Teresi, owner representative, who will also be speaking regarding the project

to address questions.
• Joann Martinez stated that one of the Committee Members had a question regarding
lighting. John Vierra stated that there will be some backlighting or up lighting on the
signage, direct lighting at each suite as well as some up lighting of the landscaping.
• Chair Slater asked if Roger’s concern regarding protection for the seating area in case
a vehicle loses control could be addressed. Mr. Martinez stated that there is a
concrete wall behind the fountain that should act as a barrier.
• Member Stafford asked for clarification regarding the monument signs lighting. Mr.
Vierra stated that there are a couple of options; one is for back lighting and the other is
for up lighting of the face and it will depend on the budget which option the applicant
chooses. Mr. Stafford asked if the applicant is comfortable with the conditions of
approval. Mr. Vierra stated that the only issue they had was with condition number
five and staff has worked with them to make the changes.
• Director Della Monica stated that the signage and landscaping plans will be submitted
as a separate submittal for director review.

MOTION / VOTE:
The Site Plan and Architectural Review Committee on motion of SPARC Member Diehl,
Stafford second, approved the request for Site Plan and Architectural Review for the
existing Kettleman Station Shopping Mall for façade improvements at 400 E. Kettleman
Lane subject to the draft conditions of approval with the change to condition number 5.
The motion carried by the following vote:

5. REGULAR BUSINESS
Mr. Della Monica stated that the next meeting that SPARC will have an item ready for review
is currently April 14th.
6. COMMENTS BY SPARC MEMBERS AND STAFF
Member Stafford asked about the realtor signage and how long they can remain on walls and
fences along Lower Sacramento Road. Mr. Della Monica stated that he believes that it is 45
days from the start of building, but that the time can be extended.
Chair Slater stated that there is a new resident on the north east side of the Kettleman Lane
train trellis underpass that is a little messy. He would like to alert CalTrans.

Chair Slater asked how the Tiny Homes project is progressing. Mr. Della Monica stated that
the project should be breaking ground soon.

The Mixed-Use Corridor classification includes a variety of office and general
commercial uses, as well as low-, medium-, and high-density residential along the
city’s major corridors: Kettleman and Cherokee lanes and Lodi Avenue. This
category allows for somewhat more intensive development along these corridors
to take advantage of vacant and underutilized sites and provide shopping and
services to residents in highly accessible corridors. The maximum FAR for this
designation is 1.2.

PROPOSED PROJECT
The applicant is proposing:
• New façade improvements to the existing supermarket building.
• The applicant has proposed a new paint scheme, it will include mixture of natural colors that
will complement the existing center and create distinct entry features.
• The façade improvements will include a new metal cladding panels at the front of the building
along with new metal clad soffit at the entry.
The applicant has provided proposed elevations, site plans etc. (Figure 5 - 11). The project
proposal helps modernize an existing commercial center with updated colors, textures and
elevations.

FINDINGS
The project has been reviewed in accordance with the City’s General Plan, the Municipal
Development Code standards, and the City’s Design Guidelines. Based upon City evaluation and
analysis, staff recommends that the SPARC adopt the findings of this report and approve the
proposed modification to the existing buildings. The design and architecture of the proposed
project, as conditioned, complies with the Findings for Architectural Review as required in Lodi
Development Code 17.40.020 (E):
1. The design is consistent and compatible with the design standards/guidelines of the
applicable zoning district. Comment: The project site is zoned PD 15. The project applicant is
proposing façade and site improvements that modernizes the center and is consistent with
other commercial developments in Lodi. The proposal does not include new buildings on the
site.
2. The project will not interfere with the use and enjoyment of neighboring existing or future
developments, and does not create traffic or pedestrian hazards. Comment: The proposal
does not include any new buildings on the project site and will not create altered circulation
patterns.
3. The project shall maintain and enhance the affirmative, harmonious, and orderly development
contemplated by the Development Code. Comment: The proposed façade improvements are
visually compatible with the rest of the commercial center and neighborhood. The façade
modernization will enhance the aesthetics of the commercial center and has the potential to
help modernize the rest of the center buildings.
4. The project provides a desirable environment for its occupants, neighbors, and visiting public
through good aesthetic use of durable materials, texture, and color. Comment: The project
design promotes visual environments that are of high aesthetic quality and variety.
5. The project will not be detrimental to the public health, safety, or welfare or materially injurious
to the properties or improvements in the vicinity. Comment: The project is consistent with the
Lodi Development Code and adopted City standards. The project proposal is an investment
into an existing commercial facility. All improvements are on private property and approval of
the proposed project would not result in any significant effects relating to traffic, noise, air
quality, or water quality. The site of the proposed project can be adequately served by all
required utilities and public services.
6. Comment: The project is found to be categorically exempt from CEQA review under 14 CCR
§15301. Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing,
or minor alteration of existing public or private structures, facilities, mechanical equipment, or
topographical features, involving negligible or no expansion of use beyond that existing at the
time of the lead agency’s determination. The key consideration is whether the project involves
negligible or no expansion of an existing use. The project proposal does not increase the
intensity of the project site.

