PROJECT / AREA DESCRIPTION General Plan Designation: General Commercial Zoning: Planned Development 39 (PD 39) Property Size: 9.24 Acres – 402,494 square feet SUMMARY The applicant, Lars Andersen and Associates, Inc. (“Applicant”), proposes to expand outdoor display, outdoor storage areas, and establish a yard for the display and storage of rental mobile equipment in existing parking lots of a large home improvement retail building and associated garden center (Home Depot) (“Project”) located at 2960 Reynolds Ranch Parkway, Lodi, California, 95240 (“Site”). Per the Lodi Municipal Code (“LMC”) Zoning regulations, the Project requires approval of a site plan and architectural review by the Site Plan and Architectural Review Committee (SPARC). 382242.1 SPARC Home Depot Outdoor Display and Storage Areas December 11, 2024 Page 2 of 15 BACKGROUND The following sections describe the Site and its setting: • Site Location Map • General Plan and Zoning • Existing Conditions Figure 1: Site Location Map General Plan and Zoning The General Plan designation for the Site is General Commercial. The Site is located in the Reynolds Ranch Planned Development (PD 39), and the underlying zone is General Commercial (GC). This category includes large-parcel retail uses around Lower Sacramento Road and Kettleman Lane and highway-oriented commercial development near the exits of SR-99, as well as smaller-scale retail uses, including around the intersection of Vine Street and Central Avenue. The maximum FAR for this designation is 0.6. Figure 3: Zoning – Planned Development 39 (PD 39) PLANNED DEVELOPMENT 39 (PD 39) INDUSTRIAL (M) PLANNED DEVELOPMENT 39 (PD 39) PD 39 allows for General Commercial (GC) uses on the Site. A PD zone is intended to allow deviations from standard zoning requirements to create a development pattern specifically designed for a project site that allows a more desirable and efficient use of land. In accordance with LMC Section 17.28.040, a PD zone is intended to accommodate various types of development, including residential developments, public, quasi-public, commercial, retail, office, schools, and open space. The GC Zoning District is described as follows: The GC zoning district is applied to areas appropriate for a range of community serving commercial, regional retail, and service land uses. The FAR is 0.6. The GC zoning district is consistent with the General Commercial land use designation of the General Plan. 382242.1 SPARC Home Depot Outdoor Display and Storage Areas December 11, 2024 Page 5 of 15 The outdoor storage and display areas for the garden center and the rental mobile equipment yard are allowed uses in the GC zoning district. Existing Conditions The Site is developed with a 108,101 square-foot Home Depot building, a 28,783 square-foot garden center and associated parking lots and landscaped areas. The area around the Site is partially developed with a Dick’s Sporting Goods store and parking lot adjacent to the north, an office complex to the south across Reynolds Ranch Parkway, a vacant lot adjacent to the West, and a single-family residence and vacant land adjacent to the east next to State Highway 99 (Figure 4). Outdoor display and storage of merchandise is occurring in front of the Home Depot building and the garden center, within the parking lot in front of the garden center, and within the parking lot to the West of the garden center. There is also storage of merchandise occurring within the area between the rear of the Home Depot building and Reynolds Ranch Parkway. Finally, there is a rental mobile equipment yard in the northeast portion of the parking lot in front of the Home Depot building. A SPARC review in 2010 (10-SP-02) required that outdoor display and storage of merchandise be limited to the front of the Home Depot retail building and garden center and to the West of the garden center along the western property line. The site plan for the 2010 SPARC review did not show a mobile rental equipment yard. Thus, Home Depot is currently in non-compliance with the conditions of approval and approved site plan of the 2010 SPARC review. As part of the SPARC application, the Applicant submitted a revised site plan that reflects current outdoor display and storage areas on the Site. The revised site plan also shows the proposed location of the rental mobile equipment yard. The rental yard will be moved from its current location to the northwest portion of the Site. These areas identified in the proposed Site Plan (Figure 6) and described in the table below. There will also be landscape screening on the West side of the rental mobile equipment yard along the West driveway. Compliance with Parking Standards Staff conducted a parking analysis to determine if there is sufficient parking remaining after the rental mobile equipment yard and new display and storage areas are factored in. The following table shows the results of the analysis if the staff recommendations are followed. FINDINGS The LMC Section 17.40.020 E requires that the SPARC make the following findings in order to approve a site plan and architectural review application: 1. The design and layout of the proposed project would: a. Be consistent with the development and design standards/guidelines of the applicable zoning district; b. Not interfere with the use and enjoyment of neighboring existing or future developments, and not create traffic or pedestrian hazards; c. Maintain and enhance the attractive, harmonious, and orderly development contemplated by this development code; and d. Provide a desirable environment for its occupants, neighbors, and visiting public through good aesthetic use of durable materials, texture, and color. 