MINUTES CITY OF LOGAVNILLE Regular Council Meeting Thursday, April 12, 2012 7: 30pm Council Chambers The City of Loganville Mayor and Council met for their regularly scheduled Council Meeting on Thursday, April 12, 2012 at 7: 30pm. Mayor Ray Nunley and Council Members Skip Baliles, Dan Curry, Mike Jones, Mark Kiddoo, Michelle Lynch and Rey Martinez were all present. Mayor Nunley called the meeting to order at 7: 30pm. WQC Director Chris Yancey gave the invocation and the pledge to the flag was led. Council Member Dan Curry made a motion to adopt the agenda. Council Member Mark Kiddoo seconded the motion. Motion carried 6- 0. Council Member Mark Kiddoo made a motion to adopt last month' s financial report as presented. Council Member Rey Martinez seconded the motion. Motion carried 6- 0. Council Member Mike Jones asked for a few changes in the March Council Meeting minutes. He requested that in this discussion of the retirement funding listed as 19% be changed to 29% and that the surplus be listed as $ 5 million with $4. 5 in reserves. With those changes noted, Council Member Mike Jones made a motion to approve the minutes from last month' s meeting including the minutes from the executive session. Council Member Dan Curry seconded the motion. Motion carried 6- 0. Mayor Ray Nunley presented his veto of the Council' s action regarding Case# SU012- 001 requested by Loganville First Baptist Church. The Mayor expressed that he was opposed to waiving the tap fees specifically the sewer tap fee citing that it is a direct violation of the City' s current bond ordinance. Council Member Mark Kiddoo made a motion to amend the original motion to approve the special use permits without the fee waiver for a period not to exceed two ( 2) years. Council Member Skip Baliles seconded the motion. Council Member Mike Jones stated that he thought the code section that was highlighted was taken out of context. He stated that it states that all services must be metered and it applies to free water and sewer and does not apply to some fees. He further explained that last fall the City Council passed an economic incentive plan that would waive certain fees. He stated that we are in a recession and if we can refuse fees for them why not for the church. Mayor Ray Nunley stated that he felt like Mr. Jones has misinterpreted the economic plan as it has nothing to do with water and sewer. Council Member Mike Jones stated that it( bond ordinance) says metered services and that you don' t meter a tap, it has been taken out of context. He further stated that he respectfully disagrees. With no further discussion, motion carried 5- 1, with Council Member Mike Jones voting in opposition. Council Member Mike Jones made a motion to approve the Special Use Permit( SU012- 001). Council Member Skip Baliles seconded the motion. Motion carried 6- 0. Council Member Skip Baliles reported that the representatives from GMA would be present on May 7, 2012 at 5 pm to discuss the City' s retirement plan. He also reported that the Human Resource Committee had met and agreed to make a change to the City' s vacation " buy- out" policy that would essentially save the City money in additional payroll expense. Council Member Mark Kiddoo presented the Mayor and Council with copies of the proposed budget for 2013. He also mentioned that the City had received a check from Gwinnett County as part of the SDS settlement for$ 165, 000 for police and planning services. He explained that the police department is in need of some replacement vehicles and he stated that after meeting with the Public Safety Committee, it would be recommended to use a portion of that money for 3 additional police cars. Council Member Rey Martinez made a motion to approve the ADA State Code Update as presented. Council Member Michelle Lynch seconded the motion. Motion carried 6- 0. Council Member Rey Martinez explained that the police department needs to replace a few of their current police cars to help reduce their repair and maintenance costs on the current vehicles. Police Chief Mike McHugh explained that it is requested to purchase two cars from the seized and forfeiture account and three cars from the money received in the settlement for SDS. Council Member Mike Jones asked why some of our current police cars say they are from Buford, SC. Police Chief Mike McHugh explained that the vehicles are purchased locally but because demand is so high the dealers have to have them shipped into Georgia. Council Member Mike Jones asked if we buy from Georgia. Chief