Staff’s recommended conditions of approval for the proposed project are included in the
attachments to this report.

PUBLIC HEARING NOTICE:
Legal Notice for the Use Permit was published in the Lodi News Sentinel on Saturday, April 3,
2021. Fifty-Seven (57) public hearing notices were sent to all property owners of record within a
300-foot radius of the project site as required by California State Law §65091 (a) 3. Public notice
also was mailed to interested parties who expressed their interest of the project.

1. The project proponent and/or the property owner and/or successors in interest and management shall,
at their sole expense, defend, indemnify and hold harmless the City of Lodi, its agents, officers, directors
and employees, from and against all claims, actions, damages, losses, or expenses of every type and
description, including but not limited to payment of attorneys’ fees and costs, by reason of, or arising
out of, this SPARC approval. The obligation to defend, indemnify and hold harmless shall include, but is
not limited to, any action to arbitrate, attack, review, set aside, void or annul this SPARC approval on
any grounds whatsoever. The City of Lodi shall promptly notify the developer of any such claim, action,
or proceeding and shall cooperate fully in the defense.
2. The project proponent shall submit appropriate plans to the Community Development Department for
plan check and building permit. The plans shall include architectural features such as the colors,
elevation including all other elements approved by the Site Plan and Architectural Review Committee.
Any significant alteration to the site plan as approved by the Site Plan and Architectural Review
Committee shall require an action by the Site Plan and Architectural Review Committee. Minor changes,
however, may be approved subject to review and approval of the Community Development Director.
3. The developer/applicant shall construct and operate the project in strict compliance with the approvals
granted herein, City standards, laws, and ordinances, and in compliance with all State and Federal laws,
regulations, and standards. In the event of a conflict between City laws and standards and a State or
Federal law, regulation, or standard, the stricter or higher standard shall control.
4. The project shall be developed in accordance with the Site Plan and Architectural Review approved by
the SPARC on April 14, 2021, including the approved site plan, architectural elevations, colors, materials,
etc., including all changes required by these conditions of approval.
5. The applicant shall comply with all of the conditions from the Public Works Department, below.
6. The applicant shall comply with all of the conditions from the Building and Safety Department, below.
7. Any roof-mounted equipment not shown on the plans approved by the SPARC shall be subject to review
and approval by the City to ensure that adequate screening is provided to prevent view of the
equipment from the public right of way.
8. All signs shall be in strict compliance with the City of Lodi’s Zoning Ordinances. All signage shall be
subject to review and approval of the Community Development Director. All signage shall be individual
channel letters or the equivalent. No exposed raceway shall be permitted with the signage. All
identification signs shall require a building permit.
Building Department (General Comments):
9. Any changes to the existing buildings, which are regulated by the current codes, shall require a building
permit. All plan submittals shall be based on the City of Lodi Building Regulations and currently adopted
2016 California Building code. Please review our policy handouts for specific submittal procedures.
10. The California Building Code (Title 24 Section 11B-202) requires that existing buildings, when alterations
are made, shall be verified for compliance with disabled access requirements. These requirements shall
apply only to the specific area of alteration and shall include an accessible entrance, an accessible route
to the altered area, at least one accessible restroom for each sex, telephones and drinking fountains (if
existing), and when possible additional items such as parking, storage and alarms.
Public Works
The Public Works Department has the following comments regarding the approval of the SPARC review
for 610 West Kettleman Lane:
11. Project Remove and replace all damaged or non ADA-conforming sidewalk and driveways fronting the
subject parcel in conformance with City of Lodi Standard Plans, if applicable. These improvements, if
required, shall be done under the terms of a CalTrans encroachment permit.
12. All existing survey monuments are to be preserved per California Senate Bill 1467. It is the applicant’s
responsibility to ensure that monuments are properly protected and/or perpetuated. If any of the
monuments are to be disturbed or are near the area of construction, a licensed surveyor must confirm
that the monuments have been protected and/or perpetuated and the appropriate documentation has
been recorded.
13. As required by the California Green Building Code (CALGreen), project shall participate in the
Construction and Demolition Recycling Program.
14. Obtain the following permits:
a. Building permit issued by the City of Lodi Building Division.
b. Encroachment Permit issued from CalTrans for any work within the Kettleman Lane right of way.
15. Payment of the following fees prior to building permit issuance unless noted otherwise:
a. Fees and charges for services performed by City forces per the Public Works Fee and Service
Charge Schedule.
i. (The fees referenced above are subject to periodic adjustment as provided by the
implementing ordinance/resolution. The fee charged will be that in effect at the time
of collection indicated above.)
16. Additional comments and conditions will be provided during the building permit review process when
more detailed plans are available.

