BROADWAY, STE. 400 CONDEMNATION MINUTES LONG BEACH, CA 90802, 2:30 PM REGULAR MEETING - 2:30 P.M. Chairman Thompson opened the hearing at 2:33 p.m. CALL TO ORDER ROLL CALL Commissioners Diane L. Arnold, Michael W. McCarthy, Jo Anne Fitzpatrick, Jim Present: Thompson, Michael Hamilton and Eric Witten SWEARING OF WITNESSES Chairman Thompson referred to Ordinance No. C-5232, asked for all the people in the audience who planned to give testimony to stand, and they were sworn in by Myeesha Ayala. APPROVAL OF MINUTES FROM JULY 21, 2014 It was moved by Board Member McCarthy and seconded by Board Member Arnold to approve the minutes as submitted. The motion carried 4-0. Board Member Witten abstained. Board Member Hamilton was not present at the time of the vote. 2 CASE NO. C - 7850-09-14: 2100 SOUTH STREET, THOMAS J. STEINBRECHER, Owner, Proj. No. CEAC208083, Council Dist. 8 Administrative Citation Appeal Case.. Chairman Thompson called for the owner or representative to appear before the Board and Richard Cowles, 400 Oceangate, Ste. 800, Long Beach, CA 90802, Attorney Representing the Owner, appeared. Mr. Cowles submitted a letter and requested that this matter be continued. It was moved by Board Member McCarthy and seconded by Board Member Fitzpatrick that the board grant the request for continuance to the next scheduled hearing of October 20, 2014. The motion carried 5-0. Board Member Hamilton was not present at the time of the vote. No. CEAC208085, Council Dist. 8 Administrative Citation Appeal Case Chairman Thompson called for the owner or representative to appear before the Board and Richard Cowles, 400 Oceangate, Ste. 800, Long Beach, CA 90802, Attorney Representing the Owner, appeared. Mr. Cowles submitted a letter and requested that this matter be continued. No. CEAC2209443, Council Dist. 5 Administrative Citation Appeal Case Chairman Thompson called for the owner or representative to appear before the Board and no person appeared before the board. Lei Ronca advised the board that the owner, Steven Thompson called at 11:35 a.m. on the date of the hearing and indicated he would not attend the hearing. Board Member Michael Hamilton arrived at 2:50 p.m. It was moved by Board Member Fitzpatrick and seconded by Board Member McCarthy to adopt the findings as follows: The witnesses presented by the City were, in fact, credible. The Property Owner, as the property owner of record, is the responsible party for the cited violations. The cited violations 3 & 4 did exist on the date the citation was issued. The cited violations for items 1 & 2 did not exist on the date the citation was issued. The Appellant violated sections 8.76.010K and 9.65.030 of the Long Beach Municipal Code, because on June 19, 2014, the conditions of the subject property were such that trash cans and trash and debris existed at the front of the property on the driveway. The Appeal is denied. The motion carried 5-1. Chairman Thompson abstained. OPPORTUNITY FOR PUBLIC COMMENTS NEW OR UNFINISHED BUSINESS Staff introduced new board member, Eric Witten. BROADWAY, STE. 400 CONDEMNATION MINUTES LONG BEACH, CA 90802, 2:30 PM SET DATE FOR THE NEXT HEARING: OCTOBER 20, 2014 MOTION FOR ADJOURNMENT It was moved by Board Member McCarthy and seconded by Board Member Fitzpatrick that the hearing be adjourned at 3:08 p.m. The motion carried unanimously.