2. The proposed development: a. Would not be detrimental to the public health, safety, or welfare or materially injurious to the properties or improvements in the vicinity; and b. Has been reviewed in compliance with the California Environmental Quality Act (CEQA) and the Lodi Environmental Review Guidelines. Staff believes that SPARC can make the required findings and determination as described below: 1a. The design and layout of the proposed project would be consistent with the development and design standards/guidelines of the applicable zoning district; Analysis: The Project complies with the development standards of PD 39, and the LMC (where the PD standards are silent), including setbacks, minimum and maximum height, site coverage, and parking. 1b. The design and layout of the proposed project would not interfere with the use and enjoyment of neighboring existing or future developments, and not create traffic or pedestrian hazards; and Analysis: The Project will not create any known impediments to surrounding developments. 1c. The design and layout of the proposed project would maintain and enhance the attractive, harmonious, and orderly development contemplated by this development code; and Analysis: The staff recommended layout for the rental mobile equipment yard and the proposed landscape screening will be consistent with development contemplated by the development code. 1d. The design and layout of the proposed project would provide a desirable environment for its occupants, neighbors, and visiting public through good aesthetic use of durable materials, texture, and color. 382242.1 SPARC Home Depot Outdoor Display and Storage Areas December 11, 2024 Page 14 of 15 Analysis: The use of landscaping to shield storage areas will contribute to a desirable environment for customers, employees, and neighbors. 2a. The proposed development would not be detrimental to the public health, safety or welfare, or materially injurious to the properties or improvements in the vicinity; and Analysis: There is no evidence in the record to suggest that the Project buildings would result in any detriments to public health, safety, or welfare. The Project has been designed to be consistent with the design guidelines of the LMC and will be reviewed for compliance with building and other codes and requirements. 2b. Has been reviewed in compliance with the California Environmental Quality Act (CEQA) and the Lodi Environmental Review Guidelines. Analysis: The Project is exempt from environmental review per CEQA Guidelines Sections 15061(b)(3) and 15303, as discussed below. ENVIRONMENTAL REVIEW The Project is Categorically Exempt according to the CEQA Guidelines Section 15061(b)(3). This is the “Common Sense” exemption, which applies to projects as follows: “The activity is covered by the “Common Sense” exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.” This Project requests approval to install screen trees and wrought iron fencing at a home improvement center at 2960 Reynolds Ranch Parkway. Because this Site Plan and Architectural Review approval only includes minor physical alterations to the Site and no significant environmental impacts are anticipated, the Common-Sense exemption can be applied and no mitigation measures are required. Therefore, no further CEQA analysis is required for the Project. The Project is also categorically exempt pursuant to CEQA Guidelines Section 15303 (“New Construction or Conversion of Small Structures”), which applies to projects as follows: “Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. The numbers of structures described in this section are the maximum allowable on any legal parcel. Examples of this exemption include but are not limited to: … (e) Accessory (appurtenant) structures including garages, carports, patios, swimming pools, and fences. Because this Site Plan and Architectural Review approval only contemplates installation of new fences and screening, this approval is categorically exempt from CEQA as new construction of small structures. 382242.1 SPARC Home Depot Outdoor Display and Storage Areas December 11, 2024 Page 15 of 15 CONDITIONS OF APPROVAL Staff’s recommended conditions of approval for the proposed Project are included in Attachment B of this report. STRATEGIC PRIORITY ADDRESSED: 5.A. Infrastructure: Community Development: Examine both public and private underutilized or vacant property City wide and consider approaches for achieving highest and best use, including policy or zoning modifications, for Council’s consideration. PUBLIC HEARING NOTICE Legal Notice for this item was published in the Lodi News Sentinel on Saturday, November 30, 2024. Six (6) Public Hearing Notices were sent to all property owners of record within a 300-foot radius of the project site as required by California Govt. Code § 65091(a)(4) and LMC Section 17.74.020. Public notice also was mailed to interested parties who expressed their interest of the Project. RECOMMENDED