The Industrial classification includes a mix of heavy manufacturing,
warehousing, general service, storage, and distribution activities. This category
includes the General Mills factory and existing uses along the railroad and east
of SR-99. Industrial sites are available within and adjacent to the existing cluster
of industrial uses in the east side of the city. The maximum FAR for this
designation is 0.6.
The M (Industrial) zoning district is described as follows:
The M zoning district is applied to areas appropriate for a mix of heavy
manufacturing, warehousing, general service, storage, and distribution
activities. The maximum FAR is 0.6. The M zoning district is consistent with the
industrial land use designation of the general plan.

PROPOSED PROJECT
The proposed project is a new industrial building. From the applicant’s submittal:
The proposed project consists of redeveloping the site with the construction of two
buildings. Building A will be for owners storage, 3,300 sf building. Building B will be
for a future tenant, 1,225 sf. Buildings will be pre-engineered metal buildings
matching the surrounding industial park.

The proposed landscaping would include trees shading in the parking areas, as well as
ornamental understory plantings. The project does include the installation of fences and gates
at the perimeter of the site.
The proposed project includes 6 parking spaces, including:
• 5 standard parking spaces
• 1 ADA-accessible parking space (without electrical vehicle charging)
The project also proposes no bicycle parking spaces.
The building will have roof-mounted equipment, which will be screened from public view by a
combination of a parapet and the placement of the equipment. A proposed condition of
approval is included to require staff review of any equipment not shown on the current plans.

Industrial Design Guidelines
The Lodi Zoning Code includes architectural design guidelines for industrial uses (Zoning Code
section 17.24.050). These guidelines provide,
“… useful recommendations for the design construction, review, and approval of
industrial development … [to] … ensure that new projects will be well designed, uphold
the city's vision, and contribute to the quality of the public realm.”

Parking Lot Shading
The Lodi Zoning Code seeks to ensure that parking areas will have shade for both aesthetics
and for the comfort of patrons and employees. The most direct standard is:
"Landscaped areas within or adjacent to the parking area shall provide for a minimum
of one shade tree for every four parking stalls. Depending on type and size of shade
tree, requirements may be modified by the City Site Plan and Architectural Review
Committee." [Zoning Code 17.32.070.D.2]
Staff interprets this requirement to require that parking spaces alternate with trees every fourth
space, providing shade throughout the parking lot. Staff views this as important in this particular
case for the comfort of both visitors and staff, especially during Lodi’s hot summer months.
The Code also includes "General Design Considerations" for parking areas that includes a
variety of factors including,
"Shading the parking lot by means of canopy trees or other landscaping." [Zoning Code
17.32.110.A.1.i]
The Code also requires that,

"Tree well and planting islands shall have a minimum dimension of eight feet and be
excavated to a depth of three feet and filled with amended soil as necessary." [Zoning
Code 17.32.110.F.9]
The proposed landscape plan (Figure 11, earlier in this report, excerpt below) provides parking
which meets these requirements.

