MINUTES CITY OF LOGAVNILLE Regular Council Meeting Thursday, July 12, 2012 7:30pm Council Chambers The City of Loganville Mayor and Council met for their regularly scheduled Council Meeting on Thursday, July 12, 2012 at 7:30pm. Mayor Ray Nunley and Council Members Skip Baliles, Dan Curry, Mike Jones, Mark Kiddoo and Michelle Lynch were all present. Rey Martinez was absent due to his military service. Mayor Nunley called the meeting to order at 7:30pm. WQC Director Chris Yancey gave the invocation and the pledge to the flag was led by a group of Boy Scouts and Lance Corporal Anthony Davis. Council Member Mark Kiddoo made a motion to adopt the agenda. Council Member Skip Baliles seconded the motion. Motion carried 5-0. Council Member Mark Kiddoo made a motion to approve last month’s minutes. Council Member Dan Curry seconded the motion. Motion carried 5-0. Council Member Mark Kiddoo made a motion to approve last month’s financial report as presented. Council Member Dan Curry seconded the motion. Motion carried 5-0. Mayor Ray Nunley asked those involved in the July 4th Parade to stand and he recognized them for their efforts in the planning and handling of the parade. Mayor Ray Nunley also asked Lance Corporal Anthony Davis to come forward. Mayor Ray Nunley recognized him for his service to our country. Council Member Skip Baliles reported that the hearing scheduled at the last Council Meeting of the Board of Ethics was not held. He reported that at the last minute the employee requesting the hearing decided that he no longer wanted the hearing. Council Member Mark Kiddoo made a motion to allow for the write-off of $13,366.66 in uncollectable personal property. Council Member Dan Curry seconded the motion. Council Member Mike Jones asked if the list would be available for the Council. Council Member Mark Kiddoo stated that it would be available. With no further discussion, motion carried 5-0. Council Member Michelle Lynch stated that preparations are underway for this year’s Autumn Heritage Festival. She explained that applications are available on the website and are currently being accepted. Council Member Dan Curry explained that the WQC Department and Public Works Department have worked in conjunction to come up with a policy / standards for paving jobs that would be placed out to bid on a yearly basis. He explained that this is being done in an effort to save money. Council Member Dan Curry made a motion to approve the policy to be bid as a flat fee per job. Council Member Skip Baliles clarified that this will be simply put out to bid and will be evaluated once we have received bids. Council Member Dan Curry stated that was correct. Council Member Skip Baliles seconded the motion. Motion carried 5-0. City Manager Bill Jones presented the Joint Development Authority of Jasper County, Morgan County, Newton County and Walton County Resolution to the Council. He explained that the purpose of this resolution was necessary for the Authority to be able to develop Stanton Springs by allowing the Authority the ability to service water and sewer services to this location. Council Member Mike Jones made a motion to approve the resolution. Council Member Dan Curry seconded the motion. Motion carried 5-0. City Attorney Karen Woodward presented a resolution to create the office of Prosecuting Attorney in the City of Loganville. She explained that since we have a City Solicitor this is required under recently passed legislation. Council Member Mark Kiddoo made a motion to approve this resolution as presented. Council Member Michelle Lynch seconded the motion. Motion carried 5-0. City Attorney Karen Woodward asked that Larry Steele be appointed as Solicitor for the City of Loganville for a period of one year as required under the previous resolution. Council Member Michelle Lynch made a motion to appoint Larry Steele as Solicitor. Council Member Mark Kiddoo seconded the motion. Motion carried 5-0. City Attorney Karen Woodward presented a resolution to the Council that would allow the City to remain a member of a Class Action law suit regarding Hotel Tax Litigation. She explained that the resolution would allow the City to remain a member of the class and receive money from any potential settlement. Council Member Mike Jones made a motion to approve this resolution. Council Member Dan Curry seconded the motion. Motion carried 5-0. City Attorney Karen Woodward asked the Council for authorization to allow City Manager the ability to negotiate the purchase of a piece of property. Council Member Mike Jones made a motion to authorize City Manager Bill Jones the authority to negotiate the purchase of a piece of property. Council Member Skip Baliles seconded the motion. Motion carried 5-0. COMMUNITY FEEDBACK Jerry Golden came forward and recognized everyone who worked on the July 4th parade. Jamie Dempsey came forward and told the Council that Loganville Citizens for Choice has been out working on the petition to allow for package sales within the City. He explained that they have almost reached their entire goal of signatures. He stated that they need 2,292 signatures and currently have 2279. He stated that within the next 12 to 15 days they should be submitting the petition to Election Superintendent Kristi Ash.
