Jim Rexwinkel, Deputy Chief of the Long Beach Fire Department Operations
Bureau addressed the Commission to present a proposal for consideration,
to provide specialized training to place qualified Engineers in a provisional
capacity in the Fire Engineer position until the next Fire Engineer
examination is conducted.
Deputy Chief Rexwinkel provided a background packet to the
Commissioners including a memorandum explaining the duties of the Fire
Engineer position, the proposed selection process, and a summary of the
proposed provisional classification.
Deputy Chief Rexwinkel presented a PowerPoint highlighting the duties of
the Fire Engineer position, and current staffing issues, critical shortages,
and immediate needs being experienced by the Fire Department.
A discussion followed between Deputy Chief Rexwinkel, Commissioner Kerr,
President Arias, Vice President Smith Watts, Ms. Slaten, Fire Department
Administrative Officer Meg Rau, Ms. McDonald, and Commissioner
Gonzalez Edmond. The Commission approved the recommendation.

Ms. Slaten briefed the Commission on this request.
Drew Schneider, Assistant Director of Security for the Harbor Department
was present to answer questions from the Commission. Mr. Schneider
introduced his Harbor Department colleagues; Bridgett Lewis, Manager of
Security Operations; Sandy Witz, Assistant Director of Human Resources,
and David Espinoza, Administrative Analyst, who were also present to
answer questions.
Mr. Schneider advised that the earliest available academy class that Harbor
Special Services Officers can attend does not begin until February 2019,
necessitating the need to extend the employee’s probationary period. A
discussion followed between Mr. Schneider, President Arias, and Mr.
Espinoza, with the Commission approving the recommendation.

10. 18-184CS COMMUNICATION REGARDING DISQUALIFICATION OF
APPLICATION - Street Maintenance Supervisor
Communication from Lance Whitacre, Tree Trimmer II, Public Works
Ms. Slaten briefed the Commission on this request, advising that Mr.
Whitacre did not meet the minimum qualifications to apply for the Street
Maintenance Supervisor position (Job Number: J61AN-18).
Wendell Phillips, General Counsel for the Association of Long Beach
Employees (ALBE), addressed the Commission and introduced Mr. Lance
Whitacre, who currently holds the position classification of Tree Trimmer II
with the Department of Public Works.
Mr. Phillips advised that he and Mr. Whitacre do not object to the Civil
Service Department’s decision to deny Mr. Whitacre’s attempt to be placed
on the current Street Maintenance Supervisor list. However, Mr. Phillips
described an issue that could arise in the future, requiring him to return
before the Commission to object if Mr. Whitacre is denied the opportunity to
be considered for promotion into the Street Maintenance Supervisor
position.
Mr. Phillips explained that the current Street Maintenance Supervisor (Street
Operations Division, Public Service Bureau, Department of Public Works),
previously held the position of Street Landscape Supervisor. If he retires,
there is concern that the Department of Public Works may fill the vacancy
with an employee on the current Street Maintenance Supervisor list, and
then revert the position back to a Street Landscape Supervisor. If this
occurs, it will prevent Mr. Whitacre from applying for the vacancy because
he is not on the current Street Maintenance Supervisor list, but he would
qualify to apply under the Street Landscape Supervisor requirements.
Mr. Phillips wished to make a formal record documenting this explanation,
and request that the Commission take an oversight role in directing staff
to communicate with the Department of Public Works. If it is the intention of
the Public Works Department to establish a new Street Landscape
Supervisor position, that the Civil Service Department create a list for the
position for which Mr. Whitacre qualifies, and can apply for in order to be
considered for promotion.

Ms. Slaten advised that she has spoken to the Personnel Officer for the
Department of Public Works, and reported that it is the intention of the
Public Works Department to fill the potential vacancy with someone from the
Street Landscape Supervisor list.
Mr. Phillips was prepared to present the Commission with a letter from Mr.
Whitacre along with supporting documentation. Ms. Slaten advised that Mr.
Whitacre’s letter was already provided to the Commissioners with the
Agenda Packet distributed to them on September 14, 2018.
Mr. Phillips thanked the Commission for their time and attention to this
matter.

11. 18-185CS REPORT ON CIVIL SERVICE ADOPTED BUDGET FOR FY19
Report prepared by Maria Alamo, Special Projects Officer,
Administration Support Services
Ms. Alamo provided a budget report to the Commission.
President Arias proposed that the Commission take a more active role in the
budget process for FY20, explaining the need for an increase in staffing and
funding for disciplinary hearings.
A discussion followed between President Arias, Vice President Smith Watts,
Commissioner Gonzalez Edmond and Commissioner Morrison. It was
suggested that a working group be created to compile statistics, evaluate
data, and identify funding needs. Recommendations developed by the
working group can then be delivered to the Mayor and City Council for
consideration during next year’s budget process.