FINDINGS
The Lodi Municipal Code (Section 17.14.040 F) requires that the SPARC make the following
findings in order to approve a site plan and architectural review application:
1. The design and layout of the proposed project would:
a. Be consistent with the development and design standards/guidelines of the applicable
zoning district;
b. Not interfere with the use and enjoyment of neighboring existing or future
developments, and not create traffic or pedestrian hazards;
c. Maintain and enhance the attractive, harmonious, and orderly development
contemplated by this development code; and
d. Provide a desirable environment for its occupants, neighbors, and visiting public
through good aesthetic use of durable materials, texture, and color.
2. The proposed development:
a. Would not be detrimental to the public health, safety, or welfare or materially injurious
to the properties or improvements in the vicinity; and
b. Has been reviewed in compliance with the California Environmental Quality Act (CEQA)
and the Lodi Environmental Review Guidelines [Zoning Code 17.040.020.E]

Staff’s recommendations are shown below:
1a. The design and layout of the proposed project would be consistent with the development
and design standards/guidelines of the applicable zoning district;
Analysis: The proposed building complies with the development standards of the M district,
including minimum and maximum height, floor area ratio, and parking The project will
provide more parking than is required by the Zoning Code.
1b. The design and layout of the proposed project would not interfere with the use and
enjoyment of neighboring existing or future developments, and not create traffic or
pedestrian hazards;
Analysis: The proposed project will not create any impediments to surrounding
developments. The project includes safe pedestrian access into the site from the adjacent
public sidewalk.
1c. The design and layout of the proposed project would maintain and enhance the attractive,
harmonious, and orderly development contemplated by this development code; and
Analysis: The project’s design, colors, and materials are appropriate for the type of building,
and reflect a high level of design and quality.
1d. The design and layout of the proposed project would provide a desirable environment for
its occupants, neighbors, and visiting public through good aesthetic use of durable
materials, texture, and color.
Analysis: The proposed project includes colors consistent with the type of building, and
would be constructed with durable materials and finishes.
2a. The proposed development would not be detrimental to the public health, safety, or welfare
or materially injurious to the properties or improvements in the vicinity; and
Analysis: There is no evidence in the record to suggest that the proposed industrial building
would result in any detriments to the public health, safety, or welfare. The project has been
designed to be consistent with the Zoning Code and applicable public works, building, and
other codes and requirements.
2b. Has been reviewed in compliance with the California Environmental Quality Act (CEQA)
and the Lodi Environmental Review Guidelines.
Analysis: The proposed project is exempt from environmental review per CEQA section
15332, as discussed below.
ENVIRONMENTAL REVIEW
The proposed project meets the criteria for a “common sense” exemption from CEQA per
CEQA Guidelines Section 15332:
Class 32 consists of In-Fill Development Projects. The project is consistent with the General
Plan, is located in the City limits, is less than 5-acres in size and is surrounded by existing

urban uses. The project site is not a habitat for any rare or endangered species of plant or
wildlife, and the project will not create a significant environmental impact. The project would
not result in any significant effects relating to traffic, noise, air quality, or water quality, and the
site of the proposed project can be adequately served by all required utilities and public
services.
CONDITIONS OF APPROVAL
Staff’s recommended conditions of approval for the proposed project are included in the
attachments to this report.
PUBLIC HEARING NOTICE
Legal Notice for this item was published in the Lodi News Sentinel on Saturday, April 3, 2021.
Thirteen (13) public hearing notices were sent to all property owners of record within a 300-
foot radius of the project site as required by California State Law §65091(a)3.
Public notice also was mailed to interested parties who expressed their interest of the project.
RECOMMENDED MOTION
Staff recommends that the SPARC approve Site Plan and Architectural Review PL2020-035,
subject to the attached conditions of approval.
Should the Committee agree with staff’s recommendation, the following motion is suggested:
“I move that the Site Plan and Architectural Review Committee find that the proposed
project is exempt from CEQA per CEQA Guidelines Section 15332 and approve site
plan and architectural review PL2021-005, subject to the conditions of approval.”