McHugh stated that we do, Laprade is from Cleveland. He further explained that the actual cars come from Akins in Winder. Chief McHugh further stated that two of the cars would be paid for from the confiscated funds courtesy of the local drug dealers and three would be paid for from the money received through the settlement for Police Services from the Gwinnett County SDS. Council Member Mike Jones asked if this was not coming from the City Budget. Chief McHugh stated that it was not from the budget. Council Member Rey Martinez made a motion to approve the purchase of 5 vehicles as requested with two vehicles ($ 61, 000) from confiscated funds and three vehicles ($ 93, 000) from the SDS settlement. Council Member Dan Curry seconded the motion. Motion carried 6- 0. Council Member Michelle Lynch stated that the Easter Egg Hunt was a success. She announced that the Broad Street Country Market will be starting soon. She explained that it would be a place for residents to come sell their homegrown/ homemade products. It will begin next weekend from Sam until noon through July 7, 2012. Council Member Michelle Lynch announced that there have been some recent improvements to Toddler Park including stained sidewalks and landscaping. She also announced that the gateway sign on Highway 78 has also received a facelift with the purchase of plants and trees. She explained that the Loganville Woman' s Club had donated money to help pay for this project. Council Member Michelle Lynch also announced that the Woman' s Auxiliary from the American Legion has agreed to help provide some improvements to the Veteran' s Memorial here at City Hall. She explained that they would be taking up the brinks and relaying them in a new and improved way. Council Member Dan Curry explained that the main influent pump at the wastewater treatment plant needs to be repaired. He explained that bids were obtained and the low bid was for$ 15, 605. 00. Council Member Dan Curry made a motion to approve the repair of the pump for$ 15, 605. 00. Council Member Dan Curry explained that water department is requesting to purchase a crawler drainage camera and software to be used to assist with sewer maintenance and repair. Council Member Dan Curry made a motion to approve the purchase of the crawler drainage camera and software for 74, 700. Council Member Mark Kiddoo seconded the motion. Council Member Michelle Lynch asked if they knew how much we could save by not having to dig. WQC Director Chris Yancey stated that he was not sure what the amount would be however, the water/ sewer permit requires that 20% of your system be inspected every year. He explained that if we outsourced this service it would cost approximately $ 50, 000. Council Member Mark Kiddoo asked if this would be paid for using SPLOST funds. Council Member Dan Curry stated that SPLOST funding would be used for this purchase. With no further discussion, motion carried 6- 0. Council Member Mike Jones thanked Randall Casper and the Public Works Department for their work on improvements to the Toddler Park. Council Member Mike Jones reported that curbing has been installed by the Lions Club bench. Council Member Mike Jones also announced that the City would be 5th sponsoring Dump Days on May and May 12th between 8am and 4pm. He explained that people could bring large items to be disposed to the public works facility during those days at no charge to city residents. City Manager Bill Jones presented the Ethics Ordinance to the Council to renew our status as a Certified City of Ethics. Council Member Michelle Lynch made a motion to approve the resolution. Council Member Mark Kiddoo seconded the motion. Motion carried 6- 0. City Manager Bill Jones announced that the City would be applying for a Health Promotion Grant to help promote health and wellness to the employees. Mr. Jones also announced that there would be a 19th ribbon cutting at Princeton Dental on Thursday, April from 2pm— 4pm. He also announced that Walton Municipal would be held next Thursday at the Community Center in Monroe at 7pm. He also presented a copy of the new City Ad that will be in the upcoming Visions publication from the Walton Tribune. COMMUNITY FEEDBACK State Representative Tom Kirby came forward and addressed those present. He announced his Town Hall meeting next Tuesday at the Anna Holbrook Club. He also highlighted several of the key points from the recent Tax Reform Bill passed by the legislature. He also answered questions in regards to the Open Records Act and the Sunset Committee.