12. 18-186CS RECOMMENDATION TO CONSIDER SUBCOMMITTEE REPORT
REGARDING POSSIBLE CHANGES TO AND IMPLEMENTATION OF
CIVIL SERVICE POLICY 1.61 - CONDUCT OF CIVIL SERVICE
COMMISSION HEARINGS
Report by Susana Gonzalez Edmond, Commissioner, CSC Hearing
Subcommittee member
Hearing Subcommittee members, Commissioner Gonzalez Edmond and
Commissioner Kerr met to begin identifying potential efficiencies that might
be implemented in the hearing process. Prior to proposing any changes or
recommendations, the Subcommittee will continue to adhere to established
rules throughout the evaluation period, and will ensure that stakeholders are
included in discussions.
The Hearing Subcommittee understands that funding may become available
for the Commission to refer appeals to a Hearing Officer to reduce the
backlog of hearings waiting to be scheduled.
The Hearing Subcommittee also requests the guidance and counsel from
the City Attorney’s Office to advise and make recommendations if an appeal
hearing requires more than three days to complete.
Commissioner Kerr advised that as new members of the Civil Service
Commission, she and her colleagues reviewed the Civil Service Policies and
Procedures manual to gain an understanding of their roles and
responsibilities regarding disciplinary appeal hearings.
The appeal hearing process has experienced changes over time, and the
Subcommittee wants to ensure that current practices align with written
policy. If changes to current practice are needed, or if Policy 1.61 requires
updating since its last revision in April 2003, particularly with regard to the
guidelines for the length of appeal hearings, any recommended changes
should reflect the needs of the employee, the Commission and Civil Service
staff. The financial impact on the Department’s annual budget must also be
taken into consideration if there is an increase in the use of Hearing Officers
to preside over appeals.
After identifying Policy 1.61, Section 2, Subsection A) 1. e), a discussion

Advising Counsel Gary Anderson, Vice President Smith Watts,
Commissioner Gonzalez Edmond, and President Arias.
Mr. Anderson will contact the attorneys to discuss a hearing schedule time
estimate to ensure the Commission is adhering to written policy.
President Arias invited James Trott, Attorney at Law representing the Long
Beach Police Officers Association (LBPOA) to comment on this issue.
Mr. Trott, who has represented numerous employees over the years,
provided a detailed historical background of the disciplinary appeal hearing
process. He cautioned that if the Commission decides to utilize Hearing
Officers for dismissal appeal cases, to ensure the Hearing Officers are
experienced and knowledgeable. Mr. Trott also advised that the LBPOA
welcomes the opportunity to roundtable with the Commission and other
stakeholders regarding the hearing schedule.
The Hearing Subcommittee did not have any recommendations
to change Policy 1.61 at this time, but asked that the Executive
Director & Secretary identify and refer appeals that may qualify
to be decided by an Administrative Law Judge.

Ms. Slaten introduced Mr. Fred Verdugo, who is the new Assistant Director for the
Department of Human Resources. With Mr. Verdugo’s expertise, Civil Service looks forward
to partnering further with Human Resources.
Ms. Slaten introduced Mike Goldschmidt, Administrative Officer of the Development Services
Department. Ms. Slaten advised that Development Services hired a new Analyst who will be
assisting Civil Service with Development Services recruitments.
Mr. Goldschmidt introduced Analyst Eugene Kim, and explained that Development Services
ran the recruitment to hire Mr. Kim, however Mr. Kim will be placed in Civil Service to focus
on filling Development Services vacancies and classified Civil Service recruitments.
Mr. Kim obtained his undergraduate and graduate degrees from CSULB, and gave a brief
history of his previous Human Resources-related work experience throughout Los Angeles
and Orange Counties.
Mr. Goldschmidt explained that Development Services is excited to follow the successful
Harbor Department model by providing a part-time Analyst to address Development Services
recruitments so that Civil Service can maintain their established recruitment schedule.
Mr. Goldschmidt thanked Personnel Analyst Shellie Goings, for providing expert training to
Mr. Kim, and looks forward to continuing to collaborate and partner with the Civil Service
Department.
The Commission thanked Mr. Goldschmidt and the Development Services Department, and
welcomed Mr. Kim to the City of Long Beach.
Ms. Slaten advised that applications for Police Recruit are now being taken on a continuous
basis. She thanked Analyst Kris Ramos for facilitating the continuous recruitment, and
thanked the Police Department for partnering with Civil Service by hiring a Recruitment
Officer to focus full-time on recruiting efforts.
Sergeant Brian McPhail was pleased to announce that the Police Department selected
Recruitment Officer Daniel Haas to coordinate recruitment efforts and build key relationships