Conditions of Approval
Site Plan and Architectural Review 2021-005

1. The project proponent and/or the property owner and/or successors in interest and management shall,
at their sole expense, defend, indemnify and hold harmless the City of Lodi, its agents, officers, directors
and employees, from and against all claims, actions, damages, losses, or expenses of every type and
description, including but not limited to payment of attorneys’ fees and costs, by reason of, or arising
out of, this SPARC approval. The obligation to defend, indemnify and hold harmless shall include, but is
not limited to, any action to arbitrate, attack, review, set aside, void or annul this SPARC approval on
any grounds whatsoever. The City of Lodi shall promptly notify the developer of any such claim, action,
or proceeding and shall cooperate fully in the defense.
2. The project proponent shall submit appropriate plans to the Community Development Department for
plan check and building permit. The plans shall include architectural features such as the colors,
elevation including all other elements approved by the Site Plan and Architectural Review Committee.
Any significant alteration to the site plan as approved by the Site Plan and Architectural Review
Committee shall require an action by the Site Plan and Architectural Review Committee. Minor changes,
however, may be approved subject to review and approval of the Community Development Director.
3. The developer/applicant shall construct and operate the project in strict compliance with the approvals
granted herein, City standards, laws, and ordinances, and in compliance with all State and Federal laws,
regulations, and standards. In the event of a conflict between City laws and standards and a State or
Federal law, regulation, or standard, the stricter or higher standard shall control.
4. The project shall be developed in accordance with the Site Plan and Architectural Review approved by
the SPARC on April 14, 2021, including the approved site plan, architectural elevations, colors, materials,
etc., including all changes required by these conditions of approval.
5. The applicant shall comply with all of the conditions from the Public Works Department, below.
6. The applicant shall comply with all of the conditions from the Building and Safety Department, below.
7. Any roof-mounted equipment not shown on the plans approved by the SPARC shall be subject to review
and approval by the City to ensure that adequate screening is provided to prevent view of the
equipment from the public right of way.
8. All signs shall be in strict compliance with the City of Lodi’s Zoning Ordinances. All signage shall be
subject to review and approval of the Community Development Director. All signage shall be individual
channel letters or the equivalent. No exposed raceway shall be permitted with the signage. All
identification signs shall require a building permit.
9. All landscape and irrigation plans shall be consistent with the requirements of Zoning Code Chapter
17.30, Landscaping, and other applicable codes and requirements.
10. Customer to ensure that the electrical utility has 24-hour access to the main panel. Main panel
should be located in an accessible location for maintenance and readings.
Building Department (General Comments):
11. The construction of the new buildings and related site improvements shall require building permits. All
plan submittals shall be based on the City of Lodi Building Regulations and currently adopted 2019
California Building code. Please review our policy handouts for specific submittal procedures.
12. All buildings and structures shall have the required fire separation distance separation to the property
lines as specified by the 2019 CBC, Table 602 or shall provide the required fire rated protection of walls,
limitations of protected and unprotected openings for each building, as per 2019 CBC, Sections 705,
Tables 601, 602 ,705.8 and 716.5
13. This project includes a shell building. A separate and complete tenant improvement plan submittal and
permit is required prior to occupancy of each tenant space and issuance of a “Certificate of Occupancy”.
Such plans shall specify the tenant’s name, type of business, and include a complete design for: Site &
Building Accessibility, Occupancy, Exiting, Sanitation, Ventilation and other Habitability elements (i.e.,
envelope, lighting, mechanical design and energy reports)”.
14. Storage racks greater than 6’ in height are required to be submitted under separate permit and cover.
