MINUTES CITY OF LOGAVNILLE Regular Council Meeting Thursday, August 9, 2012 7:30pm Council Chambers The City of Loganville Mayor and Council met for their regularly scheduled Council Meeting on Thursday, August 9, 2012 at 7:30pm. Mayor Ray Nunley and Council Members Skip Baliles, Dan Curry, Mike Jones, Mark Kiddoo, Michelle Lynch and Rey Martinez were all present. Mayor Nunley called the meeting to order at 7:30pm. Pastor Brent Ross gave the invocation and the pledge to the flag was led. Council Member Skip Baliles made a motion to adopt the agenda as presented. Council Member Dan Curry seconded the motion. Motion carried 6-0. Council Member Mark Kiddoo made a motion to adopt last month’s minutes as presented. Council Member Skip Baliles seconded the motion. Motion carried 6-0. Council Member Mark Kiddoo made a motion to approve last month’s financial report. Council Member Dan Curry seconded the motion. Motion carried 6-0. Council Member Michelle Lynch presented an application from Loganville FBC for a 5K Run to be held on Saturday, September 15th requesting to close the effective streets between 7:45am and 9:15am. Council Member Michelle Lynch made a motion to approve the permit as requested. Council Member Skip Baliles seconded the motion. Motion carried 6-0. Council Member Dan Curry made a motion to approve the annual maintenance contract for the SCADA system for $11,060.68 from Missions Communications. Council Member Mark Kiddoo seconded the motion. Motion carried 6-0. Council Member Skip Baliles reported that the proposed SPLOST Projects are underway waiting on engineering but work should begin in the near future. City Manager Bill Jones updated the Council on the status of the LOST negotiations with Walton County. He explained that several meetings have been held and the county has agreed to a 65/35 split with the Cities. Mr. Jones explained that it was up to the Cities to decide how their 35% would be split among themselves. He stated that he will have a meeting with the City of Monroe on Monday and another meeting with the County on Wednesday. City Attorney Karen Woodward presented the Wine Tasting Ordinance to the Council. She explained that this ordinance would allow those businesses who hold a valid license to sell wine the ability to hold / have wine tasting. She explained the changes to the ordinance that had been made following the work session. Council Member Skip Baliles made a motion to approve the ordinance with revision noted by Mrs. Woodward. Council Member Rey Martinez seconded the motion. There was much discussion regarding this ordinance including the cost of the permit for wine tasting. After discussion Council Members Baliles and Martinez both agreed to amend the motion and second to include reducing the fee for the wine tasting permit from $200 to $100. Motion carried 6-0. City Attorney Karen Woodward presented the purchase of property located at 235 Main Street and the environmental remediation / demolition of this property and 4400 Pecan Street. Council Member Mike Jones made a motion to approve the purchase of the property located at 235 Main Street for $222,810.36 using reserve funds to be used as green space. Council Member Dan Curry seconded the motion. Motion carried 6-0. Council Member Michelle Lynch made a motion to approve the environmental remediation / demolition of 4400 Pecan Street and 235 Main Street not to exceed $75,000 from reserve funding as well. Council Member Mark Kiddoo seconded the motion. Motion carried 6-0. City Attorney Karen Woodward explained that the Election Supt has received a petition asking for a referendum to allow for the sale of distilled spirits by the package in the City. She explained that the petition has been turned over to Walton and Gwinnett County to verify the signatures. She also explained that she has already submitted a request to the Department of Justice for approval to place the matter on the ballot should the petition be verified. She explained that the counties have started that it should take between 30 to 60 days to verify the petition. Mayor Nunley spoke regarding the newly purchased property. He explained that his vision is that this will be a new focal point for the City. He explained that it would be a park with a pavilion to hold events and concerts. He stated that he felt like this would be the first step in developing the downtown area. COMMUNITY FEEDBACK: Council Member Dan Curry recognized Council Member Rey Martinez stated that is being deployed in the next few weeks to serve our country. Council Member Rey Martinez stated that although he would be away physically he hoped to be able to join the meetings via Skype. He also stated that he looked forward to returning in the spring to continue to work with the City Council and begin his re-election campaign. Walton County Commissioner Chuck Bagley reminded everyone to vote in the run off on the 21st. Council Member Mike Jones spoke about the history of the well and that the City was once again in possession of the well. With no further discussion, Council Member Michelle Lynch made a motion to adjourn. Council Member Mark Kiddoo seconded the motion. Motion carried 6-0. Meeting adjourned at 8:15pm.