MOTION Staff recommends that the SPARC approve Site Plan and Architectural Review PL2024-002 with the staff recommended layout for the mobile equipment rental yard, subject to the attached Conditions of Approval. Should the Committee agree with Staff’s recommendation, the following motion is suggested: “I move that the Site Plan and Architectural Review Committee find that the proposed Project is exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Sections 15061(b)(3) and 15303, and approve site plan and architectural review for outdoor display, outside storage areas, and rental mobile equipment yard at a home improvement center at 2960 Reynolds Ranch Parkway, file number PL2024-002, subject to the Conditions of Approval.” ALTERNATIVE SPARC ACTIONS • Approve the Applicant request with attached or alternate conditions • Approve the Project with revisions • Deny the Project • Continue the item to a future SPARC meeting Respectfully submitted, Tim Kohaya John R. PL2024-002 SP Site Plan and Architectural Review for Outdoor Display, Outdoor Storage Areas, and a Rental Mobile Equipment Yard at 2960 Reynolds Ranch Parkway APN: 058-650-18 Project No. PL2024-002 SP– Site Plan and Architectural Review for outdoor display, outdoor storage areas, and a rental mobile equipment yard (“Project”) at 2960 Reynolds Ranch Parkway, Lodi, California, 95240 (“Site”). The Project applicant is Lars Andersen and Associates, Inc., at 28827 North 91st Avenue, Peoria, AZ, 85383 (“Applicant”). PLANNING DIVISION General Conditions 1. The Applicant shall sign below verifying the “Acceptance of the Conditions of Approval” and return the signed page to the Lodi Planning Division. Project approval is not final until a signed copy of these conditions is on file with the City. By signing my name electronically in the space provided, I intend to authenticate my receipt and acknowledgment of the Conditions of Approval for Project No. PL2024-002 SP and agree that my electronic signature has the same force and effect as a manual handwritten signature for purposes of validity, enforceability, and admissibility. The Applicant, Property Owner, and/or any successor(s) in interest shall indemnify, protect, defend, and hold harmless the City, and/or any of its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof, from any and all claims, demands, law suits, writs of mandamus, and other actions and proceedings (whether legal, equitable, declaratory, administrative, or adjudicatory in nature), and alternative dispute resolutions procedures (including but not limited to arbitrations, mediations, and other such procedures) (collectively “Actions”), brought against the City, and/or any of its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof, that challenge, attack, or seek to modify, set aside, void, or annul any action of, or any permit or approval issued by, the City and/or any of its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof (including actions approved by the voters of the City), for or concerning the Project, whether such Actions are brought under the California Environmental Quality Act (CEQA), the Planning and Zoning Law, the Subdivisions Map Act, Code of Civil Procedure Section 1085 or 1094.5, or any other state, federal, or local statute, law, ordinance, rule, regulation, or any decision of a court of competent jurisdiction. It is expressly agreed that the City shall have the right to approve, which approval will not be unreasonably withheld, the legal counsel providing the City’s defense, and that Applicant, Property Owner, and/or any successor(s) in interest shall reimburse City for any costs and expenses directly and necessarily incurred by the City in the course of the defense. City shall promptly notify the Applicant, Property Owner, and/or any successor(s) in interest Applicant, Property Owner, and/or any successor(s) in interest of any Action brought and City shall cooperate with Applicant in the defense of the Action. Nothing herein shall prohibit the City from participating in the defense of any claim, action, or proceeding. The Applicant, Property Owner, and/or any 1 successor(s) in interest, whether in whole or in part, indemnifies the City for all the City’s costs, fees, and damages which the City incurs in enforcing the above indemnification provisions. 3. Unless a shorter limitation period applies, the time within which judicial review of this decision must be sought is governed by California Code of Civil Procedure, Section 1094.6. 4. The Project shall be developed in accordance with the Site Plan and Architectural Review approved by SPARC on December 11, 2024, including the approved Site plan, architectural elevations, etc. The Applicant may only request modifications or revisions to the approved Project as outlined in the Lodi Municipal Code (“LMC”) Title 17, Articles 2 and 3. 5. This Project approval does not include signage. All Project signs shall be subject to separate review and approval by the Lodi Planning Department to ensure compliance with the sign regulations in the LMC Title 17. Prior to Issuance of Building Permit 6. The Applicant shall submit a photometric plan showing compliance with the California Building Code (“CBC”), as adopted by the City. 7. The Applicant shall submit landscape plans which are in substantial conformance with the Project plans as approved by the SPARC, and shall be submitted to, and approved by, the Community Development Department Director. a. A landscape architect licensed by the State of California shall prepare the Project plans (the “Project Landscape Architect”). b. All Project landscape and irrigation plans shall be consistent with the requirements of LMC Chapter 17.30, landscaping, and any other applicable codes and requirements. 