Storage racks greater than 8’ in height shall be provided with structural calculations. Storage 12’ or
greater in height must be reviewed as high piled storage.” City of Lodi Policy and Procedure B-[08]-[09]
15. Plans shall provide occupancy load calculations for each building based on square footage and the
applicable occupant load factor from Table 1004.5. 2019 CBC, Section 1004.5
16. If the occupant load for either building exceeds 49, the plans shall show:
a. A minimum of two (2) exits that are separated by a minimum of 1/2 (1/3 in sprinklered buildings)
of the diagonal distance of the area served. 2019 CBC, Section 1007.1.1
b. Exit doors shall swing in the direction of egress travel. 2019 CBC, Section 1010.1.2.1
c. The exit doors and exit access doors shall be equipped with panic hardware. 2019 CBC, Section
1010.1.10
d. A means of illuminating the egress path of travel in case of power failure, including path to the
egress doors, the corridor and the exterior landings. The emergency power system shall provide
back up power for the duration of at least 90 minutes and shall illuminate the path of travel at
the rate of an average of 1 foot candle at floor level. 2019 CBC, Sections 1008.1 thru 1008.3.5
e. Show locations of required illuminated exit signs. 2019 CBC, Section 1013
f. Provide complete and adequate details and locations of the required tactile exit signs at the
following locations:
i. Each grade-level exterior exit door shall be identified by a tactile exit sign with the word,
“EXIT.”
ii. Each exit access door from an interior room or area that is required to have a visual exit
sign, shall be identified by a tactile exit sign with the words, “EXIT ROUTE.” 2019 CBC,
Section 1013.4
17. Site Plan to show all building entrances and ground level exits shall be connected on an accessible route
to other buildings on the site, public transportation stops, accessible parking and passenger loading
zones and to public streets and sidewalks. 2019 CBC, Sections 11B-206.4.1, 11B-404, 11B-Division 4
18. Plans to specify walkways and sidewalks along accessible routes of travel (1) are continuously accessible,
(2) have maximum 1/2" changes in elevation, (3) are minimum 48" in width, (4) have a maximum 2%
cross slope, and (5) where necessary to change elevation at a slope exceeding 5% (i.e., 1:20) shall have
ramps complying with 2019 CBC, Section 11B-405 or 11B-406 as appropriate. Where a walk crosses or
adjoins a vehicular way, and the walking surfaces are not separated by curbs, railings or other elements
between the pedestrian areas and vehicular areas shall be defined by a continuous detectable warning
which is 36” wide, complying with 2019 CBC, Sections 11B-247.1 & 11B-705.1.2.5.
19. Plans to specify and show accessible parking spaces in compliance with 2019 CBC, Sections 11B-208.2,
11B-502 and Table 11B-208.2. At least one space shall be van accessible as per 2019 CBC, Section 11B-
208.2.4.
Provide complete and adequate accessible parking details to specify and show:
a. A 9’ wide x 18’ deep accessible parking space(s) with 5’ wide striped access aisle. “Van
accessible” parking spaces shall be a minimum 12’ wide x 18’ deep with a 5’ wide access aisle or
9’ wide with an 8’ wide access aisle. 2016 CBC, Section 11B-502.2
b. The access aisle(s) may be located on either side of the accessible parking space(s), except “van
accessible” parking spaces shall have the access aisle located on the passenger side of the
accessible parking space. Two accessible parking spaces shall be permitted to share a common
access aisle. 2016 CBC, Sections 11B-502.3.4, 11B-502.3
c. The access aisles shall be marked with a blue painted borderline around their perimeter. The
area within the blue borderlines shall be marked with hatched lines a maximum of 36” on center
in a color contrasting with the aisle surface, preferable blue or white. The words “NO PARKING”
shall be painted in 12” high white letters in each access aisle. 2016 CBC, Section 502.3.3
d. The accessible parking spaces and the access aisles shall not exceed 2% cross slope in any
direction. 2016 CBC, Section 11B-502.4
20. Plans to specify location and provide complete and adequate details of the following required parking
signage:
a. "Unauthorized vehicles..." signs at all driveway entrances, or located adjacent to and visible
from each accessible parking space. Indicate on the plans that the sign shall be filled out with
the correct appropriate information to become a permanent part of the sign (Lodi Police
Department, 209-333-6727). 2016 CBC, Section 11B-502.8