that are so vital in the community in order to attract qualified applicants for the Police Recruit
position.
Being born and raised in the City of Long Beach will give Recruitment Officer Daniel Haas a
strong advantage in working with the community to implement new ideas to enhance
recruiting efforts.
Ms. Slaten advised the Commissioners that the Microsoft Surface Pros have been received
and should be ready soon so they can access and refer to Agenda attachments and other
reference material during CSC meetings.
Ms. Slaten thanked Ms. Alamo for her budget report. She also thanked Ms. McDonald and
Sharon Hamilton for their assistance with website updates and eligible list requests.
Special Projects
On August 27th, Ms. McDonald attended the City Clerk’s “Records 101” training session in
preparation for the move to the new City Hall building. Ms. McDonald advised that the
training was very timely as it relates to the Department’s Retention Schedule, because she
learned that NEOGOV plans to begin destroying old data in January. Ms. McDonald advised
that Civil Service needs to evaluate their records retention schedule and carefully monitor
their records to ensure documents are not purged prematurely.
Ms. McDonald is in contact with Human Resources on this matter, and will meet with the City
Clerk’s Office to obtain guidance on the Retention Schedule which has not been revised
since 1983. A discussion followed between President Arias, Ms. McDonald and Vice
President Smith Watts.
Ms. McDonald is continuing with staff training, and will schedule additional sessions to
accommodate other Civil Service staff who have expressed interest in learning more about
NEOGOV and its functionalities. Ms. McDonald also plans to incorporate Civil Service rules,
past practices, and procedures training for some of the newer Analysts to ensure they have a
broad foundation of knowledge to assist them in their assignments.
Ms. McDonald advised that she has not yet closed out the summary on the Performance
Management Pilot Program, as LB COAST leaders want to meet to discuss the NEOGOV
pilot before demonstrating the Tyler Munis performance piece before the participants. A
discussion followed between President Arias and Ms. McDonald.
Ms. McDonald announced that Implicit Bias training presented by Lisa Stewart was well
attended. Ms. Stewart had participants engage in small group exercises which were very
enlightening.

Ms. McDonald advised that the Rules and Regulations Committee met last week. Additional
updates will be forthcoming.
Administration Support Services
Ms. Alamo advised that the purging of NEOGOV data is going to impact Administration
Support Services staff who will need to create a procedure for preserving requisitions that are
being maintained electronically. Requisition data is critical in calculating seniority points if a
layoff order is authorized.
Ms. McDonald will be including Ms. Alamo in discussions with HR and the City Clerk’s Office
to ensure all Departments are operating under the same guidelines when NEOGOV initiates
their scheduled purge.

President Arias inquired about Item #24 from the City Council Agenda of September 18,
2018, requesting the City Auditor to partner with the City Manager to conduct a review of the
hiring, training, and onboarding of new employees. A brief discussion followed between

MINUTES CIVIL SERVICE BOARDROOM, 8:00 AM
COMMENTS FROM THE PUBLIC – The Civil Service Commission will hear from members
of the public on matters within the Commission’s jurisdiction.
Richard Suarez, Grand Lodge Representative for the International Association of Machinists
and Aerospace Workers (IAM), addressed the Commission regarding Agenda Item #12, and
the IAM's position regarding the role of the Advising Counsel. Mr. Suarez advised he will
address the Commission again when the report for Agenda Item #12 is made public.
Wendell Phillips, General Counsel for the Association of Long Beach Employees (ALBE),
addressed the Commission, explaining that he has raised concerns in the past regarding the
position of the Advising Counsel to the Commission. Mr. Phillips has advocated for the
Commission to hire independent counsel. Mr. Phillips also looks forward to the Hearing
Subcommittee report.
Mr. Phillips also expressed concern regarding the manner in which the city administers Rule
#87 - Summary Suspension. Mr. Phillips looks forward to presenting the Commission with a
detailed brief regarding ALBE’s position and findings regarding Rule #87, and participating in
discussions with the Commission before it takes any action on proposed recommendations
by the Hearing Subcommittee.
