MINUTES CITY OF LOGANVILLE Regular Council Meeting Thursday, January 10, 2013 7: 30pm Council Chambers The City of Loganville Mayor and Council met on Thursday, January 10, 2013 at 7: 30pm for their regularly scheduled Council Meeting. Vice Mayor Dan Curry and Council Members Skip Bali les, Mike Jones, Mark Kiddoo and Michelle Lynch were present. Mayor Ray Nun ley and Council Member Rey Martinez were not present. Vice Mayor Dan Curry called the meeting to order at 7: 30pm. An invocation was given and the pledge to the flag was led. Council Member Mark Kiddoo made a motion to adopt the agenda as presented. Council Member Michelle Lynch seconded the motion. Motion carried 4- 0. Council Member Mark Kiddoo made a motion to adopt last month' s minutes with the correction that the Parks & Event Chair be allowed to make any necessary minor changes to the plans for the Town Green. Council Member Skip Bali les seconded the motion. Motion carried 4- 0. Council Member Mark Kiddoo made a motion to adopt the financial report as presented. Council Member Michelle Lynch seconded the motion. Motion carried 4- 0. Planning& Development Director Tim Prater presented Case # R12- 005 to the Council. He explained that Mahaffey, Pickens Tucker, LLP has requested that 31. 75 acres located on Old Zion Cemetery be rezoned from RM- 8 to R22. He explained that they are seeking to develop an 84 lot subdivision. He further explained that the Planning Commission voted to approve this rezone with the conditions that this subdivision be limited to 84 lots and conform to the conditions of the R22 zoning. Mr. Prater also presented Case# V12- 006 to the Council. He explained that Mahaffey, Pickens Tucker, LLP is seeking a variance for 26. 02 acres located on Highway 78. He explained that they are asking to increase the height and the number of units per acre for a proposed apartment complex ( 3 story/ 12units per acre). Mr. Prater explained that the Planning Commission approved this variance with the stipulations that a fence be installed along the east side of the development. Attorney David Gussio was present representing Mahaffey, Pickens Tucker, LLP. He explained that they recently met with fire and police personnel with the City of Loganville and is working to elevate their concerns. He stated that there was still a lot of work to be done. He requested that this case be tabled for 30 days until the next council meeting to allow these issues to be resolved. Vice Mayor Dan Curry asked if it would be airight to table this for a period not to exceed 60 days in the event more time is needed. Mr. Gusslo stated that he did no have a problem with that. Council Member Mike Jones stated that he did not have a problem with the 60 days. He explained that he did not like the proposed exit on Trident Trail and believed that the Board of Education would not like it either. He stated that we do not have an R12 zoning and that we needed to be careful not to set a president. Be also expressed is concerns over the previous history related to this property. Be explained that it appears in the July 20, 1999 minutes there was no vote on the proposed property. He also stated that the November 8, 2004 minutes show that the rezone of the property was denied. He raised questions whether this property was properly annexed and rezoned in the past. He stated that he would like to have the City Attorney research this to see if the property is legally in the City. At this time there was some discussion regarding the entrance / exit on Trident Trail. Council Member Mike Jones made motion to table Case # a R12- 005 for a period up to 60 days. Council Member Skip Baliles seconded the motion. Motion carried 4- 0. Council Member Mike Jones made a motion to table Case # V12- 006 for a period up to 60 days. Council Member Skip Baliles seconded the motion. Motion carried 4- 0. Council Member Mike Jones made a motion to have City Attorney Karen Woodward research the annexation and rezone on this property and report back to the City Council. Council Member Skip Baliles seconded the motion. Council Member Michelle Lynch asked for some clarification on this request she stated that she saw the minutes from 1999 but not from 2004. Council Member Mike Jones explained that there should be a file on this and he would like for it to be looked at to see if the property was properly annexed and rezoned. After brief discussion, motion carried 4- 0. Council Member Mark Kiddoo made a motion to approve the resolution for the City' s Short Term Work Program to include the plans for the town green as pointed out by Council Member Skip Baliles. Council Member Michelle Lynch seconded the motion. Motion carried 4- 0. Council Member Skip Baliles presented to the Council an amendment to City Manager Bill Jones' contract with the City. He explained that this amendment would extend Mr. Jones' contract through March 1, 2018 giving him the opportunity to retire as City Manager of Loganville. Council Member Skip Baliles made a motion to approve this amendment, Council Member Mike Jones seconded the motion. Motion carried 4- 0. Council Members took a moment to thank Mr. Jones for his work and expressed their appreciation for his hard work. City Manager Bill Jones reported that the ISO Report has been received by Fire Chief Danny Roberts and it indicated the rating has been reduced from a 5 to 4. Be explained that this should reflect a savings in resident' s home owners insurance from $ 25 to $ 40 per year. Council Member Michelle Lynch reported that work has begun on the Town Green project. She also explained that she would be holding an Events Committee Meeting before the next Council Meeting to set the event schedule for the year. WQC Director Chris Yancey reported that the City has received a CDBG Grant for 504,000 that would allow for the construction of a 12 inch water main form to Pecan Street/ Race Trac. He Highway 20 / Brand Road that would connect explained that the project would go out for bid in the near future. Vice Mayor Dan Curry stated that once completed this could also help to lower our ISO rating even further. Council Member Skip Baliles stated that we are still waiting on DOT approval on several of our proposed projects, however we are very close to beginning the work on the sidewalks on Highway 78. He stated that at the last Council Meeting it had been requested to stripe Lee Byrd Road and Bay Creek Road where the lines are not visible. He stated that this has been completed. He also reported that the DOT has notified the City that they would not allow a red light to be installed at Huntington Ridge and Highway 20. Council Member Dan Curry presented the 2013 Committee assignments to the Council. City Manager Bill Jones thanked everyone for the extension to his contract. He stated that he appreciated it very much. Mr. Jones stated that the DOT has also denied red light requests by the City for left turn signals at Main Street and Hwy 78 and Brand Road/ Hwy 78. He explained that we would continue to work for these requests even with the City offering to pay for the lights. He also explained that we are still working with the DOT for improvements at Hwy 20 and Hwy 81. Council with for$ 1. 36 as part City Attorney Karen Woodward presented the a check of a settlement from a class action lawsuit in the case Rome et al Vs. . Com et al. Council Member Michelle Lynch made a motion to table the appointment of the Vice Mayor until next month. Council Member Mike Jones seconded the motion. Motion carried 4- 0.