b. Specify permanently posted reflectorized parking space identification sign at each accessible
parking space, 70-sq. inches in area, and mounted a minimum of 60" (80” when located in the
path of travel) from bottom of sign to paving. Provide a "van accessible" sign at appropriate
parking spaces. The sign may also be posted on a wall at the interior end of the parking space
at a height of 36" above the finished walk or grade. An additional sign below the symbol of
accessibility shall state “Minimum Fine $250”. 2016 CBC, Section 11B-502.6
c. Specify pavement-marking symbols at each accessible parking space. 2016 CBC, Section 11B-
502.6.4
21. Long and short term bicycle parking as required by the 2019 CGBC, Section 5.106.4 and designated
parking spaces for Clean Air/Van Pool/EV vehicles as required by the 2019 CGBC, Section 5.106.5.2 shall
be provided.
22. Plans shall show facilitation for future installations of Electric Vehicle Supply Equipment (EVSE) for the
charging of electric vehicles. The number of Electric Vehicle (EV) charging spaces to be provided shall
be as per the 2019 CGBS, Table 5.106.5.3.3. The plans shall specify: 1) The type and locations of the
EVSE(s), 2) Raceways that originate at the service panel or subpanel serving the area, and shall
terminate in close proximity to the proposed location(s) of the charging equipment and into listed,
suitable cabinets, boxes, enclosures or equivalent. 3) Plan design shall be based on 40 amp minimum
branch circuits. 4) Electrical calculations shall substantiate the electric system design to include the
rating of the equipment and any on-site transformers and have sufficient capacity to simultaneously
charge all required EVs at its full rated amperage. 5) The service panel or sub-panel shall have sufficient
capacity to accommodate the required number of dedicated branch circuits for the future installation
of the EVSE. 6) Future EV charging spaces qualify as designated clean air vehicle spaces. 2019 CGBS,
Section 5.106.5.3
Be aware, in determining the location(s) of the EVSE(s) to take into consideration accessibility
requirements for the future installation of EV charging spaces. Minimum number of accessible EV
charging spaces will be required as per 2019 CBC, Table 11B-228.3.2.1 at the time of installation.
Accessible EV charging spaces are required to comply with 2019 CBC, Section 11B-812 and to be located
on an accessible route. The accessible EV charging spaces are not considered accessible parking spaces
for the purpose of calculating the minimum number of accessible parking spaces as per 2019 CBC,
Sections 11B-208.1, 11B-208.2, & Table 11B-208.2
23. Unless the building meet one of the exceptions of 2019 CPC, Section 422.2 (allowing a unisex restroom),
separate toilet facilities shall be provided for each sex. Plumbing occupant load shall be calculated using
the plumbing occupant load factor specified by 2019 CPC Table A for each area use. The required
number of plumbing fixtures (water closets, urinals, lavatories) shall be provided, as specified for each
occupancy by 2019 CPC, Table 422.1.
24. Restrooms will be required to be accessible as per 2019 CBC, Section 11B-213xxx
Public Works
The Public Works Department has the following comments regarding the approval of the SPARC review
for 3 Commerce Street:
25. Project Project design and construction shall be in compliance with applicable terms and conditions of
the City’s Stormwater Management Plan (SMP), and shall employ the Best Management Practices
(BMPs) identified in the SMP.
a. Conformance with the City’s Stormwater Development Standards will be required with this
project and an appropriately sized sand/oil trap in compliance with City of Lodi Standard Plan
315 shall be installed onsite before discharging storm water to the public system (if one does
not exist already).
b. State-mandated, year around construction site inspections to assure compliance with the City
of Lodi Storm Discharge Permit are required. The fee for the inspections is the responsibility of
the developer.
26. Existing water, wastewater, and storm water services to the parcel shall be utilized for this project, if
possible. Otherwise the developer is responsible to abandon any excess/unused connections and install
new service connections to the public facilities at the developer’s expense.
27. If a new connection to the City’s storm system is proposed with this project, then submit a Project
Stormwater Plan in compliance with the Multi-Agency Post-Construction Stormwater Standards Manual
(PCSP) as adopted by City Council on November 4, 2015. If connection to the existing onsite shared