8. The Project landscape plan submittal shall include the following: a. Complete Project title and address. b. Square footage of on-site landscape (and off-site where applicable). c. Plan preparation date. d. City of Lodi Project number PL2024-002 SP shall be shown on all plans. e. Match lines, limit lines, property lines, and project limit lines. f. The following items need to be located on the landscape plan and a detail identifying them: walls, fences, easements, right-of-way, street names, and building footprint(s). g. Dimensioned setbacks for all buildings and parking areas. h. All existing trees and major shrubs, indicating whether they are to remain or be removed. i. Owner/developer name, address, telephone number, facsimile number, Project manager's name, and email. 2 j. Planting Plans and Irrigation Design Plans shall be prepared by the Project Landscape Architect licensed by the State of California. The licensed Project Landscape Architect shall sign the plans verifying that the plans comply with this City of Lodi Water Efficient Regulations. Include Project Landscape Architect’s name, registration number, address, telephone number, and email. k. Provide intended irrigation approach/written statement of the type of irrigation design approach and equipment intended to be utilized for the subsequent construction plans. l. Plant legend, including the following: • Botanical Name • Common Name • Container Size • On-center spacing (not required for trees) • WUCOLS rating (very low, low, moderate, high) m. A note that all exposed surfaces of non-turf areas (soil area) within the landscape area shall be identified to receive a minimum of 3-inch layer of mulch. n. Notes, details, and specifications shall be included. o. Landscape plans shall be drawn at a scale of 20 feet equal to 1 foot or larger. p. Trees shall be installed at a minimum 24-inch box size. 9. All required landscaping and irrigation systems shall be installed in accordance with the plans approved by SPARC. If the Project Landscape Architect has inspected the landscaping, the Project Landscape Architect shall provide the City with a Certificate of Compliance stating that the landscaping was installed per the approved Project plans. The City will review the approved plans, and Certificate of Compliance, if applicable, and conduct inspections to ensure that the installation is in compliance with the approved plans. FIRE DEPARTMENT 1. Any exterior storage alongside the building shall not block exits to ensure accessible paths of travel. PUBLIC WORKS DEPARTMENT 1. Project design and construction shall be in compliance with applicable terms and conditions of the City’s Stormwater Management Plan (SMP), and shall employ the identified Best Management Practices (BMPs). a. No vehicle or equipment repair/maintenance/washing shall take place within the Project area. 2. All Public Utility Easements (PUEs) shall be shown and clearly identified on Project plans. 3 a. No proposed structures, including but not limited to trees, signs, and fences/gates (apart from wood or chain link), shall be located in City Right-of-Way (ROW), PUEs, or on adjacent properties without proper permissions. Gates shall not swing across property lines. b. Structures proposed inside PUEs will require a structural encroachment permit and hold harmless agreement which are subject to utility companies’ approvals. 3. Project onsite parking shall be in conformance with City of Lodi Standard Plan 134. 4. Project irrigation plans and plantings shall conform to the Model Water Efficient Landscaping Ordinance (MWELO) per the Governor’s Executive Order B-29-12 adopted on December 31, 2015, if the proposed landscape area is larger than 500 square feet. 5. Any private trees proposed within 5 feet of public sidewalk shall be selected from the City’s approved street tree list and be planted per City of Lodi Standard Plan 140 (including root barriers). 6. Prior to any work within City ROW or PUEs, the Applicant shall obtain an encroachment permit(s) issued by the City of Lodi Public Works Department. 7. The Applicant and/or Project developer and/or any successor(s) in interest must obtain the following permits: a. Building permit issued by the City of Lodi Building Department, if applicable. b. Encroachment Permit(s) issued from the City of Lodi Public Works Department for any work within City ROW or PUEs, if applicable. 8. The Applicant and/or Project developer and/or any successor(s) in interest must pay the following fees prior to building permit issuance unless noted otherwise: a. Encroachment permit fee, if applicable. b. Structural Encroachment permit fee, if applicable c. Hold Harmless Agreement Preparation fee, if applicable. d. MWELO Compliance Plan Check fee, if applicable. 9. Additional comments and conditions will be provided during the building permit review process when more detailed plans are available. 4
