MINUTES CITY OF LOGAVNILLE Regular Council Meeting Thursday, November 8, 2012 7:30pm Council Chambers The City of Loganville Mayor and Council met for their regularly scheduled Council Meeting on Thursday, November 8, 2012 at 7:30pm. Mayor Ray Nunley and Council Members Skip Baliles, Dan Curry, Mike Jones, Mark Kiddoo, Michelle Lynch and Rey Martinez were all present. Mayor Nunley called the meeting to order at 7:30pm. WQC Director Chris Yancey gave the invocation and the pledge to the flag was led. Council Member Skip Baliles made a motion to adopt the agenda with the addition vehicle purchase and tap fee / credit under public utilities and moving the audit presentation after the financial report. Council Member Mark Kiddoo seconded the motion. Motion carried 6-0. Council Member Rey Martinez made a motion to approve last month’s minutes as presented. Council Member Dan Curry seconded the motion. Motion carried 6-0. Council Member Mark Kiddoo made a motion to approve last month’s financial report as presented. Council Member Rey Martinez seconded the motion. Motion carried 6-0. Ken Neil from Clifford, Lipford, Hardison & Parker came forward and presented the FYE 6-30- 2012 Audit. He explained that this report reflected an unqualified opinion which is what you strive for in an audit report. Mr. Neil reviewed the highlights of the report and there was some discussion. Council Member Mark Kiddoo made a motion to reengage Clifford, Lipford, Hardison & Parker once again to perform the Audit for FYE 6-30-2013. Council Member Rey Martinez seconded the motion. Motion carried 6-0. Walton County Chamber of Commerce President Teri Womack presented the contract between the City and the Walton County Chamber for 2013 and discussed recent chamber activity / support within the City. Council Member Dan Curry made a motion to renew the contract with the Walton County Chamber of Commerce. Council Member Mark Kiddoo seconded the motion. Motion carried 6-0. Council Member Mark Kiddoo made a motion to table the proposed changes to the Alcohol Ordinance for a period not to exceed 90 days. Council Member Michelle Lynch seconded the motion. Motion carried 6-0. Council Member Mark Kiddoo made a motion to table the fees associated with the Alcohol Ordinance as well for a period not to exceed 90 days. Council Member Michelle Lynch seconded the motion. Motion failed 2-4 with Council Members Skip Baliles, Dan Curry, Mike Jones and Rey Martinez voting in opposition. Council Member Skip Baliles made a motion to make the fee for a bona fide private club / non- profit private clubs $500 for beer, $500 for wine and $500 for distilled spirits for a combined license fee of $1500. Council Member Mike Jones seconded the motion. After discussion, motion carried 4-2 with Council Members Mark Kiddoo and Michelle Lynch voting in opposition. Council Member Michelle Lynch reported on the Autumn Heritage Festival. She recognized Mr. Don Vick, the Civil Air Patrol, Teri Womack and Kenny Smiley for their help and assistance with the festival. She also recognized the Special Olympics Volunteers and departments from the City for their work with the festival as well. Mrs. Lynch also reminded everyone of the Veteran’s Day Ceremony, Annual Christmas Tree Lighting and Christmas Parade. Council Member Dan Curry announced that the water department has been awarded a CDBG in the amount of $402,000 to help create / build another access point for the water system on Highway 20. Council Member Dan Curry made a motion to purchase three replacement vehicles for the water department two for $16,938 and one for $16,189. Council Member Mike Jones seconded the motion. Motion carried 6-0. Council Member Dan Curry explained that the City currently requires a $4800 tap fee for a dedicated water meter for fire protection. This meter is only used in case of a fire and is used as a way to document our water usage in case of a fire. He proposed that this tap fee be used as a credit as an incentive to businesses/churches that might want to locate in the City of Loganville. Council Member Dan Curry made a motion to allow this tap fee to be used as a credit for business/churches to help them get started. Council Member Mike Jones seconded the motion. After discussion, motion carried 6-0. Council Member Skip Baliles gave an update on the current SPLOST Projects. He reported that the Bay Creek Sidewalk project is 90% complete. He reported that the Tommy Lee Fuller Sidewalk project is approximately 50% complete and should be complete within the next 10 days. Mr. Baliles stated that the SR10, SR20, SR 81 Sidewalk Projects as well as the SR20/SR10 intersection improvement have all been submitted to the DOT for approval. He stated that currently we are holding off on the status of the Huntington Ridge Project until more information can be obtained from the engineers. City Manager Bill Jones reported that the City is still in discussions with Walton County BOE regarding the Intergovernmental Agreement for sewer service to the new schools on Bay Creek Road. He explained that the attorneys are still working out the agreement but he does not foresee any issues. City Manager Bill Jones also stated that he would be looking at replacing a few vehicles in the Public Works Department while we have SPLOST funds available under transportation. He explained that we should take this opportunity to replace a few aging vehicles as well. COMMUNITY FEEDBACK: Mrs. Janice Tribble came forward and expressed her appreciation for everyone’s help and support of the Special Olympics. She explained that we have 168 special needs children in Walton County and could not help provide for them without the assistance from the City. JT Barnhardt, CEO of Clearview Regional, came forward stating that Clearview Regional intends to oppose the free standing Emergency Facility being proposed by Eastside Medical in Loganville. He stated that he was aware of the City’s support of this project but wanted to explain that hospital’s position and reason for their opposition. He stated that they do not believe there is a need for this service. He explained that Clearview just completed a $60million replacement project in April and is already looking to expand with another 27 beds. He explained that they have added 60 new positions, mostly nurses and 20 new doctors to grow their practices as well. He stated that Eastside has also recently expanded their facility as well. He stated that this is a duplication of services. He stated that the limited service ER that is being proposed would not handle traumas as they have suggested and EMS would not take patients to this facility to them have to transfer them somewhere else. He also explained that this would impact the hospital financially as they would lose patients that would otherwise come to their facility and hurt those doctors who are trying to grow their practices in Walton County. City Manager Bill Jones asked if they opposed the application for the Imagining Center that Eastside has opened here in Loganville. Mr. Barnhardt stated that the originally opposed it but they pulled their opposition from the table and allowed them proceed with the imaging center. He explained that this is a business decision for the hospital and the doctors in the area. Council Member Skip Baliles stated that the Council is here for the citizens and what is in their best interest. He explained that he is pleased with the hospital in Monroe but also wants to be able to take care of the citizens here in Loganville. Mr. Barnhardt explained that the expansion of both hospitals would be completed before this type of need is necessary. Chuck Bagley came forward and reminded everyone of the Town Hall Meeting tomorrow at 10:30am. He explained that the topic would be the effect of the “birthday tax” and the changes regarding this recent legislation. He also thanked the Council for taking steps tonight to help non-profits like the American Legion tonight. Jamie Dempsey thanked everyone for coming out and voting. He stated that he was looking forward to working in the community. Council Member Mike Jones thanked Robbie Schwartz for his recent article on how the failure of TSPLOST will affect Walton County. He stated that he would be looking at things that the City might be able to do to complete some of the proposed projects our self. Council Member Michelle Lynch stated that she forgot to mention that we had over 150 vendors at the Autumn Heritage Festival and that 60% of the vendors were from Loganville. She explained that this was more than in years past. Mayor Ray Nunley announced that earlier in the week he had been diagnosed with lung cancer. He explained that he does not know what the future holds but he will keep everyone informed along the way. With no more discussion, Council Member Michelle Lynch made a motion to adjourn.