storm drain system is proposed for this project, then this development would be considered as part of
a planned development and no PCSP shall be required.
28. If fire service is needed it shall be installed according to the City of Lodi Design Standards § 4.403.
29. The parking lot shall be designed in conformance with City of Lodi Standard Plan 134. The first parking
stall shall continue to be located a minimum of 10-feet from the street Right-of-Way.
30. The proposed slide gates shall be remained open during business hours to avoid stacking of vehicles
onto the public street.
31. All existing Public Utility Easements (PUEs) shall be clearly identified and labeled to ensure no structures
are being proposed within the City Right-of-Way (ROW) or PUEs.
32. Irrigation plans and plantings shall conform to the Model Water Efficient Landscaping Ordinance
(MWELO) per the Governor’s Executive Order B-29-12 adopted on December 31, 2015, if the proposed
landscape area is larger than 500 square feet.
33. As required by the California Green Building Code (CALGreen), project shall participate in the
Construction and Demolition Recycling Program.
34. All on-site water wells and septic systems, if any, shall be abandoned in conformance with applicable
City and County codes and requirements prior to the approval of the public improvement plans. A copy
of the abandonment permit shall be submitted to the City after the completion of the abandonment.
35. The City of Lodi is a participant in the San Joaquin County Multi-Species Habitat Conservation and Open
Space Plan (SJMSCP). An application for evaluation of the project site with respect to SJMSCP
requirements shall be submitted to the San Joaquin Council of Governments (SJCOG) prior to
commencement of any clearing, grading or construction activities on the project site.
36. Install the proposed driveways and remove and replace all damaged or non ADA-conforming sidewalk,
driveways, and ramps fronting the subject parcel in conformance with City of Lodi Standard Plans.
37. All project design and construction shall be in compliance with the Americans with Disabilities Act (ADA).
Project compliance with ADA standards is the developer’s responsibility.
38. Prior to any work within City Right-of- Way and Public Utility Easements, the applicant shall obtain an
encroachment permit issued by the Public Works Department.
39. All existing survey monuments are to be preserved per California Senate Bill 1467. It is the applicant’s
responsibility to ensure that monuments are properly protected and/or perpetuated. If any of the
monuments are to be disturbed or are near the area of construction, a licensed surveyor must confirm
that the monuments have been protected and/or perpetuated and the appropriate documentation has
been recorded.
40. Obtain the following permits:
a. Building permit issued by the City of Lodi Building Division.
b. Encroachment Permit issued from the City of Lodi Public Works Department for any
work within the City’s public right of way or on existing public water, wastewater, and
storm drain infrastructure.
c. San Joaquin County well/septic abandonment permit (if needed).
41. Payment of the following fees prior to building permit issuance unless noted otherwise:
a. Fees and charges for services performed by City forces per the Public Works Fee and
Service Charge Schedule.
b. Installation of water and wastewater services by City Forces if current services shall be
upsized.
c. Abandonment of existing water and wastewater services by City Forces, if applicable.
d. Water meter installation fees.
e. Regional Transportation Impact Fee (RTIF).
f. Encroachment permit fee.
g. Habitat Conservation fee.
h. County Facilities fees.
i. Stormwater Compliance Inspection Fee prior to building permit issuance or
commencement of construction operations, whichever occurs first, if applicable.
j. Post Construction Storm Water Plan Check fee, if applicable
k. MWELO Compliance Plan Check fee, if applicable.
42. Payment of the following fee prior to temporary occupancy or occupancy of the building unless
noted otherwise:
a. Development Impact Mitigation Fees per the Public Works Fee and Service Charge
Schedule.
i. (The fees referenced above are subject to periodic adjustment as provided by
the implementing ordinance/resolution. The fee charged will be that in effect
at the time of collection indicated above.)
43. Additional comments and conditions will be provided during the building permit review process
when more detailed plans are available
